Steve Penny, former USA Gymnastics president, arrested for allegedly tampering with evidence in Larry Nassar case

Steve Penny, former president of USA Gymnastics, was arrested Wednesday night for allegedly tampering with evidence in the case of disgraced team doctor Larry Nassar.

Penny was arrested by the U.S. Marshals service in Tennessee on a warrant issued by the state of Texas. He was indicted by a grand jury on a charge of tampering with evidence, a felony, on Sept. 28.

He allegedly removed documents from the Karolyi Ranch, the U.S. gymnastics' training facility in Huntsville, Texas, related to Nassar's activity at the gym.

I bet those were financial docs of what they were doing with the tiny humans.

"The indictment further alleges that the removal of the documents was done for the purpose of impairing the ongoing investigation by destroying or hiding the documents," the U.S. Marshals said in a press release. He allegedly ordered the documents be sent to him at USA Gymnastics headquarters in Indianapolis. Those documents have never been recovered, authorities said.

Penny was taken into custody at a cabin in rural Gatlinburg, Tennessee, by the U.S. Marshals and Smoky Mountains Fugitive Task Force, according to authorities. He is awaiting extradition to Texas.

He faces up to 10 years in prison, if convicted.

The Karolyi Ranch was operated by Bela Karolyi and wife Marta Karolyi, the two people tasked with selecting and developing athletes for the U.S. national team. It served as the national team's training facility from 2001 until earlier this year. Nassar worked at the facility and several of his accusers said they were abused by him at the facility.

Penny resigned as USA Gymnastics president in March 2017 amid allegations of sexual abuse against Nassar. Nassar pleaded guilty to seven counts of child molestation, but more than 130 women and girls, including Olympic gold medalists Simone Biles, Gabby Douglas and Aly Raisman, have accused him of assaulting them. Many of those accusers testified at a hearing in January when he was sentenced to up to 175 years in prison. He pleaded guilty in two other cases — one pertaining to assault and another possession of child pornography — as well.

Rhonda Faehn, Penny's former deputy, testified to the Senate in June that she brought up allegations of misconduct to him and she was told to keep quiet. Penny, who appeared before the same committee, chose to plead the Fifth and not testify.

In a statement, USA Gymnastics said that it had "learned of the charges filed against its former CEO Steve Penny, who resigned in March 2017. We support law enforcement's efforts and have fully cooperated with the investigations by the Texas Rangers, Congress and others, and will continue to do so to help the survivors and our community heal from this tragedy."

USA Gymnastics has been in near-constant turmoil since the Indianapolis Star broke the story in September 2016 of Nassar's abuse of gymnasts under his care, both with the U.S. national team, where he was the team doctor, and at Michigan State University, where he was a faculty member. Nassar had been dismissed from his job with the U.S. national team in 2015, but only said it was done due to "athlete concerns."

After Penny's departure in March 2017, he was replaced by Kerry Perry in November 2017. But Perry's tenure was marked by consistent criticism over the handling of the Nassar scandal as well. She resigned less than a year after being named as Penny's replacement.

Perry was criticized by stars, like Raisman, over her lack of transparency about how the organization planned to protect athletes going forward. She resigned days after she hired Mary Lee Tracy, in part to replace the Karolyis, as the sport's top coach. The hiring of Tracy received condemnation from athletes because she supported Nassar in the immediate wake of accusations against him.

But the neverending parade of presidents didn't end with Perry's ouster.

Just this week, former Congresswoman Mary Bono, who was tasked with replacing Perry as interim president of USA Gymnastics, was forced out for a pair of scandals -- less than a week since her hiring. A day after her hiring, Biles criticized Bono, a Republican, for a photo posted on Twitter in which she was shown blacking out a Nike logo over the company's hiring of Colin Kaepernick as spokesperson. She publicly apologized for the photo.

A few days later, Raisman joined calls for Bono's ouster after discovering that Bono worked for the same law firm that worked with USA Gymnastics during the Nassar scandal and crafted excuses for his absences.

Bono was not directly involved in the law firm's representation of USA Gymnastics, but she stepped down nonetheless on Tuesday.

Penny is one of at least three people arrested in connection with the handling of the Nassar scandal. Debbie Van Horn, a trainer who worked with Nassar, was arrested last month in Walker County, Texas. She has denied charges, according to her lawyer, who spoke to the Houston Chronicle.

