Marcus R. Mumford, the Utah attorney who successfully represented Ammon Bundy in federal court in Portland, was found dead in his home Monday morning.

A colleague and friend who had stopped by Mumford’s home in Salt Lake City to bring him breakfast and discuss a case found Mumford, said Mumford’s sister-in-law, Katie Mumford.

Mumford, 46, lived alone. Family members don’t know what caused his death.

He was a divorced father of seven children ranging in age from 5 to 17. His ex-wife and children lived nearby in Salt Lake City, Katie Mumford told The Oregonian/OregonLive.

He wasn’t ill with the coronavirus, and there were no signs of foul play, according to relatives. They’re awaiting the results of an autopsy. His father and mother both suffered serious ailments at a young age; his father had a heart attack around age 40, according to Katie Mumford.

Marcus Mumford represented Bundy when he was acquitted on all charges stemming from the armed takeover of the Malheur National Wildlife Refuge in January 2016.

Mumford was tackled and stunned with a Taser by federal marshals moments after the acquittal. He had shouted at the judge, argued for Bundy’s release and demanded to see a detention order from Nevada following the October 2016 announcement of not guilty verdicts for Bundy and six co-defendants.

Mumford later agreed to voluntarily give up his standing to practice in federal court in Oregon, putting an end to U.S. District Judge Michael W. Mosman’s attempt to officially ban him in Oregon’s federal district.

Mosman pursued the sanction against Mumford, citing repeated instances of Mumford’s arguing with U.S. District Judge Anna J. Brown during the refuge occupation trial, inappropriate commentary on a witness in the presence of a jury and failures or refusals to observe court rulings. Mumford previously told The Oregonian/OregonLive that Mosman was being “vindictive.”

At the time, another defense attorney in the refuge occupation trial praised Mumford. Defense lawyer Matthew Schindler, who was defendant Kenneth Medenbach’s standby lawyer during the trial, said Mumford represented Bundy zealously and successfully.

“What we need far more of in our legal community are Marcus Mumfords,” Schindler told The Oregonian/OregonLive then. “We have plenty of people who are polite. We need people who give everything they have to give.''

Inviting wrath of judge may be part of a calculated approach by Ammon Bundy's lawyer

Attorney Marcus Mumford told The Oregonian/OregonLive that he's striving to show a link between what he and Bundy perceive as the government's "misconduct'' in the shooting of Robert "LaVoy" Finicum with what they contend is the government's mishandling and mischaracterization of the refuge occupation.

"Marcus Mumford was fearless in defending Ammon and the other men in the trial in Portland. He also became a friend to the family and he will be greatly missed. He was the one who felt that the case could be won, and helped make it happen. Our hearts are broken, Rest in Peace.''

Mumford grew up on an Idaho dairy farm and told students at his alma mater, Utah State University, in 2010 that he had to be “audacious enough” to enter the field of law with a significant stuttering condition that he had struggled with since age 4 because “the world wasn’t prepared for a stuttering lawyer.”

Mumford went on to graduate from Brigham Young University’s law school. He clerked for a federal appellate judge and worked eight years for one of the country’s biggest law firms, Skadden, Arps, Slate, Meagher & Flom, before returning to Utah to open his own practice.

Canadian lawmaker urges probe of dock collapse at Detroit site

A Canadian lawmaker is calling on U.S. and Canadian officials to investigate last month's dock collapse at an industrial riverfront site in southwest Detroit and see if there is a threat of contaminating the river.

Michigan's environmental department said there is "no evidence to suggest that there is a current radiological risk" at the site, but it still plans to assess the situation with Friday boat examinations of the location and drone flights.

Brian Masse, a New Democratic Party member of the Canadian Parliament who represents the Windsor region, has expressed concern to the Canadian and U.S. governments about the collapse.

But Detroit Bulk Storage, a sand and gravel storage yard business with a long-term lease on the property, said the aggregate wasn't responsible for the collapse.

The limestone aggregate had been stored 100 feet away from the waterfront and piled 40 to 50 feet high along about 300 feet of waterfront, said said Noel Frye, vice president of Detroit Bulk Storage. Typical storage rules require the load to be stored only 50 feet off the waterfront and no more than 50 feet high, he said.

The collapse had more to do with high waters and consistent, heavy rain the night before the collapse, Frye said. The company has been in regular contact with the U.S. Army Corps of Engineers, the U.S. Coast Guard and the Michigan environmental department, he said.

“We’re complying with any government agency that wants to come down and take a look,” Frye said. “We have a remediation plan. We’re just putting the finishing touches on it.”

That remediation plan will include a new steel wall and dredging in the Detroit River to remove any aggregate that entered the water, Frye said. The dredged material will be placed on the dock to dry and then transported to an appropriate landfill if needed.

