Ex-lawyer to serve 70 months in prison for Birmingham, Bloomfield real estate scheme

A former Oakland County lawyer will serve 70 months in federal custody because of his role in a real estate scheme that caused Fifth Third Mortgage to release more than $8 million for upscale developments.

Paul Nicoletti, whose license to practice law was suspended in May, also must pay restitution totaling $5.3 million and serve two years of supervised release upon walking away from federal prison.

U.S. District Judge Victoria Roberts sentenced Nicoletti, owner of a Bloomfield Hills title company, last week.

According to the U.S. Department of Justice, a jury returned guilty verdicts on one count of conspiracy to commit bank fraud and three counts of bank fraud, aiding and abetting, in May after a trial. He was indicted in 2015 for 2005 loan practices.

Officials said in their press release Nicolette was part of a scheme to obtain large mortgage loans from Fifth Third Mortgage, a lending arm of Fifth Third Bank.

The scheme involved real estate developers, a corrupt loan officer and Nicoletti working together to obtain large mortgage loans, purportedly for the purchase and development of high-end properties in Bloomfield Hills and Birmingham.

Numerous false statements were made during the application and closing process involving “straw buyers.

One or more conspirators would find and recruit “straw buyers” who would serve as mortgage loan applicants intent on purchasing properties the conspirators wanted to both purchase and develop.

The “straw buyers” viewed themselves as “investors.” They were paid a fee for the use of their names and credit histories on loan applications and real estate transactions and promised a portion of the expected profits from the properties being developed and resold.

The straw buyers had no intention of living at or exercising ownership and control of the properties.

This was contrary to representations in their applications and in closing documents.

False information pertaining to their income and assets was included in the mortgage loan applications.

Nicoletti’s role was as the title agent that, among other things, falsely verified that the borrowers made substantial down payments on properties.

Nicoletti apparently obtained cashiers checks that were issued after loan proceeds were released to his Continental Title account and which were funded by the loan proceeds themselves.

Names of the straw buyers appeared as “remitters,” and the checks were then re-deposited into Nicoletti’s Continental Title account, making it look like there were big down payments.

Prosecutors said Nicoletti destroyed relevant electronic and paper records when authorities discovered the fraud.

Nicoletti is one of several people convicted in the FBI’s investigation. A loan officer, mortgage broker,  appraiser and several of the real estate developers have previously been sentenced after entering guilty pleas relating to the scheme, according to the DOJ.

California Real Estate Developer Sentenced to 15 Months for Making Conduit Contributions in Two U.S. Congressional Campaigns

Oakland-area real estate developer James Tong was sentenced to 15 months today for funneling tens of thousands of dollars of his own money through straw donors into two consecutive congressional campaigns for a member of the U.S. House of Representatives.

Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division, United States Attorney David L. Anderson for the Northern District of California, and Special Agent in Charge John F. Bennett of the FBI’s San Francisco Field Office made the announcement. 

Tong, 74, of Fremont, California, was sentenced by U.S. District Judge Jon S. Tigar of the Northern District of California.

A federal jury convicted Tong on Oct. 8, 2019, of two counts of making contributions to a federal campaign in the names of other individuals.  According to the evidence presented at trial, in 2012 and 2013 Tong made $38,000 in conduit contributions to the initial and reelection campaigns of a candidate who was running for the U.S. House of Representatives.  Tong provided envelopes of cash to his bank manager and another business associate and directed them to give the cash to individuals in the community, who then used Tong’s cash to write checks in their own names to the campaign for the U.S. congressional candidate Tong was supporting.  Tong leveraged financial obligations and the implied loss of business opportunities to induce his bank manager and business associate to distribute cash in the community to be donated.  The network of straw donors included dozens of conduits, including at least one foreign national who was not eligible to make donations to federal elections.  Tong also directed his middlemen to conceal the scheme by instructing the straw donors not to deposit the cash; and he later directed one of the middlemen to withhold information from the FBI after he was interviewed. 

