The community advocates invited to a land use summit at Detroit Mayor Dave Bing's office last week had a few words of caution for him: Don't make assumptions. Include the community in the conversation. Stay away from business jargon. 

Urban agriculture may not be the answer. 

The city, attendees said, should also move quickly to develop a positive message and terminology around the idea of developing a long-term land use strategy that will see some parts of the city mothballed and other neighborhoods bolstered. 

Rumors have flown that city officials had a plan to reshape Detroit, or were developing such a plan in secrecy, fueled by the city's hiring of a Kresge Foundation-funded urban planner. 

Until last week, the administration hadn't said much. Bing has said that among Detroit neighborhoods there will be “winners” and “losers,” that the city lacks the revenue to support its 139 square miles, and most often, that there's not a plan to shrink the city. 

“I want to start by making one thing perfectly clear,” Bing told the group at a meeting on May 12, which was not open to the public. “There's been a lot of conversation about ‘the plan.' For all of you, there is no plan. … I think there are a lot of people in the media and in the community, people from all across the country, who are under the impression that we have a master plan for land reuse. This is just the beginning of the development of that plan.” 

The assembled group, above, will serve as the mayor's advisory team. 

Bing's team also plans to assemble a citizen advisory group. 

City leaders have thus far declined to give a name to the process. In that absence, terms like “downsizing,” “shrinking” or “rightsizing” frequently are used. 

But those words, the advocates said, rub residents the wrong way. 

“The words you use are very important,” said Heidi Mucherie, director of the Detroit-based nonprofit Community Legal Resources. “There's a lot of pushback on ‘downsizing' or ‘shrinking,' and some people are embracing words like ‘re-envisioning' or ‘revisioning.' There are some people who said look, don't give this a fancy word, this is planning, so call it planning.” 

Mucherie told Bing and his team that she observed two pervasive fears at a recent meeting held by her group. “(Detroiters) felt strongly that residents should lead the way, that the process should not be led by ‘outsiders' — and that could mean philanthropy, it could be consultants,” she said. “The other fear is the fear of land-grabbing and the fear of being involuntarily displaced.” 

Some concerns aren't entirely unfounded. 

While the city doesn't want to involuntarily relocate residents, said Karen Dumas, Bing's group executive for communications, “Nothing's off the table.” Business jargon like “rightsizing” or “downsizing” doesn't calm fears, said Tom Goddeeris, executive director of the Grandmont Rosedale Development Corp. “In the general population, rightsizing is a euphemism for layoffs,” he told the mayor. “It comes from the business community. … I also think you need to be careful about using too much business jargon. I know you're obviously a successful businessman, and you're using a business model for the city, but you need to be careful about business jargon. It makes people think it is all a front for big corporations that are going to grab all the land.” 

Mucherie also urged city officials to approach the community without preconceived notions. Some Detroiters, she said, are put off by the idea of creating density. “They don't want to live in a dense neighborhood,” she said. “We heard from other citizens that they are furious about farming and urban agriculture being offered as a solution. That's not to say everyone feels that way, but … just because there are people out there who have advocated a solution doesn't mean this community has embraced it. You need to be very careful not to take assumptions to the community.” 

Development of the plan will take 12 to 18 months, Bing said, and will be led by Marja Winters, deputy director of the city's Planning and Development Department, and Toni Griffin, the nationally recognized urban planner whose salary is paid by Troy-based Kresge. 

Kresge will also foot the bill for a team of technical advisers to work on the plan and a community engagement effort, Winters said. 

The advisory team will meet regularly to vet plans or suggestions developed by Griffin and a team of technical consultants before such items are incorporated into the plan. 

The group's next move will be to weigh in on a formal community engagement strategy. 

A request for such proposals has been made through the Kresge Foundation, but no companies have been chosen, Winters said. Kresge Communications Director Cynthia Shaw wrote in an e-mail to Crain's that costs for the consultants haven't yet been finalized, saying Kresge hopes the costs ultimately will be paid in concert with other foundations through a grant to a nonprofit organization. 

Openness and transparency are key, Bing said. “I think people feel like this group in particular is a secret agent for this administration, that we're going to come out with this plan and keep it close to our chest and nobody's going to know about it — won't work,” he said.

 “We've got to be transparent, and we've got to be inclusive.” Linda Smith, executive director of U-SNAP-BAC Inc., urged the city officials to develop a positive branding message. “What's the tag?” she said. “Something you can put on buses, something you can put on billboards. People have to get excited. Detroiters haven't been excited in a long time and it makes them negative.” 

