DOJ: Former CIA Officer Arrested and Charged with Espionage

Non Disclosure Agreements...

I like the bearing false witness direction.

#maytheheavensfall

Alexander Yuk Ching Ma, 67, a former Central Intelligence Agency (CIA) officer, was arrested on Aug. 14, 2020, on a charge that he conspired with a relative of his who also was a former CIA officer to communicate classified information up to the Top Secret level to intelligence officials of the People’s Republic of China (PRC).  The Criminal Complaint containing the charge was unsealed this morning.
Assistant Attorney General for National Security John C. Demers, U.S. Attorney for the District of Hawaii Kenji M. Price, Assistant Director of the FBI’s Counterintelligence Division Alan E. Kohler Jr., and Special Agent in Charge of the FBI’s Honolulu Field Office Eli S. Miranda made the announcement.
“The trail of Chinese espionage is long and, sadly, strewn with former American intelligence officers who betrayed their colleagues, their country and its liberal democratic values to support an authoritarian communist regime,” said Assistant Attorney General for National Security John C. Demers.  “This betrayal is never worth it.  Whether immediately, or many years after they thought they got away with it, we will find these traitors and we will bring them to justice.  To the Chinese intelligence services, these individuals are expendable.  To us, they are sad but urgent reminders of the need to stay vigilant.”
“The charges announced today are a sobering reminder to our communities in Hawaii of the constant threat posed by those who seek to jeopardize our nation’s security through acts of espionage,” said U.S. Attorney Price. “Of particular concern are the criminal acts of those who served in our nation’s intelligence community, but then choose to betray their former colleagues and the nation-at large by divulging classified national defense information to China. My office will continue to tenaciously pursue espionage cases.”
“This serious act of espionage is another example in a long string of illicit activities that thePeople's Republic of China is conducting within and against the United States,” said Alan E. Kohler Jr., Assistant Director of the FBI's Counterintelligence Division.  “This case demonstrates that no matter the length or difficulty of the investigation, the men and women of the FBI will work tirelessly to protect our national security from the threat posed by Chinese intelligence services.  Let it be known that anyone who violates a position of trust to betray the United States will face justice, no matter how many years it takes to bring their crimes to light.”
“These cases are very complicated and take years if not decades to bring to a conclusion,” said Eli Miranda, Special Agent in Charge of the FBI's Honolulu Division.  “I could not be more proud of the work done by the men and women of the FBI's Honolulu Division in pursuing this case. Their dedication is a reminder that the FBI will never waiver when it comes to ensuring the safety and security of our nation.”
Ma is a naturalized U.S. citizen born in Hong Kong. According to court documents, Ma began working for the CIA in 1982, maintained a Top Secret clearance, and signed numerous non-disclosure agreements in which he acknowledged his responsibility and ongoing duty to protect U.S. government secrets during his tenure at CIA.  Ma left the CIA in 1989 and lived and worked in Shanghai, China before arriving in Hawaii in 2001.
According to court documents, Ma and his relative (identified as co-conspirator #1) conspired with each other and multiple PRC intelligence officials to communicate classified national defense information over the course of a decade.  The scheme began with three days of meetings in Hong Kong in March 2001 during which the two former CIA officers provided information to the foreign intelligence service about the CIA’s personnel, operations, and methods of concealing communications.  Part of the meeting was captured on videotape, including a portion where Ma can be seen receiving and counting $50,000 in cash for the secrets they provided.
The court documents further allege that after Ma moved to Hawaii, he sought employment with the FBI in order to once again gain access to classified U.S. government information which he could in turn provide to his PRC handlers. In 2004, the FBI’s Honolulu Field Office hired Ma as a contract linguist tasked with reviewing and translating Chinese language documents.  Over the following six years, Ma regularly copied, photographed and stole documents that displayed U.S. classification markings such as “SECRET.”  Ma took some of the stolen documents and images with him on his frequent trips to China with the intent to provide them to his handlers.  Ma often returned from China with thousands of dollars in cash and expensive gifts, such as a new set of golf clubs.
According to court documents, in spring 2019, over the course of two in-person meetings, Ma confirmed his espionage activities to an FBI undercover employee Ma believed was a representative of the PRC intelligence service, and accepted $2,000 in cash from the FBI undercover as “small token” of appreciation for Ma’s assistance to China.  Ma also offered to once again work for the PRC intelligence service.  On August 12, 2020, during a meeting with an FBI undercover employee before arrest, Ma again accepted money for his past espionage activities, expressed his willingness to continue to help the Chinese government, and stated that he wanted “the motherland” to succeed.
Ma will make his initial appearance before a federal judge tomorrow in the U.S. District Court for the District of Hawaii.  He is charged with conspiracy to communicate national defense information to aid a foreign government and faces a maximum penalty of life imprisonment if convicted.  The maximum sentence is prescribed by Congress and is provided here for informational purposes.  In the event Ma is convicted, a federal district court judge will determine any sentence after taking into account the advisory Sentencing Guidelines and other statutory factors.
The investigation was conducted by the FBI’s Honolulu and Los Angeles Field Offices. Assistant U.S. Attorney Ken Sorenson and Trial Attorneys Scott Claffee and Steve Marzen of the National Security Division’s Counterintelligence and Export Control Section are prosecuting the case.