On Aug. 31, 2017, a federal grand jury indicted Tong charging him with two counts of making and causing campaign contributions in the name of another, in violation of 52 U.S.C. §§ 30122 and 30109(d)(1)(D).  The jury found Tong guilty of both counts.

As part of the sentence, Judge Tigar found that Tong obstructed justice when he told his middlemen to not deposit cash given to them. Judge Tigar also sentenced the defendant to a one-year period of supervised release and a $380,000 fine. 

The FBI conducted the investigation.  Trial Attorneys Amanda R. Vaughn and Rebecca G. Ross of the Criminal Division’s Public Integrity Section and Assistant U.S. Attorney S. Waqar Hasib of the Northern District of California prosecuted the case.

DOJ: Michigan Attorney Indicted for Tax Fraud

Allegedly Used His Attorney Trust Account to Conceal Income

A grand jury in Detroit, Michigan, returned an indictment yesterday charging Carl L. Collins III, a Michigan attorney, with tax evasion, filing two false tax returns and seven counts of willfully failing to file individual and corporate tax returns, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney Matthew J. Schneider for the Eastern District of Michigan.

According to the indictment, Collins was a personal injury attorney with offices in Southfield, Michigan.  Collins also allegedly owned two medical companies, MedCity Rehabilitation Services LLC and Alpha Living LLC, as well as a real estate company called First Third LLC.  The indictment charges that Collins filed a tax return for 2012 with the Internal Revenue Service (IRS), which failed to report approximately $550,000 in income.  Collins allegedly deposited most of this unreported income into an attorney trust account, which he failed to disclose to the Michigan State Bar Foundation and his tax return preparer. The indictment further alleges that Collins evaded personal income taxes for 2015 by depositing approximately $580,000 of income into his undisclosed attorney trust account and using much of the money to purchase real estate.  The indictment also charges that, in 2017, Collins filed a false delinquent tax return for 2015. 

The indictment further alleges that Collins willfully failed to timely file tax returns for several years for both himself and his corporations.  Specifically, Collins failed to timely file his individual tax returns for 2013 through 2015, corporate income tax returns for Alpha Living LLC for 2013 through 2015, and corporate income tax returns for MedCity Rehabilitation Services LLC for 2013. 

If convicted, Collins faces a maximum sentence of five years in prison for the tax evasion count, three years for each of the false return counts, and one year for each of the failure to file counts.  He also faces a period of supervised release, restitution, and monetary penalties.

An indictment merely alleges that crimes have been committed, and the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.

Principal Deputy Assistant Attorney General Zuckerman and U.S. Attorney Schneider commended special agents of IRS-Criminal Investigation, who conducted the investigation, and Trial Attorneys Kenneth Vert and Jeffrey McLellan of the Tax Division, who are prosecuting the case.

See, the way the letter is written, it leaves one with the idea that if Jerusalem taxes the lands of the churches, that could be open to interpretation which would include all the lands owned by the these churches, recognized by the Government of Israel, to bear arms, and conduct business, because we are dealing with taxes, which means you can ask what kind of taxes are to be levied, like personal, corporate, tragedy of the commons, inheritance....oh, there are so many different ways to verify stuff in the public record.

West Michigan priest allegedly held teen against his will, wrapped him in plastic

In 2013, a couple of concerned Otsego parents asked their priest, Father Brian Stanley, to counsel their son.

Instead, authorities said, he bound the teenage boy with plastic wrap and held him against his will.

The Attorney General's office said Stanley coerced the boy into following him into the janitor's room, where he immobilized him with plastic wrap and used masking tape to cover his eyes and mouth.

He then left the young man alone for an hour in the janitor's room of their Otsego church, St. Margaret’s parish, officials said.

Now, six years later, Stanley was arrested by special agents from the Attorney General's office, who believes his conduct was an ongoing, sexually motivated crime.

He is being charged with one count of false imprisonment, facing up to 15 years in prison and an obligatory registration as a sex offender. His bail was set at $100,000.

