When Jacob Blake’s father talked with his son Sunday morning, the younger Blake was gearing up for a day of celebrating his son’s eighth birthday.

That evening, the father got word that his son had been shot eight times by police officers in Kenosha, Wisconsin. Eighteen minutes later, he saw the now-viral video, he said.

“What justified all those shots?” his father said. “What justified doing that in front of my grandsons? What are we doing?”

Some witnesses say Jacob Blake, a 29-year-old Black man who attended middle and high school in Evanston, was simply trying to break up a fight Sunday evening. The cellphone video of the incident shows Blake walking around and opening up his car door before appearing to be shot in the back by police.

Eight holes
His father said there are now “eight holes” in his son’s body, and he’s paralyzed from the waist down. Doctors don’t yet know if the injury is permanent.

The elder Blake made the drive from Charlotte, North Carolina, to be with his son in the hospital Tuesday.

“I want to put my hand on my son’s cheek and kiss him on his forehead, and then I’ll be OK,” his father said. “I’ll kiss him with my mask. The first thing I want to do is touch my son.”

He called the incident “attempted murder” and said “those two officers shot eight shots inside my baby’s back.”

“At first, it catches you off guard and you become over-the-top emotional,” his father said. “Then you get to the point where you go from emotional to mad. Your child is not in danger of dying, but they took him to the edge.”

Jacob Blake’s fiancee and six children are “getting showered with love,” his uncle Justin Blake said, and the family hopes to get both the children and his fiancee into therapy concerning the shooting.

He’s been living in Kenosha for about three years, his father said, and is the father of six children between ages 3 and 13. Family is “definitely” important to the younger Blake, who has seven brothers and five sisters, according to his father.

“If you were in need of something and my son had it, he would not hesitate to give it to you,” his father said. “He’s a very giving individual.”

The elder Jacob Blake keeps a book on his nightstand that his son made and dedicated to him in third grade. “He’s very sincere,” his father said.

Family’s Evanston, civil rights ties
Musician L. Stanley Davis has been friends with the Blake family since 1971. The Rev. Jacob Blake Sr., the grandfather of the Jacob Blake whom police shot in Kenosha, was the “father that I never really had,” said Davis, 68, of Woodlawn.

The minister was an activist for affordable housing in Evanston and pastored the Ebenezer African Methodist Episcopal Church from 1967 to 1976, said the Rev. Deborah Scott, who currently leads the church.

In 1968, the Rev. Blake helped to organize a march in support of fair housing after Martin Luther King Jr’s death, according to the Evanston History Center. Four years later, he led his church in building the Ebenezer Primm Towers, which provide affordable housing for seniors. In 2003, Jacob Blake Manor, which also provides low-income housing for seniors, was named after the minister.

Much of what Evanston’s Black community benefits from today can be traced back to the Rev. Jacob Blake, Davis said. The pastor employed Black students at Northwestern University in the church and offered up space to house the Northwestern Community Ensemble, a gospel choir Davis founded in 1971, Davis said. Seeing a lack of Black teachers at Evanston Township High School, the Rev. Jacob Blake urged the district to diversify its teaching staff.

“Forget the glass ceiling — he knocked the door down,” said Davis, 68, of Woodlawn, of the Rev. Jacob Blake. “He turned a couple tables over in Evanston.”

Justin Blake also attended ETHS and now lives in the Park Manor neighborhood. He founded Black Underground Recycling in neighboring Englewood to provide income to the Black community and run a community center.

Justin Blake said his nephew would visit and help serve food to thousands of Chicagoans on the South and West sides.

“Him being a Blake, you don’t have an option to say, ‘No, I don’t feel good today,’” his uncle said. “You go out and build the community. You have no choice but to do something positive in your community.”

Protests erupted Sunday after the shooting of the 29-year-old Blake, with cars set on fire and windows smashed out. Monday night, peaceful protesters marched through the city streets, denouncing police abuse, but the incidents again turned violent after dark. Kenosha residents were waking up Tuesday to desolate streets with burned out buildings.