The Tale Of The New Crown: Emergency Manager Emperor Pence, Michigan Governor Whitmer & Their Magical Procurement Task Forces

What about money?

Do you know where that dollar bill has been?

What about the looming Detroit Water shutoffs?

What about the children, who seem to be "carriers".

Does CPS come in with their latest and greatest pitches for programs?

Where's the data?

What about my two cents?

This is about Parental Rights because this is about the entire concept of the Emergency Manager.

This is what they did to Detroit and Flint, and many more places in Michigan, where the Emergency Manager all began.

Whitmer creates 4 task forces to combat spread of coronavirus in Michigan

(FOX 2) - Gov. Gretchen Whitmer has created multiple task forces to help fight the potential spread of the coronavirus COVID-19 in Michigan.

Right now there are no confirmed coronavirus cases in Michigan, but cases are starting to spread in the United States and multiple people have already died.

Gov. Whitmer's four task forces include one on state operations, one on health and human services, one on education, and the final on the economy and workforce. The task forces will include key state government agencies, who will work closely with the appropriate community and non-governmental stakeholders.

The task force on state operations will cover all aspects of state operations, including employment and facilities.

The task force on health and human services will cover the provision of medical and human services, including protecting the healthcare workforce.

The task force on education will cover K-12 public schools and universities and colleges.

And the task force on economy and workforce will cover general economic impact, workforce, supply chain, business continuity, and related issues.

“While there have been no confirmed cases in Michigan yet, we must recognize that this virus has the potential to impact nearly every aspect of our lives,” said Governor Whitmer. “From our public schools, colleges, and universities to our businesses and hospitals, we must harness all of the resources we have to ensure we can prevent the spread of coronavirus and keep Michiganders safe. This is a strong, smart team that will make protecting our public health their number one priority and work closely with me to protect the people of our state.”

RELATED: Don't panic, but be prepared: Coronavirus 101 for Michiganders

On Friday, February 28, Whitmer activated the State Emergency Operations Center to maximize coordination with state, local and federal agencies, as well as private partners, and to help prevent the spread of the disease. Since then, the administration has been working with schools, businesses, medical providers, and local health departments to make sure they have the information they need to prepare for potential cases.

COVID-19 has been identified as the cause of an outbreak of respiratory illness first detected in Wuhan City in the Hubei Province of China. As of March 3, there were over 91,313 cases globally with over 3,000 deaths.

Person-to-person spread of the virus has occurred in the U.S., with some of those occurring in people with no travel history and no known source of exposure.

For the general American public, who are unlikely to be exposed to this virus at this time, the immediate health risk from COVID-19 is considered low. People in communities where ongoing community spread with the virus that causes COVID-19 has been reported are at elevated though still relatively low risk of exposure.

Patients with confirmed infection have reportedly had mild to severe respiratory illness with symptoms of fever, cough and shortness of breath.

The best prevention for viruses, such as influenza, the common cold or COVID-19 is to wash your hands often with soap and water for 20 seconds. If not available, use hand sanitizer.

Also avoid touching your eyes, nose or mouth with unwashed hands.

