Mike Pence came to Detroit to say how great the economy is to the Detroit Economic Club.

While telling everyone about how great the economy is, Trump tweeted about cutting interest rates, contrary to what Pence was promulgating, which led me to the conclusion that Pence did not get the memo that the Detroit Economic Club is under an international investigation.

Erica Ward Gerson is a corporate attorney by background and training, but she spent the early part of her career in the federal government and is now engaged full time in the non-profit sector. Erica graduated from Stanford University and the University of Michigan Law School, where she was Managing Editor of the Law Review. She initially joined a corporate firm in Washington, DC, but moved after only three years to the federal government.

She worked first for the U.S. Senate Ethics Committee and then moved to senior positions at the Department of Energy. In addition, Cullen is president and chief operating officer of Rock Gaming LLC, a Midwest-based gaming partnership formed to bring first-class casino gaming to Ohio. Through a partnership with Caesars Entertainment, the group has developed unique urban casinos under the Horseshoe brand in Cleveland and Cincinnati. Cullen was chief architect of GM’s $500 million acquisition and development of the Renaissance Center as the automaker’s global headquarters. Since 2003 he has helped oversee the billion dollar redevelopment of the city’s international riverfront as the founding chairman of the Detroit RiverFront Conservancy, whose vision is to create more than five miles of contiguous public access and linked parks along the river.


In addition, Cullen is the chairman of Invest Detroit; vice chairman of the Downtown Detroit Partnership; and serves on the Detroit Zoological Society executive committee. He is also a board member of Bizdom, Detroit Regional Chamber, Hudson-Webber Foundation, St. Johns Health Foundation, and Tech Town, and a trustee of the College of Creative Studies and Community Foundation of Southeast Michigan. He has previously chaired the Metropolitan Detroit Convention and Visitors Bureau, The Parade Company and the Metropolitan Detroit YMCA, and retains current executive committee membership with all three organizations. For more than 10 years, Cullen served as the governor-appointed chairman of the Michigan Economic Development Corporation (MEDC) executive committee.

Cullen earned a degree in economics from the University of Michigan and an MBA from the University of Detroit Mercy. He also completed the Senior Executive Program at Harvard University.

Pence tells Detroit the economy is riding high as Trump tweets about interest rates

Vice President Mike Pence gave one of those “you’ve-never-had-it-so-good” speeches to the Detroit Economic Club on Monday just after his boss went on a tweet storm about interest rates.

Minutes before Pence took the stage at Motor City Casino, President Donald Trump  tweeted a call for massive interest rate cuts from the Federal Reserve, the overseer of the nation’s money supply. He also bashed his own appointed Fed chair, Jerome Powell, in some of his harshest language to date, deploring Powell’s “horrendous lack of vision.”

In the tweets Trump called for the Fed to slash interest rates by “at least 100 basis points” or 1 percentage point, a far bigger cut than the Fed is likely to approve.

But when the tweets cleared, Pence,  as expected,  delivered upbeat economic bromides of the kind that will form the elixir of the Trump reelection effort in 2020.

Pence's message to  300 Detroit Economic Club members and guests, in short, was that the economy was in dire straits before Trump became president but now is riding high, and will continue to do so as long as voters don't turn to what he termed Democratic socialists.

A practiced speech maker, Pence's delivery was strong but every one of his lines will be contested by the other side.

"President Donald Trump delivered, and the American economy is booming," Pence said. He peppered his 25-minute speech with variations on that theme.

Among those: “The American dream is working again for every American. The forgotten men and women of America are forgotten no more." And "We're gonna keep doing what we're doing 'cause it's working for Americans." And, "It's about trade and jobs and tax cuts ... and the results have been nothing short of remarkable."

Along the way, Pence offered a lot of the most reliable conservative chestnuts about his Democratic opponents: “socialized medicine,” "open borders" and “siren song of socialism.”

Summing it up, he said, "I leave here today with confidence that we will continue to strengthen the greatest economy in the world."

