It Seems Michigan v. Carmack Trial Has Been Canceled At Request Of The Court

Why has the Carmack case been canceled?

I do not know.

Someone could ask Larry Garcia, Corporate Counsel for the City of Detroit.

Someone could ask the Detroit Land Bank Authority latest corporate counsel.

Someone could ask the court but I doubt there will be any further information, considering the fact that there may be a situation about the legitimacy of the appointment of the Noah Hood, but, hey, what do I know?

I know I have popcorn.

I wonder if Marion Brown is going to visit Elisa Grubbs in prison, or just end up her cell mate, to keep the family together.

Melanie Sloane should try and get Perkins Coie to represent the rest of the individuals who were mean to my Sweetie.

Isaac can continue to help them with their #MeToo moments, as I am quite sure everyone involved is going to be in dire need of long term clinical psychological services.

I wonder the tales Elisa shall tell...

Detroit — City Councilman Gabe Leland's campaign staffer was charged in federal court Wednesday with joining a conspiracy to bribe an unnamed Detroit politician with thousands of dollars in cash and valuable items.

Elisa Grubbs, 53, is expected to plead guilty amid a federal grand jury investigation targeting City Councilman Gabe Leland, who was first identified as being under investigation last year after The News obtained sealed FBI wiretap documents.

Leland is not named in the criminal filing but a Detroit businessman says he gave $7,500 to Grubbs in an envelope last year as a bribe for the councilman's help with a business dispute.

The conspiracy involving Grubbs is one of the latest corruption scandal to hit Detroit City Hall in the wake of the racketeering conspiracy scandal that sent former Detroit Mayor Kwame Kilpatrick to prison for 28 years.

Grubbs was charged 11 months after she leveled claims of inappropriate sexual behavior against Congressman John Conyers, a claim that contributed to the political titan's downfall after a 53-year career in public service. Grubbs, who said she worked for Conyers from 2001-13, claimed she was also touched by him inappropriately and that he appeared naked in front of her.

Grubbs' court-appointed lawyer did not respond to a message seeking comment Wednesday.

The city official who received bribes from Grubbs is not identified in court records. Instead, investigators refer to the politician as "City Official X."
The conspiracy outlined by the government involved "City Official X" receiving bribes in exchange for the city official using their official position to help an unnamed business owner.

In May 2017, "City Official X" met with an unnamed business owner and discussed helping the businessman in exchange for thousands of dollars.

Three months later, in August, the city official talked with the businessman on the telephone. The city official told the businessman to give the money to Grubbs.

On Aug. 4, 2017, Grubbs met the business owner and accepted thousands of dollars on behalf of "City Official X," according to federal court records. That same day, Grubbs gave the money to the city official.

The allegation and dates in the criminal case against Grubbs matches a claim involving bribes and Leland in a civil lawsuit in federal court.

Businessman Robert Carmack said he delivered $7,500 cash in an envelope to a Leland campaign worker in late summer 2017, according to the lawsuit filed against the councilman, Mayor Mike Duggan, the Detroit Land Bank and Wayne County Treasurer Eric Sabree.

The lawsuit’s allegations date to a few weeks before the August 2017 primary election in Detroit. Leland was running for re-election and Carmack was trying to resolve a dispute involving property he owned at 8124 Michigan Ave. Carmack alleges the city illegally demolished his commercial building using federal funds and was trying to sell the property.

“Leland demanded and requested...$15,000 for his reelection campaign,” Carmack’s lawyer Andrew Paterson wrote in the lawsuit.

Carmack says he ignored the request.

Leland, who chaired a City Council committee responsible for community development, promised not to sell the property in exchange for $15,000, Carmack alleges.

Leland's lawyer Steve Fishman declined comment about the Grubbs criminal case. Leland could not be reached for comment.

Carmack feared he was being extorted so he approached the FBI, according to the lawsuit. The FBI is investigating widespread corruption involving politicians, police officers in Detroit, Macomb County and across southeast Michigan.

“The FBI asked (Carmack to) wear a recording device and to pay defendant Leland as defendant Leland demanded,” Carmack’s lawyer wrote in the lawsuit.

The day after Leland asked for $15,000, Leland called the businessman and said he would be sending someone to pick up the cash, according to the lawsuit.

