There are a few facts which have been withheld from the public.  There were almost 100 officers, snipers on the roofs when they came to remove her daughter for not taking the psychotropic medications that a second medical doctor said she did not need to take.

The only reason the police did not raid the house was because one of the lead officers was a member of her church where she is very active.

Children's Center is notorious for the "bait and switch".  They offer counseling services to children but will slap a CPS case on you only to refer back to themselves.  Last time I checked this was called a self-referral.  Unfortunately, as CPS is not a physician, there is no Stark law violations, so they are allowed to get away with whatever they want.  In this case, it was a heap load of Medicaid false claims.

Judge sets deadline for teen to be placed with relative

A Wayne County juvenile court judge ruled Wednesday that a girl -- taken by the Department of Human Services from her mother, who is accused of medical neglect -- needs to be placed with a relative by Friday afternoon.

If the 13-year-old isn't placed by then, Judge Lynne Pierce ruled she'll have a hearing at 1:30 p.m. that day and hold any party not cooperating with the placement process in contempt of court.

The girl has been in a facility in Northville since shortly after Child Protective Services employees showed up at her mother's Detroit home in March to take her. The girl's mother, Maryanne Godboldo, who prefers holistic treatments in lieu of a prescribed drug for psychosis, is accused of firing a gun at police, triggering a standoff.

At Pierce's behest last month, an official from Hawthorn Center and a family doctor who believes in holistic medicine met and jointly agreed to a treatment plan for the girl.

In a letter dated April 29, Dr. George Mellos, acting chief of clinical affairs for Hawthorn, wrote that the girl was ready for discharge.

But a DHS foster care worker testified Wednesday that, among other things, she found the treatment plan too vague and said the girl's aunt and likely caregiver, Penny Godboldo-Brooks, needs to complete foster care licensing paperwork.

Pierce, though, said she wasn't concerned about the treatment plan and said the licensure process can be completed once the girl is placed.

"I'm not going to have anyone stonewalling the placement," Pierce said.

I will betcha the social worker will come up with a new charge to keep the child in the system.

Parents, civil rights groups support Detroit mom jailed over daughter's meds

Detroit — A group of parental rights supporters and activists gathered at a northwest-side church this morning to raise awareness and money for a mother jailed after a 10-hour standoff with police over her daughter's medications.

Maryanne Godboldo, 56, told the audience at the rally held at Hartford Memorial Baptist Church on James Couzens Freeway that the state had no right to take her 13-year-old daughter.

Godboldo had been in custody for five days since surrendering to police March 25 after barricading the girl inside their west-side home where she is alleged to have fired a shot with a .38-caliber revolver at three police officers who broke open the door of her home and entered. The shot hit a wall, according to a police report."I want my daughter back and I want her back today," Godboldo said.

Godboldo has said she was protecting the child from unnecessary medication and Wayne County Child Protective Services workers who arrived March 24 with a warrant to remove her daughter. The warrant was apparently issued without a hearing by a Wayne County Circuit Court judge, because the mother had stopped medicating the girl.

Community leaders, including ministers, civil rights activists and a judge, helped negotiate Godboldo's March 25 surrender.

Godboldo's resistance of authorities has drawn nationwide attention from conservative and liberal groups advocating for parents' rights and concerned about the safety of childhood immunizations, the use of psychotropic drugs on juveniles and government intrusion.

"Our parental rights are being undermined. Maryanne Godboldo sought to provide the best health care for her child," said a statement from the Justice for Maryanne Godboldo Action Committee, rally organizers. "Providing health care for one's children is not something that should be surrendered to any state authority."

The teen's physical and mental problems stem from a bad reaction to a cocktail of immunizations she took so she could enroll last year in a traditional middle school after being home-schooled, Godboldo has said. The medical treatment plan was developed by Godboldo and specialists at The Children's Center, a family service organization for troubled children, according to its website. The court had no prior involvement with the family, defense attorney Wanda Evans said.

Godboldo has not seen her daughter since her arrest, but expects to arrange supervised visits at the Northville psychiatric services agency where her daughter is being held, Evans said.

Barbara Ann Polizzi, a 44-year-old mother, drove 13 hours from New York with her 15-year-old son, Michael Polizzi, to attend the rally and support Godboldo's cause. Michael was once given Risperdal by doctors to treat behavioral problems. The drug, which had also been prescribed for Godboldo's daughter and is commonly used to treat schizophrenia, left the boy debilitated by visual and auditory hallucinations, severe anxiety and rapid heartbeat, Polizzi said. She fought for six years to get her son back after he was taken by authorities and placed in state-run residential schools.

"I know what it's like to put my head down on a pillow every night and worry about what might happen to my son," she said.

The mother and son both cried when they learned about Godboldo's plight, she added.

"The hospitals never really tell moms what goes on behind those locked-up, closed doors," Michael told the audience.

