It seems language from George Webb Sweigert's pro se law suit was lifted in section, word for word, with the party named, "Awan", being replaced with "Russian names".

Now, here are my two cents:

I just saw the article as an extremely poorly written, through its severely dearth knowledge of the legal process.

It was a nice try at launching a propaganda smear on George Webb, his online personae, though.

He is not a "right-winged conspiracy theorist"; he is an original source.

I am always leery with sources who are anonymous, as it is such a legal irritant when it comes to identifying an internet spook for service with subpoenas.

I am keeping it real because this black psyop propaganda crap is slowly encroaching into my legal realms and it is my belief this new audience has not been educated in the spirit of fuchsia...


"Do not be mean to my Sweetie, Period."

Anyway, why not file to enjoin the cases?

Rule 19. Required Joinder of Parties


Webb is the original source.

He has invested time and interest in the case.

He has subject matter expertise.

Perhaps, this is what he is supposed to do, being a pro se.

Perhaps, he is supposed to enjoin in another case, perhaps, a False Claims Act case.

Perhaps, he has another FCA under seal.

Perhaps, he is doing what he is supposed to do as an original source considering the fact that certain laws prevent certain people of being whistleblowers, like a former POTUS.

Under the False Claims Act, there are special provisions for an original source.

For example:

(A)The court shall dismiss an action or claim under this section, unless opposed by the Government, if substantially the same allegations or transactions as alleged in the action or claim were publicly disclosed—(i) in a Federal criminal, civil, or administrative hearing in which the Government or its agent is a party;
(ii) in a congressional, Government Accountability Office, or other Federal report, hearing, audit, or investigation; or
(iii) from the news media,  unless the action is brought by the Attorney General or the person bringing the action is an original source of the information.
But the FCA goes on to identify what I call a special power of an original source, better understood as a subject matter expert.
(3)the term “false claims law investigator” means any attorney or investigator employed by the Department of Justice who is charged with the duty of enforcing or carrying into effect any false claims law, or any officer or employee of the United States acting under the direction and supervision of such attorney or investigator in connection with a false claims law investigation;
Even though Webb did not file under the FCA, perhaps, just perhaps, it is time to push the proverbial envelope when it comes to opening the magical doors to the kingdom.

Perhaps, the Mueller indictments are pushing the same proverbial legal envelope, because, from what I see, there will be no more excuses for anyone to scream voter fraud in the 2018 Primary and General elections.

That would mean any claims of "voter fraud" would fall upon the state and local elections clerks.

Oops, did I just say that?

My apologies.  I never meant to infer that anyone would ever compromise state and local elections clerks, and in no way am I making any assertions, whatsoever, that anything such as using fake mortgages & bogus property tax foreclosures for the purposes of gerrrymandering redistricting or voter packing through community development corporations with fake absentee ballots, like I allege with the Detroit Land Bank Authority.

But I digress.

I was always taught: "Nothing beats a failure but a try."

No one is perfect but at least whistleblowers try, and so is the U.S. Department of Justice.

I keep telling everyone, this is the work of the old school legal dogs of the civil rights era, which makes me think this is "The Shining", a term lifted from the "pre-emancipation and civil rights eras", but hey, what do I know?

This is probably Mueller' last legal hoorah and I am quite sure he has a place carved out in the annals of history for his legacy and his Ham Sandwich.

He is 74.

Perhaps, the Russian indictments are about immigration Ham Sandwiches or what may be better recognized as "fake identities" or what I like to call "Corporate Shape Shifters".

Citizenship is just a grant from an application on a piece of paper, that lots of people change like their underwear, you know.

Considering the fact that the U.S. has the worst immigration laws in the world, being that they are nothing but residuals of the peculiar institution, which, subsequently allows the maximization of revenues in the trafficking of tiny humans, or for those with a weak stomach to reality, we shall call it "helping refugees" instead of foster care and adoption.

Even those the individuals named in the Mueller indictment have Russian names, who said they are Russian and why are they in the United States, even in Michigan?

Are they illegal immigrants, considering the fact that we do have more than just a southern boarder with Mexico.

What about the other southern boarders with Canada?

Are some of these individuals of human predation for their abilities, on behalf of other actors, as named in Webb's complaint?