William Strampel, the former dean of Michigan State University's osteopathic medical school and boss of Larry Nassar while he was a sports doctor there, was charged March 27 with neglect of duty and criminal sexual conduct. His case will go to trial at a yet-to-be-scheduled date.

What we have here, is a situation of a former Michigan Supreme Court Justice, Bob Young, now in the private capacity of representing a former Michigan Governor, John Engler, who is in a private position representing a public university, MSU, in the public matter of a criminal investigation in the trafficking of tiny humans and child rape, which was funded through public Title IX funds, through an publicly appointed special counsel, Bill Forsyth, by a Michigan Attorney General, Bill Schuette, crying "attorney-client privilege" regarding publicly funded email communications of a public university dealing with questionable activities federal fraud.

Show me what ya got, Bill...Forsyth, that is.

MSU fights search warrant in Nassar inquiry

Michigan State University has filed a motion to quash a search warrant served against it by the Michigan Attorney General's Office as part of an investigation into the school's handling of sexual abuse allegations against disgraced sports doctor Larry Nassar.

The search warrant was served this week after special prosecutor William Forsyth had threatened to obtain it for documents he said the university is "wrongfully withholding"that relate to the investigation.

But MSU said the documents the attorney general wants are privileged, and filed its motion to quash the warrant Thursday in Ingham County's 54-B District Court.

The university is willing to share all of the material with the judge and allow him to determine, case by case, if the materials are protected by privilege, said MSU spokeswoman Emily Guerrant.  

“We stand behind our previous position on this issue, that the attorney general is not entitled to examine our lawyer’s communication and legal advice to the university,” said Robert Young, general counsel for MSU.

“We have been cooperating with the attorney general’s investigation, and will continue to do so,"

Young said. "We are willing to share the documents in question with the judge if he wishes to individually review our privileged communications and make an independent opinion on the issue. This continues our cooperation in the investigation and also does not waive our attorney-client privilege.”

Officials from the AG's office did not immediately respond to a request for comment.

Then, I sat back to wait and see what Bill Schuette, Michigan Attorney General and 2018 Gubernatorial Candidate was going to do as a comeback to the weak response to Calley.

Yes, my precious Bill did the ultimate smackdown on Brian, but he did more than that.

Bill Schuette let me know that he is all over this.

See, the State Auditor General has "Reopened" the Ricky Holland investigation by suing the Michigan Department of Health and Human Services and I just so happen to be an original source about this, so I can tell you that it is about child welfare fraud.

I am pretty sure the case is being represented by Schuette's office, or at least coordinated, because the case is in the Court of Claims.

Anyway, Schuette is using lots of special prosecutors, which is great to distance himself from any look of impropriety or political bias, because William Forsyth could be considered as a political operative for his campaign, but I really do not care at this point because Schuette is going for the glory.

Now, let us play a little game called, "Guess who did not incorporate in the State of Michigan".

If you say, "Detroit Land Bank Authority" you are absolutely correct, but there is one more organization, where the "Legal Geniuses" (trademark pending) of #perkinscoiesucks did not incorporate.

Perkins Coie did not incorporate the Clinton Global Initiative University in the State of Michigan.

So, how is it that Michigan State University joined with the Clinton Global Initiative University?

Kent County Land Bank Authority of the Michigan State University College of Agriculture & Natural Resources Land Policy Institute.

Yes, the same Kent County where William Forsyth, the special prosecutor, hails, but this might just be a good thing considering that he might just be considered a subject matter expert.

This might be the same phenomenon that happened with Matt Schneider, Schuette's former Deputy Attorney General, coming back down to Detroit as the top U.S. Attorney for Michigan Easter District Court, to continue t he Detroit public corruption investigation that put former Detroit Mayor Kwame Kilpatrick, et al in their proverbial proper places.

There is one more area of significance the local rags will not talk about.

Michigan State University is a major influence in child welfare policies in the State of Michigan, for quite some time.

Hillary Clinton made her claim to fame on the Adoption and Safe Families Act, which is nothing more than a child trafficking operation, where Michigan is up there in the top 3 in the nation for children trafficked through foster care and adoption.

Michigan State University has a youth mentoring program just like Penn State had, except it is part of the University called FAME.

