Cocktails & Popcorn: Sessions Resigns, Matt Whitaker Is Acting & I Am Ready

"I saved a seat for you.
Is it my turn, yet?"
I do not know of this Matt Whitaker, or do I?

He has a background in trafficking tiny humans and patents, which is always a good thing.

He also seems to have no problems in the spotlight, which is odd for an USAA, but not uncommon, and needs to be done more often so the people understand what is going on in federal litigation in their districts.

But then, I decided to go through my database and found out that he knows stuff....lots of stuff....

FACT Request For House Ethics To Investigate U.S. Representative Debbie Wasserman Schultz For Employment Violations Of Staffer Imran Awan

Well, hello, Matt.

My little Jeffy set it all up, and is now leaving the stage, taking his seat with a bucket of popcorn and an icy beverage for the show.

Jeff Sessions resigns as attorney general

Washington — Attorney General Jeff Sessions has resigned as the country’s chief law enforcement officer.

Sessions announced his plan to resign in a letter to the White House on Wednesday.

President Donald Trump announced in a tweet that Sessions’ chief of staff Matt Whitaker would become the new acting attorney general.

The attorney general had endured more than a year of stinging and personal criticism from Trump over his recusal from the investigation into potential coordination between Russia and the Trump campaign.

Trump blamed the decision for opening the door to the appointment of special counsel Robert Mueller, who took over the Russia investigation and began examining whether Trump’s hectoring of Sessions was part of a broader effort to obstruct justice.

Matthew Whitaker: 5 Fast Facts You Need to Know

Matt Whitaker
Attorney General Jeff Sessions has submitted his resignation after being asked to do so by President Donald Trump. The acting attorney general will be Sessions’ chief of staff, Matthew Whitaker, an attorney from Iowa.

Whitaker, 49, penned an op-ed in August 2017 in which he argued that Robert Mueller’s investigation of President Donald Trump was going “too far.” Trump has been sharply critical of Sessions for recusing himself in the Russia investigation, which the president has derided as a witch hunt. It is not clear if Whitaker will be forced to recuse himself from overseeing the Russia investigation and Mueller’s probe. Deputy Attorney General Rod Rosenstein has been supervising the special counsel’s probe because of Sessions’ recusal.

“Matt is a well-respected attorney and entrepreneur. Matt is the former United States Attorney for the Southern District of Iowa. Matt was also the starting tight end for the Iowa Hawkeyes in the 1991 Rose Bowl,” Whitaker’s LinkedIn page reads.
Here’s what you need to know about Matt Whitaker:

1. Trump Floated the Idea of Matthew Whitaker Replacing Jeff Sessions Permanently, Reports Say

On October 10, 2018, The Washington Post reported that Trump had talked recently with Matt Whitaker “about replacing Sessions as attorney general.” The newspaper cited anonymous sources for its reporting. The newspaper added that it was not clear how serious the president was or whether he had Whitaker in mind in a permanent sense or as an acting AG. Whitaker’s name has also been floated as a possible replacement for Rod Rosenstein at DOJ if Trump fires him. Rosenstein oversees the Mueller probe because Sessions recused himself.

Matt Whitaker is the chief of staff to Jeff Sessions, a position to which he was named in October 2017. His LinkedIn page describes him as “chief of staff and senior counselor to the Attorney General.” He once lost a Republican primary in Iowa to Sen. Joni Ernst, who released a statement praising Sessions’ choice of Whitaker as his chief of staff, calling him a “tireless advocate for the rule of law and the enforcement of our nation’s laws.”

He’s also been floated as a possible replacement for White House Counsel Don McGahn.

2. In the Op-Ed, Whitaker Argued That Mueller Should Not Look Into Trump’s Finances

The op-ed by Whitaker was published by CNN. In it, Matthew Whitaker argued that the Mueller probe was coming close to crossing a “red line.”

“Mueller has come up to a red line in the Russia 2016 election-meddling investigation that he is dangerously close to crossing,” he wrote, referring to any probe of the president’s finances.

He brought up his own legal background, writing, “I can understand how a motivated prosecutor, in a broad investigation into the financial affairs of high-profile individuals, can become overzealous toward the targets of such probes — with calamitous results.”