Cover your mouth and nose with a tissue or upper sleeve when coughing or sneezing.

Avoid contact with people who are sick - and if you are sick, stay home and avoid contact with others.

Information around this outbreak is changing rapidly. The latest information is available at Michigan.gov/Coronavirus and CDC.gov/Coronavirus.

DEFANGO: Devin Nunes granted discovery McClatchy bankruptcy #russiagate Hoax exploded

The McClatchy Company, a news media company that is being sued for defamation by House Intelligence Committee Ranking Member Devin Nunes (R-CA), moved to dismiss the lawsuit in court on Wednesday, but the judge in the case rejected the request — an interim win for Nunes. In a letter obtained by Fox News, Reps. Devin Nunes, R-Calif., and Chris Stewart, R-Utah, the ranking members of the committee and subcommittee, respectively, joined GOP colleagues in blasting Schiff, D-Calif., for not holding hearings on FISA in the wake of the IG report. “Under your chairmanship, the House Intelligence Committee has strayed far from its mandate of overseeing the Intelligence Community. In fact, we have gone months at a time in which we’ve hardly held any oversight-related briefings or hearings at all,” they wrote Wednesday.

U.S. House Intelligence Committee Trump - Ukraine Impeachment Inquiry Report

"This is very poorly written." declared the Celestial Goddess of the Woodshed.
The Trump-Ukraine Impeachment Inquiry Report
The impeachment inquiry into Donald J. Trump, the 45th President of the United States, uncovered a months-long effort by President Trump to use the powers of his office to solicit foreign interference on his behalf in the 2020 election.  As described in this executive summary and the report that follows, President Trump’s scheme subverted U.S. foreign policy toward Ukraine and undermined our national security in favor of two politically motivated investigations that would help his presidential reelection campaign.  The President demanded that the newly-elected Ukrainian president, Volodymyr Zelensky, publicly announce investigations into a political rival that he apparently feared the most, former Vice President Joe Biden, and into a discredited theory that it was Ukraine, not Russia, that interfered in the 2016 presidential election.  To compel the Ukrainian President to do his political bidding, President Trump conditioned two official acts on the public announcement of the investigations:  a coveted White House visit and critical U.S. military assistance Ukraine needed to fight its Russian adversary.

During a July 25, 2019, call between President Trump and President Zelensky, President Zelensky expressed gratitude for U.S. military assistance.  President Trump immediately responded by asking President Zelensky to “do us a favor though” and openly pressed for Ukraine to investigate former Vice President Biden and the 2016 conspiracy theory.  In turn, President Zelensky assured President Trump that he would pursue the investigation and reiterated his interest in the White House meeting.  Although President Trump’s scheme intentionally bypassed many career personnel, it was undertaken with the knowledge and approval of senior Administration officials, including the President’s Acting Chief of Staff Mick Mulvaney, Secretary of State Mike Pompeo, and Secretary of Energy Rick Perry.  In fact, at a press conference weeks after public revelations about the scheme, Mr. Mulvaney publicly acknowledged that the President directly tied the hold on military aid to his desire to get Ukraine to conduct a political investigation, telling Americans to “get over it.”

President Trump and his senior officials may see nothing wrong with using the power of the Office of the President to pressure a foreign country to help the President’s reelection campaign.  Indeed, President Trump continues to encourage Ukraine and other foreign countries to engage in the same kind of election interference today.  However, the Founding Fathers prescribed a remedy for a chief executive who places his personal interests above those of the country:  impeachment.  Accordingly, as part of the House of Representatives’ impeachment inquiry, the Permanent Select Committee on Intelligence, in coordination with the Committees on Oversight and Reform and Foreign Affairs, were compelled to undertake a serious, sober, and expeditious investigation into whether the President’s misconduct warrants that remedy.

In response, President Trump engaged in an unprecedented campaign of obstruction of this impeachment inquiry.  Nevertheless, due in large measure to patriotic and courageous public servants who provided the Committees with direct evidence of the President’s actions, the Committees uncovered significant misconduct on the part of the President of the United States.  As required under House Resolution 660, the Intelligence Committee, in consultation with the Committees on Oversight and Reform and Foreign Affairs, has prepared this report to detail the evidence uncovered to date, which will now be transmitted to the Judiciary Committee for its consideration.