It is so easy to get a new identity when you have the industry of adoption.

What the heck do you think they do with all those identities when a child is adopted out, or dies in the legal custody of a state...or under the legal aegis of a privatized parental corporation?

Just remember, the States are moving to amend laws to make being a child a condition of disability, demonstrated in the legal conditions of affidavits, which means there needs to be a legal guardian, whether a state, a corporate or a human, who can then claim the assets, such as the identities of the child.

Obviously, no one cares about children, particularly the Congress, because they refuse to speak upon the industry of trafficking of tiny humans.

Anyway...

How come no one cares about the original sources who suffer physical, financial, psychological reprisals like Task Force or Webb for just being original sources?

Perhaps, the GRU is having a similar situation as the FBI?

Perhaps, there are other, international whistleblowers.

These are questions that will never be answered unless they are asked, and asked in new and improved creative manners.

I have faith in the old school legal dogs of the DOJ because the pro se doctrine is just another civil right.

Besides, we have everything.

DOJ: Grand Jury Indicts 12 Russian Intelligence Officers for Hacking Offenses Related to the 2016 Election



The pdf to the indictment is locked, so I have provided link to the document.

It seems the Russian GRU may have a similar issue to the U.S. intelligence agencies, but hey, what do I know?

Voting fraud is not just for elections, it is also for congressional votes, too.

Does this indictment mean the DOJ possesses the content of the servers?





The Department of Justice today announced that a grand jury in the District of Columbia returned an indictment presented by the Special Counsel’s Office. The indictment charges twelve Russian nationals for committing federal crimes that were intended to interfere with the 2016 U.S. presidential election. All twelve defendants are members of the GRU, a Russian Federation intelligence agency within the Main Intelligence Directorate of  the Russian military. These GRU officers, in their official capacities, engaged in a sustained effort to hack into the computer networks of the Democratic Congressional Campaign Committee, the Democratic National Committee, and the presidential campaign of Hillary Clinton, and released that information on the internet under the names "DCLeaks" and "Guccifer 2.0" and through another entity.

“The Internet allows foreign adversaries to attack America in new and unexpected ways,” said Deputy Attorney General Rod J. Rosenstein. “Together with our law enforcement partners, the Department of Justice is resolute in its commitment to locate, identify and seek to bring to justice anyone who interferes with American elections. Free and fair elections are hard-fought and contentious, and there will always be adversaries who work to exacerbate domestic differences and try to confuse, divide, and conquer us. So long as we are united in our commitment to the shared values enshrined in the Constitution, they will not succeed.”

According to the allegations in the indictment, Viktor Borisovich Netyksho, Boris Alekseyevich Antonov, Dmitriy Sergeyevich Badin, Ivan Sergeyevich Yermakov, Aleksey Viktorovich Lukashev,  Sergey Aleksandrovich Morgachev, Nikolay Yuryevich Kozachek, Pavel Vyacheslavovich Yershov, Artem Andreyevich Malyshev, Aleksandr Vladimirovich Osadchuk, Aleksey Aleksandrovich Potemkin, and Anatoliy Sergeyevich Kovalev were officials in Unit 26165 and Unit 74455 of the Russian government’s Main Intelligence Directorate.

In 2016, officials in Unit 26165 began spearphishing volunteers and employees of the presidential campaign of Hillary Clinton, including the campaign’s chairman. Through that process, officials in this unit were able to steal the usernames and passwords for numerous individuals and use those credentials to steal email content and hack into other computers. They also were able to hack into the computer networks of the Democratic Congressional Campaign Committee (DCCC) and the Democratic National Committee (DNC) through these spearphishing techniques to steal emails and documents, covertly monitor the computer activity of dozens of employees, and implant hundreds of files of malicious computer code to steal passwords and maintain access to these networks.

The officials in Unit 26165 coordinated with officials in Unit 74455 to plan the release of the stolen documents for the purpose of interfering with the 2016 presidential election. Defendants registered the domain DCLeaks.com and later staged the release of thousands of stolen emails and documents through that website. On the website, defendants claimed to be “American hacktivists” and used Facebook accounts with fictitious names and Twitter accounts to promote the website.  After public accusations that the Russian government was behind the hacking of DNC and DCCC computers, defendants created the fictitious persona Guccifer 2.0. On the evening of June 15, 2016 between 4:19PM and 4:56PM, defendants used their Moscow-based server to search for a series of English words and phrases that later appeared in Guccifer 2.0’s first blog post falsely claiming to be a lone Romanian hacker responsible for the hacks in the hopes of undermining the allegations of Russian involvement.

