Moderna's Patents Probed by U.S. Defense Department, FT Says

Moderna Inc.’s patents that were filed or awarded are being probed by the U.S. Department of Defense’s research arm, the Financial Times reported, saying the company failed to disclose government funding as required by federal law.

Knowledge Ecology International, a patient advocacy group, said in a report this week that researchers didn’t disclose in vaccine patents where they got about $25 million in grants from the department’s Defense Advanced Research Projects Agency, or Darpa, for its vaccine technology, the newspaper said.

“The company believes it has complied with applicable patent reporting requirements regarding patent filings, including as they relate to the Darpa program,” Ray Jordan, a spokesman for Moderna, said Saturday. The company estimates that Darpa funding was about $50 million, or 1% of its $5.1 billion total private funding.

The newspaper cited Darpa spokesman Jared Adams as saying that all awards to Moderna included the need to report the role of government funding, adding that “Darpa is actively researching agency awards to Moderna to identify which patents and pending patents, if any at all, may be associated with Darpa support.”

At least one Darpa-linked patent shows government support was disclosed.

The Cambridge, Massachusetts-based company said earlier this week it’s in talks with Japan’s Ministry of Health, Labor and Welfare to potentially supply the country with 40 million or more doses of its vaccine candidate against Covid-19. It also unveiled new findings relating to its trial.

Summary of Humanized Mouse Model Workshop

On December 18, 2018, NIAID, in coordination with the NIH Office of the Director and HHS, organized a workshop to assess recent advances and opportunities in the development and use of humanized immune system (HIS) mouse models, in which the immune system of the mouse is partially replaced with human immune cells and tissues. Participants included leading scientists in the fields of immune system development and function, transplant immunology, autoimmunity, and infectious disease research. Adm Brett Giroir, Assistant Secretary of HHS, welcomed the participants and described HHS interest in this area, including a clearer understanding of the limitations and adequacy of existing HIS models, and the possibility of developing scientifically validated alternatives to the use of human fetal tissue. Dr. Daniel Rotrosen, Director of the Division of Allergy, Immunology and Transplantation at NIAID, provided an overview of the workshop goals and expected outcomes, including: evaluation of the features, strengths and limitations of current HIS mouse models; procedures to compare HIS models made from fetal and non-fetal tissue sources; and studies that would be required to fully characterize and standardize these models. Dr. Lawrence Tabak, NIH Principal Deputy Director, provided brief introductory comments on behalf of NIH.

Dr. Leonard Shultz provided a comprehensive summary of HIS mouse model development and usage from 1988 to the present. In following breakout sessions, participants discussed the strengths and limitations of various HIS mouse models and provided opinions on ways to optimize HIS models for the development of vaccines and therapeutics for infectious and immune-mediated diseases and cancer. The meeting participants reconvened for reports from the two breakout groups and a final discussion, that resulted in the following summary points:

Major scientific advances have been made in understanding infectious disease pathogenesis and development of therapeutics using HIS mouse models made with human fetal tissues.
No single humanized immune system model is universally appropriate or optimal for all applications.
Various models can recapitulate key aspects of human T cell immunity; existing models are less able to recapitulate human innate immunity and antibody responses regardless of tissue source. Improvements in modeling antibody responses should be a focus of future work and may be particularly important for advances in vaccinology; and in modeling infectious, autoimmune, and allergic diseases.
Few direct comparisons have been conducted of HIS mice derived using fetal vs. non-fetal human tissue sources.
Meeting participants included investigators working on fetal tissue-derived and non-fetal tissue-derived HIS models. Considering published data and other information shared at this meeting, participants expressed the opinion that fetal tissue-derived HIS models remain the “gold standard” to which other model systems should be compared. This preference is based on the preponderance of data indicating superior engraftment, differentiation, survival and function of the adaptive immune cells (particularly T cells) in fetal tissue-derived models.
Following the breakout sessions, there was strong opinion that work should proceed on a variety of models derived with fetal tissues or from alternative sources.

Michigan teen died after screaming 'I can't breathe' while being restrained by staff member, lawsuit claims

WEST BLOOMFIELD, Mich. (AP) - A civil lawsuit filed Monday following the death of a 16-year-old in a Michigan youth facility says he screamed "I can't breathe" as at least one staff member placed their weight on the Black teen's chest for nearly 10 minutes.

