Mueller deputy Weissmann criticizes DOJ for bringing case against ex-FBI lawyer

Weissmann weighed in following reports Friday that Clinesmith intends to plead guilty to falsifying a document that was part of the FBI's justification for wiretapping former Trump campaign adviser Carter Page as part of the 2016 investigation into Russian election interference.

"Question for [U.S. Attorney General William Barr]: how are [former national security adviser Michael Flynn's] confessed lies to the FBI (repeated to the VP) not a crime, but Clinesmith changing an email (the full version of which he also sent to DOJ) is?" Weissmann tweeted, referencing the Justice Department's controversial move to withdraw its case against Flynn, who had already pleaded guilty to lying to the FBI.

Weissmann later asserted that there were "two systems of justice at play."

The charge against Clinesmith marks the first criminal case arising from the probe led by U.S. Attorney John Durham. The Justice Department alleges that the former FBI attorney altered an email to say that Page was not a source for the CIA, even though Page had had a relationship with the agency.

Clinesmith’s lawyers on Friday said this was unintentional.

“Kevin deeply regrets having altered the email. It was never his intent to mislead the court or his colleagues as he believed the information he relayed was accurate. But Kevin understands what he did was wrong and accepts responsibility,” his lawyers told The Washington Post.

The DOJ's probe into Clinesmith came at Barr's behest after a report from Justice Department Inspector General Michael Horowitz found “significant inaccuracies and omissions” in the FBI’s application to a court to obtain permission to monitor Page.

What to Know About Donald Trump's Brother Robert

Robert Trump is Donald Trump's youngest brother. In mid-August 2020, the White House confirmed that Robert has been hospitalized in Manhattan. The President then visited his brother who is said to be very sick.

While he has not been in the media spotlight as much as his older sibling, he is back in the news this summer, as his niece Mary Trump is publishing a tell-all about her family called: Too Much and Never Enough: How My Family Created the World's Most Dangerous Man.

Her publisher, Simon & Schuster, describes the text as a “revelatory, authoritative portrait of Donald J. Trump and the toxic family that made him.”

Robert requested a temporary restraining order in an attempt to stop the book from being published. In a statement to the New York Times, he said he was "deeply disappointed" in his niece's decision to publish the book. “Her attempt to sensationalize and mischaracterize our family relationship after all of these years for her own financial gain is both a travesty and injustice to the memory of my late brother, Fred, and our beloved parents,” he said. “I and the rest of my entire family are so proud of my wonderful brother, the president, and feel that Mary’s actions are truly a disgrace.”

Original 11/02/2016: Judging by his media footprint, Robert Trump cuts a markedly lower profile than his brother Donald. In the Trump family, that may not be saying much.

Anyone who paid attention to New York society in the '80s and '90s will recognize Robert's name. He is the youngest Trump sibling, born two years after his brother Donald. (There are five member of that generation: the oldest is Maryanne Trump Barry, a federal judge; next comes Frederick Trump Jr., who died in 1981 at the age of 43; Donald is in the middle, then Elizabeth Trump Grau, a retired bank executive; and finally Robert.)

Like Donald, Robert joined the family business and was a top executive with the company. Unlike his brother, he doesn't court publicity; ostentation, by most accounts, doesn't excite him. He may have learned to hold back the hard way in the mid-aughts, when his high-profile divorce from socialite Blaine Trump, his wife of about 25 years, was tabloid fodder. There was a mistress, a house Robert bought her on Long Island, and no prenup—a perfect recipe for the gossip pages.

Since then, Robert has pretty much vanished from public view. He is "gainfully retired," as he described himself to Page Six, and lives in Millbrook, New York, in the Hudson Valley, where he leads a relatively parochial but presumably lavish life with his now-not-so-secret partner and former secretary, Ann Marie Pallan, whose family owned and operated Gurney's, the famed Montauk resort and spa, for decades. (Robert did not respond to voicemail requests asking for an interview.)

According to town residents, Robert maintains a reserved but affable presence in Millbrook and its environs, using his financial largesse to support a number of local causes and small businesses. Now in his late 60s, Robert is a trustee of Angels of Light, a holiday giving nonprofit, and he's donated quite heavily to a horse rescue operation in the area, among other things.

"He's not flamboyant," says one local who has met Robert a few times and asked to remain anonymous, describing him as a classy and dignified guy. "He couldn't be more different than his brother, quite frankly," the local adds. "I don't even know how they're in the same family."