Developing a formal method for citizen input is crucial, said Anita Lane, project manager at Community Development Advocates of Detroit. “We want to be really creative about how we engage citizens and how we engage young people” she said. “I think it's important that we find a way to interact with the community. … Unless that happens here as well you will have a lot of pushback, and the plan may not succeed.”

ROME (AP) — A powerful Vatican cardinal who was sacked by Pope Francis in an astonishing twist to

the Vatican’s latest financial scandal pushed back Friday against allegations he embezzled Holy See money and denied he did anything wrong.

Cardinal Angelo Becciu presided over an extraordinary news conference a day after Francis fired him and yanked his rights and privileges as a cardinal. The 72-year-old Becciu, a onetime papal contender, said his downfall was “surreal,” but that he had a clear conscience, remained loyal to Francis and was ready to die for him.

Becciu said Francis had asked him to step down as prefect of the Vatican’s saint-making office during a “troubled” 20-minute meeting Thursday evening in which the pope said he “no longer had confidence in me.”

Becciu had gone to the pope’s residence for a previously scheduled meeting to go over possible sainthood candidates when the pope told him that documents from the Italian financial police alleged he had embezzled 100,000 euros of Holy See money and sent it to a charitable fund run by his brother.

The cardinal’s name had previously been caught up in a whirlwind financial scandal involving the Holy See’s investment in a London real estate venture. But Becciu said the London investment didn’t even come up Thursday; instead, he said the issue that forced his removal was the allegation of embezzlement, which was first reported by the L’Espresso news magazine Friday.

Becciu, the former No. 2 in the Vatican’s secretariat of state, admitted he sent the money from the office’s asset fund in 2017 to his home diocese in Ozieri, Sardinia, for its charitable work. Becciu’s brother, Tonino Becciu, is the legal representative of the diocese’s operational charitable arm, Spes Cooperative.

But the bishop of Ozieri, Corrado Melis, issued a statement Friday saying the money was never used and remains in the diocesan coffers for a future project. And the Becciu family said in its own statement that Spes never saw a dime of the money.

Becciu said such donations were fully in line with directives that the secretariat of state’s off-the-books fund be destined toward charity, and that it was the only time in his seven years that he had approved a donation for his native Sardinia.

“Certainly, one could say it would have been better if I hadn’t given it. But I wanted to help the diocese, not my brother, and that 100,000 euros was for the diocese.”

Becciu said he also recommended the Italian bishops’ conference donate 300,000 euros to the same charitable fund years earlier to help set it up, but insisted that too was legitimate because it was the conference’s decision to do so. The cooperative is a non-profit that runs a bakery and some vineyards that Becciu said employs around 60 young people who otherwise wouldn’t have jobs.

“I don’t think I’ve committed any crime,” Becciu said during the news conference, sitting in front of a giant silver crucifix in a religious institute just off St. Peter’s Square.

Becciu, long considered a possible papal contender himself, said in giving up his rights as a cardinal he obviously could not vote in a conclave to elect a new pope. But he acknowledged that he can now also be judged by others, including Vatican magistrates, and not just the pope since he no longer had a cardinal’s privileges.

“If they want me to clarify, I’ll clarify,” Becciu said of Vatican prosecutors. “I’m a citizen like everyone else, and if they call me, I’m ready.”

In its report, L’Espresso also reported other allegations of conflicts of interest involving Becciu and his brothers: That when he was ambassador to Angola and Cuba, his brother did carpentry work for the Vatican’s embassies, and that he also promoted another brother’s beer business.

Becciu denied having anything to do with the beer business. But his response was also an indication of a general acceptance in the Italian-dominated Holy See of favors and displays of nepotism that are anathema to many Anglo-Saxon corporate cultures, where even the appearance of such conflicts are forbidden.

Becciu admitted he gave work to his carpenter brother when he was renovating the embassies, but justified it saying the Vatican secretariat of state had approved the work and that in Cuba at least, it was impossible to obtain building materials locally.

“What was I supposed to do, go around Italy calling up carpenters to avoid let’s say a conflict of interest?” he asked.

Becciu was long known to have clashed with Francis’ first economic czar, Cardinal George Pell, who was brought in to reform the Vatican’s opaque finances and impose international accounting standards across the Curia, or bureaucracy.

Pell greatly irritated the Vatican’s old guard, Becciu included, and he issued a statement Friday congratulating Francis for finally taking action.

