Michigan Attorney General Nessel Busts Southfield Clerk In 2018 Absentee Ballot Election Fraud, Jocelyn Benson Silent On Detroit

Wait a minute....

If there has been found to election irregularities in the 2018 election in absentee ballots, well, that would mean there exists a plausible pattern of past practice that may be applied to the 2016 election....and the 2014 election....and the 2012 election...and the 2010 election... and the 2008 election....

But, hey, what do I know?

I know there is a strong probablitly Fat Ass probably got to her.

I know we have arrived in Detroit where there is a similar absentee ballot election fraud scheme when it comes to Janice Winfrey and the Detroit Land Bank Authority.

I know Jocelyn Benson and "The Girls" have a few of their own "election issues" in the 2016 election where Judge Jeanine has been trying to cover up, too.

SOUTHFIELD, Mich. (FOX 2) - Southfield city clerk Sherikia Hawkins is facing six felony charges. 

The charges, which stem from the Nov. 6, 2018, general election, are as follows:



Count One. Election Law - Falsifying Returns/Records, a five-year felony and/or $1,000
Count Two. Forgery of a Public Record, a 14-year felony
Count Three. Misconduct in Office, a five-year felony and/or $10,000
Count Four. Using a Computer to Commit a Crime - Election Law - Falsifying Returns/Records, a seven-year felony and/or $5,000
Count Five. Using a Computer to Commit a Crime - Forgery of a Public Record, a 10-year felony and/or $10,000
Count Six.  Using a Computer to Commit a Crime - Misconduct in Office, a seven-year felony and/or $5,000

Southfield city clerk Sherikia Hawkins is facing 14 years in prison for six felonies related to the 2018 general election.

Discrepancies in the Southfield voter count were brought to the Secretary of State’s attention by the Oakland County Clerk’s office, following its efforts to certify Southfield’s absentee ballots.

Michigan State Police conducted a thorough investigation and determined that election records had been altered.

“Today upon learning that the Southfield City Clerk was formally charged with multiple crimes under Michigan election law, I exercised my authority under Michigan law to exert supervisory control over local election officials and directed the clerk to refrain from administering any election while there are charges pending against her,” Michigan Secretary of State Jocelyn Benson said. “Our elections are the foundation of our democracy, and under my and Attorney General Nessel’s administration there will be no tolerance for any actions that undermine that foundation - anywhere, anytime, by any person or official.”

Hawkins, 38, of Southfield, was elected Southfield city clerk in November 2017.  Prior to election she was the city clerk of Pontiac, a non-elected position, where she was responsible for that city’s elections.

Hawkins turned herself in and was charged and arraigned late Monday morning in the 46th District Court (Southfield) on six felony counts in front of visiting judge Michelle Friedman Appel, chief judge of the 45th District Court.

Hawkins was given a $15,000 personal bond and a probable cause conference was scheduled for 10:30 a.m. Monday, Sept. 30. A preliminary examination hearing is set for Tuesday, Oct. 15, before Judge Appel.

CONYERS v. TRUMP: DOJ Files To Certify Dismissal Of Case Violating Foreign Emolument Clause

The following is from the 9-28-2018 Order:

Accordingly, the Court finds that plaintiffs have standing to sue the President for allegedly violating the Foreign Emoluments Clause. The Court therefore DENIES IN PART the motion to dismiss and DEFERS ruling on the remaining arguments in the motion to dismiss.

The Foreign Emoluments Clause provides: No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State. U.S Const. art. I, § 9, cl. 8.  

DOJ motioned 10-22-2018 to certify the interlocutory appeal to "advance termination of the litigation" based on "difference of opinions".

The timing is impeccable considering that the DOJ OIG report has yet to be released and the 2018 General Election is 11-06-2018, which would be facts, not opinions.

Nip It In The Bud: DOJ Moves To Fast Track Appeal In Trump Emoluments Case

Justice Department attorneys want to give one of the myriad lawsuits accusing President Trump of violating the Constitution’s emoluments clause a quick death.

In a court filing late Monday, DOJ attorneys sought permission to appeal immediately a September ruling that found nearly 200 members of Congress do have standing to sue Trump for violating the Constitution’s emoluments clause.

Government attorneys argue that allowing the appeal would “materially advance the termination of this litigation.”

“If the D.C. Circuit decides the issue in the President’s favor, this case would be dismissed, thereby avoiding the need to address Plaintiffs’ novel Foreign Emoluments Clause claim and preserving both the Court’s and the parties’ resources,” attorneys from the Justice Department’s civil division write in the filing.