Members of Unit 74455 also conspired to hack into the computers of state boards of elections, secretaries of state, and US companies that supplied software and other technology related to the administration of elections to steal voter data stored on those computers.

To avoid detection, defendants used false identities while using a network of computers located around the world, including the United States, paid for with cryptocurrency through mining bitcoin and other means intended to obscure the origin of the funds. This funding structure supported their efforts to buy key accounts, servers, and domains. For example, the same bitcoin mining operation that funded the registration payment for DCLeaks.com also funded the servers and domains used in the spearphishing campaign.

The indictment includes 11 criminal counts:
  • Count One alleges a criminal conspiracy to commit an offense against the United States through cyber operations by the GRU that involved the staged release of stolen documents for the purpose of interfering with the 2016 president election;
  • Counts Two through Nine charge aggravated identity theft for using identification belonging to eight victims to further their computer fraud scheme;
  • Count Ten alleges a conspiracy to launder money in which the defendants laundered the equivalent of more than $95,000 by transferring the money that they used to purchase servers and to fund other costs related to their hacking activities through cryptocurrencies such as bitcoin; and
  • Count Eleven charges conspiracy to commit an offense against the United States by attempting to hack into the computers of state boards of elections, secretaries of state, and US companies that supplied software and other technology related to the administration of elections.

There is no allegation in the indictment that any American was a knowing participant in the alleged unlawful activity or knew they were communicating with Russian intelligence officers. There is no allegation in the indictment that the charged conduct altered the vote count or changed the outcome of the 2016 election.

Everyone charged with a crime is presumed innocent unless proven guilty in court. At trial, prosecutors must introduce credible evidence that is sufficient to prove each defendant guilty beyond a reasonable doubt, to the unanimous satisfaction of a jury of twelve citizens.

This case was investigated with the help of the FBI’s cyber teams in Pittsburgh, Philadelphia and San Francisco and the National Security Division. The Special Counsel's investigation is ongoing. There will be no comments from the Special Counsel at this time.

Detroit Sues Bedrock For Tax & Voter Fraud?

City of Detroit sues Bedrock for info on any tax-evading tenants

The City of Detroit is taking its campaign against tax evaders another big step forward by reportedly suing businessman Dan Gilbert's Bedrock real estate arm for tenant information.

If Bedrock real estate is allowing its residents to rent using residency outside the City of Detroit to assist in avoiding income tax, well, could not this fraud scheme also be applied to absentee voting?

The city has contended for years that many residents who live in the city evade the city's residential income tax by claiming residence in the suburbs.

People have been using residency outside of Detroit for years, due to all that redlining in auto insurance.  It is substantially cheaper to insure a vehicle north of Eight Mile.

The city has now sued Bedrock to get tenant information on several of its properties. The city alleges that Bedrock has withheld the information for the past year despite city requests, Michigan Radio said in the first report of the lawsuit.

NOTE TO SELF: Get copy of the complaint.  The city may have sued the wrong Corporate Shape Shifter considering the fact that there are 119 corporate entities with the name "Bedrock".

Gilbert issued a statement citing issues of privacy of tenants as a reason for not providing the information the city wants.

Well, he does have a point.

"The City of Detroit has asked our commercial real estate company, Bedrock, to provide it with the confidential personal information of all of our residential tenants, including their Social Security numbers and employers," he said in the statement.

Technically, considering it is public information that can be easily obtained from the elections data, is it not possible to cross check?  I mean, does not NPG VAN have this information, just in case the data from the City Election Clerk's Office was corrupt.

"We do not believe we have the legal right or contractual permission to release the highly sensitive personal information of all our tenants to any third party, including any governmental entity, without the tenant's consent to do so, or a constitutionally valid final court order. … We value the strong relationship our organization shares with Mayor [Mike] Duggan and our city government partners. We have a dispute over this issue, and in this situation the privacy rights of our tenants must take priority."