“He plays a long game and is to be thanked and congratulated on recent developments,” Pell said in the statement. “I hope the cleaning of the stables continues in both the Vatican and Victoria.”

Asked about Pell’s statement, Becciu readily admitted the two had professional differences. He recalled that he lost his temper when Pell accused him once in a meeting of being “dishonest.”

But Becciu said when Pell left the Vatican to face trial in his native Australia for historic sexual abuse charges for which he was eventually absolved, Becciu sent him a handwritten note expressing his solidarity and assurances of his innocence.

“If he still considers me corrupt, there’s nothing I can do,” Becciu said. “My conscience tells me I’m not corrupt.”

Despite his bitterness, Becciu said he remained loyal to the pope and pledged again his obedience even to the point of death.

“I promised him loyalty until the end, and when I became a cardinal I promised I’d give my life for the church and the pope,” he said. “I will never betray him.”

A Detroit litigator has started his term Tuesday as the president-elect of the American Bar Association.

Reginald Turner, a law firm member of Clark Hill PLC, will serve as the president-elect of the ABA for one-year, the ABA said in a news release. He will become president of the association in August 2021.

“Being a lawyer means conducting yourself with professionalism, service and honor,” Turner said in a news release. “As I assume a leadership role in the ABA, I will honor those values and fulfill the obligation to pursue access to justice, which is true justice.”

Operation Legend: Update on Federal Charges

On July 8, 2020, Attorney General William P. Barr announced the launch of Operation Legend, a sustained, systematic and coordinated law enforcement initiative in which federal law enforcement agencies work in conjunction with state and local law enforcement officials to fight violent crime. The initiative is named in honor of four-year-old LeGend Taliferro, who was shot and killed while he slept early in the morning of June 29 in Kansas City. 

Launched first in Kansas City, MO., on July 8, 2020, the operation was expanded to Chicago and Albuquerque on July 22, 2020, to Cleveland, Detroit, and Milwaukee on July 29, 2020, to St. Louis and Memphis on August 6, 2020, and to Indianapolis on August 14, 2020.

Since the operation’s launch, through Monday, August 31, 2020, more than 2000 arrests – included 147 for homicide – have been made; more than 544 firearms have been seized; and more than seven kilos of fentanyl, 14 kilos of heroin, 12 kilos of cocaine, and 50 kilos of methamphetamine have been seized.

Of those individuals arrested, 476 have been charged with federal offenses. 249 of those defendants have been charged with firearms offenses, while 185 have been charged with drug-related crimes. The remaining defendants have been charged with various offenses. The breakdown of federal charges is below.

Feds unveil charges against ex-Macomb prosecutor Smith

Detroit — Former Macomb County Prosecutor Eric Smith was charged Wednesday with obstructing a federal investigation into whether he stole campaign funds, capping a steep fall for one of the region's top law enforcement officials.

Smith has agreed to plead guilty to one count of obstruction of justice, a 20-year felony, after a prolonged period of turmoil that included a raid at his home, his resignation six months ago and questions about whether he illegally spent campaign money.

Smith tried to get a friend and two unidentified assistant county prosecutors to lie to a federal grand jury and FBI investigators who concluded he orchestrated two fraud schemes to steal $75,000 from his political campaign fund, prosecutors said Wednesday. Smith used the money for personal expenses from 2012 to this year, authorities allege.

The 53-year-old Democrat from Macomb Township is the highest-ranking public official ensnared in a years-long federal crackdown on corruption in Macomb County. Since 2016, federal prosecutors have secured the convictions of 22 contractors and public officials, including former Clinton Township Trustee Dean Reynolds, trash mogul Chuck Rizzo and towing titan Gasper Fiore. Former county Public Works Commissioner Anthony Marrocco is awaiting trial on corruption charges.

The case against Smith focuses on lies and campaign cash. Smith controlled the campaign fund, telling donors the money would be used for his re-election, U.S. Attorney Matthew Schneider said.

"Sometimes that was true," Schneider said, "but sometimes that was a lie. It was a fraud. That is because Mr. Smith stole money from his campaign account and used it for his own personal whims."

Smith will plead guilty to one count of obstruction of justice, his lawyers Martin Crandall and John Dakmak said in a statement Wednesday.

“Never did I trade justice for money or any other benefit,” Smith said in a statement Wednesday. “Let me be absolutely clear: The Macomb County Prosecutor’s Office was never for sale under my watch. I acted irresponsibly and recklessly, and I will be held accountable for my actions. However, I never compromised when it came to protecting the citizens of Macomb County and prosecuting criminals.”