U.S. District Judge Emmett Sullivan of Washington, D.C., ruled in late September that members of Congress have standing to sue Trump over the alleged emoluments violation. The members argue in their lawsuit that Trump’s receipt of gifts – through his self-branded hotel chain, foreign intellectual property rights, and The Apprentice TV licensing fees – constitute foreign governmental gifts that should be subject to congressional approval under the Constitution.

Andy Grewal, a law professor at the University of Iowa, said that “judges grant these types of requests if they can in fact speed up the end of the litigation.”

“The idea is that if you resolve this one issue, this will end quickly,” he said. “And that’s a reason to grant the request.”

Sullivan’s September ruling only rejected half of an attempt by the Trump Administration to quash the lawsuit. The judge did not rule on the other half – on whether Trump-owned companies taking money from foreign governments counts as an emolument.

Regardless, the government slammed Sullivan’s ruling as “in substantial tension” with legal precedent.

“Congress can still vote on whether to consent or to withhold consent to the President’s alleged acceptance of foreign emoluments,” government attorneys argue. “If the President’s past alleged violations cannot be adequately remedied by congressional action now, it is not clear how this Court would be in a better position to provide a remedy.”

Since Sullivan’s ruling only concerned standing and came at an early stage in the court case, the government needs permission to file an immediate appeal.

Sen. Richard Blumenthal (D-CT) and then-Rep. John Conyers Jr. (D-MI) filed the lawsuit in June 2017, along with 194 other Democratic members of Congress.

The suit alleges that foreign governments have used Trump’s businesses to exercise influence on the executive branch. It specifically cites instances like the granting of foreign patents to Trump-owned businesses and foreign diplomats renting Trump hotel rooms en masse as examples of emoluments that were accepted without congressional approval.

“Because [Trump] has failed to come to Congress and seek its consent for at least some foreign emoluments that have been the subject of public reporting, it is impossible to know whether Defendant has also accepted, or plans to accept, other foreign emoluments that have not yet been made public,” the members alleged in the lawsuit, adding that Trump’s acceptance of the gifts had “thwarted the transparency that the ‘Consent of Congress’ provision was designed to provide.”

You all remember Kevin, right?

Kevin Thurm is the chief executive officer of the Clinton Foundation. 

He previously served as a senior counselor at the U.S. Department of Health and Human Services (HHS), where he worked with Secretary Sylvia Burwell and HHS senior leadership on a number of cross-cutting strategic initiatives, including continuing implementation of the Affordable Care Act. Prior to that role, Kevin held various leadership positions at Citigroup, including chief compliance officer and deputy general counsel. Perkins Coie Sucks Even More: Michael Avenatti & Stormy Daniels

 Perkins Coie pays Michael Avenatti to represent Stormy Daniels in her quest for...well...I have really not figured out her harms yet, but I am sure something will come up from the "Legal Geniuses" (trademark pending) like not being to get a job or make money, against an elected official about coming up with a way to enter a fake NDA into the court to proceed through a falsely advised legal machination of judgment, to prosecute for some sex drama, that the elected official has previously entered into the public record a denial.

Wow, those transposable models just keep popping up because this sounds like a legal cover narrative to justify using more sex drama stuff to get a FISA.  Must be the Vernal Equinox.

This sounds so much like a Child Protective Services child abuse proceeding and another reason why that "attorney-client privilege" thing needs to be stripped!

Stormy Daniels’ Lawyer Accused of Shady Business Practices

"Legal Genius" (trademark pending) Michael Avenatti

Michael Avenatti became famous for representing Stormy Daniels in her lawsuit against President Donald Trump, but as it turns out, that development comes at a rocky time in his business life. Over the past few years, this attorney has been dealing with court battles and accusations surrounding his investment in the coffee chain Tully’s, according to a report from The Seattle Times. His ownership firm Global Baristas US, LLC, purchased the company five years ago for $9.15 million at a bankruptcy auction.

Problems started from the beginning. Avenatti was in business with Patrick Demspey (that’s right, he of Grey’s Anatomy and 1980s movie fame), but the actor sued, saying the lawyer falsely claimed that Global Baristas fully financed the Tully’s operation. According to Dempsey, Avenatti actually took out a $2 million loan at a high 15 percent interest rate, and used the newly purchased coffee chain as security. Avenatti denied allegations, and that complaint was settled out of court.