Bibi Indicted - Let the 911 Tales Be Told

Bibi has many demons in his cache of tales to tell the world.

Israeli PM Netanyahu indicted on charges of bribery, fraud and breach of trust

Image: Israeli Prime Minister Benjamin Netanyahu
Netanyahu has previously denied any wrongdoing and has said he is the victim of a politically orchestrated "witch-hunt" by the media and the left.

Israel’s Attorney General Avichai Mandelblit announced Thursday that he was indicting Prime Minister Benjamin Netanyahu on charges of bribery, and fraud and breach of trust.

Netanyahu has previously denied any wrongdoing and has said he is the victim of a politically orchestrated "witch-hunt" by the media and the left.

It comes while Netanyahu is serving as Israel's caretaker prime minister after he failed to cobble together a government last month.

Netanyahu had hoped to pass legislation that would prevent him from being indicted but has been unable to do so because he failed to form Israel’s next government following the Sept. 17 election.

The caretaker prime minister still has the option to ask the Israeli Parliament for immunity. But this request would need to be approved by a special committee that has not been established due to ongoing political deadlock.

The Ukraine story has been playing out for a lot longer than you might think
Netanyahu’s chief political rival Benny Gantz announced Wednesday that he had also failed to form a government, prolonging the country’s political uncertainty and raising the prospect of Israel holding its third national election in a year.

There are now 21 days in which any member of Parliament can become prime minister if they muster the 61 signatures needed to achieve a majority in the Knesset. If that does not happen Israel will return to the polls.

In which case, Netanyahu’s indictment potentially poses a new legal problem.

If he wins the next election, it will be the first time a candidate for government is under indictment, raising the question as to whether President Reuven Rivlin can give Netanyahu the mandate to form the next government.

Omar Awan Has Been Found In A Burnt Out Tesla

Here is Omar Awan.

If this is the same one in congress, this is going to be interesting, but hey, what do I know?

I know someone should ask Imran Awan.

Dad died in burning Tesla because its futuristic doors wouldn’t open, lawsuit claims

Slender Man victim breaks silence for the first time

Incredible moment cops revive toddler choking on a cracker
Cops use genealogy website to find man who raped and strangled girl
A Tesla driver burned to death after a crash because the “futuristic handles” on his car trapped him inside and rescuers couldn’t open the doors, it is claimed.

Dr. Omar Awan, 48, lost control of his car, skidded across a road and smashed straight into a palm tree in Fort Lauderdale, Florida, in February.

Smoke and then flames engulfed his blue Model S Tesla shortly after the crash.

A police officer arrived almost immediately, and crowds gathered outside the vehicle, but no one was able to save the father of five because of the “inaccessible door handles,” a lawsuit claims.

The car’s retractable door handles are meant to “auto-present” or pop out when they detect a key fob nearby.

But it malfunctioned, stopping first responders from opening the doors and saving Awan, it is claimed.

His loved ones are now suing the electric car company for wrongful death, alleging the car’s lithium-ion battery caught fire.

The smoke from this suffocated Awan and burned him from his feet upwards, it claimed.

The complaint said the car burned for hours, reigniting several times even after firefighters extinguished the flames and also when it was being towed away.

The lawsuit added: “After the Tesla hit the tree, he was alive. He had no internal injuries or broken bones.

Enlarge ImageDr. Omar Awan
Dr. Omar Awan
“He died from the smoke he inhaled as he sat locked inside the Tesla, despite that a police officer and others were there and ready to help, until flames forced them away.

“The fire engulfed the car and burned Dr. Awan beyond recognition — all because the Model S has inaccessible door handles, no other way to open the doors, and an unreasonably dangerous fire risk.”

The Sun has contacted Tesla for a statement.

The company’s lawyers have not yet responded in court.

Tesla, the maker of electric vehicles, claimed the Model S once achieved the “best safety rating of any car tested.”

Awan’s family lawyer Stuart Grossman described the victim as environmentally sensitive and safety conscious.

He insisted Awan could afford a Mercedes or another luxury vehicle but went with the 2016 Tesla because of its safety.