There is little doubt, however, that Robert is rooting for his brother's presidential bid—in a rare interview earlier this year, he told Page Six, "I support Donald one thousand percent." He also favors Donald's supporters, like Republican Andrew Heaney, who hitched his congressional primary campaign to the Trump wagon and failed miserably in New York's 19th district, where Robert resides.

From his perch in Millbrook, it appears that Robert does what he can for his brother and other Republican affiliates, hosting events and fundraisers out of Monte's Local Kitchen & Tap Room, Pallan's farm-to-table restaurant in nearby Amenia helmed by Chopped star Dafna Mizrahi (and where it is apparently uncouth to mention Donald's name unbidden, according to the local). The restaurant catered a Trump rally in Poughkeepsie in April.

Robert has a meal named after him on Monte's menu, the "RST All American Burger," an eight-ouncer with cheese, lettuce, aioli, homemade pickles, and truffle fries that goes for $17.50. "The Trump boys love their burgers," Pallan told The Hudson Valley News last year.

In overseeing federal litigation, Solicitor General Francisco made strategic use of emergency motions to defend important federal programs against improper nationwide injunctions.  To that end, the government obtained relief from the Supreme Court on major immigration initiatives, including the travel proclamation, restrictions on asylum abuses, allocation of funds to build a border wall, and revisions to the definition of a public charge.  As a result of these successes, some lower courts have begun to curb the erroneous use of nationwide injunctions.

Rod Rosenstein: DOJ ‘Not to Blame’ for Lisa Page’s Abuse

The former deputy attorney general says he had no choice but to release Page’s texts with FBI agent Peter Strzok.

Former Deputy Attorney General Rod Rosenstein said Monday that ex-FBI lawyer Lisa Page should not blame the Department of Justice for the abuse she has suffered at the hands of Donald Trump and his allies.

Rosenstein’s comments come in response to an exclusive interview with Page by Daily Beast contributor Molly Jong-Fast, in which Page blasted the Justice Department for making public texts between her and agent Peter Strzok.

Page alleged the messages—in which Page and Strzok, who were having an affair, belittled then-candidate Donald Trump—were chosen and released for political impact. Trump went on to publicly ridicule the “lovers” over and over again in the two years since their release.

In a statement to The Daily Beast, Rosenstein said that there was no political motive to the disclosure and that he had no choice but to release the texts, which had been the subject of an Inspector General’s investigation into possible political bias.

“To the best of my knowledge, career Department of Justice officials determined in December 2017 that those text messages were NOT personal,” he wrote. “They were official government records related to FBI business and there was no legal basis to withhold them, so they should be released as requested by Congress.”

Rosenstein said the IG’s office had “no objection” to releasing the messages.

“I consistently defended the right of Department of Justice employees to express political opinions and even make political contributions,” he continued. “However, the Inspector General concluded that the FBI employees ‘demonstrated extremely poor judgment and a gross lack of professionalism’ by exchanging messages that ‘appeared to mix political opinions with discussions about the [Hillary Clinton email] and Russia investigations, raising a question as to whether Strzok’s and Page’s political opinions may have affected investigative decisions.’”

“Ms. Page received more opprobrium than she deserved for her mistakes,” he added. “But the Department of Justice is not to blame.”

In her interview, Page says the release of the text messages destroyed life as she knew it, driving her out of the FBI and making her a Trump rally punchline.

“It’s like being punched in the gut. My heart drops to my stomach when I realize he has tweeted about me again. The president of the United States is calling me names to the entire world. He’s demeaning me and my career. It’s sickening,” she said.

“But it’s also very intimidating because he’s still the president of the United States. And when the president accuses you of treason by name, despite the fact that I know there’s no fathomable way that I have committed any crime at all, let alone treason, he’s still somebody in a position to actually do something about that. To try to further destroy my life. It never goes away or stops, even when he’s not publicly attacking me.”

Her complaints apparently fell on deaf ears at the White House. In an apparent reaction to The Daily Beast story, Trump tweeted about Page on Monday afternoon.

“When Lisa Page, the lover of Peter Strzok, talks about being ‘crushed’, and how innocent she is, ask her to read Peter’s “Insurance Policy” text, to her, just in case Hillary loses,” he wrote. “Also, why were the lovers text messages scrubbed after he left Mueller. Where are they Lisa?”