The lawsuit filed in Kalamazoo County Circuit Court names Lakeside Academy in Kalamazoo and Sequel Youth and Family Services as defendants.

Cornelius Fredericks died May 1 after going into cardiac arrest April 29. At the time, authorities said he was being restrained by staff after throwing a sandwich.

His death came nearly a month before George Floyd died May 25 in Minneapolis with a white police officer's knee pressing his neck to the ground.

Floyd's dying words, "I can't breathe," have become a rallying call for people protesting police violence against Black people and racial injustice during demonstrations across the U.S.

"The excessive use of restraints and the lack of concern for Cornelius's life draw an eerily similar comparison to that of George Floyd's death," according to the lawsuit, which alleges negligence and says Lakeside staff improperly and wrongfully used restraints on Fredericks.

Authorities have not provided details of the race of the staff member or members involved.

"Video from Lakeside Academy even shows a staff member placing his/her weight directly on Cornelius's chest for nearly ten minutes as Cornelius lost consciousness," the lawsuit states. "Cornelius's scream of `I can't breathe' was not enough to get the staff members to stop the excessive restraint."

Detroit attorney Jon Marko, who filed the civil rights lawsuit, said he has yet to view the video, but that he spoke with the mother of another child in the facility.

That child "claims to have heard Cornelius scream `I can't breathe,"' Marko said, adding that a state Health and Human Services Department report confirmed that account.

The lawsuit seeks damages allowed under the Michigan Wrongful Death Act. No financial amount was specified.

The Associated Press left a message Monday seeking comment from Lakeside Academy.

Sequel Youth and Family Services told The AP in an email that it cannot comment on pending legal matters, but that it has terminated all staff involved and removed the former executive director of Lakeside.

"We have been in regular contact with law enforcement and state officials to help ensure justice is served and have accelerated the work that was already underway across our organization to move to a restraint-free model of care," the company said. "We take our obligation to meet the significant behavioral health needs of all our students incredibly seriously and remain focused on our mission of providing the absolute best care and treatment possible."

The foster care system or parents placed youths in Lakeside Academy, a residential treatment facility about 140 miles west of Detroit, to receive behavioral health services after being abused or neglected.

Fredericks was a ward of the state, Marko told reporters Monday.

His aunt, Tenia Goshay, is named in the lawsuit as the representative of Fredericks' estate. The teen's mother is dead. His father and rest of the family were not in a position to care for him, Marko said.

Fredericks had been at Lakeside Academy about two years, Goshay told reporters.

"I want to know what happened to my nephew," she said.

The state last week terminated its contracts with Lakeside for youth in Michigan's foster care and juvenile justice systems and said all 125 youth at Lakeside were placed in other "settings based on their individual needs."

The facility also had its license to operate suspended.

Gov. Gretchen Whitmer has told the department to cut ties with Sequel Youth and Family Services, which provided staffing to Lakeside Academy.

After Fredericks' death, Lakeside Academy officials said what happened didn't reflect the institution's mission to "serve and care for our clients with excellence."

But Michigan's Health and Human Services department has conducted more than 30 investigations since 2016 on maintenance, staff qualifications, discipline, behavior management, resident restraint and staff sufficiency at Lakeside Academy, the lawsuit said.

Six months prior to Fredericks' death there were six separate violations pertaining to improper use by staff of deescalation techniques, including improper restraints, according to the lawsuit, and at least eight employees had been fired since 2016 due to improper use of restraints, failure to use proper deescalation techniques or improperly supervising youth.

Michigan Health and Human Services officials have said an investigation of the for-profit academy found 10 licensing violations, including a failure to follow rules related to resident restraint and discipline.

Foster care teen's death prompts state to pull Michigan group home's contract, license

LANSING, Mich. — Prompted by the death of a teen who was wrongly restrained by staff, a Michigan facility for teenagers with behavioral problems on Thursday lost its contract with the state to care for youth in the state’s foster care and juvenile justice systems and its license to operate.

The termination of the Michigan Department of Health and Human Services’ contract with Lakeside Academy in Kalamazoo came in the wake of the death last month of Cornelius Frederick. The 16-year-old went into cardiac arrest while being restrained on April 29 by Lakeside Academy staff. He died May 1. At the time, authorities said the teen was being restrained by staff after he threw a sandwich.