He added: “These things, they just love to burn. The car is so over-engineered.

“It’s so techy, it makes you want to buy a Chevy pickup truck.”

After the incident, Tesla said in a statement: “We understand that speed is being investigated as a factor in this crash, and know that high-speed collisions can result in a fire in any type of car, not just electric vehicles.”

His family is seeking more than $15,000 in damages.

The emergency guide says: “If the door handles do not function, open the door manually by reaching inside the window and using the interior door handle.”

It is not the first time Tesla has been blamed for a death.

In May 2018, Barrett Riley and his friend Edgar Monserratt, both 18, died when they lost control of Riley’s dad’s car at 116 mph.

Dad James Riley claimed Tesla is at fault for the speed, fire and the teens’ deaths.

JUDICIARY: CHAIRMAN NADLER STATEMENT FOR THE HEARING ON SECURING AMERICA’S ELECTIONS PART II: OVERSIGHT OF GOVERNMENT AGENCIES - October 22, 2019

Washington, D.C. – Today, House Judiciary Committee Chairman Jerrold Nadler (D-NY) issued the following statement for the hearing on “Securing America’s Elections Part II: Oversight of Government Agencies.”

“In 2016, our elections were attacked.  Three years later, our intelligence community has universally confirmed that foreign actors have redoubled their efforts and are preparing, as we speak, to attack our 2020 elections.

“We know the threat picture.  But three years since the 2016 attacks, we have not done enough to combat these threats.

“We know—through our agencies and our independent experts—what must be done.  Our agencies and experts have set forth concrete recommendations.  It is now our responsibility to make sure those recommendations get implemented – to ensure that all levels of our government are taking the steps needed to safeguard our democratic processes.

“But despite the severity of the threat, and the universal consensus that more government aid is required, the President and his Administration have blocked security efforts and have consistently cut programs designed to safeguard our elections.

“For example, according to multiple senior officials, including the former Secretary of Homeland Security, President Trump’s chief of staff issued instructions not to mention election security ‘in front of the President.’

“Another senior Homeland Security official reported that despite his Department’s conclusion that the U.S. needs to ‘significantly step up its efforts’ to block foreign influence campaigns, his Department was ‘stymied by the White House’s refusal to discuss it.’

“Moreover, on January 3, 2018, the White House disbanded the Commission on Election Integrity.  Shortly thereafter, the White House eliminated the cybersecurity coordinator position on the National Security Council.  In February 2019, Homeland Security officials revealed that the Executive Branch dramatically downsized two teams fighting foreign election interference.  And the President’s 2020 budget proposed cutting funding for the Cybersecurity and Infrastructure Security Agency—our main election security agency—even further.

“Our enemies are agile, persistent, and constantly intensifying their methods of attack.  I am extremely troubled that the Administration’s policies will handicap our agencies in their efforts to secure our elections.  We must listen to our agencies when they ask for more resources, and strengthen our efforts to match the evolving threat – not, as the Administration has done, cut resources where they are most needed.

“But what is most disturbing is that the latest threat to the integrity of our elections has come from the President himself.

“We now have concrete evidence that the President has directly solicited foreign leaders to interfere in our elections.  President Trump said to President Zelensky of Ukraine:  ‘I would like you to do us a favor though because our country has been through a lot and Ukraine knows a lot about it.  . . .  I would like to have the Attorney General call you or your people and I would like you to get to the bottom of it. . . . There’s a lot of talk about Biden’s son, . . . so whatever you can do with the Attorney General that would be great.’

“The President of our country reached out to a foreign leader and asked him point blank to meddle in our elections.  And he did not stop there.  Earlier this month, the President publicly stated that, ‘China should start an investigation into the Bidens.’

“The President has defended these actions, which should no longer come as a surprise.  During the 2016 elections, then-candidate Trump publicly asked Russia to hack into his opponent’s e-mails: ‘Russia, if you’re listening, I hope you’re able to find the 30,000 emails that are missing,’ he publicly stated on television.  As candidate for President, Trump encouraged a foreign adversary to illegally hack into his opponent’s emails and release sensitive information.  And in June of this summer, the President told an ABC reporter that he would do it again—when asked what he would do if a foreign government offered him information on his opponent in the next election, President Trump said without hesitation: ‘I think I’d take it.’