He argued that Rod Rosenstein, who is in charge of the Russia probe because of Sessions’ recusal, should limit the inquiry or it could risk looking like a political fishing expedition.

3. Matthew Whitaker, Who Is Married With 3 Children, Played Tight End on the 1991 Rose Bowl Team for the Iowa Hawkeyes

Matthew Whitaker was a successful college football player. He was an Iowa Hawkeyes tight end and member of the 1991 Rose Bowl team, according to WHO-TV.

The television station reports that Whitaker played football at Ankeny High School and “was named to the all-state football team and later got inducted into the Iowa High School Football Hall of Fame.”
A press release bio says Matthew Whitaker “was an academic All-American football player, playing on the University of Iowa’s last Rose Bowl team in 1991…Matt will be inducted into the Iowa High School Football Hall of Fame at half time of the 4A state championship game.”

He also served as Executive Director of a conservative “ethics watchdog” group called the Foundation for Accountability and Civic Trust (FACT). For example, he released a statement for the group that quoted him as saying, “The revelation today that the Obama State Department has deemed some of Hillary Clinton’s emails ‘too damaging’ to release in any kind of form now removes any doubt about whether Hillary Clinton put our national security at risk for the sake of her personal privacy and pursuit of the White House. This week I called for the appointment of a special counsel to investigate this most serious breach of national security. Because the Obama administration has a clear conflict of interest, it is imperative this investigation is done by an individual independent from the administration and is required to maintain the citizen’s trust in and the integrity of the government. This call is even more urgent given today’s disturbing news.”

Whitaker is married, to Marci Whitaker, and has three children. His wife works as a civil engineer. According to her bio on the website for the Des Moines company she works for, Mc2 Inc., Marci Whitaker, “has been with Mc2, Inc. since May 2011. Marci has a B.S. civil engineering degree from the University of Iowa and worked for consulting engineering firms in Minnesota and Iowa for 18 years prior to joining Mc2. She currently holds a Professional Engineer license in Iowa. Her past design experience includes wastewater treatment design, biosolids treatment, biogas handling, odor control and disinfection. Marci is a member of WEF and is the newsletter committee chair for IAWEA. Marci is originally from Ely, Iowa.”

4. Whitaker Is a Former U.S. Attorney Who Has Appeared on CNN

Matthew Whitaker worked as U.S. Attorney for the Southern District of Iowa. In 2009, Whitaker “tendered his resignation” to Barack Obama after serving since 2004 in the position. He was described as a “Bush holdover” as he was chosen for the position by former President George W. Bush.

“Being United States Attorney is the greatest professional experience and honor of my life. I am very proud of what we have accomplished in this office,” Whitaker said in a press release. “We have worked very hard these almost 5 ½ years to advance the goals of the Department of Justice. We have been firmly committed to protecting our citizens from terrorist attacks, reducing gang and gun violence, protecting our children from predators, reducing the availability of meth, cocaine, and marijuana in our communities, and protecting the taxpayers through our civil division.”

The press release listed these cases:
“• United States v. Cunningham, et al, the “CIETC” case: pleas and convictions in connection with the fraud at the Central Iowa Employment Training Consortium;
• Operation Wirebreaker: a coordinated District-wide enforcement effort seeking individuals that trade child porn on peer-to-peer networks resulting in 13 individuals being charged;
• United States v. Wallenfang: conviction and sentencing of a child pornography producer from Ankeny;
• Swift & Company Immigration Enforcement: charged almost 30 individuals with Immigration and Identity Theft charges with pleas and convictions;
• United States v. Davis and Edwards: both defendants received 360 months in prison for their involvement in an arson in Iowa City that resulted in one person’s death.”

Whitaker also served as a partner at a Des Moines law firm, writing on LinkedIn that he performed, “civil litigation, business transactions and estate planning and probate. We can offer efficient and effective legal representation as well as unparalleled client service and a true commitment to obtaining the best result possible. Let us fight for you and be your voice. Offices in Des Moines and Cedar Rapids, Iowa.”

According to his resignation press release as U.S. Attorney, Whitaker “holds three degrees from the University of Iowa (Law, MBA and BA).”