The children who were raped in the Jerry Sandusky, Penn State incident were foster kids, and more than likely, so were some of the youth in the MSU situation.

MSU to join Clinton Global Initiative University

As they prepare for a Wednesday visit from former President Bill Clinton, Michigan State University will join his Global Initiative University and offer a campus-wide minor in entrepreneurship and innovation.

In doing so, MSU will be the first Michigan university to join CGIU, which was created to engage the next generation of leaders on college campuses around the world.

“Michigan State is committed to creating an entrepreneurial culture on campus and preparing our students to solve the world’s most pressing problems in innovative ways and to embark on careers that won’t resemble those of the past,” Neil Kane, MSU’s director of undergraduate entrepreneurship, said in a written statement.

Clinton will be on campus Wednesday and be the keynote speaker at the Governor Jim Blanchard Public Service Forum and first recipient of the Spartan Statesmanship Award for Distinguished Public Service.

The award and forum, announced in September, were established through a $1-million gift to MSU from Blanchard and his wife, Janet. Blanchard said the program honors distinguished leaders in politics, diplomacy, public service and journalism and gives MSU students and others “a chance to meet them and be energized by them.”

“The goal of this lecture series is to provide generations of students, faculty and people in the MSU community with the opportunity to hear and learn from national and international political leaders and others,” said Blanchard, former Michigan governor, U.S. congressman and ambassador to Canada, in a written statement. “His public service in politics, followed by his excellent work through the Clinton Foundation, is exactly the type of dedication and inspiring story we hoped to bring through the Blanchard Forum.”

The Clinton Global Initiative Network is a consortium of colleges and universities that provides support, mentoring and seed funding to student entrepreneurs. Students develop a “commitment to action” to explain how they might solve a social problem in areas such as education, the environment and public health.

Some students are chosen to attend the CGIU’s annual meeting. By joining the initiative, MSU pledges to financially support students invited to the meeting, which next takes place April 1-3 at the University of California-Berkeley.

Raeuf Roushangar, an MSU doctoral student in biochemistry, attended the CGIU at Washington University in St. Louis in April 2013. As part of his commitment to action, Roushangar formed a nonprofit organization that to date has donated more than $1 million worth of medical supplies to the developing world.

Two MSU students have applied for next year’s CGIU: a neuroscience freshman from Ghana, who is creating a mentoring program similar to Big Brothers Big Sisters, and a computer science sophomore from Ethiopia, who is working on a software application to make college more accessible to students in Ethiopia.

With the Minor in Entrepreneurship and Innovation, which starts in the spring semester of 2016, MSU establishes a way for students to develop entrepreneurial skills, whether they aspire to start a business or become more competitive candidates for traditional employers.

Required for the minor are 15 credit hours consisting of two core courses and an assortment of electives that allow students to tailor the curriculum toward their interests.

“A university is an ideal setting for students to experience the entrepreneurial journey because there is no financial or professional risk in trying,” Kane said. “Once students leave campus, the cost, which is measured many ways, goes up a lot.”

JUDICIARY: NADLER PRAISES LEGISLATION TO ADDRESS ABUSE OF ATHLETES CALLS ON CONGRESS TO PROVIDE ADEQUATE FUNDING TO SUPPORT IMPLEMENTATION

I normally do not comment on House Judiciary Press Releases but this time it is different.

What the hell is this redundant legislation supposed to do to protect the other young victims from sexual abuse and safe sports?

I guess children of "The Poors" (always said with clinched teeth) do not qualify, particularly the children in foster care and adoption who are exposed to sexual abuse on a daily basis.

I do not believe children under the auspices of a state should be excluded from protection.

What the hell was Child Protective Services created to do?

Obviously, not to protect young victims from sexual abuse and safe sports.

I guess Nadler is upset he might lose campaign finance from his contributors if these organizations are stripped of their funding.

Who is Nadler protecting?

Washington, D.C. - Today, the House passed S. 534, the “Protecting Young Victims from Sexual Abuse and Safe Sport Authorization Act.”  This bill would help prevent and address instances of abuse of young athletes participating in sports organized under the national governing bodies recognized by the U.S. Olympic Committee.  Among other provisions, the bill would authorize the U.S. Center for Safe Sport to receive and investigate allegations of abuse, and to develop training, oversight practices, policies, and procedures to prevent the abuse of these minors and amateur athletes.  However, the House version of the legislation would amend the Senate-passed version by stripping the funding authorization of $1 million every year through 2021. 