Perhaps, the City sued a "working group" that was not in existence during the time of the actions or inactions.  Sounds like a Mueller Ham Sandwich to me.

Last time I checked it was okay for the City of Hamtramck to release personal income tax information to the public and nothing was done about it outside the courts.

The city's efforts come about a year after officials first told the Free Press the city was cracking down on tax evaders living or working at 33 properties in the downtown and Midtown areas including New Cadillac Square Apartments and Broderick Tower, two properties sued last year by the city.

I wonder who was named in the lawsuits because there are lots of different registered "owners" of those properties, just saying, you know.

In those earlier lawsuits, the city said it believed "many residents" living in the city were using the suburban address of a relative or friend "for purposes of obtaining lower auto insurance rates and/or the purpose of avoiding city income tax liability," the Free Press reported in April.

Everyone does it.

Claiming a suburban address can help avoid the city's expensive auto insurance rates. Detroit has some of the highest insurance rates in the country.

Detroit's income tax rate for residents is 2.4%. Nonresidents who work in the city are required to pay a rate of 1.2%. Businesses pay a 2% rate. In total, 23 cities across the state have an income tax.

City Treasurer Christa McLellan recently told the Free Press that the scope of the crackdown on tax evaders, which began in 2015, has since widened to include more than 50 properties across downtown and Midtown.

Is it just me or does anyone see federal income tax violations here?  I believe this is a job for #Superfans...who are probably already on it, but hey, what do I know?

"The city is pursuing passage of a regulation to require landlords to annually report tenant rolls to the city's tax compliance branch and we continue to review tenant information to identify non-filers in the apartments and lofts in the city," McLellan told the Free Press in April. "In addition, the city continues robust collection activities across all industries in an effort to enhance tax compliance.

This would be a good initiative to stop human trafficking.

Legal action is used only when voluntary compliance fails."

Michigan Democratic Party Asks Detroit Precinct Delegates Who They Want When Something Happens to Gretchen Whitmer

The following is a poll sent out by the Democratic National Committee to Precinct Delegates in the State of Michigan.

But, before we get into this poll with a foreboding chill of a pending legal calamity or death, let us take a look into The Action Network.

The Action Network, http://actionnetwork.org, is an inactive non-profit corporation registered out of Washington, DC. that is now a for-profit corporation registered out of Washington, DC. and has a history of not filing annual reports.

It also has a separate fund.

But, then, there is The Action Network, with its website registered through Amazon, where I have yet to find any corporate filings, even though its ICANN states it is out of Washington State.

It is an online sports betting database. 

Hmmmm....money laundering...predictive modeling? 

Anyway, I digress, back to Gretchen and the DNC, which looks like it has taken over the MDP.

I wonder why....not really...money laundering...predictive modeling for elections...same software intel programs...?

Gretchen is nothing but a DNC talking points mouth piece, who is willing to sell her soul to get the next spot in the DNC with sugar coated dreams of one day running for POTUS.

Gretchen has dismissed each and every query I have presented her, either to her face, or to her staff, about child welfare fraud, human trafficking, poverty and that god awful thing called privatization.

The silence from her is deathly, just like this poll.

This was not constructed by local Precinct Delegates, this came from Nationals because Detroit has the largest concentration of voters in Michigan, where voter fraud is rampant.

Voter fraud is not perpetrated by the voters and the only need to challenge voter identification is when the "Precious Ones" come in from out of town, like the suburbs, thinking they are funny trying to prove voter fraud by intentionally stealing someone's identity to cast a vote.

It is quite comical to see someone who is typically an elderly man who legally resides far north of Eight Mile Road, extremely pro-"keep the system the way it is" kinda guy from the traditional upper echelon of the socio-economic status tiered hierarchy of society, come into the hood and get loud when a poll worker, who knows just about everyone as the same people come to the same church to vote in every election, year after year, asks them to produce identification to vote.

Many of these voting fraud enthusiasts typically are known to carry firearms, making sure to coyly brandish, of course, so the poll workers just let them vote.

It is just an issue of safety and poor Wayne County Clerk training to report, if there is even an option to report because the Detroit Police have better things to do.