5. Whitaker Ran for Public Office Twice & Once Said He Wanted to Be Like Rand Paul

Matt Whitaker has two previous failed bids for state office, running for state treasurer and U.S. Senate. He lost the treasurer’s race to the Democrat, 43% to 54%, in 2002. Whitaker ran as a Republican.

When he ran for U.S. Senate, Whitaker commented that he wanted to model himself after U.S. Sen. Rand Paul. He also said he wanted to be like Sen. Ted Cruz, according to The Des Moines Register.

He has served on advisory boards, including The World Patent Marketing Advisory Board.

In 2017, the Federal Trade Commission alleged, “At the Federal Trade Commission’s request, a federal court has found that the FTC is likely to prevail in its case against World Patent Marketing, an invention-promotion scheme that allegedly deceived consumers through misrepresentations about its success and the services it provided, and suppressed complaints about the company by threatening dissatisfied customers.”

As previous positions, he listed on LinkedIn that he was previously owner of Little Endeavors, principal of the Freedom Strategy Group, an Iowa-based consulting firm, director and shareholder of State Savings Bank in West Des Moines, corporate counsel for SuperValu, and director-member of the board of directors for Merit Resources. He was also an associate at other law firms.

Cocktails & Popcorn: Why Everyone Is Picking On Matt Whitaker - Watergate, Whitewater & Detroit

Image result for powerlifting gif
"Powerlifters need protein, not popcorn, when challenged by
"Legal Geniuses" (trademark pending)

Ok, let me see if I got this right.

Before Matt Whitaker became Acting Attorney General, he filed a request for investigation through his 501c3 FACT, to the Ethics Committee to investigate Imran Awan and Debbie Wasserman Schultz which was referred to DOJ IG Horowitz, who parceled out the investigative request to the Office of Special Prosecutor and respective Districts of the U.S. Department of Justice, where he has no hand in the investigations or prosecutions because he was Chief of Staff for Attorney General Jeff Sessions.

So, now, everyone wants to get rid of him.

Hmmmmm.......

Sounds like Matt is an original source, but hey, what do I know?

I know powerlifters need protein, not popcorn, when challenged by "Legal Geniuses" (trademark pending).

Supreme Court rejects challenge to Matt Whitaker's appointment as acting attorney general

Opponents of his appointment said he was not qualified for the position because he was not subject to Senate confirmation.

Matt Whitaker
WASHINGTON — The Supreme Court on Monday rejected a challenge to the appointment of Matt Whitaker as acting attorney general.

President Donald Trump appointed him on Nov. 7, shortly after Attorney General Jeff Sessions announced that he was stepping down at the president's request. Whitaker had been serving as chief of staff to Sessions.

https://beverlytran.blogspot.com/2018/11/cocktails-popcorn-sessions-resigns-matt.html

Opponents of his appointment said he was not qualified for the position because he had not been subject to Senate confirmation. Their vehicle for the challenge was a pending case against the attorney general, who was Sessions when the case was filed in June. The challengers asked the justices to rule that the name on the case should be changed to Rod Rosenstein, who they said is actually the acting attorney general.
The Supreme Court case was originally brought by a Nevada man, Barry Michaels, who asked the justices to rule that the right to own a gun should not be taken away from someone convicted of certain nonviolent felonies.
On Monday, in a brief order, the court denied the motion to take Whitaker's name off the case and also said it would not hear the Michaels gun case.

That is because the right to bear arms has nothing to do with guns.

A similar challenge to the Whitaker appointment is pending in federal court in Maryland.

Sssshhhhh.......whatever you do, do not let anyone know that the Old School Civil Rights Legal Dogs planned for every legal challenge to the DOJ appointments you could ever conceive.  I want to see what else they come up with.

https://beverlytran.blogspot.com/2018/11/cocktails-popcorn-fact-v-crew-matt.html

Ssssshhhh.......I got cocktails & popcorn.

The Trump administration has vigorously defended Whitaker's appointment. An opinion from the Justice Department's Office of Legal Counsel said the government has identified over 160 times throughout U.S. history when presidents appointed non-Senate-confirmed government officials to serve in high level positions. In recent years, the opinion said, such appointments were made by Presidents George W. Bush and Barack Obama.

DOJ is busy, busy, busy!