Pence’s audience was a friendly crowd but not a campaign-rally crowd. The applause was frequent but polite, and lots of people headed for the exits even as Pence was still shaking hands with front-row audience members.

In a break with Economic Club tradition, Pence neither held a news conference nor took questions from the audience.

And the Economic Club took precautions to ensure no repeat of protests from the audience that marked candidate Trump's appearance in 2016, when several anti-Trump protesters, including now-Congresswoman Rashida Tlaib, were yanked kicking and screaming from the room. The club did not allow public ticket sales and took no last-minute new member sales.

This financial speculation of the City of Detroit publication was generated to finalize the decision by the Governor of Michigan to make a judicial determination of the fake ass bankruptcy for Detroit, where the Detroit Land Bank Authority was a creditor, was written by Erica, who sits on the board for the Detroit Land Bank Community Development Corporation and that fake ass Detroit Land Bank Authority that does not exist because Bill *Smooches* Schuette took me to court to dissolve my LLC, filed with the State of Michigan, LARA.

Trump Names Emperor Pence As Corona Emergency Manager Czar - Just Like Snyder Named Kevyn Orr

We still do not have Emperor Pence's emails from Indiana, just like we do not have Bill Schuette's emails, but, then again, it probably has something to do with emergency manager privatization powers of maximizing revenues,and/or trafficking tiny humans, but, hey, what do I know?

She started her career with the United States Department of Defense as a clinician in immunology, focusing on HIV/AIDS vaccine research. I also know that much of these emergency manager czar activities are going to be contracted out for "job creation" purposes of revenue maximizaition, probably through their children's trust funds.

As an infectious disease physician, I (and many others) was shocked at last night’s announcement that Vice President Mike Pence was appointed to oversee the Coronavirus-19 (COVID19) response. There are a number of reasons why.

First, while the President cited Pence’s experience with healthcare as Governor of Indiana, he was widely criticized by the infectious disease community, particularly for his response to opioid use and HIV.

HIV: In Indiana, Pence was instrumental in fueling an HIV epidemic. In tiny Austin, Indiana (pop. 4200), Planned Parenthood, the only place where people could get HIV testing, was defunded. Combine that with poverty, high unemployment and drug use, and the town had over 150 cases of HIV. This prompted then CDC Director Tom Frieden to note that Austin now has a higher incidence of HIV than "any country in sub-Saharan Africa… They've had more people infected with HIV through injection drug use than in all of New York City last year." Many were coinfected with Hepatitis B and/or Hepatitis C (HCV), causing further illness and costly treatment. In fact, in the U.S., 50-80% of people with IV drug use  become infected with HCV within 6-12 months of starting injecting drug use, all avoidable with needle exchanges.

Pence was adamantly opposed to needle exchanges, although they are of proven public health benefit and efficacy in reducing these infections which can be transmitted sexually or by shared needles. Two months after the outbreak was detected, Pence said he would “pray on it.” Because of the HIV epidemic, Pence reluctantly agreed to allow needle exchanges—but only briefly and only in that county. The Chicago Tribune’s David Rutter (@theeditor50) concluded: “The public's HIV treatment bill for Austin will run $200 million once the epidemic peaks—at least $1 million to save each uninsured patient, say health experts...It's the price of inattention and indifference.”

Public Health:

Here, too, Governor Pence was known for cutting funding for the state’s public health departments. Indiana spent $12.40 per person on public health, compared to $220 for West Virginia. As a member of Congress, Pence also voted against the State Children’s Health Insurance Program although he professes belief in “the sanctity of life.”

The one thing I do know is that formal protocol has been tossed out the window when it comes to governmental action, which sounds like privatizaiton through foreign corporations, just like they did, and are still doing in Michigan.

Here, Michigan Governor Gretchen Whitmer is taking unilateral action, all by herself to manage the emergency of coronavirus, unless she was advised, but, hey, what do I know?

'Tis Better To Be Vile Than To Be Mike Pence

Mike Pence has just demonstrated to the international community what little value he deems of poor humans.

January has been designated National Slavery and Human Trafficking Prevention Month but I shall assume Pence did not get the email. 