“The President’s actions are unacceptable.  If we ask other governments to interfere in our elections, if we undermine the public’s confidence in the integrity of our voting processes, we are doing our adversaries’ work for them.

“We cannot continue to undermine our own democratic values on the world’s stage.  Regardless of the President’s actions and statements, we must work together to secure our democratic processes.  Election Security cannot be a partisan issue – it must be an American issue.

“Even with all of our efforts, our systems will be targeted—they may even be breached.  It is how we respond that will define us.  And I am confident that working together, we will be up to the task of defending our voting systems.

“I thank this Committee, including Ranking Member Collins, for joining me in this task.  I thank the witnesses from our federal agencies for appearing here today, for your ongoing work to protect our elections, and for your continued willingness to improve your efforts.   I look forward to hearing your testimony, and to finding ways to work together to ensure that each and every American feels confident in the accuracy and integrity of his or her vote.”

JUDICIARY: CHAIRMAN NADLER STATEMENT AT SUBCOMMITTEE HEARING ON “ONLINE PLATFORMS AND MARKET POWER, PART III: THE ROLE OF DATA AND PRIVACY IN COMPETITION” - October 18, 2019

Washington, D.C. – Today, House Judiciary Committee Chairman Jerrold Nadler (D-NY) delivered the following opening remarks during a Subcommittee on Antitrust, Commercial and Administrative Law hearing on “Online Platforms and Market Power. Part III: The Role of Data and Privacy in Competition.”

"Digital technologies have provided Americans with a remarkable array of services. It has never been easier to share news and information, to publish content, and to communicate with loved ones, all at a moment’s notice.

"But, as with technological revolutions of the past, this transformation has upended the balance of power across our economy. It is important for Congress to study and understand how these imbalances are affecting Americans, what is causing these asymmetries of power, and whether these new and growing inequalities are compatible with our democratic values. The Committee’s ongoing oversight of competition in digital markets is a key part of this process.

"Today’s hearing will examine the role that data plays in creating and maintaining inequalities of power and how this affects competition. As previous hearings have shown, a growing share of commerce and communications is now controlled by a small number of companies. Because these platforms are, in essence, large intermediaries, they are perfectly positioned to closely track each transaction and communication that passes through their channels.

"While intermediaries have long-collected information on the economic activity that flows through their platforms, the large firms of the digital economy have unprecedented ability to track and surveil users across the Internet. This data collection includes information not only about a person’s shopping and reading habits, but also about the time that they wake up and go to sleep, their precise location at each hour of the day, and the content of their most private communications.

"Because several of these platforms derive the vast majority of their revenue through digital advertising, these firms also have an incentive to collect as much information as possible so that they can target consumers with precision. This trove of personal information can also be used by companies in even more nefarious ways to discriminate based on a user’s race, gender, or income, or otherwise to intrude on personal privacy.

"In light of these trends, there are at least two questions that I hope will be addressed in today’s hearing. First, how are digital technologies—and the constant data-collection they enable—affecting competition? Is there something unique about digital markets that enables firms to acquire and maintain market power in novel ways?

"In digital markets, maximizing data collection can provide a company with a significant competitive advantage. A large and constantly growing set of user data allows firms both to improve existing products and services and to expand into new lines of business, often with a competitive edge.

"Frequently, the most dominant companies in the digital economy are those that have captured the most data from as many sources as possible. In recent years, scholars have described this dynamic as leading to ‘winner-take-all’ markets, where the first company to establish a competitive lead wins the market, crushing any potential competition.

"In other words, competitors in digital markets have a strong incentive to collect as much information on users as possible—as quickly as possible—as part of a long-term strategy to compete in the marketplace and to achieve market dominance.

"This raises serious questions about whether it is good for society for unrelenting data collection to be the key dimension on which companies are looking to out-compete one another. The fact that several major digital platforms make most of their profits by selling targeted advertisements heightens these incentives.