The opinion said that while courts have held that the Constitution requires principal officers to be confirmed by the Senate, "it does not follow that Acting Attorney General should be understood to be one," because the person appointed to serve in that capacity is not in a "continuing and permanent" position.

Matt Whitaker Is Now A Private Citizen

Image result for excited kid
"Is Matt going to take down Her Flatulent Boviness
and her rogue ass crew?"
Former Acting Attorney General, Matt Whitaker, who went over to the Antitrust Division for a hot second, has left federal service.

That means he is now a private citizen and can say whatever he wants, even in a court of law, with a law license.

Whatcha gonna do, now, Matt?

What is Jeffy up to?

I bet it has something to do with the children's trust.

Matthew Whitaker has left the Justice Department

His next career move is unknown, but Whitaker has told friends that he will remain in Washington because there are "many opportunities here," sources said.

WASHINGTON — Former acting Attorney General Matthew Whitaker left his position at the Justice Department on Saturday, a department spokeswoman said.

Whitaker had been serving as a senior counselor at the Justice Department since Attorney General William Barr was sworn in last month.

His next career move is unknown, but Whitaker has told friends that he will remain in Washington because there are "many opportunities here," according to sources who have spoken with him in recent days.

Whitaker previously served as former Attorney General Jeff Session’s chief of staff. He was accused by some within the Justice Department of being more loyal to the White House than to Sessions as President Donald Trump grew frustrated with his attorney general.

Trump publicly criticized Sessions for recusing himself from the investigation into Russian meddling in the 2016 election, a move that allowed Deputy Attorney General Rod Rosenstein to appoint special counsel Robert Mueller to lead the probe. Sessions was eventually forced to resign after the November midterms.

When Whitaker took over Sessions’ position last November, Democrats expressed concerns that he would hamper the Mueller probe. Whitaker, who had previously questioned the scope of the special counsel investigation, ultimately decided not to recuse himself from the probe.

Barr now holds oversight power in the Mueller probe and with that, has the job to decide what portions of the probe, which is reportedly in its final stages, to share with Congress.

JUDICIARY: AAG Matt Whitaker Meets The "Legal Geniuses" Of The U.S. House Judiciary Committee - We Are Almost In Detroit

Image may contain: 2 people, people smiling
John Conyers, Jr. sees and hears everything!
For your historic pleasure, in the spirit of fuchsia, I have provided my "Colored" commentary, because I am quite sure there are going to be numerous media outlets, political scholars, and "Legal Geniuses" (trademark pending) out there who are going to claim they know everything about everything that has gone on in this hearing.

Here, is almost, but not quite, everything you want to know about Matt Whitaker.

Why are some of the members so contentious and way outside the scope of the hearing?

Well, it is because the U.S. House Judiciary Committee is under the purview of the U.S. Department of Justice.

Yes, boys and girls, that is correct.

Judiciary was mean to my Sweetie.

That was not very nice because it gave me Saddy face, right Perry?

But, have no fear, there is always the original plan...by the original source.

It is just a shame that the Members of the Committee did not take the time to address the items of the national agenda that Trump outlined in his State of the Union 2019 speech.

  • child trafficking;
  • child sex trafficking;
  • human trafficking;
  • women trafficking;
  • drug trafficking;
  • slavery;
  • civil rights;
  • jobs;
  • justice;
  • peace.

But, then again, when you are facing prosecution of war crimes, you tend to forget about the children.

The following is my "Colored" Commentary of the Oversight of the U.S. Department of Justice Hearing, where I have extracted my comments in conversation for a more pleasurable experience, via the castigation of the Celestial Goddess of the Woodshed.

Yes, this is about Detroit.

Perry put this hearing together because I smell the fear.

Collins just put forth a motion to dismiss the hearing.

10 - 12 motion to adjourn does not pass.

Nadler is trying to find out if he is part of the Special Investigation!
Image may contain: 1 person, text

Matt just smashed Nadler when asked for the umpthenth time of what the special counsel investigation was about. He said "I believe your 5 minutes are up".

A bit of fun you can take with you. Look at the portraits in chambers on the wall. Who are they?

Lofgren asked if his views were based on conversations with the Trump Administration. Whitaker said his comments on the special investigations were made before, as a private citizen.