During his speech for the March For Life, I was completely stunned, that an individual, who has just been elected as a leader of this hegemonic state, blatantly and publicly, condoned human trafficking.

Abortion hinders job creation in the multi-billion dollar industry of child trafficking.

Of course, one cannot engage in the profiteering of human chattel unless there is more human chattel, hence, the pro-life movement.



Many will quickly assume that my position is nothing but one taken from behind partisan lines, but it is not.

I go both ways when it comes to calling out vile esteem because his campaigns, state and federal, have been funded through dark money of questionable organizations.

Pence does not seem to be very sophisticated in ethics, which, therefore, begs investigation.

Human trafficking of women and children has been a scourge upon the existence of compassion within the extremist Christian community for generations.

Human trafficking, specifically child sex trafficking, in the United States operates throughout the entire child welfare system, from Child Protective Services legally kidnapping a child, onto the Medicaid billable profit aspect of foster care, to the end user(s) of adoption.


Adoption is more than the trafficking of humans who hail from historically, economically disparaged, targeted populations, it is the oldest form of survival, just with a newly coined socially constructed label.

Federal and International investigations have uncovered arms, drug, human and organ trafficking, including using children.

Just in case Mr. Pence has forgotten about his time in the Congress, I thought it only proper to provide him with a visual stimulant to remember.

Mike Pence knows about child trafficking because he was a congressional signator within this Department of Defense report on Kosovo.

Just in case he forgot, I have provided the report, below, so someone can graciously remind him.

So, instead of honoring the laws of biology, women are now forced, or rather "enslaved" to produce goods to be acquired and sold by the state through adoption.

I expect Mr. Pence to demonstrate the same vim and vigor in a march to end global human trafficking of women and children, but I highly doubt that would fit the political agenda of his financeers.

Emperor Mike Pence, Jonestown & Trafficking Tiny Humans In The Name Of The Prolife Corporate Parental Rights Tax Exempt God

Jim Jones seems to have spearheaded, with help, of course, the very first model of stealin' the children, land & vote because he is from Indiana and so is Emperor Mike Pence.

I am quite sure there are those who are now mumbling outloud, in a failed attempt to turn away, and go to another link, in knowing that I am intentionally foreshadowing a complete implosion of your sacred cognitive dissonance, because you know you must continue reading.

Jim Jones was not just into the implementation of the first transposable model in the acquisition of human goods, but had launched the first chattel ranching model in human asset forfeiture.

Jim Jones was gerrymandering and it looks like he had Eli Lilly as a fan.




Jones Appointment to San Francisco Housing Authority
On October 18, 1976, almost a year after he was elected as Mayor of San Francisco, George Moscone appointed Jim Jones to the San Francisco Housing Authority, the agency with jurisdiction over public housing in the city. The appointment has been interpreted as an indication both of Jones’ power in the city and of his weakness in the political realm.

It was a victory for Jones in several respects. The position gave the Temple leader a chance to turn his political rhetoric delivered from the pulpit into action, and Jones spoke up for the poor and minorities whom the Authority was supposed to serve. The new platform also gave him new audiences and more access to press coverage. Eventually, after becoming chair of the commission, he was able to hire three Temple leaders to positions on Housing Authority staff.

There were aspects of the appointment which were disappointing, however. The Temple’s active support of Moscone the previous year may — or may not — have been pivotal in the mayor’s victory, but the interval of 11 months between the election and the appointment acted to undermine Jones’ presentation of himself as kingmaker. Just as telling is that, even though Temple spokesman Mike Prokes served on Moscone’s committee to submit and review names for appointments to commissions in the new administration, neither Jones nor any other Temple names were among the first 100 nominations. And when Jones finally was selected for a position in March 1976, it was to the city’s Human Rights Commission. As Tim Reiterman point out in his book Raven, the appointment might have been “an appropriate place for a liberal preacher. But to Jones, it was a lateral appointment – the same position he had held 15 years earlier in Indianapolis” (p. 268). Jones declined the initial offer, and seven months later, Moscone made the second appointment.