House Judiciary Committee Ranking Member Jerrold Nadler (D-NY) released the following statement on the bill:

“I support the legislation being considered on the floor today. However, I am deeply disappointed that it strips funding for the organization charged with investigating abuse and developing policies to prevent it. We must do all we can to prevent the abuse of young athletes by those entrusted with caring for and coaching them, to remove obstacles that make it difficult to raise cases of abuse to the attention of higher ups, and to hold perpetrators accountable when such horrendous abuse occurs. I call on my colleagues in Congress to work together to ensure adequate funding is provided to ensure the bill lives up to its promise of protecting our young athletes.”

Congresswoman Jackson Lee to introduce Penn State Inspired Bad Legislation

This is a great example of good intentions misdirected.

Penn State should not be penalized and this is why.  It followed the law of the state.  There is even indication that the school did inform one of my favorite State Attorney Generals, Tom Corbett who is in control of child welfare, or rather the Medicaid Fraud Control Unit.

This Bill will never go anywhere for the simple fact that is was not very well researched regarding its funding.  

Penn State is neither a recipient nor a subrecipient of child welfare funding.  The transgressor or what I prefer to call fraudfeasor is The Second Mile.  This is the nonprofit organization which has violated standing federal policy and well-established federal law pertaining to funding compliance.

Is there even an appeal process and what venue will this be adjudicated?  Administrative or judicial.  I could go on and on about the substantial flaws of this proposal but I will not.  It missed its mark and will not see the light of day.

Now, if one were to conceivably vision the passage of such legislation, it would be raining cats and dogs as just about every single child welfare service provider would be shut down because the horrors exist for children of foster care.  Unfortunately, one would have to navigate around the shroud of secrecy in child welfare reporting and investigations.  Hell, you would have to design a system to just collect and manage the data of the abuses in foster care.  Wait, how the hell is a child going to report abuse in foster care?  Give it to their case manager and say, 

"Ms. Foster Care Worker, Mr. Program Man has been doing bad things to me.  Would you please report this so you will loose your job and this agency is shut down making me throw my worldly possessions in a garbage bag to move to another town to live in another foster home which is so far from my mommy that you will end up putting me up for adoption to shred the evidence of the complaint I am about to hand you."

Instead of legislation that is just not technically nor economically feasible, how about enforcing some simple pre-existing mechanisms of compliance.

Oh, I have a better idea...have your staff return my damn calls.

Congresswoman Jackson Lee to introduce The Federal Zero Tolerance of Child Sexual Abuse Act of 2011

Washington, DC – Congresswoman Sheila Jackson Lee, Co-Chair of the House Congressional Children’s Caucus, released the following statement regarding protecting our children from any type of sexual abuse and the legislation she intends to introduce this week:

“As Co-Chair of the Congressional Children’s Caucus, I work diligently to bring attention to the interests of children, and to ensure that they are considered as Congress moves to enact laws across many different areas and industries.  The incident at Penn State University is a very unfortunate situation. Much of the legislation that we face on a day to day basis can have a direct or indirect affect on children. The issue of non-profits and other entities that deal with children should be addressed when it comes to child sexual abuse.

“I will soon be introducing legislation that will immediately suspend and stop all federal funds being received by institutions, employees or any other entities where sexual abuse of children is not immediately reported. This legislation will of course exempt any funding going directly to students such as Pell Grants etc. This legislation will cover non-profits, state and local organizations and possibly other entities.

“Protection from child sexual abuse in the United States is principally the responsibility of state and local governments. Each of the 50 states has enacted laws defining child sexual abuse and mistreatment, determining when outside intervention is required, and establishing administrative and judicial structures to deal with mistreatment when it is identified.

“While principal responsibility for addressing child sexual abuse rests with states and local governments, the federal government does play an important supporting role. In 1974, Congress enacted the Child Abuse Prevention and Treatment Act, establishing the legal framework for current federal efforts which focus on data collection and technical assistance to states. The issues surrounding children are ever changing, and it is paramount that we stay current to ensure that policies intended to protect and benefit children, do in fact achieve their purpose.