End of that story, but problems have continued to the current day. Tully’s has been clashing with local shopping mall Bellevue Square. After Bellevue owner Kemper Development didn’t renew leases for two Tully’s locations, Global Baristas pulled out of a third in spite of being in the middle of a 10-year lease and a remodel. Cue lawsuit by Bellevue. They won after a judge granted a default judgment, sanctioning Global Baristas, and ordering it to pay fines and plaintiff legal fees.

Last month, Bellevue attorney David Nold filed a complaint to the California State Bar Association, claiming Avenatti took $6 million withheld from Tully’s employee paychecks, even though that cash was meant for paying federal and states taxes. Avenatti also committed fraud by moving $100,000 from Tully’s to pay for his law firm’s bankruptcy, Nold claimed. The U.S. Attorney in Seattle was cc’d in the complaint. The California State Bar declined to tell the Times if they were investigating.
Avenatti denied allegations to the outlet, and attacked Nold as an attorney.

“Mr. Nold is widely known as an unethical ‘hack’ of a lawyer who routinely files baseless complaints,” he wrote in an email. “He is a disgrace to the legal profession and is consumed by jealousy of other attorneys so he makes baseless allegations. His most recent conduct is yet more of the same — I hope he gets the help he needs.” The outlet said it found evidence of no disciplinary or ethical problems by Nold in Washington State Bar records.

Since the 2013 purchase, Avenatti’s investment firm has reportedly been named in over 50 lawsuits nationwide, including one by Keurig Green Mountain, which owns the Tully’s name, and claims Global Baristas hadn’t paid licensing fees of $500,000. Federal records obtained by Law&Crime show that litigation is ongoing. The final few Tully’s locations shut down in March, during what a spokeswoman described as a “rebranding process,” according to the Times.
Avenatti did not answer questions about Tully’s.

“You will have to ask your questions to the new ownership group who long ago took on responsibility for various tax liabilities etc.,” he wrote. The outlet said he declined to name the owners, and explain when he divested.

CONYERS: House Judiciary Committee To Consider Sessions' Recusal and Comey Firing Resolution

Washington, DC – On Wednesday, July 26, 2017, the House Judiciary Committee will consider Representatives Pramila Jayapal (WA-07) and David Cicilline’s (RI-01) resolution of inquiry requesting the Trump Administration to release any and all information pertaining to Attorney General Sessions’ involvement in the firing of FBI Director James Comey in violation of his recusal and related matters. “The Majority has shown itself to be in complete lockstep with President Trump.  Rather than talk about a crisis at the Department of Justice, our colleagues would rather re-litigate the 2016 election and question the credibility of a long list of public servants who no longer work for the government.

“There is simply no excuse for our Committee’s failure to hold a single oversight hearing on these matters.  Their attempt to hide behind stale conspiracy theories is both tone deaf and counterproductive.  It makes the Majority complicit in the actions of President Trump and his associates.

“I am disappointed that the Republicans denied us an opportunity to debate our resolution, but we will not be deterred.  Whether the crisis comes to the Committee or the Committee comes to the crisis, we will conduct oversight of the Trump Administration.”

BACKGROUND:  A resolution of inquiry is a legislative tool that has privileged parliamentary status, meaning it can be brought to the floor if the relevant committee hasn’t reported it within 14 legislative days, even if the Majority leadership has not scheduled it for a vote.

House Judiciary Committee Democrats have long been calling for House Judiciary Republicans to provide proper oversight over Trump and his Administration. Democrats have written to Chairman Goodlatte four times to request hearings on Russian interference with the 2016 election, potential collusion with Russia, the firing of James Comey and Attorney General Sessions’ recusal. 

 Democrats have also sent several letters to Speaker Paul Ryan, the Department of Justice and the White House requesting related information. 

Despite Judiciary Republicans’ attempts to block Democratic efforts, resolutions of inquiry should be the proper next step in the Committee’s oversight of the Trump Administration.  House Judiciary Republicans have so far blocked Rep. Jerrold Nadler’s (D-NY) resolution of inquiry and Reps. Hakeem Jeffries (D-NY) and Ted Lieu’s (D-CA) resolution of inquiry, from reaching the House floor.

CONYERS: Members Hold Forum On Civil Rights Under The Trump Administration

Washington, D.C. – Today, April 6, 2017 at 10:30AM, Members of the U.S. House of Representatives held a forum entitled, “Civil Rights Under the Trump Administration-The First 100 Days.”