But, in reality, voter fraud is committed by the City and County Clerks through absentee ballots and voter registration schemes, not the voters in Detroit.

And yes, I can back up everything I say, or have I already? Hmmmm.....

If Gretchen Whitmer is the nominee. Who would you want to be the next Lieutenant Governor? 

Please consider these factors. 

1. What if something happened to the next Governor? 

2. Experience? 

3. Have they ever been elected? 

4. Who can appeal statewide?

Paul Ryan Exit Plan Stokes Fears In Detroit

We have everything.

Ryan’s exit plans stoke GOP midterm fears

Washington — House Speaker Paul Ryan abruptly announced Wednesday he will retire rather than
seek another term in Congress as the steady if reluctant wingman for President Donald Trump, sending new ripples of uncertainty through a Washington already on edge and a Republican Party bracing for a rough election year.

The Wisconsin Republican cast the decision to end his 20-year career as a personal one — he doesn’t want his children growing up with a “weekend dad” — but it will create a vacuum at both ends of Pennsylvania Avenue. It will leave congressional Republicans without a measured voice to talk Trump away from what some see as damaging impulses, and it will rob Trump of an influential steward to shepherd his more ambitious ideas into legislation.

It’s unusual for a House speaker, third in line to succeed the president, to turn himself into a lame duck, especially so for Ryan, a once-rising GOP star who is only 48 and was the party’s vice presidential candidate in 2012. His decision fueled fresh doubts about the party’s ability to fend off a Democratic wave, fed by opposition to Trump, in November. And it threw the House into a leadership battle that could end up pushing Ryan aside sooner than he intended and crush any hopes for significant legislation before the election.

Ryan, though, said he had no regrets after having accomplished “a heckuva lot” during his time in a job he never really wanted. He said fellow Republicans have plenty of achievements to run on this fall, including the tax cuts Congress delivered, which have been his personal cause and the centerpiece of his small-government agenda, even though they helped skyrocket projected annual deficits toward $1 trillion.

“I have given this job everything I have,” Ryan said.

Speculation over Ryan’s future had been swirling for months, but as he dialed up colleagues and spoke by phone with Trump early Wednesday, the news stunned even top allies.

Ryan announced his plans at a closed-door meeting of House Republicans. Rep. Mark Walker of North Carolina said an emotional Ryan “choked up a few times trying to get through” his remarks and received three standing ovations.

He later briefly thanked Trump in public for giving him the chance to move GOP ideas ahead.
While Ryan was crucial in getting the tax cuts passed, a prime Trump goal, he and the president have had a difficult relationship. Trump showed impatience with Congress’ pace in dealing with his proposals, and Ryan had to deal with a president who shared little of his interest in policy detail.
Still, for many Republicans, it’s unclear who will be left in leadership to counterbalance Trump. Ryan has been “a steady force in contrast to the president’s more mercurial tone,” said Rep. Mark Sanford of South Carolina. “That’s needed.”

The speaker had been heading toward this decision since late last year, said a person familiar with his thinking, but as recently as February he had considered running for another term. His own father died suddenly of a heart attack when he was 16, and though Ryan is in good health, the distance from his family weighed on him. A final decision was made over the two-week congressional recess, which he partly spent on a family vacation in the Czech Republic.

Ryan, from Janesville, Wisconsin, was first elected to Congress in 1998. Along with Reps. Eric Cantor and Kevin McCarthy, he branded himself a rising “Young Gun” in an aging party, a new breed of hard-charging Republican ready to shrink the size of government.

He was GOP presidential nominee Mitt Romney’s running mate in 2012.

Ryan was pulled into the leadership job by the sudden retirement in 2015 of Speaker John Boehner, who had struggled to control the chamber’s restless conservative wing. He has had more trust with the hardliners in the House.

“That’s probably his greatest gift to us,” said Rep. Kevin Cramer of North Dakota. “His ability to bridge the vast divide.”

House Majority Leader McCarthy, a Californian known to be tighter with Trump, is expected to again seek the top leadership post that slipped from his reach in 2015. He will likely compete with Majority Whip Steve Scalise of Louisiana. Both men spoke at the closed-door meeting Wednesday, delivering tributes to Ryan, and both attended a GOP leadership dinner Wednesday night with Trump at the White House.