In announcing the termination of its contract and suspension of the operating license, Health and Human Services said an investigation of the for-profit Lakeside Academy found 10 licensing violations, including a failure to follow rules related to resident restraint and discipline. The agency contends the revocation of the license of a child caring institution is rare and occurs when there are serious licensing violations that make closure necessary to protect children.

Lakeside Academy officials did not immediately return calls for comment.

“MDHHS continues to mourn the loss of this young man’s life, which came needlessly to an end at the hands of those meant to care for him” said JooYeun Chang, executive director of the MDHHS Children’s Services Agency, in a prepared statement. “We are committed to protecting children and will not accept the completely unnecessary death of a youth who is deprived of the opportunity to grow up, complete his education, begin a career, and start a family.”

Kalamazoo County Prosecuting Attorney Jeff Getting said Thursday his office is reviewing completed investigations to determine if criminal charges are authorized in Frederick’s death.

"If charges are brought, my office will be prosecuting the cases,’’ Getting said.

At the time of Frederick’s death, Lakeside Academy officials said in a statement the incident didn’t reflect the institution’s mission to ``serve and care for our clients with excellence.”

However, Assistant Chief David Boysen of the Kalamazoo Department of Public Safety has said in the weeks leading up to Frederick’s death there were numerous calls for false fire alarms, runaway students and assaults. In addition, three chaotic days followed the boy’s death, as students fought and fled the facility.

Just before Health and Human Services announced its moves, the Legal Rights Center in Minneapolis called for Hennepin County, Minnesota, to stop placing children in Lakeside Academy for juvenile delinquency matters.

The county removed all Minnesota children from the facility after Frederick's death. However, center officials said that was is enough. They contend it is time to end the practice of removing children from local communities and confining them in correction facilities "under the pretense of providing therapeutic treatment."

How Huber Can Finally End Child Sexual Exploitation - Termination Of The Right To Bear Arms

Children should be free from sexual exploitation, but to do so would interfere in the right to engage in commerce and an invasion of privacy for the individuals who decry the Parental Right to do what they want to do with their chattels.

This is deeply woven into society and culture as a method of "pick yourself up by the bootstraps" survival.

Back in the days, all you needed to venture out under the marque of the king to vanquish governments and lands of the savages, were a boat and a virgin, because the term virgin was just the colloquial of the day for the sale of a little girl, and the younger you start breeding, the greater the increase in profits of more little girls and boys being born to be used at the leisure of the legal parent.

Today, all you need is a foster care license.

Children are are legally determined by law as a good in the hierarchy of property, where their is financial incentive to procure and purvey tiny humans, called Child Protective Services.

The acquisition of these tiny human goods is the industry of child welfare, where it is perfectly legal to target and convert the lives of children into a sustainable livelihood through Foster Care and Adoption, all done in the best interests of the child to maximize revenues, if you are a privatized, foreign contracted NGO, or generate profit if you are incorporated, even in the stock markets.

Children should be free from sexual exploitation but it will never happen because there is too much money to be made and no one wants to hold these institutions accountable, because it is all  perfectly legal, as an act of the tax exempt god.

Huber: Childhood should be free from sexual exploitation

Child exploitation cases merit federal prosecution. My office files dozens of child exploitation cases every year. Each year, the ages of the children in the images get younger, and an increasing number of offenders use online platforms to target children.

The label “child pornography” fails to capture the true essence of the crimes.

"Wanna kid?"

More accurately described, our prosecutions involve images that depict sexual violence and rape of children by depraved adult perpetrators. Even one image of this violence would evoke tears, nausea or anger from a parent, grandparent or any human being. Yet federal defendants record and possess videos and images in the hundreds and thousands. They barter and trade images amongst themselves like collectible sports cards.

Adult perpetrators do not limit themselves to images of rape. Some of them creep online through social media in search of child victims. They assume a false online persona, groom victims with gifts and promises, and blackmail children by coaxing them to send embarrassing sexualized images to the perpetrators. Parents and those who try to guard against this conduct may not realize that no boundary or safety wall exists that adult perpetrators cannot cross to meet a child with the intent to sexually abuse the victim.