The Temple leader  served on the Housing Authority for less than a year. In August 1977, Jones embarked on his final trip to Guyana, and he did not leave Jonestown for the rest of his life.

Obama in Detroit: Vote because 'character of our country is on ballot'


Detroit — Former President Barack Obama rallied thousands of Michigan Democrats here Friday night, channeling his past calls for hope and change as he urged voters to get to the polls Nov. 6 for what "might be the most important election of our lifetime."

Speaking to an enthusiastic overflow crowd at Cass Tech High School, Obama warned supporters that the failure to vote in the mid-term election could have "dangerous and profound" impacts for a country now led by President Donald Trump and a Republican-led Congress.

"The character of our country is on the ballot," he said.

While he rarely addressed Trump by name, Obama repeatedly criticized his bombastic successor while lamenting what he called a "cynical" politics of division.

"You can reject that kind of politics," the former president said. "The good news is, Michigan, you can choose a more hopeful, more generous vision of America. But to get there, you have to vote."

Fans packed the roughly 5,000-seat gymnasium, where the high school marching band punctuated Obama's punch lines with drum fills and cymbal crashes. Supporters cycled between "Yes we can" and "Obama" chants.

His visit came 11 days before a mid-term election in which turnout could be a critical factor for Democratic candidates like gubernatorial nominee Gretchen Whitmer and U.S. Sen. Debbie Stabenow. Vice President Mike Pence is expected to rally with Republicans on Monday.

Michigan Democrats traditionally struggle to turn out voters in non-presidential election years, particularly in urban areas like Detroit. Beyond Whitmer's running mate Garlin Gilchrist II, Democrats are offering a predominately white statewide ticket to voters in the majority African-American city.

Obama, the nation's first black president, pumped his fist to the crowd as he took the stage before hugging Stabenow and Whitmer, whom he praised during his speech.

He also gave shout-outs to congressional candidates, including 11th Congressional District hopeful Haley Stevens, who worked on his auto task force and was "a critical part of my team that helped the auto industry come roaring back" after near collapse. Pence's wife Karen rallied early Friday evening with Stevens' Republican opponent Lena Epstein in Commerce Township.

Two years after an election that Trump and other Republicans won on a promise to repeal and replace the Affordable Care Act, Obama touted his signature health care law and its popular protections for pre-existing conditions.

Voters can trust Stabenow to defend those protections "because she was there" fighting for them in the first place, Obama said, questioning Republican challenger John James' claim he supports Trump "2000 percent."

Whitmer helped expand Medicaid access when she served in the state Legislature, he said, "and few people fought against it harder than her opponent," Republican Attorney General Bill Schuette, who now says the Healthy Michigan program is "the law of the land" and not going away.

While the national and state economy have improved since cratering during the Great Recession that peaked Obama's first year in office, critics say sluggish growth under his watch has improved under Trump and federal tax cuts. Michigan's unemployment rate in January 2017 when Obama left office was 5 percent, while the jobless rate in September was 4 percent.

Republicans called it "insulting" for Obama to rally with Democrats who "will work to systematically dismantle the policies generating all of this progress," said Republican National Committee spokesman Michael Joyce. "Michiganders have high hopes for a bright and prosperous future, and voters know that no matter what Obama says, Michigan Democrats do not share that vision.” 
Obama criticized tax cuts he said will balloon the deficit and primarily benefit the wealthy and corporations.

He accused Republicans of trying to distract voters from critical issues. Instead of talking about Flint water, infrastructure or health care, Trump is trying to fire up his base by talking about "impoverished refugees 1,000 miles away," he said, referencing the Honduran migrant caravan the Republican president has bemoaned.

And Obama repeatedly criticized "lies" coming out of Washington, D.C., arguing that telling the truth should be something that Democrats and Republicans should agree on.

“When words stop meaning anything, when truth doesn’t matter, when people can just make up facts, then democracy, it doesn’t work," Obama said. "There’s no accountability”.

Whitmer and other Democrats contrasted Obama's presidency with Trump.