Another potential rival, Rep. Mark Meadows of North Carolina, a member of the conservative House Freedom Caucus, demurred when asked if he’d pursue the speaker’s job. “Leadership has never been on my bucket list, and it’s not on my bucket list today,” he said.

Ryan’s announcement came as Republicans are bracing for a potential blue wave of voter enthusiasm for Democrats, who need to flip at least 24 GOP-held seats in November to regain the majority.
As the House GOP’s top fundraiser, Ryan’s lame-duck status could send shockwaves through donor circles that are relying on his leadership at the helm of the House majority. He has hauled in $54 million so far this election cycle.

“It injects some more uncertainty to be sure,” said the No. 2 Senate Republican, John Cornyn of Texas. “It’s just another issue that’s floating out there, and obviously there’s going to be some competition for his successor.”

But a top GOP fundraiser, Eric Tanenblatt, expects Ryan to remain a force in a tough cycle.
“Donors who are committed to making sure Republicans hold onto the majority will do whatever they have to do to make that happen,” he said.

Senate Majority Leader Mitch McConnell, who has worked with Ryan, praised his colleague’s tenure. The Democratic House leader, Nancy Pelosi of California, said she hoped Ryan would work constructively on bipartisan goals before he leaves.

In Wisconsin, Republicans had no obvious successor in waiting. The most likely GOP candidate for Ryan’s seat is state Assembly Speaker Robin Vos, Republicans in the state said. Another Republican mentioned as a potential candidate is longtime Ryan family friend and backer Bryan Steil, an attorney and member of the University of Wisconsin Board of Regents.

Democrat Randy Bryce, a colorful ironworker who has cultivated an “IronStache” moniker, had been Ryan’s best-known challenger, drawing liberal support from around the country. He had nearly $2.3 million in the bank at the end of the first quarter. Janesville teacher Cathy Myers has also been running on the Democratic side. The only declared Republicans are Paul Nehlen, who was banned from Twitter earlier this year for posts criticized as racist or anti-Semitic, and Nick Polce, an Army veteran who also co-owns a security consulting firm.

While his plans are uncertain once he steps down in January, Ryan has long said being speaker would be his last job in elected office. Others have suggested that an ideal job for the policy wonk could be running a think tank, noting the leader of the conservative American Enterprise Institute recently announced he would be stepping down.

CONYERS: Statement From CBC Chairman & Top Judiciary Democrat On White House Voter Fraud Investigation


WASHINGTON – Today, the Chairman of the Congressional Black Caucus (CBC), Congressman Cedric Richmond (D-La.), and the Ranking Member of the House Judiciary Committee, Congressman John Conyers, Jr. (D-Mich.), released the following statement on President Trump’s creation of the Presidential Commission on Election Integrity to investigate voter fraud. Vice President Mike Pence will be the chair of the commission and Kansas Secretary of State Kris Kobach will be the vice chair.

“President Trump says this commission is an effort to protect voting rights but it is really an effort to suppress and intimidate African-American and other minority voters. Instead of supporting an investigation into fake issues like voter fraud that pose no threat to the country, the Trump Administration should support an investigation into real issues that do – real issues like Russian interference in the 2016 presidential election, campaign collusion and cover-up, and voter suppression and intimidation."

“This announcement and the timing of it is no accident; President Trump is, once again, trying to distract us from these real issues. But, as the CBC urged last week, Americans must ‘stay woke’ during this time of fake news and alternative facts. This commission is a waste of taxpayer dollars and government time and will only do what President Trump wants it to do: encourage and empower public officials like Attorney General Sessions and Kansas Secretary of State Kobach who have a history of allowing voter suppression and intimidation.”  

Most cases of so-called voter fraud are the result of clerical and other errors made by lawful voters and election officials. In a 2014 investigation, led by Justin Levitt of Loyola Law School in Los Angeles, researchers found 31 instances of voter fraud out of more than one billion votes cast between 2000 and 2014. That is the equivalent to one instance of voter fraud out of every 32 million votes cast.

On January 25, 2017, in a letter to President Trump, Conyers and Richmond urged that if an investigation was going to be completed in regard to President Trump’s voter fraud allegations, that it be completed by a non-partisan independent body and that it also focus on voter suppression in the wake of the 2013 Supreme Court Shelby v. Holder decision.

