My Memo Man, Rod Rosenstein, is in Baltimore, in a corporate law firm, with lots of new friends and Sally Yates.

Can you say "Land Bank"?

How about 2018 election interference.

Perhaps, just perhaps, if we are all very nice, My Memo Man will say "gerrymandering".

I would throw out "drugs, weapons, and tiny humans", but that would give away the mystery as to why he took the position.

I never did like Sally Yates because she took a peculiar stance in a piece she wrote, while at DOJ, entitled, "Poverty is not a crime" and failed to acknowledge where she got that line, then turned around and bastardized it by not making one single reference to child welfare.

She was mean to my Sweetie.

It seems I did not preserve her writings, neither did the DOJ.

Former U.S. Deputy Attorney General Rod Rosenstein Joins King & Spalding as a Partner in Washington, D.C.

Rosenstein is the latest high-ranking Justice Department official to join the firm’s Special Matters & Government Investigations team; he will work closely with a deep bench of former federal prosecutors and senior government officials to help clients with their most challenging litigation, enforcement and reputational issues.

WASHINGTON, Jan. 8, 2020 — King & Spalding today announced that former Deputy Attorney General Rod Rosenstein joins the firm’s Washington, D.C., office as a partner on its Special Matters & Government Investigations team.

Rosenstein spent almost two decades in senior legal management and leadership positions at the U.S. Department of Justice during the administrations of Presidents George W. Bush, Barack Obama and Donald Trump, including as Deputy Attorney General (2017 to 2019) and United States Attorney (2005 to 2017). Prior to his appointment as the Department’s second-highest ranking official, he was the longest-serving Senate-confirmed U.S. Attorney in recent history.

As Deputy U.S. Attorney General, Rosenstein formulated and implemented Department policies and programs; coordinated interactions with the White House and other federal agencies, the Judiciary, and the Congress; interacted with state, local, and foreign government leaders; and provided supervision and direction to all Department components, including its litigating divisions and law enforcement agencies.

Rosenstein conducted complex investigations and handled litigation in trial and appellate courtrooms as Principal Deputy Assistant Attorney General for the Department’s Tax Division (2001 to 2005), as an Assistant U.S. Attorney for the District of Maryland (1997 to 2001), and as an Associate Independent Counsel (1995 to 1997).

Rosenstein started his legal career in 1989, as a law clerk to Judge Douglas H. Ginsburg of the U.S. Court of Appeals for the D.C. Circuit. He first joined the Department of Justice as a trial attorney in the prestigious Public Integrity Section of the Criminal Division (1990 to 1993), before serving as counsel to the Deputy Attorney General and the Assistant Attorney General for the Criminal Division (1993 to 1995). In these and other roles, he received dozens of awards and honors for his performance. In addition, Rosenstein gained impressive trial experience while representing the United States at 23 jury trials and arguing 21 appeals in various appellate courts around the country, including the 2018 U.S. Supreme Court criminal case of Chavez-Meza v. United States, in which the Court ruled in favor of his argument.

After Trump administration stint, Baltimore is still on Rod Rosenstein’s mind

As he takes a job with a high-profile law firm, Maryland’s former longtime U.S. Attorney Rod J. Rosenstein isn’t looking to talk much about his time with the Trump administration. He’s turned down book offers, and avoids questions on the subject.

If he did write a book, Rosenstein told The Baltimore Sun Wednesday, “it would probably be a lot about Baltimore.”

The city remains on the former deputy U.S. attorney general’s mind, after 12 years leading federal law enforcement efforts that he said were key to the city experiencing fewer than 200 homicides in 2011. (There were 348 homicides in the city last year.) He remains in touch with protege Robert K. Hur, who succeeded him as U.S. attorney for Maryland.

“It’s important for everybody at the federal, state and local level to agree that reducing murders is a priority,” Rosenstein said. “I’m hopeful they’ll get back to where we were before ... but it’s going to take a long time.”

The law firm of King & Spalding announced that Rosenstein will join its special government investigations team, following about eight months he spent with his family after stepping down as deputy attorney general. Rosenstein said it was Maryland’s former Republican governor Robert Ehrlich who helped connect him to the new job after they had lunch in the summer.

Rosenstein’s tumultuous two-year tenure included writing a memo supporting the firing of FBI Director James Comey and overseeing special counsel Robert Mueller’s investigation into Russian interference in the 2016 election.

Of his tenure, Rosenstein said, “I’ve been out of government for eight months, and I’m on to a new career. ... I’m practicing law, not politics."