“Because children need adults in order to receive protection from child sexual abuse and neglect, it is thereby imperative that anyone who works with children receives the training they need to identify evidence of child sexual abuse and neglect. Under Pennsylvania law, everyone is encouraged to report child sexual abuse; however, individuals who work with children are required to report child sexual abuse. 

"The failure of top university officials to act on reports of Mr. Sandusky's alleged sexual misconduct, even after it was reported to them in graphic detail by an eyewitness, possibly allowed a predator to walk free for years - continuing to target new victims. Equally disturbing is the lack of action and apparent lack of concern among those same officials, and others who received information about this case, who either avoided asking difficult questions or chose to look the other way. My legislation will hopefully put an end to situations like this.

“Individuals who work with children need the appropriate training to detect and report evidence of child sexual abuse. These individuals form the first line of defense for children who do not have a voice in an adult world. Non profits who receive federal funds should receive additional funding for training on how to identify evidence of child sexual abuse and mandatory reporting procedures. As these persons have an authoritative relationship with the very children that we as a society hope to protect.

“Just last week, Ashley Billasano, known as ‘Billy’ to her close friends, from my state of Texas committed suicide because she could not deal with the sexual abuse that she had went through for years. She thought that there was no one she could turn to and as a result she took her own life. I hope people will understand that any suspicion of sexual abuse should be reported to the police. Sexual abuse is a serious issue and children are often scared to tell anyone about the abuse - many cases are hidden for years - but by informing the police they can stop it."

Since the Democrats are jumping aboard the mandatory reporting ship that will eventually sink with a dramatic spike in calls to child protective services about the littlest of delusional transgressions, I will engage the Republican Members of Congress to ask them to address legislation to end Medicaid fraud in child welfare.

Penn State Incident Spurs Flurry of Legislative Proposals

In the wake of the recent Penn State incident, where a 10 year-old was allegedly raped and the adults, including coaches and school personnel, failed to act, legislators are taking aim at child protection laws. Sen. Barbara Boxer (D-Calif.), Sen. Robert Casey (D-Pa.), Sen. Robert Menendez (D-N.J.), and Rep. Karen Bass (D-Calif.) have in the past week sponsored legislation aimed at strengthening child maltreatment reporting laws.

The bills generally expand reporting requirements to the general population and enact criminal penalties for failure to report. They also clarify that reports must be made to the appropriate agency, either law enforcement or child enforcement, which is meant to address the lack of clarity which currently exists within some state laws. Some state laws are vague enough that it leaves them open to the interpretation that internal reporting is sufficient.

Whether these proposed changes would significantly improve the child protection reporting system, is a matter of debate.

All states have mandatory reporting laws for professionals who come into contact with children, such as police officers, teachers, and doctors. And, 18 states, as well as Puerto Rico, already have laws that require all persons to report suspected maltreatment.

Some of the legislative proposals make the failure to report criminally punishable, either by misdemeanor or felony. This could have serious implications, such as professionals flooding the system with reports because they fear being held liable. It could also affect victims of domestic violence, who sometimes fail to report because they are being psychologically or physically intimidated by their partners.

Rep. Sheila Jackson Lee, (D-Texas), co-chair of the House Congressional Children’s Caucus, released a statement saying she plans to introduce the Federal Zero Tolerance of Child Sexual Abuse Act of 2011, which would curtail funding for institutions guilty of failure to report maltreatment. The legislation will include penalties for government entities, as well as nonprofits.

Child protection laws should be shored up through additional training and education about child maltreatment, especially for those who regularly work with or come into contact regularly with children. A recent study published in Academic Pediatrics found that primary health providers under-reported maltreatment in 21 percent of cases.

A general societal understanding of child abuse might go a long way in helping create a safer atmosphere for children. Child abuse reporting can be said to be both under- and over-reported. That's because, in some cases, well-meaning adults call hotlines with allegations that don’t rise to the level of maltreatment. On the other hand, cases that should be called in go unreported because people fear getting involved or fear the child will be removed from their home.

Sen. Casey’s Speak Up to Protect Every Kid Act (S.1877) contains education provisions to address these challenges, as well as a mechanism for gauging states’ progress.

On top of the slew of federal bills, state legislators are also weighing in. Virginia Del. Robert G. Marshall (R-Manassas) has proposed legislation to expand persons required to report under state law. However, the patchwork of state and federal efforts could become misaligned and problematic.