“Anyone miss the days when we had a president we could be proud of?" Whitmer said. "A president who told the truth? A president who protects the Great Lakes and the auto industry? A president who made it possible for us to expand Medicaid here in Michigan and get 680,000 people covered?”
Stabenow praised Obama for continuing and expanding the auto bailout that helped save jobs at General Motors and Chrysler.

"No thanks to the current Vice President Mike Pence, who voted against us when he was a congressman," she said. 'And by the way, he'll be here Monday stumping for my opponent."
Former U.S. Attorney General Eric Holder, who served under Obama, spent significant time touting Michigan Proposal 2, which would create a citizen redistricting commission to draw new political boundaries each decade instead of politicians.

“This is one of the most gerrymandered states in the country,” said Holder, who chairs the National Democratic Redistricting Committee. “I’ve been all around, and you’ve got it bad in Michigan. You’ve got to do something about it.”

Holder also urged Democrats to vote Nov. 6 even if they are “disappointed or feeling despair” after election loses in 2016.

“Think about Martin Luther King Jr. and John Lewis and how they must’ve felt tired at some points of the civil rights struggle,” he said. “People died so that people would have the right to vote. People suffered so that people would have the right to vote.”

U.S. Rep. Brenda Lawrence, D-Southfield, rallied female voters before introducing 11th Congressional District candidate Haley Stevens and 8th Congressional District candidate Elissa Slotkin, women Lawrence said she wanted with her on the “front lines” in Congress.
Thousands of supporters lined up outside Cass Tech earlier Friday to hear Obama speak, some who waited from 10 a.m. until the doors opened at 5 p.m. At the front of the line, a diverse group of women were sharing food and stories.

“It’s amazing the decency that we’ve all demonstrated toward each other,” said Fazila Siddiqui, a 45-year-old Pakistani immigrant and nurse practitioner student from West Bloomfield.

The former president “helped keep the country together, and I feel like that’s something we’ve gotten away from,” said Siddiqui, who plans to vote for Whitmer in the governor’s race.

Renee Hill of Detroit, a 56-year-old legal department worker, said she started her day by texting as many people as possible to tell them to vote on Nov. 6. She’s borrowing her daughter’s phone and didn’t even know most of the people she was messaging.

“I don’t care if you’re a Democrat or Republican, if you don’t vote, you take away from your voice,” she said. “You can’t complain about nothing because you didn’t get off or your behind and go do your civic duty.”

Just 31 percent of Detroit voters cast ballots in 2014, compared with 43 percent statewide, when Republican Gov. Rick Snyder won re-election over Democratic challenger Mark Schauer by roughly four percentage points.

About 48.6 percent of Detroit voters cast ballots in 2016, when statewide turnout topped 64 percent and Republican President Donald Trump  beat Democratic nominee Hillary Clinton by less than one point.

Detroit elections officials are projecting that 41 percent to 46 percent of the city's 470,000 registered voters will cast ballots on Election Day based on the primary turnout in the city and statewide. In 2016, City Clerk Janice Winfrey expected a voter turnout of 45 percent to 50 percent.

James, who is challenging Stabenow, on Friday launched a new a commercial that argued black voters shouldn't be captives of the Democratic Party.

"So Joe Biden has said that he believes that Republicans don't want black people to vote. Well, I'm a Republican. I want black people to vote. In fact, I want everyone to vote who is eligible to vote," James says in the one-minute ad.

"...The Democratic Party leadership cares more about the black vote than the black people, and it's time to wake up. It doesn't have to be this way. We can have a seat at both tables, and we can elevate our people together."

Pence is expected to campaign 8th Congressional District candidate Mike Pence and 11th District candidate Lena Epstein on Monday before attending a Kent County GOP dinner with Schuette, James and other Republicans.

The Michigan Republican Party on Friday bashed Democrats ahead of the visit by Obama, arguing his eight years as president "were an unmitigated disaster."

"Obama’s policies of high taxes, more regulation and fewer jobs were the perfect book end to Jennifer Granholm’s Lost Decade," said Michigan GOP spokeswoman Sarah Anderson. "Republicans have the momentum, and just like in 2016, last minute fly-ins will not slow that momentum down.”