The criminal charge was announced six months after The Detroit News exclusively reported that Smith had resigned while pursuing a deal to plead guilty to forthcoming federal corruption charges.

Smith's lawyers were negotiating with federal prosecutors to resolve a corruption investigation that coincided with a separate state probe that in March led to the Michigan Attorney General's Office filing racketeering charges against the county's top law enforcement officer. Smith and three others were accused of participating in a scheme to embezzle $600,000 in county forfeiture funds.

Smith had approximately $55,000 in checks written from his campaign account that was purportedly for renting a campaign office, the U.S. Attorney said Wednesday.

"But that was a sham," Schneider said.

An unidentified associate cashed the checks and gave Smith the money "for Smith's own enjoyment," Schneider said.

In 2016, Smith gave a $20,000 check to an unidentified assistant prosecutor. That person gave $15,000 to Smith "for his own personal expenses" and kept the rest, Schneider said.

Smith also tried to cover up the crimes, the U.S. Attorney said.

In September 2019, Smith learned a grand jury was investigating the use of his campaign account and that FBI agents were planning to interview his associates, Schneider said.

"Smith tried to convince his associate to falsely tell the FBI that the $55,000 kicked back to Smith was simply a loan that Smith would repay."

DOJ Takes Down International Trafficking Tiny Humans Adoption Operation In Strongsville, Ohio

Strongsville seems to be the focus, de jour.

The same thing goes on in the United States, except it is much more gruesome because no one cares about the horrors of Child Protective Services, Foster Care & Adoption, the oldest form of survival.

Three Individuals Charged with Arranging Adoptions from Uganda and Poland Through Bribery and Fraud

Three women were charged in a 13-count indictment filed on Aug. 14 in the Northern District of Ohio for their alleged roles in schemes to corruptly and fraudulently procure adoptions of Ugandan and Polish children through bribing Ugandan officials and defrauding U.S. adoptive parents, U.S. authorities, and a Polish regulatory authority.

Margaret Cole, 73, of Strongsville, Ohio, Debra Parris, 68, of Lake Dallas, Texas, and Dorah Mirembe, 41, of Kampala, Uganda, were charged in the indictment.  In relation to the Uganda scheme, Parris and Mirembe were each charged with one count of conspiracy to violate the Foreign Corrupt Practices Act (FCPA) and commit visa fraud, one count of conspiracy to commit mail fraud and wire fraud, one count of conspiracy to commit money laundering, three substantive FCPA counts and three substantive counts of money laundering.  Parris was also charged with one count of mail fraud.  In relation to the Poland scheme, Parris and Cole were each charged with one count of conspiracy to defraud the United States.  Cole was further charged with one count of making a false statement to a U.S. accrediting entity and one count of making a false statement to a Polish authority.

“The defendants allegedly resorted to bribery and fraud to engage in an international criminal adoption scheme that took children from their home countries in Uganda and Poland without properly determining whether they were actually orphaned.  The defendants sought to profit from their alleged criminal activity at the expense of families and  vulnerable children,” said Acting Assistant Attorney General Brian C. Rabbitt of the Justice Department’s Criminal Division.  “These charges clearly show that the Department of Justice is committed to protecting children worldwide, including those involved in the international adoption process.”

“These defendants are accused of orchestrating an alleged scheme that bribed Ugandan officials, defrauded the United States and manipulated parents inside and outside of the country,” said U.S. Attorney Justin Herdman of the Northern District of Ohio.  “As a result of this alleged conduct, prospective parents were deceived, hundreds of thousands of dollars were misused and innocent children were displaced from their homes.”

“These three defendants preyed on the emotions of parents, those wanting the best for their child, and those wishing to give what they thought was an orphaned child a family to love,” said Special Agent in Charge Eric B. Smith of the FBI’s Cleveland Field Office.  “These defendants allegedly lied to both sides of the adoption process, and bribed Ugandan officials who were responsible for the welfare of children.  Parents, prospective parents and children were emotionally vested and were heartbroken when they learned of the selfishness and greed in which these three engaged.  The FBI will never cease in its efforts to protect the innocent and unwitting from those who prey on that trust and confidence and we will vigorously pursue and hold those responsible accountable.”

With respect to the Uganda scheme, the indictment alleges that Parris and Mirembe, together with others, engaged in a scheme to pay bribes to Ugandan officials to corruptly procure the adoption of Ugandan children by families in the United States, including the adoption of children who were not properly determined to be orphaned and who had to be ultimately returned to their birth parents.