Chabot said "Conyers" and mentioned their work on the opioid crisis.

Whitaker is trolling Her Flatulent Boviness. CoS physically stood up behind her. They are terrified.

The Her Flatulent Boviness (Sheila Jackson Lee) tried to as Whitaker about his background in Voting Rights cases. Her time expired. She was trying to get into the Russian Interference. Instead, he said voting fraud, which is his investigation of Detroit.

Cohen is about to break down in tears trying to get Whitaker to say this is a russian investigation. This is so romantic.

If anyone runs across any articles or *youtubers/investigative jounalists* running their own analysis, please drop the links so I can put them on the list.

Deutch asked about the interview to become CoS. This is going to be relevant to other CoS.

Karen Bass asked about Whitaker's background with FACT. Collins challenged that it was outside the scope of the hearing. Nadler was forced to take a vote. They tabled the issue. Karen Bass is the head of the Foster Care Caucus. Need I say more? Bass is going after FACT because she is part of CREW. I told you, Melanie Sloane is coming back.

Nadler: "we taking a 5 minute recess for lunch". Whitaker: "only 5 minutes for lunch"? <=== I need a meme.

McClinton tried to compare the Stone raid and Medenez case arrest procedure. Whitaker said there are ongoing investigations. FBI will brief in closed session,

Cedric Richmond is throwing the Civil Rights Act creation of the DOJ. Yes, who was behind creating the DOJ. #sayhisname

Richmond is standing up for the "Colored" Revolution. He is throwing the race card. DUCK!

Lesko (cannot see her name she is new) is asking about coming together. She is asking about the new infantcide laws. DOJ is looking into it. She is talking about infant mortality.

Jefferies tried to rip Whitaker about responding to a statement and a question. Now Jefferies is throwing out numbers on indictments, pleas, sentencing. He is bringing up Wikileaks, Stone, Manafort, Flynn, Cohen.

Cicilline is asking about Presidential privilege. They keep harping on if Whitaker talked to Trump or his legal team about the Mueller investigation. If Cicilline was part of this group, or just read my cases, or signed up for my blog, he would know.

Reschenthaler raised good questions in the scope of the hearing, appropriate questions.

Swawell asked if Mueller was honest and conflicted because Trump said he was running a witchhunt. He wants Whitaker to repeat his "terms and words" to the president. That was a cute set up for a violation of law.

Armstrong is asking about the First Step Act. He asked commended the pretrial release program and asked to work with DOJ for a Second Step Act.

Armstrong asked about universal understanding of "gross negligence" even under the Espionage Act.

You do know, there is a strong possibility that when they take a break, walking into the back office, they are on the phone, calling #perkinscoiesucks . There is also a distinct possibility that, due to the investigation on Judiciary, that everything has been wired up.

Raskin. Oooo, he read Whitaker's wikipedia page!

Raskin is getting fiesty! Smells like fear. Israel?

Jayapal is lying. She keeps talking about the leaked draft immigration family separation policy memo. That is a lie. The States take over. Bethany Christian. Michigan. Where is Betsy DeVos. She is using a fake memo to attack Whitaker.

The States hand out the contracts to private corporations. Jayapal has said absolutely nothing about foster care and adoption. They do not even track in the U.S.

Demmings asked about private conversations with Trump about Cohen or, District of Virginia and SDNY personel.

She is getting on him about drugs coming in from the border or ports of entry.

Correa is on white supremist out numbering islamic extremist attacks.

Scanlon is getting hard on undocumented immigrants but he cannot comment due to ongoing litigation. She is clarifying. Garcia is asking about Zero Tolerance policy. Whitaker said Sessions implemented it. These people refuse to say foster care and adoption. The states take those kids. Michigan has the national contract. No one is even mentioning termination of parental…See More

She asked about dropping the ACA litigation. Why? He cannot discuss that. That is the decision of the president.

Neguse is asking about medical cannibis research. Whitaker said there are international treaty challenges.