Trump cancels, then re-reschedules trip to CDC after coronavirus scare

Trump will visit the Centers for Disease Control and Prevention in Atlanta on Friday as the coronavirus outbreak escalates.

President Donald Trump abruptly canceled and then re-scheduled a Friday visit to the Centers for Disease Control and Prevention in Atlanta as the coronavirus outbreak escalates.

Trump told reporters early Friday morning that the trip was initially scrapped because of a suspected coronavirus case at the CDC itself. After the case turned out to be negative, the trip was re-scheduled.

The last-minute change sent Trump's aides scrambling to rearrange his schedule and respond to questions about the trip. Even Vice President Mike Pence, who Trump tapped with leading the administration's response to the outbreak, appeared to be unaware of the change late Thursday.

Trump’s schedule Friday, which had been released publicly at nearly midnight, no longer listed the trip to Atlanta. It showed the president flying to the Nashville area following a series of deadly tornadoes there, and then onto Florida, where he is scheduled to spend three nights at his south Florida retreat, Mar-a-Lago.

Trump says CDC visit may happen after official said it was canceled

"They thought there was a problem at CDC with somebody that had the virus," Trump told reporters Friday morning. "It turned out negative so we are seeing if we can do it. They've tested the person fully and it was a negative test. So I may be going. We're going to see if they can turn it around with Secret Service. We may be going."

The reveal surprised CDC staffers, including those preparing for Trump’s visit. They had not been previously informed about the suspected case of coronavirus at the agency, said three individuals with knowledge of the situation.

Asked about the potential coronavirus case and whether staff was briefed, the health department declined to comment.

“CDC has many employees who have deployed in support of the nation’s response to COVID-19, some of whom are returning from areas where COVID-19 may present,” a spokesperson said, using the formal name for the coronavirus, adding that CDC staff are undergoing appropriate self-quarantine and testing measures. “No CDC employees have tested positive.”

Earlier on Friday, a White House official confirmed the president's visit had been scrapped but for a different reason. “The CDC has been proactive and prepared since the very beginning and the president does not want to interfere with the CDC’s mission to protect the health and welfare of their people and the agency,” the official said.

As of Thursday evening, the White House was communicating that the president's trip to Atlanta was still on. At around 9 p.m. Eastern time, on a trip to Washington state, where coronavirus deaths reached double digits this week, Pence announced that Trump would sign an $8 billion coronavirus funding bill during his CDC trip.

Pence did not mention a potential case at CDC headquarters, even though Trump later said the administration had learned about it on Thursday afternoon.

“We are making progress,” Pence said at his news conference in Tacoma, Washington. “As I mentioned, federal assistance was approved by the United States Senate. President Trump is expected to sign the legislation tomorrow as he visits the CDC in Atlanta.”

Ultimately, Trump signed the $8.3 billion emergency funding package at the White House just before 9 a.m. in a hastily arranged ceremony. Journalists had already gathered outside on the South Lawn awaiting the president’s departure from the White House to Nashville when Trump aides moved some of them inside for the bill signing. “We’ve signed the 8.3 billion," he said. "I asked for two and a half and I got 8.3 and I’ll take it.”

Trump has made a point to talk about coronavirus regularly but he has largely continued with his normal schedule. He spoke at a campaign rally Monday in Charlotte and a Fox New town hall in Scranton, Pa. on Thursday, where he defended his handling of the outbreak.

Trump specifically praised Pence and CDC and bragged about the praise he said the administration has received for its response. "We've done a great job," he said. "Again, we've gotten the highest poll numbers of anybody for this kind of a thing."

The CDC has been under fire in recent days for delays in testing due to earlier problems with its diagnostic tests and initial criteria limiting who should be tested. The agency says it has since fixed the problem with its test and broadened who can be tested, though experts worry the delays have already hindered the ability to detect community spread.