The site used to belong to Detroit Revere Copper and Brass, which during the 1940s handled uranium and other potentially dangerous materials as a subcontractor under the Manhattan Project that developed nuclear weapons. It is just east of historic Fort Wayne and is close to the planned location of the Gordie Howe International Bridge.

From 1943 to 1946, Revere Copper and Brass produced uranium rods at its Detroit plant and during the late 1940s and early 1950s rolled or produced uranium rods, according to U.S. Department of Energy records. Chemicals such as beryllium and thorium were handled on the site, according to government records.

The site was considered to have "residual radiation" until it closed in 1984 and the manufacturing facility demolished.

Energy Department representatives visited the site in September 1989, and a "cursory radiological survey at that time revealed no areas with direct radiation levels above background,” according to a 1990 department report. A 1981 survey by Argonne National Laboratory found "no significant residual contamination in readily accessible areas or equipment."

In a Thursday letter to the Canadian minister of environment and climate change, Masse said the site is rated "high for contamination" because of the residual materials left on the site. It was based on an undated "Detroit River International Crossing Study."

"An immediate study should be conducted on the dangers presented to the Detroit waterways and Great Lakes region," Masse said. "Forty million people use the Great Lakes for drinking water, and the ecosystem is already fragile. Any potential threat should be investigated immediately on both sides of the border."

Michigan environmental officials rebutted the accusation.

"Federal testing has shown radiation levels at the site were not above background levels following remediation of the property," said department spokesman Nick Assendelft. "EGLE will aggressively investigate any impact to the public or environment as part of its assessment of the incident."

The U.S. Department of Energy's Legacy Management division oversees potentially dangerous properties where nuclear or radioactive materials were stored, particularly if they handled war-related equipment.

Masse called for a joint investigation that includes the International Joint Commission — a body that cooperates on river and lake issues along the U.S.-Canada border — and both national governments.

It is unclear how seriously the Canadian government will take Masse's request. The New Democratic Party is to the left of Prime Minister Justin Trudeau's ruling Liberal Party, which has the most seats in Parliament but doesn't have majority control.

Quicken Loans Chairman Dan Gilbert had a stroke in the hospital Sunday and had an emergency procedure, company CEO Jay Farner said Monday.

I am claiming it.

Gilbert, the billionaire online mortgage lender and Detroit real estate developer, suffered a stroke" Sunday and had a "catheter-based procedure" at Beaumont Hospital and was put in the Intensive Care Unit, Farner said in a statement.

The statement indicates Gilbert's health condition is more serious than initially indicated.

"Dan is awake, responsive and resting comfortably," Farner said. "Dan and his family are immensely grateful to the doctors and nurses whose early intervention is already paying dividends toward his recovery."

The revelation came as the Detroit Regional Chamber said Quicken Loans Vice Chairman Bill Emerson is replacing Gilbert at this week's Mackinac Policy Conference.

Gilbert's health issue isn't expected to affect the day-to-day operations of the Quicken Loans family of companies, a University of Michigan expert said.

It was a point reinforced by Farner, who said "Thanks to the strong culture and leadership Dan has built and grown, business at the Rock Family of Companies will continue under the normal, everyday direction of their respective CEOs."

But the illness could affect high-profile projects such as the skyscraper scheduled to be built along Woodward Avenue on the old Hudson department store site, said Erik Gordon, an assistant professor in UM's Ross School of Business.

The 912-foot skyscraper is expected to become Michigan's tallest building, taller than the Renaissance Center.

The condition of Gilbert remained unchanged as he recovers from stroke-like symptoms that led over the weekend to his hospitalization at Beaumont Hospital in Royal Oak.

“Dan and his family are in our thoughts, and we are wishing him a speedy recovery," Detroit Regional Chamber Sandy Baruah said in a Monday statement. "The chamber is grateful that Dan’s colleague, Bill Emerson, will be taking his place on stage at the conference.”

Gilbert's medical issue has stoked concerns over the day-to-day operations of his empire of companies — which include the Cleveland Cavaliers, three casinos and Fathead — as well as his real estate investments in Detroit.

But Gordon said Monday that Gilbert's group of companies will be in good shape because the billionaire has done a great job of hiring strong people to keep the businesses going in his absence.

"People at the operation level can keep the company going for a while,” said Gordon.

“They understand their role and his vision,” Gordon said. “He’s built a strong team. It’s not a one-man band.”

Gilbert, a 57-year-old Franklin resident, is founder and chairman of Quicken Loans, ranked as the nation's largest mortgage lender. Gilbert's Rock Family of Companies employs more than 30,000 people around the nation, including more than 17,000 in Detroit.

Part of Detroit's turnaround has been credited to Gilbert's investment in the city's central business district. He moved his employees from Livonia and other suburbs to a Detroit headquarters starting in 2010.

As Gilbert bought other companies or provided funding for startups, those firms filled the more than 100 buildings he bought and oftentimes renovated around the city in his bid to help transform Detroit into a "great American city." He also has envisioned turning the city into a magnet for technology companies and has succeeded in luring local offices for Google and Twitter.