The text Trump referred to was from Strzok to Page and read: “I want to believe the path you threw out for consideration in Andy’s office—that there’s no way he gets elected—but I’m afraid we can’t take that risk. It’s like an insurance policy in the unlikely event you die before you’re 40…”

While Trump and his allies have claimed this is proof of a “deep-state” conspiracy against him, Page and Strzok have testified that it actually referred to Strzok’s belief the Russia investigation should be on the fast-track and not put on a slow burn because it appeared unlikely, at that point, that Trump would win.

Trump has also alleged that text messages from Page and Strzok were deliberately erased because, he said, they would have discredited Robert Mueller’s Russia investigation. Politifact reported that an outside expert hired by the Justice Department inspector general found technical glitches likely accounted for the missing messages.

Trump’s spy chief pick, Texan John Ratcliffe, accused of fudging role in 'Holy Land' terrorism case

WASHINGTON -- The North Texas Republican picked by President Donald Trump to be America's next intelligence chief is grappling with reports that he embellished his role in a high-profile anti-terrorism case he's cited as proof of his national security bona fides.

At issue is the extent of Heath Rep. John Ratcliffe's involvement as a federal prosecutor in the U.S. vs. Holy Land Foundation case, which ended in 2009 with officials at a Texas-based charity being found guilty of funneling money to the terrorist group known as Hamas.
While Ratcliffe has touted that he "convicted individuals" involved in the scheme, ABC News and NBC News this week cast doubt on that account.

Jim Jacks, one of the Holy Land case's lead prosecutors, also told The Dallas Morning News on Tuesday that Ratcliffe "wasn't part of the trial team or the investigative team." Asked if it was accurate to say that Ratcliffe "convicted individuals" in the case, he said, "No."

In response to those reports, Ratcliffe spokeswoman Rachel Stephens clarified this week that the Texan, while serving as U.S. Attorney for the Eastern District of Texas, was appointed to investigate issues related to the mistrial that occurred in the case's first trial.

"Because that investigation did not result in any criminal charges, it would not be in accordance with Department of Justice policies to make further details public," she said, confirming a written statement provided to ABC News and NBC News.

Jacks, a former U.S. attorney in the Northern District of Texas, confirmed that depiction, explaining that Ratcliffe was "appointed to look into a collateral matter after the first trial" and that the assignment lasted for a "relatively short-lived period of time."

He added that he found Ratcliffe to be "very smart, a very good lawyer, just first-rate."

The dispute over the Holy Land case is no mere résumé dispute.

Ratcliffe, a three-term lawmaker, was already facing criticism that he lacks the experience to be Director of National Intelligence, given that outgoing spy chief Dan Coats and his predecessors came into the job with extensive national security and foreign affairs backgrounds.

That dynamic, along with Ratcliffe's standing as a Trump loyalist, could jeopardize his confirmation in the GOP-run Senate.

Some key Republican senators have so far offered muted reactions, with a few admitting that they were simply unfamiliar with the Texan's credentials. Some top Senate Democrats have already weighed in against Ratcliffe's nomination, casting him as a partisan warrior unfit for the job.
Several intelligence officials have also made clear their unease.

"Mr. Ratcliffe appears to be somebody who is more interested in pleasing Donald Trump," John Brennan, CIA director under President Barack Obama and a frequent Trump critic, said this week on MSNBC.

Stephens rejected those criticisms, pointing to Ratcliffe's experience as a federal prosecutor and then as a congressman serving on the House intelligence and judiciary committees.

"Ratcliffe opened, managed and supervised numerous domestic and international terrorism related cases," she said of his time in the U.S. attorney's office, adding that he "handled top secret, secret and confidential national security information as part of his daily responsibilities."

The Texan's allies have also defended his qualifications.

Texas Sen. John Cornyn on Monday called Ratcliffe a "worthy successor" to Coats, upon whom he heaped praise. Trump on Tuesday hailed Ratcliffe as a "very talented guy. "And former U.S. attorney Matt Orwig, who hired Ratcliffe, said he was "imminently qualified."

Orwig sought to further buttress Ratcliffe's standing by telling ABC News that his one-time protégé worked several terrorism-related cases, though he declined to specify them.

The former top prosecutor in the Eastern District of Texas also told The News that when Ratcliffe served as his anti-terrorism and national security chief, he worked to "bring together all the state, federal and local agencies" involved in security efforts.

"That's the job that he did," Orwig said. "He did it very, very well."