He asked about confidential communications with the president. He is asking about RR being next in line to be appointed. Sessions resigned. Sessions was not fired.

https://beverlytran.blogspot.com/search?q=jeff+sessions+ballad&fbclid=IwAR2pQAQ8BtQf1YfLKFQ6NLF72cEa4SkaMoZ6ObcRIOLwbTIsgFXTk50HGJY#axzz5egWbwTZU

McBath is asking about the Voting Rights Act, voter suppression, and evidence. The 2016 election had a VRA complaint filed before the election. Grand Juries were called before the election, in Detroit, which threw the state, which threw the entire general election.

Stanton asked about the Religious Liberty Task Force. Sessions set it up. Whitaker has said he would follow up.

Stanton brought up foster care and discriminating against a jewish adopter by a contracted agency.

Dean is asking about his private life statements on the Mueller investigation.

The Committee is setting up for impeachment hearings, from both sides of the aisle.

Mucarsal-Powell must be new because she is not very versed on 501c3s. I am calling it out now. They are prohibiting 501c3s from engaging in political activities. They are going to file charges. This is #perkinscoiesucks set up because the "Legal Geniuses" (trademark pending) are behind the development of line of questioning.

They are going to throw Mucarsel-Powell under the bus. She is reading "their" questions under the guise that she is going to rise as a power star. I can spot grooming a thousand miles away.

Escobar is trying very nicely to tell Whitaker how to answer. She is not his legal counsel. She is new and was set up to get thrown under the bus. She dropped dead kids. Yes, she brought up the 2 kids who died at the border but refuses to speak upon the fact that congress makes law, not DOJ.

Only Congress makes law, not the Attorney General.

You would think the members of House Judiciary would know this by now.

Cocktails & Popcorn: FACT v. CREW - Matt Whitaker, Ethics, Whitewater & Detroit

There seems to be a bit of disdain in the decision for Sessions to resign and Matt Whitaker to take the helm. to steer the DOJ.

Why Trump could face legal challenges over Whitaker

People are complaining that his position is "unconstitutional" because he is not confirmed by Senate but failed to look at the

Cocktails & Popcorn: Sessions Resigns, Matt Whitaker Is Acting & I Am Ready

But, for a moment, I almost forgot  that this is another one of those transposable models I just so adore.

Then I had a revelation because I remembered about the Acting U.S. Assistant Attorneys of the Districts that were left vacant for quite some time, where many key positions within the DOJ are still, to this very moment, vacant.

There was even an issue under the Federal Vacancies Act, that came out of Whitewater to address any issues with the appointment and firing of a Special Counsel

There are, however, a few key limitations on the scope of the Vacancies Act. Notably, the Vacancies Act governs the ability of a person to perform only those functions and duties of an office that are nondelegable. Unless a statute or regulation expressly specifies that a duty must be performed by the absent officer, that duty may be delegated to another government employee.* In other words, delegable job responsibilities are outside the purview of the Vacancies Act. In addition, if another statute expressly authorizes acting service, that other statute may render the Vacancies Act nonexclusive, or possibly even inapplicable. (That is secret code for "Special Counsel". They made sure they did not that do that Fiske-Starr switcho-chango to happen again.)
But, in this instance, I thought of Sandy Baruah.

New Small-Business Chief Has Critics Already

My most sincerest apologies for the digression with the Sandy, but I was experiencing another Post Traumatic Fraud Syndrome episode.

This is also taken directly from the Federal Vacancies Act.
 As a default rule, the first assistant to a position automatically becomes the acting officer.
First assistant can also mean Chief of Staff.

Then I knew I was on the right tract to deconstructing this transposable model down to its origins, right here in Detroit.

So, let me get this straight, you have a guy, who is a power lifter (had to throw that one in), run for office, then file a bunch of complaints about people in office to Ethics, dealing with personal inurement of office, in a situation of leaking of an ongoing investigation of a former Attorney General, all swirling around the Federal Vacancies Act?

Lemisch's Leaks - Matt Schneider Is Back & So Are Detroit Public Corruption Investigations

I stood aghast for the thought that this could have actually been planned.

Image result for girl eating popcorn
"This is so hot for #MeToo."
I wonder who would plan such a cocktails & popcorn worthy moment, for the model sounds so eerily recognizable.

It would have had to be someone who knows of Said Act and Whitewater, succinctly well.

But hey, what do I know?

I know Perkins Coie Sucks because CREW just filed a letter of recusal to DOJ.