Three Real Estate Developers Charged In White Plains Federal Court With Conspiracy To Corrupt The Electoral Process In Bloomingburg, New York

Shalom Lamm and Others Charged in Voter Fraud Scheme in Connection with a March 2014 Bloomingburg Election

Preet Bharara, the United States Attorney for the Southern District of New York, and William F. Sweeney Jr., the Assistant Director-in-Charge of the New York Field Office of the Federal Bureau of Investigation (“FBI”), today announced the unsealing of an Indictment charging SHALOM LAMM, KENNETH NAKDIMEN, and VOLVY SMILOWITZ, a/k/a “Zev Smilowitz,” with conspiracy to corrupt the electoral process, in connection with an election in Bloomingburg, New York.   Bharara also today announced the guilty plea of HAROLD BAIRD, a former Town Supervisor of Mamakating, New York, to conspiracy to submit false voter registrations, charged in a one-count Information unsealed today.

Manhattan U.S. Attorney Preet Bharara stated:  “In pursuit of millions of dollars in profits from a real estate development project, the defendants allegedly hatched a cynical ploy to corrupt the electoral process in Bloomingburg.  As alleged, to get public officials supportive of their development project elected to local government, the defendants concocted a scheme to falsely register voters who did not live in Bloomingburg, including some who had never even set foot there.  And to cover up their voter fraud scheme, the defendants allegedly back-dated fake leases and even placed toothpaste and toothbrushes in empty apartments to make them appear occupied by the falsely registered voters.  Profit-driven corruption of democracy cannot be allowed to stand no matter who does it or where it happens.”

FBI Assistant Director-in-Charge William F. Sweeney Jr. stated:  “Today’s charges allege the defendants corruptly advanced their own personal real estate projects in Bloomingburg, New York, at the expense of honest citizens who expect and deserve a fair election system.  In their scheme to promote their own real estate development projects, the defendants violated federal law as they schemed to put themselves first.  This type of behavior simply won’t be tolerated.”  
As alleged in the Indictment unsealed today in White Plains federal court:

SHALOM LAMM, KENNETH NAKDIMEN, and VOLVY SMILOWITZ, a/k/a “Zev Smilowitz,” the defendants, were real estate developers who, starting in or about 2006, sought to build and sell real estate in Bloomingburg, New York.  From these real estate development projects, the defendants hoped for and anticipated making hundreds of millions of dollars.  But by late 2013, the first of their real estate developments had met local opposition, and still remained under construction and uninhabitable.  When met with resistance, rather than seek to advance their real estate development project through legitimate means, the defendants instead decided to corrupt the democratic electoral process in Bloomingburg by falsely registering voters and paying bribes for voters who would help elect public officials favorable to their project.

Specifically, in advance of an election in March 2014 for Mayor of Bloomingburg and other local officials, LAMM, NAKDIMEN, and SMILOWITZ, the defendants, and others working on their behalf, developed and worked on a plan to falsely register numerous people who were not entitled to register and vote in Bloomingburg, because they actually lived elsewhere.  People the defendants falsely sought to register to vote in Bloomingburg included those who never intended to live in Bloomingburg, those who had never kept a home in Bloomingburg, and indeed, some who had never even set foot in Bloomingburg in their lives.  The defendants took steps to cover up their scheme to register voters who did not actually live in Bloomingburg by, among other things, creating and back-dating false leases and placing items like toothbrushes and toothpaste in unoccupied apartments to make it seem as if the falsely registered voters lived there.

LAMM, NAKDIMEN, and SMILOWITZ, the defendants, also bribed potential voters by offering payments, subsidies, and other items of value to get non-residents of Bloomingburg to unlawfully register and vote there.  LAMM, for example, agreed to pay an individual $500 for every voter that the individual procured, and LAMM and NAKDIMEN’s real estate company ultimately paid the individual more than $30,000 per month for his efforts.

As alleged in a separate Information unsealed today in White Plains federal court:

From in or about January 2014 through in or about March 2014, BAIRD conspired with others to submit false voter registrations so that he could run for political office and vote in Bloomingburg.  In fact, however, BAIRD did not live in Bloomingburg, and his voter registrations were false. 