Blake’s partner, Laquisha Booker, told NBC’s Milwaukee affiliate, WTMJ-TV, that the couple’s three children were in the back seat of the SUV when police shot him. “That man just literally grabbed him by his shirt and looked the other way and was just shooting him. With the kids in the back screaming. Screaming,” Booker said.

“They start to wrestle,” said another witness at the scene, who spoke on condition of anonymity. “The officer is punching on him. Two officers come to assist. They get him down on the curb behind his vehicle. Somehow he manages to get up. They said he has a knife. All of the officers pull out their guns. ... (One of the officers) tells him, ‘Get out of the car!’ and he starts shooting.”

The witness said he never saw a knife.

Wisconsin Gov. Tony Evers said Monday that he has seen no information to suggest Blake had a knife or other weapon, but that the case is still being investigated.

The police officers who shot Jacob Blake were “the flint as well as the gasoline” sparking the violence in Kenosha, his father said.

“Those police officers that shot my son like a dog in the street are responsible for everything that has happened in the city of Kenosha,” his father said. “My son is not responsible for it. My son didn’t have a weapon. He didn’t have a gun.”

There is an amended complaint, but it, too, had lots of defects, which is why the case was dismissed without prejudice, so I do not know why they took it took it to the Court of Appeals, because all they had to do was to correct procedural errors, that is, unless... they were attempting to fast track the case to SCOTUS in time of the DC #coloredrevolution, but hey, what do I know?

I know grifting when I see it because I see TCF Bank, which means I see Detroit.

TCF Bank is the wholly owned banking subsidiary of TCF Financial Corporation, a bank holding company headquartered in Detroit, Michigan. 

I also know when I see predatory legal practices of dubious actors because the case is out Minnesota where the "Legal Geniuses" (trademark pending) of record spent more time on financially structuring its sustainability than trying to secure reunification of Mitchell's children, probably because they do not possess the legal acumen to utilize the proper nomenclature of the child welfare system.

There are far too many parents who will desperately latch on to any form of hope, even if there are nefarious goals behind the pro bono services, unbeknownst to the original parent.

There are even parents who would purvey their own children.

I wish them all well, even though there should be significant raised questions surrounding the possibility that their sustainability operations are foreign funded because I see tiny humans trust funds.

Conducted numerous land acquisitions for non-profit and for profit corporations.

STOP CHILD PROTECTION SERVICES FROM LEGALLY KIDNAPPING is a plaintiff to the action, but, is not registered in any state or federal as a legal entity, which means it has no legal standing to bring forth a claim, where the court did not even take the time to address this defect, but, then again, they do not have to.

Mitchell's "Legal Geniuses" (trademark pending) failed to file any corporate parent disclosure, which is probably why it did not address jurisdictional standing of STOP CHILD PROTECTION SERVICES FROM LEGALLY KIDNAPPING.

The term LEGALLY KIDNAPPED originated from http://legallykidnapped.blogspot.com.

Mitchell's attorneys brought forth claims of his children, without addressing his legal standing to act on behalf of his children.

I have no idea if his parental rights were terminated but I do know that Mohrman, Kaardal & Erickon and the courts have absolutely no idea of what Parental Rights are because they are "Legal Geniuses" (trademark pending).

There were no claims against the privately, contracted service providers.

Mitchell used race as a vehicle to file this action without citation of specific policies or explaining what race is, how it is measured, how membership of this group based animus is determined, or how it was relevant to his non-registered working group, comprised of a hodge podge of terms lifted from the work of other individuals, who would have graciously assisted in the construction of the arguments.

Mitchell's "Legal Geniuses" (trademark pending) did not even request issuance of summons for the amended complaint.

Nor, was the State of Minnesota named as a defendant.

Now, there is Mitchell's 501c3, The Family Preservation Foundation, which, oddly enough, was not listed as a party to complaint.

(FPF), is a not-for-profit, national public interest organization dedicated to the idea of rescuing children from unwarranted forced parental separation, family preservation, family first ideology, and restoring the respect for children's rights through litigation on the constitutionality of the preservation of the family unit. Senate’s Human Services bill emphasizes child and foster care, support for people with disabilities, mental health

The Minnesota Senate today approved a bipartisan Human Services bill that improves the way Minnesota delivers critical services like child and foster care, mental health assistance, and support for individuals with disabilities.