Rosenstein has continued to weigh in on Baltimore’s crime rates and on issues of law enforcement. On Jan. 1, he tweeted: “When Baltimore City prosecutors and police worked with federal and state partners to send every violent repeat offender to prison in 2011, only 197 people were murdered. Now criminals murder 350 victims and shoot hundreds more every year. WHAT CHANGED?”

Rosenstein maintains other ties to the city — he was scheduled to speak to a city law club, the Serjeants’ Inn, Wednesday night.

Rosenstein noted that the number of federal prosecutors in Baltimore increased significantly when he was No. 2 at the Justice Department.

“That’s not because I was showing favoritism; we had additional resources and were able to allocate them based on population and crime rates and need,” he said.

He said Hur is “doing a superb job,” and suggested, without citing specific agencies, that other law enforcement partners are not on the same page.

“If people are not being caught and prosecuted locally, they need to find out why that is,” Rosenstein said. “We had a decade of sustained improvements in Baltimore. We had improvements in Prince George’s County [as well] — the PG County improvements have stuck; they have not fallen back. Baltimore is worse today than when I got there 15 years ago.”

Bond movies are fun to watch. It’s a little different when your life becomes one.

But for the past year that has been the case for Chappaquiddick-based artist Elizabeth Whelan.

On. Dec. 28, 2018, Ms. Whelan’s brother Paul Whelan was arrested while he was in Moscow attending a wedding. Accused of international espionage, Paul Whelan has been held in the notorious Lefortovo prison for the past nine months.

Now Ms. Whelan has temporarily left her quiet life as a Martha’s Vineyard portrait artist and traded in her canvases for canvassing, moving to Washington D.C. in a tireless attempt to lobby all 535 members of Congress and the American ambassador in Russia, John Huntsman, for her brother’s release.

“I was literally in a Twitter spat with the Russian Ministry of Foreign Affairs the other weekend,” Ms. Whelan told the Gazette in an interview this week. “How often do you get in a Twitter spat with the state department of a foreign country — not to mention the one that is holding your brother hostage? When you talk about situations that you would have never dreamed of, I think that this one is pretty high on my list.”

Although the Russian government has not allowed her to contact Paul, her persistent work on Capitol Hill has played an instrumental role in the creation of two congressional resolutions that call on the Russian government to provide evidence of Mr. Whelan’s wrongdoing.

“I’m used to talking to people one-on-one for my portraits,” Ms. Whelan said. “But I’m not used to sitting at a table with all this fancy china laid out, and all of these very important people sitting across from me, in this historic room — and yelling. That is not what I do.”

Paul Whelan was arrested nine months ago. Since then, the Whelan family has undertaken an aggressive public relations campaign that has steadfastly asserted from day one that he is being unjustly held as a political chess piece. “Trade fodder,” she said. Ms. Whelan’s brothers, David and Andrew, have mobilized, sending weekly email updates, holding press conferences, and working with the governments of the three other countries where Paul holds citizenship — the United Kingdom, Canada and Ireland.

That left Elizabeth to deal with the American politicians.

“I basically ended up being the more flexible person, making me the one who went to D.C,” Ms. Whelan said. “This is a political situation, and unfortunately only a political solution will bring it to an end . . . when I said that to my brothers in January, I had no idea what that was going to turn into.”

She started by meeting with Cong. Bill Keating and the representative from Paul’s home district in Michigan, Haley Stevens, learning how to run back and forth between different sides of Capitol Hill like the proverbial K-Street lobbyist she is not. Almost a year later, Ms. Whelan has made contact with hundreds of members of Congress, non-governmental organizations, advocacy groups and embassies. But because the United States government isn’t calling Paul a hostage, she hasn’t gotten any help from the alphabet soup of bureaucrats and secret service agents whose job it is to bring home Americans who are being held hostage abroad.

“So what’s happened is that Elizabeth Whelan is running around D.C. trying to make her own fusion cell,” Ms. Whelan said.

“It’s crazy, because when I go to these meetings and talk to the Deputy Secretary of State, they aren’t telling me they are going to take care of this and get him out,” she added. “They are giving me suggestions about what I should do. And I tell them, I am more than happy to call President Putin myself and discuss the situation of my brother’s detention with him. But I will not meet with him in person because, as my brother David says, no Whelan will be going to Russia until Russia returns the Whelan they already have.”