"The second question that I hope will be addressed in today’s hearing is how data collection increases the number of ways that dominant companies can abuse their market power. Does the collection and use of data enable new forms of conduct that lawmakers and regulators should recognize as anti-competitive? For example, platforms that serve as intermediaries for commerce have critical insight into their rivals’ business models, a dynamic that raises significant competition concerns.

"With these issues in mind, I look forward to hearing from our esteemed panel of witnesses today, and I yield back the balance of my time."

I really do not understand what the big fuss is all about because they do it all the time in child protective services proceedings.

You are guilty, until proven innocent, where you are not allowed to confront your accuser.

And now, they eat each other alive, for they have no idea of what is to come...for them.

#ukrainegate - Kurt Volker, Rudy Giulian, China, Text Messages & The Impeachment 2020 Re-election Campaign

Kurt Volker, the former special envoy to Ukraine, gives House Democrats the first deposition in their impeachment inquiry.

Even as President Donald Trump ignited a huge controversy over China and the 2020 election on Thursday, House members were clashing over the closed-door testimony of the former special envoy to Ukraine and Trump’s alleged efforts to pressure officials in that country for dirt on Joe Biden and his son.

The former envoy, Kurt Volker, who is at the center of a scandal that may lead to Trump’s impeachment, spent more than eight hours on Thursday being deposed by lawmakers and aides from three House committees. The committees are looking into allegations that include whether Trump and his personal lawyer Rudy Giuliani improperly pressured Ukrainian officials to launch an investigation into Biden while withholding U.S. military aid.

Speaker Nancy Pelosi launched an impeachment inquiry last week following the revelation that Trump urged his Ukrainian counterpart, President Volodymyr Zelensky, to investigate Biden during a phone call on July 25.

“This week, current and former State Department officials have begun cooperating with the impeachment inquiry by producing documents and scheduling interviews and depositions," said Reps. Adam Schiff (D-Ca.), Eliot Engel (D-N.Y.), and Elijah Cummings (D-Md.), the chairmen of the Intelligence, Foreign Affairs and Oversight and Reform committees in a joint statement Thursday night. "Based on the first production of materials, it has become immediately apparent why Secretary Pompeo tried to block these officials from providing information.”

Volker provided Democrats with 60 pages of text messages and other documents that showed some senior State Department officials were outraged that the Trump administration would try to make aid to Ukraine contingent on efforts to help the president’s reelection campaign.

One text between Volker and Andrey Yermak, a top Zelensky adviser, on July 25 — the day of the Trump-Zelenksy call — linked a Zelensky visit to the Washington to whether the Ukrainians moved ahead with the Biden probe. Volker said "Heard from the White House. Assuming President Z convinces [T]rump he will investigate/ 'get to the bottom of what happened in 2016, we will nail down date for visit to Washington."

And in another more controversial text, a senior American diplomat expressed outrage to any linkage between U.S. aid to whether the Ukrainians took the steps Trump and Giuliani wanted.

“I think it’s crazy to withhold security assistance for help with a political campaign,” said Bill Taylor, the chargé d’affaires at the U.S. Embassy in Ukraine’s capital, Kiev, in a Sept. 9 text message.

But Gordon Sondland, U.S. ambassador to the European Union, strongly denied in a response to Taylor that this was Trump’s purpose.

“Bill, I believe you are incorrect about President Trump’s intentions,” Sondland wrote. “The President has been crystal clear: no quid pro quo’s of any kind. The President is trying to evaluate whether Ukraine is truly going to adopt the transparency and reforms that President Zelensky promised during his campaign.”

Republicans insisted that Volker testified that Trump never sought a “quid pro quo” from Zelensky, despite the new documents and Democrats’ repeated questions on the topic.

“What we do know is there was definitely not quid-pro-quo,” Rep. Mark Meadows (R-N.C.), a member of the House Oversight and Reform panel, told reporters after leaving the Volker deposition. “Any comments that would indicate that there was some nefarious purpose on behalf of this president was not backed up by the facts today.”

“If there was an Academy Award for leading the witness, my Democratic colleagues would have gotten three Oscars today,” Meadows added.

Rep. Lee Zeldin (R-N.Y.), without offering specifics, said Volker’s testimony “blew a massive hole” through allegations that Trump sought a quid pro quo from the Ukrainian leader leader.