A $500,000 cash surety bond was set at Godboldo's March 27 arraignment on felony charges, including three counts of felonious assault, three counts of resisting and obstructing an officer, one count of firing a weapon in a dwelling and one felony firearm count. But the bond was later reduced to $200,000 personal recognizance by 36th District Court Judge Paula Humphries, who said she didn't consider the mother a risk to the public.

Godboldo didn't purposely fire at police, defense attorney Allison Folmar told Humphries. "My client … had to endure the onslaught of police unlawfully taking her child," Folmar said.

A custody hearing is set for April 6, followed by an April 8 preliminary exam.

Detroit— The bond was reduced today for a woman charged with using a gun to hold off police when Child Protective Services workers came to take her daughter in a dispute over the 13-year-old's medication.

36th District Judge Paula Humphries lessened the bond for Maryanne Godboldo, 56, to a $200,000 personal bond from $500,000 cash, meaning no money will be posted and she likely will be released today.

Defense lawyers called the original bond "enormous" and "excessive."

Humphries said today she believes Godboldo isn't a threat to the public despite a police report saying Godboldo fired a shot while officers entered her home Thursday on the front porch of her west-side home.

Godboldo has been in the Wayne County Jail since surrendering Friday morning on the front porch of the home after a 10-hour standoff.

Her daughter, Ariana, was initially turned over to a relative by Detroit police, but was later taken into state custody from a hospital where her physical condition she was being evaluated after the standoff. She has been allowed visits at a state-run facility for juveniles from her father, Mubuarak Hakim, and an aunt, Penny Godboldo, a professor of dance at Marygrove College.

"She's OK," Hakim said Tuesday. "I'm not OK with it, though, and we are working at bringing her home, bringing them both home."

Godboldo's lawyers, who claim the state had no authority to take the girl, have requested an April 6 hearing on her custody in Wayne County Juvenile Court. A preliminary examination of criminal charges against Godboldo will be April 8 in the city's 36th District Court.

The standoff started Thursday afternoon, when protective services workers came to Godboldo's home armed with a warrant to take the girl. The dispute is over a medical and mental health treatment plan that had called for psychotropic drugs the mother felt were doing more harm than good. Godboldo has said her daughter's physical and mental problems are a bad reaction to immunizations the formerly homeschooled teen took so she could be enrolled in a regular middle school.

Godboldo's lawyer, Wanda Evans, has said the medical treatment plan was voluntarily developed between the mother and specialists at the Children's Center, an organization that helps "at-risk children." The court had no prior involvement with the family and granted no authority to social workers to countermand a parent's right to make medical decisions, Evans said.

The incident has attracted widespread interest since the standoff began Thursday afternoon. Ministers and civil rights advocates rushed to the home that was surrounded by police. One of the people who helped police talk Godboldo out of her house was Wayne County Circuit Judge Deborah Thomas, a former polio sufferer and advocate for the disabled. Ariana has had only one foot since birth. Thomas has said her examination of the warrant CPS workers presented to Godboldo revealed that it contained "defects."

A broad spectrum of activists, conservatives, liberals, and anti-immunization, parental and civil rights groups are expected to come from around the nation to attend a 9 a.m. event Saturday at Hartford Memorial Baptist Church, 18700 James Couzens Freeway, to support Godboldo.

"We are going to have an extremely interesting collection of Americans who believe in the sanctity of family, conservatives and liberals, coming together for this mother," said one of the event's organizers, Ron Scott of the Detroit Coalition Against Police Brutality. "We have received word that people are coming from the holistic health community and even representatives of the Tea Party in West Michigan."

Resistance Is Futile When It Comes To CPS

The question was raised in the article on whether a Detroit mother should have not fought to protect her civil rights to be safe in her home and to protect her family.  Constitutional rights do not exist in child protective services.

Was a Detroit mother right to resist efforts by Child Protective Services, police to take her child?

Maryanne Godboldo was looking only for help.

Last year, the Detroit mother went to the Children's Center, a group that works with troubled children, to seek advice and a treatment plan for her 13-year-old daughter. The girl, who'd never had behavioral problems before, was suddenly irritable and not her usual self following a series of immunization shots.

As part of the center's treatment plan, a doctor prescribed the child an anti-psychotic medication. But the child's symptoms only worsened. As a result, Godboldo sought another physician, who quickly recommended taking the child off the psychotropic drug.

The mother agreed and, according to her attorney, who spoke exclusively with MLive Detroit earlier today, Godboldo began following that doctor's orders. 

Unfortunately for Godboldo, the state didn't agree. Child Protective Services wanted Godboldo's child medicated according the center's plan, and CPS workers essentially told the 56-year-old mother — who was never under any court order to follow the plan — to agree to their program or surrender her child.

She refused both. And so, on Thursday, CPS workers showed up at Godboldo's house with the police, who said they had a warrant to take the child. But according to Godboldo's lawyer, Wanda A. Evans, officers never produced a warrant even after Godboldo repeatedly asked to see one.