The Diocese of Kalamazoo says it reported multiple allegations regarding Stanley to the authorities, including the one in 2013 and another in 2017.

The diocese says it reached out to Child Protective Services and the Otsego Police Department in 2013, when it learned about the incident involving the young boy, but the police never filed any charges.

It placed Stanley on administrative leave both times.

“We remain steadfast in our commitment to promote greater protection and safeguards of all people, particularly for children and vulnerable adults. We adhere to the National 2002 Charter for the Protection of Young People, which guides all that we do," said the Diocese in a statement to the Free Press.

Attorney General Dana Nessel's office seized files from seven Michigan dioceses, including the Diocese of Kalamazoo, in October 2018.

Officials said it was apparent from records that Stanley had been using plastic wrap and tape in similar behavior for many decades.

“This is about taking on large-scale institutions that turn a blind eye to victims and making certain we hold them accountable – that includes unapologetically pursuing any and all individuals who abuse their power to victimize our residents,” said Nessel.

An attorney for Stanley could not immediately be reached for comment.

Michigan Supreme Court to decide controversy over private school funding

LANSING — The Michigan Supreme Court says it will decide once and for all whether the Michigan Legislature can appropriate public money for private schools.

And in making that determination, the court will consider a 2017 ruling by the U.S. Supreme Court that suggests a state ban on funding for private schools could violate a U.S. constitutional provision intended to protect religious liberty.

At issue is a series of Michigan budget moves in recent years in which the GOP-controlled Legislature has appropriated millions of dollars to reimburse private schools for costs they incur to comply with state mandates, such as health and safety regulations.

In an order released Tuesday, the court said it will hear an appeal of the Michigan Court of Appeals October 2018 ruling. In that decision, the court said the Legislature may reimburse private schools for the costs to comply with state health, safety and welfare laws, but only if such costs are incidental to teaching and don't involve a key school function.

In Tuesday's order, Supreme Court Justice Stephen Markman said the court needs to resolve the longstanding issue once and for all.

"The court owes the parties, and the people of this state, a final decision in this case that fairly considers all inextricably connected issues," Markman wrote.

"The need to fully and finally resolve the present dispute has been made especially critical by the fact that it has now been nearly three years since the Legislature (first approved such funding) and since a lower court of this state issued a preliminary injunction preventing that law from taking effect."

It's important, Markman said, that "our legislative process is no longer maintained in limbo."

Justice Elizabeth Clement will not participate in the decision due to her previous role as legal counsel to former Gov. Rick Snyder, the court said.

In the 2017 case, the U.S. Supreme Court ruled that a Missouri Department of Natural Resources policy of denying grants to applicants owned or controlled by a church violated the First Amendment rights of Trinity Lutheran Church of Columbia to freely exercise its religion. The policy denied the church an otherwise available public benefit on account of its religious status, the court said in a 7-2 ruling.

“Duggar slipped and fell into the pool and drowned,” Morris told PEOPLE on Thursday. “Her daughter Deanna discovered her body and alerted authorities, who pronounced her dead at the scene.”

News of Mary’s passing was first shared by the Duggars on their official Facebook page Sunday afternoon, where the “feisty” and “incredible” County On star was remembered by her famous family in a tribute post.

“We are so sad to share that Grandma Duggar (Mary) passed away Sunday afternoon, June 9th, 2019. Mary Lester Duggar grew up in Farmington, Arkansas and was married almost 50 years to J.L. (Jimmy Lee) Duggar who preceded her in death,” the post began.

“Mary found great joy in sharing her love for Jesus and her own story of how at age 15 she asked Christ to forgive her for her sins. It was at that time she committed the rest of her life to live for Him, a commitment she kept with devotion.”

The tribute continued on to highlight Grandma Duggar’s life successes, such as her work as a prime real estate broker and her most important role of all — being “Grandma” to her 21 grandchildren and 13 great-grandchildren.