Trump officials have assured states that the CDC is sending enough test kits to test 75,000 people. Private companies are also expected to dramatically boost the amount of test kits on the market, though there are still questions about whether there are enough laboratories and staff to test a large surge of samples. Experts say the U.S. won’t likely be able to meet testing demands for several weeks.

More than 200 cases have been confirmed across 20 states so far and at least 12 people have died. Public health officials say they expect more cases as more people are tested in the coming days.

DOJ: United States Files False Claims Act Complaint Against Community Health Network - Medicaid Fraud In Indiana Under Emperor Pence


If I close my eyes really, really hard, I can recall Emperor Pence signing the Religious Freedom Restoration Act (RFRA), because it came out Michigan and I just happen to know one of the writers, super duper, really well, which brings me to a dream sequence of why the Detroit Economic Club and the Michigan Economic Development Authority embraced him, the glorious leader of the Indiana Economic Development Authority, so warmly, but hey, what do I know?

I know nothing because the case is still under seal.

What I do know is that I know about the qui tam and the False Claims Act, when dealing with Medicaid Fraud in Child Welfare and the Indianapolis Land Bank, including its marvelous artifices & machinations of stealin' the children, land & votes, just like the Detroit Land Bank Authority.

I also know that you cannot be prosecuted for Medicaid Fraud in Child Welfare, under the FCA when you use your RFRA get out of jail for stealin' card when you do it in the name of the tax exempt god, because that is why it was created.

The United States has filed a complaint against Community Health Network Inc. (Community) in the U.S. District Court for the Southern District of Indiana, the Department of Justice announced today.  Community, an integrated health care system in central Indiana, is alleged to have violated the Stark Law and thereby submitted false claims to the Medicare program.  
The Stark Law prohibits a hospital from billing Medicare for services referred by a physician with whom the hospital has an improper financial relationship that does not meet any statutory or regulatory exception.  The government’s complaint alleges that Community had employment relationships with a number of physicians that did not meet any Stark Law exception because the compensation Community paid to the physicians was well above fair market value and because Community conditioned paying bonuses on physicians achieving a minimum target of referral revenues to the hospital.  The complaint alleges that Community received referrals from these physicians in violation of the Stark Law and submitted claims to Medicare knowing that the claims for those referred services were not eligible for payment. 
“Improper financial relationships between hospitals and physicians corrupt clinical decision-making, threaten patient care, and ultimately drive up Medicare costs,” said Assistant Attorney General Jody Hunt of the Department of Justice’s Civil Division.  “We are committed to eliminating these improper inducements and thereby ensuring the Medicare program remains fiscally sound to serve our nation’s senior citizens.”
“Our goal at the U.S. Attorney’s Office is to serve the citizens and help ensure safety in their communities,” said U.S. Attorney Josh Minkler for the Southern District of Indiana.  “Hospitals are responsible for not only the health and well-being of their patients, but are also required to establish a compliance program in order to protect against improper payments, fraud and abuse as a condition of enrollment in the Medicare program.” 
The United States filed its complaint in a lawsuit originally filed under the qui tam or whistleblower provisions of the False Claims Act, which allow private parties to file suit on behalf of the United States for false claims and to receive a share of any recovery.  The Act permits the United States to intervene and take over the lawsuit, as it has done here in part.  Those who violate the Act are subject to treble damages and applicable penalties.
The government’s resolution of this
matter illustrates the government’s emphasis on combating health care fraud.  One of the most powerful tools in this effort is the False Claims Act.  Tips and complaints from all sources about potential fraud, waste, abuse, and mismanagement, can be reported to the Department of Health and Human Services (HHS), at 800-HHS-TIPS (800-447-8477).
This case is being handled by the Justice Department’s Civil Division and the United States Attorney’s Office for the Southern District of Indiana, with assistance from the Office of Inspector General of the Department of Health and Human Services.  The case is captioned United States and the State of Indiana ex rel. Thomas Fischer v. Community Health Network, Inc., et al. No. 1:14-cv-1215 (RLY-DKL) (S.D. Ind.).
The claims in which the United States has intervened are allegations only, and there has been no determination of liability.