Federal Judge Hands Downs Sentences in Holy Land Foundation Case

Holy Land Foundation and Leaders Convicted on Providing Material Support to Hamas Terrorist Organization

Today, in federal court in Dallas, U.S. District Judge Jorge A. Solis sentenced the Holy Land Foundation for Relief and Development (HLF) and five of its leaders following their convictions by a federal jury in November 2008 on charges of providing material support to Hamas, a designated foreign terrorist organization.
"Today's sentences mark the culmination of many years of painstaking investigative and prosecutorial work at the federal, state and local levels. All those involved in this landmark case deserve our thanks," said David Kris, Assistant Attorney General for National Security. "These sentences should serve as a strong warning to anyone who knowingly provides financial support to terrorists under the guise of humanitarian relief."
HLF was incorporated by Shukri Abu Baker, Mohammad El-Mezain, and Ghassan Elashi. Mufid Abdulqader and Abdulrahman Odeh worked as fund raisers. Together, with others, they provided material support to the Hamas movement.
Shukri Abu Baker, 50, of Garland, Texas, was sentenced to a total of 65 years in prison. He was convicted of 10 counts of conspiracy to provide, and the provision of, material support to a designated foreign terrorist organization; 11 counts of conspiracy to provide, and the provision of, funds, goods and services to a Specially Designated Terrorist; 10 counts of conspiracy to commit, and the commission of, money laundering; one count of conspiracy to impede and impair the Internal Revenue Service (IRS); and one count of filing a false tax return.
Mohammad El-Mezain, 55, of San Diego, California, was sentenced to the statutory maximum of 15 years in prison. He was convicted on one count of conspiracy to provide material support to a designated foreign terrorist organization.
Ghassan Elashi, 55, of Richardson, Texas, was sentenced to a total of 65 years in prison. He was convicted on the same counts as Abu Baker, and one additional count of filing a false tax return.
Mufid Abdulqader, 49, of Richardson, Texas, was sentenced to a total of 20 years in prison. He was convicted on one count of conspiracy to provide material support to a designated foreign terrorist organization, one count of conspiracy to provide goods, funds, and services to a specially designated terrorist, and one count of conspiracy to commit money laundering.
Abdulrahman Odeh, 49, of Patterson, New Jersey, was sentenced to 15 years in prison. He was convicted on the same counts as Abdulqader.
HLF, now defunct, was convicted on10 counts of conspiracy to provide, and the provision of, material support to a designated foreign terrorist organization; 11 counts of conspiracy to provide, and the provision of, funds, goods and services to a Specially Designated Terrorist; and 10 counts of conspiracy to commit, and the commission of, money laundering.
The Court reaffirmed the jury’s $12.4 million money judgment against all the defendants, with the exception of El Mezain, who was not convicted of money laundering.
From its inception, HLF existed to support Hamas. Before HLF was designed as a Specially Designated Terrorist by the Treasury Department and shut down in December 2001, it was the largest U.S. Muslim charity. It was based in Richardson, Texas, a Dallas suburb. The "material support statute," as it is commonly referred to, was enacted in 1996 as part of the Antiterrorism and Effective Death Penalty Act. That statute recognizes that money is fungible, and that money in the hands of a terrorist organization — even if for so called charitable purposes — supports that organization’s overall terrorist objectives.
The government presented evidence at trial that, as the U.S. began to scrutinize individuals and entities in the U.S. who were raising funds for terrorist groups in the mid-1990s, the HLF intentionally hid its financial support for Hamas behind the guise of charitable donations. HLF and these five defendants provided approximately $12.4 million in support to Hamas and its goal of creating an Islamic Palestinian state by eliminating the State of Israel through violent jihad.
The government’s case included testimony that in the early 1990's, Hamas’ parent organization, the Muslim Brotherhood, planned to establish a network of organizations in the U.S. to spread a militant Islamist message and raise money for Hamas. The government’s case also included testimony about Hamas material found in zakat committees. The defendants sent HLF-raised funds to Hamas-controlled zakat committees and charitable societies in the West Bank and Gaza. Zakat is an Arabic word referring to the religious obligation to give alms.
HLF became the chief fundraising arm for the Palestine Committee in the U.S. created by the Muslim Brotherhood to support Hamas. According to a wiretap of a 1993 Palestine Committee meeting in Philadelphia, former HLF President and CEO Shukri Abu Baker, spoke about playing down their Hamas ties in order to keep raising money in the U.S. Another wiretapped phone call included Abdulrahman Odeh, HLF’s New Jersey representative, referring to a suicide bombing as "a beautiful operation."
The government also presented evidence that several HLF defendants have family members who are Hamas leaders, including Hamas’ political chief, Mousa Abu Marzook, who is married to a cousin of Ghassan Elashi, HLF’s former Chairman of the Board. Ghassan Elashi, who also served as the vice-president of marketing for Infocom Corporation, is currently serving an 80-month sentence following his conviction on several charges related to export violations. Mohammed El-Mezain was HLF’s Director of Endowments and Mufid Abdulqater was a major HLF fundraiser. Two named defendants, Akram Mishal and Haitham Maghawri are fugitives.
The defendants provided financial support to the families of Hamas martyrs, detainees, and activists knowing and intending that such assistance would support the Hamas terrorist organization. Since 1995, when it first became illegal to provide financial support to Hamas, HLF provided approximately $12.4 million in funding to Hamas through various Hamas-affiliated committees and organizations located in Palestinian-controlled areas and elsewhere.
During trial, the government also presented evidence that HLF was so concerned about investigators uncovering the group’s intentions that they kept a manual entitled "The Foundation’s Policies and Procedures." HLF followed various security procedures outlined in the manual to include hiring a security company to search the HLF for listening devices, ordering defendant Haitham Maghawri, a fugitive, to take training on advanced methods in detecting wiretaps, shredding documents after board meetings, and maintaining incriminating documents in off-site locations.
The case was investigated by the Joint Terrorism Task Force, involving agents from federal, state, and local agencies including: FBI, IRS - Criminal Investigation, U.S. Immigration and Customs Enforcement (ICE), Department of State, U.S. Secret Service, U.S. Army Criminal Investigation Division, the Texas Department of Public Safety, and the Dallas, Plano, Garland and Richardson, Texas, Police Departments. In addition, the Department of Justice Criminal Division’s Asset Forfeiture and Money Laundering Section provided assistance.
The case was prosecuted by James T. Jacks, acting U.S. Attorney; Barry Jonas, Trial Attorney for the Department of Justice Counter-terrorism Section; and Elizabeth J. Shapiro, Deputy Director, Federal Programs Branch, Department of Justice, serving as a Special Assistant U.S. Attorney.
Just a naming coincidence, I am sure.