During the pandemic, parents have taken on more and more during stay at home directives. Work, school and parenting blend into demanding days. With everyone at home together, we may expect that the threat of child sexual exploitation would diminish. Unfortunately, that does not appear to be the case.

The Federal Bureau of Investigation reports that COVID-19 school closings may present increased risk of child exploitation. Children will potentially have an increased online presence and be in a position that puts them at an inadvertent risk. In order for the victimization to stop, children must have the courage to come forward to someone they trust — like a parent, teacher, caregiver or law enforcement. Understandably, the embarrassment of being enticed or coerced to engage in unwelcome behavior often prevents children from coming forward.

As a community, we can take measures to help educate and prevent children from becoming victims of child predators and sexual exploitation during this time of national emergency. We should help our young people come forward and report this predatory behavior when it happens to them or their friends. Offenders may have hundreds of victims around the world, so coming forward to help law enforcement identify offenders may prevent countless other incidents of sexual exploitation.

We can discuss internet safety with children of all ages, review and approve games and apps, and generally monitor internet usage. Children should understand that images posted online exist permanently. We should assure our children that it is not a crime for a child to send sexually explicit images to someone if they are compelled or coerced to do so — sometimes fear of being “in trouble” causes a child to hesitate to tell a trusted adult, because they feel guilty about their conduct. We want to ensure that children know they should report to a trusted adult when someone asks them to engage in sexual activity.

We should not forget about physical dangers that exist offline, as well, and watch over our children as our community transitions back to more normalized activity beyond the pandemic. Let’s teach our children about body safety and boundaries. Parents should continue to be mindful and screen those who provide childcare or babysitting, and consider safety precautions during playdates and overnight visits.

The adult perpetrators are out there, and we can all do more to prevent crimes against our children.

From 2006 to 2008, Bright returned to working in the private sector of the biotechnology industry at Novavax in Maryland, where he was vice president of their global influenza programs as well as of their vaccine research and development. During this time, he participated in World Health Organization committees on vaccine development and pandemic preparedness.[8][11][13]

In February 2008, Bright worked at the non-profit PATH on a Bill & Melinda Gates Foundation grant funded project as the director in vaccine manufacturing capacity building in Viet Nam. He was also the scientific director of the influenza vaccine project as well as the global vaccine development program, a position he held until October 2010.[8]

In 2010, Bright joined the U.S. Department of Health and Human Services (HHS) governmental agency Biomedical Advanced Research and Development Authority (BARDA). He was the program lead of BARDA International Programs, then in June 2011 became acting chief of the influenza antiviral drug advanced development program, a position he held until December 2011. From June 2011 to December 2015, he was both deputy director and acting director of BARDA's Influenza and Emerging Diseases Division, eventually serving as director of the division from December 2014 to November 2016. From February 2016 to November 2016, he was an incident commander in the ASPR/BARDA Zika Response.[8][14]

Rick Bright will warn Congress of 'darkest winter in modern history' without ramped up coronavirus response

(CNN)Dr. Rick Bright, the ousted director of a key federal office charged with developing medical countermeasures, will testify before Congress on Thursday that the Trump administration was unprepared for the coronavirus pandemic and warn that the the US will face "unprecedented illness and fatalities" without additional preparations.

"Our window of opportunity is closing. If we fail to develop a national coordinated response, based in science, I fear the pandemic will get far worse and be prolonged, causing unprecedented illness and fatalities," Bright is expected to say Thursday, according to his prepared testimony obtained by CNN. "Without clear planning and implementation of the steps that I and other experts have outlined, 2020 will be darkest winter in modern history."

Bright is set to testify Thursday morning before the House Committee on Energy and Commerce's health subcommittee after he filed a whistleblower complaint last week alleging he was removed from his post in retaliation for opposing the broad use of a drug frequently touted by President Donald Trump as a coronavirus treatment.

Bright will reiterate that he believes he was removed from his post because he "resisted efforts to promote and enable broad access to an unproven drug, chloroquine, to the American people without transparent information on the potential health risks."

Bright is seeking to be reinstated to his position as the head of the Biomedical Advanced Research and Development Authority (BARDA) and the Office of Special Counsel, which is reviewing Bright's complaint, has determined there is reason to believe his removal was retaliatory and is recommending he be reinstated during its investigation, according to Bright's attorneys.