With persistence, she has made inroads in Washington. The joint resolutions now in front of both the House and Senate say that if the Russians continue to not provide evidence of Paul’s purported crimes, he must be returned. A week after they were introduced, the bills received numerous co-sponsors and were released from committee. Now Ms. Whelan has three weeks to call all 535 legislators again before they reconvene in less than a month leading up to a vote.

“It’s an extraordinarily large job for one person,” she said. “Luckily I’m a spreadsheet queen.”

Meanwhile, Paul has had little contact with anyone other than the U.S. Embassy consular staff, according to Ms. Whelan. He’s spent time in solitary confinement and hours in the interrogation room. His attorney was chosen by the Russian government. His family cannot speak to him. They’ve sent him hundreds of letters, including many from Martha’s Vineyard. Ms. Whelan said hardly any arrive.

“It’s extremely restricted, and when you compare it to how U.S. government treats Russians who we have, they are allowed to talk and to have family visits,” she said.

Things don’t appear to be getting any easier for the Whelan family. Ambassador Jon Huntsman, who has been the primary liaison to Paul, is stepping down and had his last meeting with Paul on Wednesday, Ms. Whelan said. President Trump has appointed his Deputy Secretary of State, John Sullivan, as Mr. Huntsman’s replacement, but it could take weeks or months for him to be sworn into office.

But that hasn’t stopped the Whelans from devoting their lives to getting their brother home.

“I never, ever thought I would be doing this,” Ms. Whelan added. “One of the reps from Michigan is going to be in Boston to talk about what we should do next. Who does that? Not a little artist working from Chappaquiddick. I just want to be behind my easel in the woods.”

Tagg Romney has Twins Via a Surrogate Mother

Mitt Romney's eldest son, Tagg, made a surprise announcement today: He and his wife, Jen, are the new parents of twin boys delivered by a surrogate.

"Happy 2 announce birth of twin boys David Mitt and William Ryder. Big thanks to our surrogate. Life is a miracle," Tagg Romney said via Twitter at 3:17 p.m.

Ten minutes later, his mother, Ann Romney, said in her own tweet: "Grandchildren 17 and 18 are here – congratulations @TRomney and Jen! We can't wait to meet David and William."

Tagg Romney is one of five children of the presumptive Republican presidential nominee and his wife. Tagg and Jen Romney had four children previously.

The Associated Press reported it was the second time the couple had used a surrogate. Their son Jonathan was born in 2010 by a surrogate.

Tagg Romney said on his Facebook page that the latest surrogancy was gestational, meaning the new boys are the biological product of him and his wife.

"Everyone is healthy and happy," Tagg Romney wrote. "They weighed in at 5 pounds 13 ounces and 19-3/4 inches, and 6 pounds 13 ounces and 19 inches. A special thanks to our gestational surrogate who made this possible for us. Life truly is a miracle, and we feel so blessed to be able to celebrate the arrival of these precious boys into our family."

His Facebook homepage features a group photo at Fenway Park of him and three of his four brothers.
Both Tagg and Jen Romney are members of the Church of Jesus Christ of Latter-day Saints, which encourages its members to have large families and places a premium on genealogical research.

Nonetheless, "The Church strongly discourages surrogate motherhood," says an LDS handbook.

As for adopted children, the handbook says: "Questions regarding the exchange of information and contact between adopted children and their biological parents should be handled with sensitivity. The legal rights and emotional needs of all relevant parties should be considered."

I believe this tale is self explanatory.

Top Romney Adviser Worked With Hunter Biden On Board Of Ukrainian Energy Company

As Democrats and the media remain fanatically obsessed with assembling some form of a “quid pro quo” from the infamous Trump-Zelensky phone call, new details have emerged regarding Burisma, the company for which Hunter Biden worked and the company that Ukraine’s top prosecutor had been investigating before Vice President Joe Biden had the prosecutor fired via a months-long pressure campaign. According to web archives, top Mitt Romney adviser Joseph Cofer Black, who publicly goes by “Cofer Black,” joined Burisma’s board of directors while Hunter Biden was also serving on the board.

According to The New Yorker, Hunter joined Burisma’s board in April of 2014 and remained on it until he declined to renew his position this past May. Meanwhile, according to Burisma’s website, Black was appointed in February of 2017 and continues to serve on its board. The timelines would indicate that Black and Biden worked together at Burisma, and indeed, web archives from late 2017 show Black and Biden listed simultaneously on the board.