“We want to make sure that the people of Minnesota know they will have access to care and protections they need,” said Senator Scott Jensen (R-Chaska). “This bill makes important updates to the criteria and quality of services that many people require. This pandemic has manufactured a new sense of uncertainty and it is our hope that this legislation will bring some peace of mind.”

Childcare

The bill contains a number of non-controversial provisions that streamline childcare service grants and update childcare licensing rules to bring Minnesota into compliance with federal law. It also solidifies childcare training requirements to make sure children are safe at all times.

In addition, the bill streamlines children’s mental health crisis intervention standards in order to provide better, more patient- and family-oriented care for children in the program.

The bill also requires counties to clearly post criteria for childcare providers seeking variances, so the process of obtaining a variance for certain licensing requirements is less confusing.

Support for people with disabilities

The bill reimagines and strengthens the state’s view of disability services, with the goals of promoting independent living, supporting employment for persons with disabilities, and allowing self-directed care for services.

Foster Care

The bill requires students who switch school districts due to foster care placement to be enrolled in the new district within seven days. If at all possible, the child will remain in his or her current district.

Additionally, when a child is placed into foster care, social services will facilitate a call between the child’s parent and the foster care provider as soon as possible. The purpose of the call is to develop a connection between the foster care provider and the child’s parent and help the foster care provider learn about the child’s unique preferences and tendencies.

The bill also requires prenatal alcohol exposure screenings for children in the child protection system.

Child development

The bill extends the National Institute of Health’s “Baby’s First Years” program, which provides support for low-income mothers and their children in the crucial first three years of the baby’s life. It also cleans up the “Birth to Age Eight” Pilot program, which was created in 2017 to study developmental markers in a child’s first years of life.

Other provisions

The bill extends the “Family Assets for Independence” program, which helps people escape poverty. The federal government decided not to renew this program, so the bill will help Minnesota continue to serve these low-income families.

The bill requires sexual violence prevention training for Home and Community Based Services staff.

The bill also gives broad authority and discretion to the commissioner of Human Services to waive or modify licensing, background studies, and program standard requirements during the coronavirus pandemic. This authority was also granted within Gov. Walz’s executive orders, which were based on work that the Human Services Committee did early in session.

Attorney General Keith Ellison upgrade charges against officer who knelt on George Floyd's neck; charged other 3 involved

Ellison took over case on Sunday.

Attorney General Keith Ellison's office on Wednesday upgraded charges against the former Minneapolis police officer who knelt on George Floyd's neck and charged the other three officers at the scene with aiding and abetting murder.

Ellison held a news conference Wednesday to discuss the charges.

"We strongly believe these developments are in the interest of justice for Mr. Floyd, his family, this community and our state," he said. "George Floyd mattered. He was loved, his family was important and his life had value," Ellison said. "We will seek justice for him and for you and we will find it."

However, he acknowledged, "I don't believe one successful prosecution can reflect the hurt and loss that people feel."

Former officer Derek Chauvin, who recorded on video kneeling on Floyd's neck as he begged for air on May 25, now faces the more serious charge of second-degree murder, in addition to the original charges of third-degree murder and second-degree manslaughter with culpable negligence.

The amended complaint filed against Chauvin stated that "Police are trained that this type of restraint with a subject in a prone position is inherently dangerous. … Officer Chauvin's restraint of Mr. Floyd in this manner for a prolonged period was a substantial factor in Mr. Floyd losing consciousness, constituting substantial bodily harm, and Mr. Floyd's death as well."

During a rally at 38th St. and Chicago Av. in south Minneapolis on Wednesday, Ireland McAbee of Eau Claire, Wis., raised her fist in celebration of the news that Attorney General Keith Ellison had upgraded charges in the death of George Floyd.

Chauvin was originally charged by the Hennepin County Attorney's Office last week with one count each of third-degree murder and second-degree manslaughter.