In a nutshell, we have Trey saying Barr had no reason to release a report to him to the public about ongoing matters.



Then, we have Barb clarifying that there are two ongoing cases that were referred by Mueller.
Then, we have DOJ telling Lindsey and Judiciary Jolly Jerry that they can see the full report starting April 22 through April 29, 2019 in camera.



But, the Congressional leadership of Chuck Schumer, Nancy Pelosi, Judiciary Jolly Jerry, Dianne Feinstein, Adam Schiff and Mark Warner told Barr that they want the entire Mueller Report released, with supporting documents.

Gowdy's hiring announced during City Council meeting

A group has retained former U.S. Rep. Trey Gowdy as its attorney to address issues with a local utility, according to one of the property owners in the group.

It was announced during the public comment section of Monday night’s Spartanburg City Council meeting that property owners on Lakes Blalock and Bowen have retained Gowdy.

“We need to stop the Boston Tea Party or you’ve got a lawsuit,” Matt Spencer said, referring to the thought the property owners are being “taxed” without a representative on the Public Works Commission. “You know Trey Gowdy, right? Trey Gowdy has been hired by our group, and you don’t want that kind of lawsuit. You all know how great Trey Gowdy is.”

Spencer lives on Lake Bowen. He said the three-person commission needs to grow to seven.

There’s a bill in the legislature that would make that happen.

Spencer wasn’t the only speaker to address the council on issues surrounding Spartanburg Water.

Len Fletcher made the point county residents pay more for water than city residents do. WYFF News 4 Investigates previously reported customers in city limits pay $0.384 per 100 gallons used.

Customers outside city limits pay $0.672.

Dwight Smith wanted to know when the makeup of the commission would appear on the City Council’s agenda. He didn’t get an answer during the public comment period.

“Our understanding is that the (Commission of Public Works) and its staff are actively working through the issues of concern to those whose property abuts the water system’s reservoirs,” City Manager Chris Story wrote in an emailed response to questions about the meeting. “ There is no role for the City Council in addressing or resolving those concerns. Therefore, no related actions will appear on any upcoming City Council agendas.”

WYFF News 4 has attempted to contact Gowdy. Spartanburg Water’s spokesman did not have a comment on the news of Gowdy’s representation.