Black joined the CIA in 1974 and eventually climbed the ranks to become director of the National Counterterrorism Center from 1999 to 2002. In 2002, President George W. Bush appointed him ambassador at large and coordinator for counterterrorism. He later worked at Blackwater as a vice chairman before joining Romney’s campaign as a “special adviser” on Romney’s Foreign Policy and National Security Advisory Team in October of 2011. In 2017, Black joined the board of Burisma.

It’s looking increasingly probable that Burisma, the subject of a series of corruption allegations in the past, has been smartly buying Western complacency by slapping a few famous names on its board. In addition to the son of a vice president and a special adviser to a GOP presidential candidate, the board also boasts the former president of Poland from 1995 to 2005, Aleksander Kwaśniewski.

Fund manager sues son and brother of U.S. Senator Biden

NEW YORK (Reuters) - A Deutsche Bank executive is suing a son and a brother of Delaware Sen. Joe Biden for at least $10 million over a deal they had to buy into a hedge fund, according to court documents. Stephane Farouze, who is global head of fund derivatives for Deutsche Bank and lives in London, claimed that Biden’s son Hunter and brother James broke a May 2006 contract and defrauded him after agreeing to buy his membership interests in New York-based Paradigm Companies LLC.

The lawsuit filed in New York State Supreme Court in Manhattan in June names Washington lobbyist Hunter Biden, James Biden, and James’s former business partner Anthony Lotito as defendants. On Wednesday, Farouze’s lawyer Marlen Kruzhkov said that the Bidens “never had any intention of carrying out the agreement with my client”.

He said the Bidens and their lawyers have not responded to the complaint. Representatives for the Bidens could not immediately be reached for comment. The lawsuit said that while the Bidens took control of the company, they never paid Farouze the cash they had agreed to pay.

Sen. Biden is a Delaware Democrat who was first elected to the U.S. Senate in 1972. He has been mentioned as a possible vice presidential candidate on Sen. Barack Obama’s presidential ticket. The lawsuit is the second accusing Biden’s relatives of irregularities in their deal to buy hedge fund firm Paradigm. An earlier lawsuit was filed by Lotito in January 2007.

Vice President Biden met today with Ukrainian President Petro Poroshenko.‎ President Poroshenko updated the Vice President on coalition negotiations to form a new Ukrainian government that is committed to a reform program, including IMF and EU requirements, and the full implementation of its Minsk commitments. President Poroshenko also noted his commitment to installing a new, credible Prosecutor General. The Vice President welcomed the efforts of President Poroshenko to form a stable, reform-oriented government, and stressed that this step, as well as the enactment of needed reforms, are critical to unlocking international economic assistance, including the third $1 billion U.S. loan guarantee. The Vice President also informed President Poroshenko that the United States is moving forward with an additional $335 million in security assistance, which will fund additional advisors, training, and non-lethal assistance. The leaders condemned the illegal imprisonment of pilot Nadia Savchenko, and called for her release and for immediate and unimpeded medical access. The Vice President reaffirmed U.S. commitment to Ukraine's sovereignty and territorial integrity, emphasizing that the U.S. continues to reject the occupation and attempted annexation of Crimea, and reiterated the importance of maintaining sanctions against Russia until Minsk is fully implemented.

President Donald Trump said Tuesday that he has asked national security adviser John Bolton to resign, noting that he "strongly disagreed with many of his suggestions as did others in the administration."

"I informed John Bolton last night that his services are no longer needed at the White House. I disagreed strongly with many of his suggestions, as did others in the Administration, and therefore I asked John for his resignation, which was given to me this morning," Trump tweeted. "I thank John very much for his service. I will be naming a new National Security Advisor next week," he added.

The tweet came just one hour after the White House press office said Bolton was scheduled to appear at a Tuesday press briefing alongside Secretary of State Mike Pompeo and Treasury Secretary Steve Mnuchin.

Bolton tweeted minutes after Trump's announcement, "I offered to resign last night and President Trump said, 'Let's talk about it tomorrow.'"

Trump was irked by reports that he had faced internal pushback from Bolton over his decision to host leaders of the Taliban at Camp David, multiple people familiar with his frustration say. The President announced the plans for the meeting were canceled on Saturday.

CNN reported last week that tensions between top figures on Trump's national security team had devolved into all-out hostility , creating a deep disconnect between staffers on the National Security Council, led by Bolton, and the rest of the administration, six people familiar with the matter said.

Bolton was initially brought into the administration last year to replace HR McMaster partly due to his hawkish position on Iran -- supporting Trump's exit from the Iran nuclear deal -- but he soon began to clash with the President's vision for diplomacy in North Korea and most recently on Afghanistan.