Reporting issues are extremely complex and changes in current law should be examined for unintended consequences. In order to explore the issues, Rep. George Miller (D-Calif.), the senior Democrat on the House Education and the Workforce Committee has requested of Chairman John Kline (R-Minn.) that a hearing be held. The hearing has been set for Dec. 13.

And as some of you who personally know me, you know I will open my mouth anytime, anywhere, with the greatest of eloquence, in my elegant fashion, and rip holes in any stupid, fallacious statement regarding child abuse propaganda and its imperialistic morality parade.

With that said, I have decided to create a petition to end Medicaid fraud in child welfare.

My petition is to have U.S. Representative Lamar Smith, House Judiciary Chairman and U.S. Representative John Conyers, Jr, Judiciary Chairman Emeritus to send a letter to U.S. Attorney General Eric Holder requesting investigation of the States on Medicaid fraud in child welfare.

Of course, we all know who will be writing the letter.  Me.

Here's the plan.  I plan on riding the coattails of this Penn State scandal.  U.S. Representative Shelia Jackson Lee has already called for hearings...and she sits on Judiciary.  Many of the Judiciary members are from States who have been hit with HHS OIG findings in the millions for child welfare fraud, where H.E.A.T.  has set up shop for the unreal levels of Medicare fraud.

Unfortunately, there are Members of Congress who are stuck on broken record of revving up mandatory reporting of child abuse.  You cannot report child abuse in child welfare because it is a conflict of interest.  It is hard for a state to snitch on itself so legislation is going to have other snitch.  This snitching panic for the smallest delusion of a transgression will lead to an increase of child rape in foster care, paid with Medicaid dollars.

This petition is to wake up the nation.

The only thing left to do is your signature.

In the wake of the Penn State child sexual abuse matter, the issues of fraud in child welfare must finally be addressed as the children were under the care of the state as foster children.

Under the shroud of confidentiality laws, the number of children who are murdered, raped, tortured and have committed suicide while in foster care go unreported. What is even more egregious is not the fact that these foster children have suffered were billed under Medicaid; it is the fact that there have never been national hearings on the matters of Medicaid fraud in child welfare.

Quintessentially, child welfare service providers are paid through Social Security to literally get away with murder and rape of children.

States do not maintain policies to refer Medicaid claims violations of law by its privatized Child Placing Agencies to the Medicaid Fraud Control Units, typically housed in the States Attorney General Office, due to the fact that the States Attorney General defends its privatized Child Placing Agencies under the grant of immunity.

Children in foster care are prescribed psychotropic drugs at an alarming rate because there is no enforcement oversight mechanism beyond the False Claims Act. As a result, children in foster care are improperly and unnecessarily overmedicated creating fraudulent claims for Medicaid cost reimbursements.

There have been a number of Corporate Integrity Agreements between the U.S. Department of Justice and major pharmaceutical corporations for "illegally and wrongfully" marketing psychotropic drugs, which were never FDA approved, to children; yet, in foster care, children continue to be medicated with these same drugs.

State child welfare contracts are not competitive by nature, creating breeding grounds for numerous antitrust violations which remain omitted from national discussions. Coupled with institutionalized patterns of practice in double-billing, phantom-billing (i.e. billing for non-existent, poor quality, or unnecessary services) and kiddy kickbacks (i.e. similar to physician kickbacks), and false statistical reporting of child abuse, you have the makings of Medicaid fraud in child welfare.

Most people have heard of Medicare fraud, and the campaign to stop it, but nobody knows about Medicaid fraud in child welfare. Medicaid fraud in child welfare is a multi-billion dollar industry which exists without any penalty.

Contrary to popular belief, the largest federal funding source in foster care is not Title IV-E, Title IV-A Emergency Assistance or Title XX of the federal Social Security Act, it is Title XIX (Medicaid) and the area that we are addressing is Targeted Case Management.

Targeted Case Management (TCM) is considered a “pay-as-you-go” program. This means, whenever there is a bill in child welfare, it will be paid, in full by the feds. Unlike Medicaid Federal Financial Participation (FFP), TCM in foster care and adoption is 100% covered which means the states do not pay any portion. Then, a portion of these funds was set aside to suspend regulation, called a moratoria, on TCM.