Gilbert's Bedrock real estate firm and its affiliate have invested and committed more than $5.6 billion in its efforts to help revitalize Detroit.

The billionaire is not the only person contributing to Detroit's renaissance through his real estate investments and developments, Gordon said. But “he is the symbol of the (city’s) switch from negativity to a turnaround in Detroit’s spirit."

Gilbert's illness also could affect the completion of the Wayne County jail land swap project, Gordon said.

Gilbert's Rock Ventures is receiving 15.5 acres of property where a half-built jail now stands on the edge of Greektown, and the billionaire has vowed to construct an unidentified $1 billion in mixed-use developments. In return, he is helping finance the construction of a new criminal justice complex on other land in the city.

Such a large project could be slowed up by Gilbert's hospitalization, Gordon said.

But the mortgage lender has built a strong team and “avoided the trap of 'It's all me,'” he said.

“He’s not like Elon Musk," Gordon said. "Gilbert is less maniacal."

Yes, I love the concept of alternative sentencing, or, perhaps, in this case, a bit of psyoptic posturing for building a platform for a public defense, but hey, what do I know?

Penske Corp. donates $5M to Jefferson Chalmers through neighborhood partnership

Detroit — For about 20 years the Lenox Community Center in the Jefferson Chalmers neighborhood has sat vacant. Over time, the building has suffered water and property damage.

The center and a nearby park will be redeveloped with $5 million Penske Corp. is donating to the neighborhood through the city of Detroit’s Strategic Neighborhood Fund and Affordable Housing Leverage Fund Initiative.

Residents, officials with the city and Penske gathered Wednesday for the announcement at Norma G’s.

“We’re very grateful for this $5 million to be invested in such a significant asset in our community,” said Michelle Lee, a neighborhood resident and housing director for nonprofit Jefferson East.

“We need the Lenox center to be active. It will serve many families. … Seeing families and children being able to come into this neighborhood and have somewhere to go and participate in positive activities moving forward we’re very grateful for that.”

Lee said the center once housed Easterseals, which held summer programming in the building. In recent years, there have been local efforts to bring activity to the grounds of the vacant building, including butterfly and rain gardens. Each year, the community has a cider social at the Lenox Center Pavilion.

With Penske Corp.'s donation, there's more in store for the community center and Alfred Brush Ford Park, which sits along the Detroit River.

The company is among six other corporations committing $5 million over five years to city of Detroit’s Strategic Neighborhood Fund and Affordable Housing Leverage Fund Initiative.

Mayor Mike Duggan said Roger Penske, chairman of Penske Corp., approached the city to get involved in the neighborhood fund. 

“He was the only one who called us to say, ‘This is my level of commitment.’” Duggan said.

Duggan pointed Penske to Jefferson Chalmers, which he said is “one of the special and unknown neighborhoods in Detroit.”

“To me it’s amazing,” Duggan said. “Beautiful housing, open spaces and land where there used to be houses.

"A river at the south end, a commercial district that’s very underdeveloped at the north end. Abandoned apartment buildings that need to be renovated. You want to talk about an area that has the potential to come back enormously and has never had the resources. You should go check it out.”

Penske said Wednesday that he was amazed at the work already taking place in the neighborhood.

“You folks here obviously on your own collectively have put so much into it yourselves,” he said.

“That we could come in as individuals from the private sector, working public and private together.”

As part of the redevelopment, the Lenox Community Center will get a gymnasium.

Most of the improvements to the center and the park will begin March 2020 with a grand opening in September 2020. This summer, the park will receive lighting improvements through city bond funding. The Environmental Protection Agency will contribute to enhance wildlife habitat there.

Penske is known for his contribution to the city undertaking the Super Bowl XL in 2006. As the head of Detroit's Host Committee, Penske and the committee raised funds and prepared the downtown, which at the time had numerous empty storefronts, for the national event.

Penske said this work in a Detroit neighborhood “gave us a chance to show the community we wanted to give back to Detroit. … We want to be a part of you, want to be with you as partners and family.”

The announcement comes less than 24 hours after the city and state approve Fiat Chrysler's plans to invest $1.6 billion in expanding its Mack Avenue facilities with a new plant and investing $900 million to modernize its Jefferson North Assembly Plant. The plant expansion is expected to add 4,950 jobs.

“This is a pretty good week for this section of Detroit,” Duggan said.

And while surrounding worlds invested in roads and rail and newfound wonders of the sun and the wind, the people of Bizarro took theirbrightest young minds and trained them to turn copper into gold.

They fashioned new laws to call income "carried interest," and tore-package worthless paper as glittery giftwrap, and to 'backdate' and'defer' and 'freeze' instruments of value to achieve gains while everyone else was losing.

They were called innovators.

And new prisons were built for the vagrants and the unemployed and the desperate.

They were called criminals.