A Department of Health and Human Services spokesperson responded that it was "a personnel matter that is currently under review" but said it "strongly disagrees with the allegations and characterizations."

Expanding on his whistleblower complaint, Bright is expected to testify that he sought to warn his superiors about potential shortages of critical medical supplies earlier this year, but that his "urgency was dismissed" and that he "faced hostility and marginalization from HHS officials" after conveying his concerns about shortages to a senior White House official, Peter Navarro.

"As I reflect on the past few months of this outbreak, it is painfully clear that we were not as prepared as we should have been. We missed early warning signals and we forgot important pages from our pandemic playbook," Bright will testify, according to his written testimony.

In his written testimony, Bright also calls for several key steps to improve the federal government's response to the pandemic and head off a spike in cases in the fall, including increasing public education of preventative measures, ramping up production of essential medical supplies and developing a national testing strategy.

"The virus is out there, it's everywhere. We need to be able to find it, to isolate it and to stop it from infecting more people," Bright plans to say. "We need tests that are accurate, rapid, easy to use, low cost, and available to everyone who needs them."

He made his complaint public through Washington Post but failed to release the 33 attachments to the committee.

He did not follow the well established chain of command for filing a whistleblower action.

He sounds like he was coached by one of those absolutely brilliant "Legal Geniuses" (trademark pending).

I guess Rick was blinded by science when it comes to the rule of law in actions of false claims.

Google Sister Science Company Verily Launches Coronavirus Screening Website

Verily, Google’s sister company, has launched a screening website for those who want to get tested for COVID-19, but it’s limited to people in the Bay Area of California, the Verge reported.

“It’s more of a pilot program than a public health utility,” the website reported.

You have be 18 years of age or older, be able to speak English, and be a U.S. resident, according to the story. It resembles the program a Verily spokesperson described last week, “not the expansive triage system that the Trump administration promised,” the Verge said.

The initial question is “Are you currently experiencing severe cough, shortness of breath, fever, or other concerning symptoms?” the story said.

A “yes” answer prompts a message that the website is “not the right fit” and to seek medical attention.

“This screener was developed in partnership with government health officials,” a Verily spokesperson told the Verge. “The initial question is meant to ensure that anyone who is seriously ill does not come to our sites because they are not prepared to provide medical attention. We are early in this pilot and are going to be learning more that will help us refine this COVID-9 risk screening and testing.”

A “no,” answer prompts the user to sign in with a Google account and sign a consent form allowing data to possibly be shared with public health officials. A series of questions follows including questions about symptoms, travel and work responsibilities. It takes about three minutes to read and respond, the story said.

“Ultimately, our goal is to help local authorities expand testing access in California as the need continues to increase,” the company said. “The program is in its early stages, and we will take the time to assess operations at pilot sites in the Bay Area before rolling out to additional sites. We are working closely with Governor Newsom’s office, federal authorities and local public health authorities to ensure we have the right capabilities in place to help more people over the coming weeks.”

Gates Foundation, other charities pledge $125 million to find coronavirus antidote

The Bill and Melinda Gates Foundation has teamed up with two charities to commit up to $125 million toward treatments for the coronavirus. 

The Gates Foundation and Wellcome will each contribute $50 million and the Mastercard Impact Fund will commit $25 million, the foundation announced Tuesday. 

The funding will go toward identifying, assessing, developing and scaling-up treatments, and the partners involved in the effort are "committed to equitable access, including making products available and affordable in low-resource settings," according to the announcement. 

The group's combined effort, known as the COVID-19 Therapeutics Accelerator, "will work with the World Health Organization, government and private sector funders and organizations, as well as the global regulatory and policy-setting institutions."

There are no broad-spectrum antivirals or immunotherapies available to fight against emerging pathogens and none approved for use in COVID-19, the formal name of the coronavirus. 

"If we want to make the world safe from outbreaks like COVID-19, particularly for those most vulnerable, then we need to find a way to make research and development move faster. That requires governments, private enterprise, and philanthropic organizations to act quickly to fund R&D," Mark Suzman, chief executive officer of the Gates Foundation, said in the announcement. 

More than 115,000 cases of the virus have been confirmed globally as of Tuesday, according to data compiled by Johns Hopkins University.