So, now we have a basic formula for the child welfare fraud:

100% FFP + MORITORIA = TCM REVENUE-MAXIMIZATION SCHEME

TRANSLATION: It becomes financially beneficial for states to place children and keep them in foster care than to provide community-based services because there is no regulation of the legitimacy of TCM costs.

TCM funds exactly what it says, the management of cases from targeted populations. So what are targeted populations?

Targeted populations are children who are considered as “at-risk”, meaning the likelihood of them being in need of child welfare services is substantial because they meet the following criteria:

At or below the Federal Poverty Level
Minorities
Single parent homes (this includes divorced and widowed)
Sibling groups
Unemployed
Living in low-income neighborhoods
Special needs (education, medical, psychological)
Disabilities (caregivers and/or children)
Homeless
Lack of medical coverage
Victims of domestic violence
Children of undocumented immigrants

These are populations who have no access to legal recourse nor opportunity to redress grievance as confidentiality laws silence any whistleblower with threats of termination of parental rights.

To first properly understand Medicaid fraud in child welfare, we must conduct a forensic autopsy, meaning, it may only be examined after the billing has been submitted and costs reimbursed. The complexity of TCM child welfare fraud varies from state to state, and from child placing agency to child placing agency, but they exist, in a multitude of shapes and forms.

Concerns of the pervasiveness of these revenue-maximizing schemes have been federally expressed, but ignored by Congress.

Therefore, gentlemen, I strongly encourage you to send letter of request to the Attorney General Eric Holder to investigate Medicaid fraud in child welfare and for this honorable body to hold judiciary hearings to bring into public light the pilfering of the Social Security system under the guise of the child.

There are reasons why the Penn State matter has disgusted me and it really has nothing to do with Penn State.  It has to do with the State of Pennsylvania.

Before I begin, I want to bring to the attention of the public that Legally Kidnapped was the first to net the story.  Why? Because the rape of foster children (as I prefer to call it instead of watering it down to be more palatable for the big money donors to the child abuse propaganda machines such as The Second Mile, the child welfare organization which served foster children) happens everyday.

Yes, the children who were raped were foster children.

Mother of foster child testifies in Sandusky case

HARRISBURG - The grand jury investigating allegations of indecent assault against former Penn State assistant football coach Jerry Sandusky is continuing, with new testimony and subpoenas.

The mother of Jerry Sandusky's youngest adopted son testified before grand jurors Monday, telling the panel about the relationship between Sandusky and her son, Matt, when her son went to live with Sandusky as a foster child in 1995.

Debra Long said she was sworn in before a judge along with her son, Matt, and Second Mile Executive Director Jack Raykovitz.

According to sources close to the investigation, a grand jury has been meeting since 2009, when a 15-year-old Clinton County boy told Children and Youth Services that Sandusky indecently assaulted him during a four-year period, beginning when he was 10.

Also Monday, Penn State officials acknowledged they have received a subpoena. A source close to the investigation said the subpoena was for emails between key employees dating back to 1997.

"We are cooperating fully with the Office of the Attorney General in any way that we can," said spokeswoman Lisa Powers.

Penn State Football Coach Joe Paterno, Director of Athletics Tim Curley and retired university vice president and treasurer Gary Schultz are among those who have already appeared before the grand jury in January, according to a person with knowledge of the investigation. The grand jury meets at the attorney general's Strawberry Square office.

The Second Mile has consistently declined comment on the investigation, saying it won't respond to rumors. In a statement earlier this month, Raykovitz said he was told The Second Mile and its programs are not the subject of any investigation.

On Monday, when approached in Strawberry Square, Raykovitz declined comment on his appearance before the grand jury.

The Second Mile is a nonprofit that 67-year-old Sandusky founded in 1977 to help at-risk kids. It reaches 100,000 youth in the state each year, through programs and educational material.

Long said her testimony Monday centered on the nature of her son's relationship with Jerry Sandusky. She told the panel she saw her son's behavior change drastically when he met Sandusky through a Second Mile camp program.

When her son was 16, after he was charged with burning down a barn, he was placed in foster care with Sandusky. Court papers from that time show Long continuously challenged his placement in the courts.

Matt Sandusky could not be reached for comment.

Sandusky's attorney, Joe Amendola of State College, said Monday afternoon that Long "never liked Jerry because she saw Jerry as a person who was involved in removing her child from the home."