But Sondland and Volker — under pressure from Giuliani — were also asked to draft a statement saying Ukrainian officials were committed to beginning investigations into Biden and other Trump rivals. Volker testified about that episode to congressional investigators on Thursday, according to several people involved in the hearing. The New York Times first reported the intent to draft the statement.

One source said Volker testified that he wanted a broader statement on the Ukrainians fighting corruption. Giuliani, though, pushed for a statement more narrowly focused on Burisma — the Ukrainian energy firm on whose board Hunter Biden sat — and a possible Ukrainian role in the 2016 U.S. election, a near obsession with Trump. No statement was ever drafted, Volker said.

Volker also told investigators that he warned Giuliani that he was being fed some incorrect information on the Bidens from Ukrainian contacts, particularly Yuriy Lutsenko, the country’s former top prosecutor.

“The ambassador’s view of Ukrainian corruption and Rudy Giuliani’s view of corruption are at odds with one another,” Meadows acknowledged. “I think the ambassador had a much more forward-looking position on what he believes the new Ukrainian government will do, and I think that’s at odds with what Rudy Giuliani believes.”

Giuliani’s role in the Ukrainian scandal was the focus of a “significant portion” of Thursday’s session, according to sources familiar with the hearing, and Democrats accused the former New York mayor and ex-federal prosecutor of being involved in a “shakedown” of the Ukrainiains on Trump’s behalf.

“We saw further evidence that there was a shadow shakedown, and I would say, the lead deputy for the president was Rudy Giuliani,” said Rep. Eric Swalwell (D-Calif.), a member of the House Intelligence Committee. “You had an experienced diplomat, working for free as a special envoy, who in many ways was a front for the work being done on the side, parallel to his efforts, by Rudy Giuliani.”

According to Swalwell, there is “more and more evidence that the president of the United States was improperly using his office, using our taxpayer dollars, to leverage help from an ally in our upcoming 2020 elections.”

Volker is mentioned in a whistleblower complaint that fueled the impeachment inquiry. The complaint notes that Zelensky met with Volker the day after his phone call with Trump, and says the envoy tried to help Ukrainian officials figure out how to “navigate” Trump’s demands.

Giuliani and associate give conflicting accounts on origins of Ukraine caper
The Trump administration held up nearly $400 million in foreign aid approved by Congress as Trump and Giuliani lobbied to announced a probe into the Bidens. Trump and Giuliani alleged that Joe Biden, who was vice president at the time, intervened to block an investigation into Burisma in 2016. There is no evidence that an investigation was underway at the time or that Biden intervened to protect his son’s firm.

Giuliani has also pulled Volker into the episode, insisting that he met with Zelensky’s aides at the request of State Department officials — including Volker — and that he briefed the department about his discussions afterward.

On Thursday morning, Giuliani tweeted out screenshots of texts between him and Volker in which the envoy appeared to be arranging meeting times for Giuliani and a Ukrainian official.

The former New York mayor also railed against Democratic lawmakers pursuing impeachment, though he offered a kind word for Volker.

“Crooked Dems not letting Republicans subpoena witnesses and maybe even question witness,” Giuliani claimed in a tweet. “This is a Star Chamber, illicit and part of their conspiracy to violate constitutional rights condoned by their media lamb dogs. Kurt did nothing wrong.”

Volker has said little publicly about the unfolding drama. But the State Department has defended him in the past, saying that a Ukrainian official had asked Volker to connect him with Giuliani, which he did. Volker is a former career Foreign Service officer and ambassador to NATO who is respected among Democrats and Republicans in Washington.

Many foreign policy hands welcomed Volker’s appointment as envoy in 2017 because of his hawkish views on Russia.

Volker held the envoy position on an unpaid, part-time basis. He also works as an adviser to a lobbying firm and as executive director of a Washington think tank named for the late Sen. John McCain of Arizona.

The implication is that aides to Zelensky — a former comedian who won Ukraine’s presidency in April — were trying to establish a link to Giuliani, given his close relationship with Trump.

It’s likely Giuliani got the new Ukrainian government’s attention in part because he spent much of this past spring talking about Ukraine and alleged wrongdoings by the Bidens.