A standoff ensued. A gunshot was fired from inside the house — though, according to Evans, not at officers. Finally, after long hours of tense negotiations, Godboldo — a mother, a teacher, a dancer and a respected figure in the city's arts circles — surrendered, was jailed and, on Sunday, was arraigned on multiple felony charges.

March 28, Detroit News: Godboldo is accused of barricading herself inside her west side home with her 13-year-old daughter and a gun after being confronted Thursday afternoon by Child Protective Services workers who had a warrant to remove the girl because the mother had withheld her medication. Detroit Police said Godboldo fired a shot and refused to leave the home until negotiators, including a Wayne County judge, helped talk her into surrendering.


"We talked that day mother-to-mother. I asked her to come out on her porch and I promised I would come here today to walk out with her," Wayne Circuit Judge Deborah Thomas said Sunday after the hearing. "I'm shocked by the amount of the bond. I never dreamed it would be set so high and she wouldn't be free to care for her daughter."

Meanwhile, according to Evans, the daughter, who has a physical disability, remains in the custody of the state even though several relatives and family friends have repeatedly volunteered to care for her in her mother's absence: "They had a hearing that they didn't notify anyone of, and a woman from CPS said that no family had come forward to take care of the girl. That's just not true. Relatives were all at the house when this incident happened, saying they would take care of her. It's like, the state just wants to medicate this child."

But for now, at least, the drugs are off the table. A Wayne County Circuit Court judge ordered the medication discontinued until further review.

How isn't this entire incident a travesty?

How does a woman who voluntarily goes looking for help wind up behind bars because she's trying to do what she thinks is right by her child? How can the state make a mom who, by all accounts, has done a wonderful job of parenting give her child medicine that she and a doctor both think only worsens a problem? And how is it that we can respect a judge ordering the child off the medication but not a mother acting on her physician's advice?

Evans compares Godboldo to comic Jenny McCarthy, who has railed publicly against vaccines as a potential cause of autism in children. Granted, the science weighs heavily against that theory, but as Evans says, "Nobody is kicking in Jenny McCarthy's door. She has the right to do what she thinks is in the best interest of her child. Why can't this woman?"

Hell, this isn't about vaccines even: Godboldo had gone along with the shots. She wasn't some religious nut denying her child a life-saving medical treatment. This was a mother who, along with her doctor, didn't believe her child benefited from psychotropic drugs.

As Judge Thomas' remarks suggest, the incident has sparked shock and outrage among many in Detroit who believe that Child Protective Services overreacted (and that state agencies are often far too quick to recommend medication for kids, especially black children). A rally of support for Godboldo is being held at Detroit's Hartford Memorial Church on April 2.

I doubt that anybody's trying to justify standoffs with cops or warning shots or any of the other sensational elements of this incident. But early evidence strongly suggests that the CPS workers overstepped their bounds in a major way. 

If so, then how could Godboldo not resist? Because regardless of whether it's to mental illness, physical disabilities or state agencies, good parents do not simply surrender their children.

I truly do not understand why this story is such a shock.  Wayne County Child Protective Services has a severely long history of corruption, Medicaid fraud, and your basic state sanctioned incompetence.  Just ask Maura Corrigan.

The Children's Center is notorious for snatching the children they serve as the organization lobbies as 501c3.


The State Medicaid Fraud Control Unit of the Office of Attorney General does nothing but turn a blind eye to Medicaid fraud in child welfare because in Wayne County, it is the Attorney General who must defend the crimes of CPS as it prosecutes the mother.


The U.S. HHS/DOJ H.E.A.T. partnership is oblivious to the entire situation of Medicaid fraud in child welfare as it does not have the resources or staff to adequately go after Medicare fraud.


The State False Claims Act is not efficient enough to take any action.


So, what will happen is the 13-year old will be pumped up with more antipsychotic medication that is, more than likely banned by the FDA for use in children.  The teen, having suffered intense, life-long trauma will be doped up with more meds so the child placing agency can bill for more federal funds.


CPS will be so upset with having to deal with this issue as a public matter, they will file for termination of parental rights, dump the teen in the lap of Michigan's daddy to be shipped around to multiple foster homes, more than likely to be physically abuse and tortured, to end up aging out to a life on the streets.


Relatives will never be allowed to take the child as they may attempt to take legal action, which will never be entertained by the courts.


Only in CPS can a GED/BA holder make medical determinations!

The longer a child is in foster care; the more jobs are sustained. Sustaining and creating jobs saves money for the state. Foster parenting is a job. The state and the institutions are given financial incentives and receive financial rewards for each child transitioned into adoption. Michigan needs to make budget cuts. Michigan needs to create more jobs. Foster parenting is significantly more economical than an institution. Adoptive families receive financial rewards for each child adopted. The state no longer is financially responsible for the child. The state is no longer financially responsible for the birth parent. Everyone contributes to the economy. A stronger economy eradicates poverty. Poverty is a crime. When you stop poverty, you stop abuse and neglect.


This is why no one wants regulation or reform of the multi-billion dollar health care.