Amendola said he was not worried about Matt Sandusky's testimony Monday and is not concerned with anything Raykovitz might have said to the grand jury.

Now, there are other reasons why I refuse to direct my ire to Penn State.  It has to do, again, with the State of Pennsylvania and its funding.

Pennsylvania holds $3M grant to The Second Mile

The state of Pennsylvania has put a freeze on the $3 million grant The Second Mile was slated to get for its new learning center, the future of which seems uncertain.

The nonprofit, founded by former Penn State football coach Jerry Sandusky, had planned to build the 45,000-square-foot facility on a site at Bernel and Fox Hollow roads near University Park Airport. Centre County had helped The Second Mile obtain a $3 million Redevelopment Assistance Capital Program grant to help pay for the $9 million project.

As one can see a snapshop of the amount of money we are dealing with, it is a bit easier to understand why, when a child under the authority of the state is raped is not reported.  There is too much money involved.  These child welfare institutions are too big to fail.

For example, let's look at Pennsylvania's Cash 4 Kids scandal.  A child committed suicide because there was too much money involved.

Or we can look at other reasons why we, as a nation, have no shame in calling poverty abuse and neglect.

There are three reasons why no one cares what happens to children in the child welfare system.

1. See no evil;
2. Hear no evil;
3. Speak no evil.

But, of course, there are other reasons why Pennsylvania will do nothing about children being raped, murdered and drugged in the child welfare system:

The first is money.  The second is child abuse propaganda.  The third is Tom Corbett.

There have been two things that have been dominating my news feeds these days causing a massive increase of pro-CPS, foster care, adoption bullshit in the news. The first is the National Adoption Propaganda Day crap, you know the heartwarming stories with the fairy tale endings, of the kids who found their forever families and lived happily ever after in mass numbers all at once or rather the celebration of the sale of your children, which I refuse to advertise.

The second is the Jerry Sandusky Penn State Sexual Abuse Scandal, or whatever you wanna call it. It's interesting that a story that Legally Kidnapped linked to back in April didn't take off until last week.  What's even more interesting is the fact because of this one case, a ton of states are now reviewing and trying to strengthen their Mandated Reporting laws.  Hell, the whole world is.

I even watched on Ustream as the Occupy Wall Street protesters tried to block the New York Stock Exchange, while watching CNN's Morning Pop Tart talk about nothing but various aspects of the Penn State Sex Abuse Hysteria Scandal at the same time.  In fact, I would guesstimate that perhaps 1/3rd of her show was Jerry Sandusky, Jerry Sandusky, Jerry Sandusky, Penn State,Penn State, Penn State, etc, and the only thing said about Occupy Wall Street, where all hell was breaking loose, was, "How do you feel about the Occupy Movement 2 months into it?  Tweet me."



Similarly, the Casey Anthony verdict brought about Caylee's Law, where missing children must be reported within 24 hours or it's a felony, so the anti abuse mob all across the country raged on with their get Casey campaign, which hasn't totally died out yet.  With the Penn State, this sudden wave of Sexual Abuse Hysteria takes root in the country.  This happened because this was a famous person, a terrible crime, and massive television exposure.

My buddy the Wex tells us...

Taking knee-jerk idiocy to the ultimate level, Pennsylvania Senator Bob Casey (D-Pa.) has introduced legislation to coerce every state into passing a law to require anyone and everyone to report any and every suspicion of child maltreatment to child protective services or the police.  It’s co-sponsored by Sen. Barbara Boxer (D-Ca.).

Apparently everybody else is crying out for the same thing.  Why?  Because it's a high profile case being shown on television all over the country.  And, although I totally agree with the Wex on this one, I think that the problem is much worse than we imagined.  I also think that this is a major shot against you and parental rights or family rights or children's rights as a whole because of what the Wex calls "Knee Jerk idiocy" which is of course, crossed with the Imperialistic Morality Parade, being brought about by a massive increase in advanced anal-retentive disorder.  Everybody jumps on the bandwagon because it's the in thing of the day.  It brings all the idiots together to cry out for the same thing which will only backfire on them the moment there is the slightest suspicion of child abuse or neglect.  It makes them momentarily feel important.

Therefore, I will demonstrate now with link after link in regards to how the sheep  are reacting to this one case.  And report everybody for everything, (please note the sarcasm there).