But Trump has been getting more and more irritated with Bolton over the past several months for his statements on Iran, Venezuela and now Afghanistan, a senior administration official told CNN Tuesday.

Trump no longer believed his national security adviser could advocate for the President's agenda, and instead felt he was harming his credibility, the official said.

Trump also felt like Bolton wasn't a forceful enough advocate for him in the media -- and that when he did make appearances, he wasn't convincing enough, since it was evident he didn't believe in some of Trump's foreign policy goals, the source added.

Russia seeks prisoner exchange, but stops short of swap for Paul Whelan

Russian Deputy Foreign Minister Sergei Ryabkov called on the U.S. Monday to free Russian pilot Konstantin Yaroshenko from prison in exchange for Americans it is holding, Interfax news service reported.

But Ryabkov stopped short of saying Russia would be willing to release Michigander Paul Whelan — who was arrested in December and charged with espionage — as part of the trade.

Ryabkov told the RIA news agency that it wouldn't be right to include Whelan in a prisoner swap with the U.S. because Whelan has not yet been convicted in the Russian court system.

Whelan's detention has continued for more than six months as Russian Federal Security Service (FSB) investigators look for evidence the former U.S. Marine was spying during his trip to the country late last year.

The U.S. State Department declined to comment Tuesday on Ryabkov's offer.

"The U.S. government continues to closely follow all cases of imprisoned U.S. citizens in Russia," a State Department spokeswoman told the Free Press in an email. "We do not read out our private diplomatic discussions."

Yaroshenko was arrested in 2010 by U.S. special forces in Liberia and later convicted of conspiracy to smuggle cocaine into the United States. He was sentenced to 20 years in federal prison and is serving time in a low-security correctional facility in Danbury, Connecticut.

His release has been long-sought by Russian authorities.

Tatiana Moskalkova, the Russian Federation's high commissioner for human rights, sent a letter to U.S. President Donald Trump in 2017 asking for a pardon for Yaroshenko. It was denied.

The news comes as U.S. officials grow increasingly concerned about Whelan's health in Moscow's Lefortovo prison. The 49-year-old global security director for Auburn Hills-based auto supplier BorgWarner has not been seen by an independent doctor, said Andrea Kalan, a spokeswoman for the U.S. Embassy in Moscow, in a tweet.

His condition, she said, is worsening.

Whelan's family has declined to share details about his health condition out of concern for his privacy. But his twin brother, David Whelan, said the Russian prison doesn't offer much beyond basic First Aid and emergency medical care.

"And they appear only be able to provide it in the Russian language," David Whelan said. "Like many people in their late 40s, Paul has health concerns that need professional attention, to avoid them becoming emergencies. The Russian Foreign Ministry rejection of the US government request that an English-speaking physician be allowed to examine Paul is disappointing."

A State Department spokeswoman said the agency is continuing to press for "fair and humane treatment, due process, and access to appropriate medical care. We take allegations of mistreatment seriously, and will continue to raise Mr. Whelan’s case at every opportunity. The Department has no higher priority than the welfare and safety of U.S. citizens abroad. We urge the Russian government to guarantee a fair and transparent judicial process without undue delay, in accordance with its international legal obligations."

Whelan, who lives in Novi, denies he is a spy and has told reporters during court appearances that he is a victim of political kidnapping.

At a detention hearing in late June, Whelan asked President Trump to intervene on his behalf.

Although Trump has yet to make a statement (or tweet) about Whelan, others in his administration — most recently U.S. National Security Adviser John Bolton — have spoken out against the continued detention of an American citizen without evidence from the Russian government to support its claims of espionage.

The Russian Federal Security Service (FSB) alleges Whelan was caught in possession of a flash drive containing classified information at his hotel in Moscow. Whelan has told his lawyers that the flash drive came from a Russian friend, and that he was under the impression that it contained photos of the friend's hometown.

He will continue to be held in a Moscow prison at least until his next court hearing at the end of August, his lawyers have said. A trial date has not yet been set in his case.

David Whelan said Tuesday that the family has not discussed with U.S. officials the possibility of a prisoner swap.

"We haven't spoken with the U.S. government about swaps or sanctions, or any other tool of diplomacy they might use to bring Paul home," he wrote in an email to the Free Press. "We are leaving it up to the professional diplomats to work out the tool and the timing. Hopefully it will be sooner than later."