Don Lewis, special prosecutor in the case against Jeronimo Yanez, the former St. Anthony police officer who killed Philando Castile in 2016, said the nearly 9-minute recording of the moments before Floyd died showed ample evidence of intent to kill on Chauvin's part.

"Those are moments to cause reflection on whether or not you're in the middle of a wrongful death here," Lewis said. "You have George Floyd begging for his life, right? 'I can't breathe.' This is a moment of potential reflection on Chauvin's part," Lewis said. "He had multiple opportunities to change course here and decided not to over the span of almost 10 minutes."

The other former three officers at the scene — Tou Thao, J. Alexander Kueng and Thomas Lane — were each charged with aiding and abetting second-degree murder while committing a felony, and with aiding and abetting second-degree murder manslaughter with culpable negligence. Both charges are categorized as "unintentional" felonies.

Thao was recorded watching as Chauvin continued to press on Floyd's neck with his knee. Kueng was one of the first officers on the scene and helped pin Floyd down. Lane was detailed in earlier charges as pointing a gun at Floyd before handcuffing, and later asked whether officers should roll Floyd on his side as he was restrained.

The charges come just days after Gov. Tim Walz asked Ellison to take over the prosecution, which until Sunday had been led by the Hennepin County Attorney's Office.

The charges noted that Floyd was "calm" after he was first arrested and before Chauvin knelt on his neck. The complaint also noted three times that after Floyd was pinned to the pavement by three officers, none of them moved from their positions despite pleas from Floyd. Video of the incident showed that bystanders also pleaded with police.

Floyd had told the first two officers at the scene – Lane and Kueng – that he was not resisting arrest, but did not want to get into the back of their squad car because he is claustrophobic, the charges said.

Walz issued a statement after Ellison announced the new charges.

"I laid flowers at George Floyd's memorial this morning. As a former high school history teacher, I looked up at the mural of George's face painted above and I reflected on what his death will mean for future generations. What will our young people learn about this moment? Will his death be just another blip in a textbook? Or will it go down in history as when our country turned toward justice and change?

"It's on each of us to determine that answer," Walz said. "The charges announced by Attorney General Keith Ellison today are a meaningful step toward justice for George Floyd. But we must also recognize that the anguish driving protests around the world is about more than one tragic incident.

"George Floyd's death is the symptom of a disease. We will not wake up one day and have the disease of systemic racism cured for us. This is on each of us to solve together, and we have hard work ahead," he said. "We owe that much to George Floyd, and we owe that much to each other."

One of the attorneys representing George Floyd's family, Benjamin Crump, released a statement shortly after 1:15 p.m. Wednesday praising the arrest and charging of the other three officers and the upgrading of murder charges against Chauvin.

Crump's statement came before Ellison's office made any official announcements.

"This is a bittersweet moment for the family of George Floyd," said the joint statement by Floyd's family, Crump and the legal team. "We are deeply gratified that Attorney General Keith Ellison took decisive action in this case, arresting and charging all the officers involved in George Floyd's death and upgrading the charge against Derek Chauvin to felony second-degree murder."

Attorneys for the officers declined to comment or could not be immediately reached Wednesday afternoon.

"This is a significant step forward on the road to justice, and we are gratified that this important action was brought before George Floyd's body was laid to rest," the family's and Crump's statement said. "That is a source of peace for George's family in this painful time."

The statement urged Ellison to continue the investigation and upgrade the charges to first-degree murder, which carries a potential life sentence.

First-degree murder requires proof of planning out the crime.

"These officers knew they could act with impunity, given the Minneapolis Police Department's widespread and prolonged pattern and practice of violating people's constitutional rights," the statement said. "Therefore, we also demand permanent transparent police accountability at all levels and at all times."

The family and Crump thanked the "outpouring" of support they've received, which manifested in days of huge protests across the country and world.

"Our message to them: Find constructive and positive ways to keep the focus and pressure on," they said. "Don't let up on your demand for change."

The former officers' prosecution is the quickest in Minnesota history against officers who have killed civilians on the job, and is the first time more than one officer involved in such an incident has been criminally charged. Three officers have previously been charged with killing a civilian on the job; one, Mohamed Noor, was convicted at trial while two were acquitted.