LAMM, NAKDIMEN, and SMILOWITZ were arrested this morning and will be arraigned today on the charges in the Indictment before United States Magistrate Judge Judith C. McCarthy in the White Plains federal courthouse.    
                              
LAMM, 57, of Bloomingburg, NAKDIMEN, 64, of Monsey, New York, and SMILOWITZ, 28, of Monroe, New York, are each charged with one count of conspiracy to commit an offense against the United States, in particular to corrupt the electoral process by submitting false voter registrations, buying voter registrations, and offering bribes for voter registrations and votes.  The offense carries a maximum penalty of five years in prison and a $250,000 fine.

BAIRD, 60, of Sullivan County, New York, pled guilty to one count of conspiracy to submit false voter registrations, which carries a maximum sentence of five years in prison and a $250,000 fine.  The defendant will be sentenced at a future date.  The case is assigned to United States District Judge Cathy Seibel.

The statutory maximum penalties are prescribed by Congress and are provided here for informational purposes only, as any sentencings of the defendants would be determined by the judge.

Mr. Bharara praised the outstanding investigative work of the FBI-Hudson Valley White Collar Crime Task Force, the Sullivan County District Attorney’s Office, the Sullivan County Sherriff’s Office, the Orange County Sheriff’s Office, the Orange County District Attorney’s Office, the Internal Revenue Service, and the United States Postal Inspection Service.  Mr. Bharara also thanked the Department of Justice’s Public Integrity Section, Election Crimes Branch, for its assistance in the case.

This case is being handled by the Office’s White Plains Division.  Assistant United States Attorneys Kathryn Martin, Benjamin Allee, and Perry Carbone are in charge of the prosecution.

The charges contained in the Indictment are merely accusations, and the defendants are presumed innocent unless and until proven guilty.

Voter Fraud Has Gone High Tech In Michigan

Please, someone, anyone, correct me if I am wrong on this.

Michigan Representative Peter Lucido has introduced a Bill to streamline driver license and voter registration by making it electronic.  Great.

The matter has been referred to the House Elections Committee.  Fabulous.

Now, someone, anyone, tell me there are not inherent issues when addressing voting rights?

Look at it like this.  I can obtain official State of Michigan identification in the form of a driver's license which has me, for legal purposes, as a resident of a municipality, yet I can, in the same breath, register to vote in a different city?

Ok, I know some have listed a different address as permanent residences on driver's license in order to secure cheaper auto insurance as Detroit and its enclaves are still under pervasive redlining schemes of the auto insurance industries, stemming back before the civil rights era.

When this was done this, voting behavior drastically changed as an individual was obliged, neigh, restricted, to vote in the jurisdiction of record with the State of Michigan in accordance to the address on the state identification of choice, the driver's license.

This also led to population shifts in the calculations of redistricting.

What we have here, now, is a Bill which would allow an individual to list a legal residence for the purposes of state identification via the driver's license while, contemporaneously, granting an individual to register with the state, an absolutely distinct, secondary address for purposes of voting.

Of course, I shall be gracious and provide for the benefit of debate that college students were meant to be included in this discussion as many may live on campus for a few semesters a year yet maintain a permanent legal address at the home of their family, but I am going to say that this represents a relatively small population in relation to the rest of the state and may be resolved in other fashions.

And just to season up the debate, I am going to toss in a dash of partisan politics by speculating that this dual registration initiative is a foreboding tale of a preemptive strike to preserve the possible the demise Republican leadership for the next opportunity of electronic gerrymandering, oops, I mean, redistricting.

If by chance Democrats come into power for the 2022, as forecasted by many, the Republican plan of obviation must already be in the file cabinet, ready to go, and here it is:  electronic gerrymandering.

Dare I not utter the term of voter fraud, which is what I believe this Bill to be.

All the Michigan Secretary of State has to do is coordinate intra agency and with the Department of Health and Human Services, electronically, inclusive of a layer of encryption technology, state identification, voter registration, or EBT card.  It can be as simple a cute little box on the state issued identification, whether it be a driver's license, a BRIDGE card, or just a regular ID, the same as the organ donor box.

But then again, information technology and departmental services do not go together well in Michigan.