Specifically, Parris, Mirembe, and their co-conspirators allegedly (1) paid bribes to social welfare officers in exchange for them issuing welfare reports recommending that certain children be placed into orphanages without first ensuring that the children were actually orphaned or that putting them up for adoption was in the children’s best interest; (2) paid bribes to Ugandan magistrate judges to obtain court orders placing those children in an orphanage that was willing to accept the children without inquiring into whether they were actually orphans; (3) paid bribes to court registrars to cause the court registrars to assign the cases of these children to two corrupt “adoption-friendly” judges; and (4) paid bribes to the corrupt Ugandan judges to obtain orders to permit their clients to bring the children to the United States for adoption.

Parris, Mirembe, and others also allegedly lied to, and concealed material information from, adoptive parents, including lying about the bribe payments and whether the children were properly determined to be eligible for adoption, and concealing other material information about the children’s history.  The indictment also alleges that Parris, Mirembe, and others agreed to cause false documents to be submitted to the U.S. Department of State to hide the corrupt and fraudulent scheme and to mislead it in its adjudication of visa applications for the Ugandan children being considered for adoption.  The co-conspirators and the entities they worked for received more than $900,000 in connection with these adoptions.

With respect to the Poland scheme, the indictment alleges that after clients of their adoption agency determined they could not care for one of the two Polish children they were set to adopt, Cole and Parris took steps to transfer the child to Parris’s relatives, who were not eligible for intercountry adoption and one of whom had a criminal arrest record.  After the child was physically abused, Cole and Parris took steps to conceal their improper conduct from the entity responsible for accrediting U.S. intercountry adoption agencies—and from the Polish authority responsible for intercountry adoptions—in an attempt to continue profiting from these adoptions. 

An indictment is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

Prelude To Detroit: Dwight Mitchell, His Race To SCOTUS & Tiny Humans Trust Fund

There is an amended complaint, but it, too, had lots of defects, which is why the case was dismissed without prejudice, so I do not know why they took it took it to the Court of Appeals, because all they had to do was to correct procedural errors, that is, unless... they were attempting to fast track the case to SCOTUS in time of the DC #coloredrevolution, but hey, what do I know?

I know grifting when I see it because I see TCF Bank, which means I see Detroit.

TCF Bank is the wholly owned banking subsidiary of TCF Financial Corporation, a bank holding company headquartered in Detroit, Michigan. 

I also know when I see predatory legal practices of dubious actors because the case is out Minnesota where the "Legal Geniuses" (trademark pending) of record spent more time on financially structuring its sustainability than trying to secure reunification of Mitchell's children, probably because they do not possess the legal acumen to utilize the proper nomenclature of the child welfare system.

There are far too many parents who will desperately latch on to any form of hope, even if there are nefarious goals behind the pro bono services, unbeknownst to the original parent.

There are even parents who would purvey their own children.

I wish them all well, even though there should be significant raised questions surrounding the possibility that their sustainability operations are foreign funded because I see tiny humans trust funds.

Conducted numerous land acquisitions for non-profit and for profit corporations.

STOP CHILD PROTECTION SERVICES FROM LEGALLY KIDNAPPING is a plaintiff to the action, but, is not registered in any state or federal as a legal entity, which means it has no legal standing to bring forth a claim, where the court did not even take the time to address this defect, but, then again, they do not have to.

Mitchell's "Legal Geniuses" (trademark pending) failed to file any corporate parent disclosure, which is probably why it did not address jurisdictional standing of STOP CHILD PROTECTION SERVICES FROM LEGALLY KIDNAPPING.

Mitchell's attorneys brought forth claims of his children, without addressing his legal standing to act on behalf of his children.

I have no idea if his parental rights were terminated but I do know that Mohrman, Kaardal & Erickon and the courts have absolutely no idea of what Parental Rights are because they are "Legal Geniuses" (trademark pending).

There were no claims against the privately, contracted service providers.

Mitchell used race as a vehicle to file this action without citation of specific policies or explaining what race is, how it is measured, how membership of this group based animus is determined, or how it was relevant to his non-registered working group, comprised of a hodge podge of terms lifted from the work of other individuals, who would have graciously assisted in the construction of the arguments.

Mitchell's "Legal Geniuses" (trademark pending) did not even request issuance of summons for the amended complaint.

Nor, was the State of Minnesota named as a defendant.

Now, there is Mitchell's 501c3, The Family Preservation Foundation, which, oddly enough, was not listed as a party to complaint.