That same day, a woman who Carmack believed to be a Leland campaign worker met him on a side street near a bank on East Jefferson Avenue in Detroit, the lawsuit alleges.

“During the exchange, (Carmack) explains to the female campaign worker that the cash in the envelope was for defendant Leland and the female campaign worker responds by (stating) that it was not for her and that she would be delivering the money to defendant Leland immediately,” the lawsuit alleges.

The next day, Carmack said he met with Leland.

“Leland responded that he had in fact received the money from the campaign worker,” Paterson wrote.

Carmack was free to do whatever he wanted with the commercial property, Leland said, according to the lawsuit.

On Wednesday, Paterson identified Grubbs as the campaign staffer who received and delivered the bribe. Carmack believes he is the unidentified businessman referenced in the criminal case, Paterson said.

The lawyer said the criminal case proves Carmack was telling the truth about his dealings with Leland and other elected officials.

"My client has been unlawfully retaliated against by Councilman Leland and other elected city officials for exposing this corrupt behavior," Paterson said in a statement to The News. "Hopefully, today's (criminal charge) will send a clear message to other elected city officials who conspired with Councilman Leland to retaliate against my client that the FBI and the U.S. Attorney's office are seriously investigating their unlawful conduct."

In one of the photos, posted by Isaac Robinson, an attorney and candidate for Michigan’s House District 4, Robinson notes “Leland and the District 7 team” were out supporting the cause. Grubbs is tagged in the Facebook post.

Leland corruption trial delayed until January

A federal judge Monday delayed the October corruption trial of Detroit City Councilman Gabe Leland until January.

The delay by U.S. District Judge Judith Levy came two weeks after Leland's campaign staffer Elisa Grubbs was indicted in the case; the extension gives her new lawyer time to prepare for trial.

Leland was indicted by a federal grand jury in October on bribery charges and accused of agreeing to accept $15,000 and free car repairs from a businessman. It was the latest corruption scandal to hit the top levels of Detroit government since former Mayor Kwame Kilpatrick's downfall.

Leland is the highest-ranking Detroit politician charged with a federal crime since Kilpatrick was indicted nine years ago and sentenced to 28 years in federal prison.

The three-count indictment capped a tumultuous year for Leland, 36, who had lived under a cloud of suspicion since The Detroit News obtained sealed FBI wiretap affidavits that revealed he was the target of a federal bribery probe.

Recorded conversations played a prominent role in the indictment, which portrayed the Detroit Democrat as a greedy, expletive-spewing schemer who used his political power to stall votes on a businessman's real estate matter last year while demanding bribes.

“I held it up again,” Leland told the businessman, who The News has identified as Detroit auto shop owner Robert Carmack. “It stayed … right in committee brother.”

On May 16, 2017, Leland offered to help the businessman in exchange for $15,000 and free car repairs, the government claims.

“I should ask for thirty,” Leland said, according to the indictment, “but I’m nice to you.”

Grubbs is accused of delivering the bribe from Carmack.

If convicted, Leland faces up to 10 years in prison and a $250,000 fine for each bribery count and five years for bribery conspiracy.

Leland, who remains on City Council, has professed his innocence.

"I'm innocent and I'm looking forward to trial," Leland told reporters outside court last year.

This is going to be painful, but I am going to call this out because I am sick of this shit.

I have been battling Rehab Amer for decades.

Her children were snatched because her youngest got a broken bone and bruises in the tub.

CPS snatched all her kids.

Her kid died in foster care, her parental rights were terminated and the kids adopted out.

The body was exhumed and it was found that her child had brittle bones disease.

Instead of going after the child welfare system for snatching kids and killing her child, she decides to go after the law to have muslim kids placed in muslim foster care.

That is religious discrimination.

Her kids grew up to be christian and do not want much to do with her.

I do not believe she even bothered to sue the State of Michigan, let alone go to the FBI, but, instead, she opted out for the money, faith based, that is.

So now, she has a fancy foster care operation complete with faith based donations and money laundering to be the first muslim foster care facility.

Would that mean that non-muslim children would be turned away?

Would that mean that she will start trafficking tiny humans from muslim countries?

That would be an issue of forced migration, a war crime.

Would be just like St. Vincent and Bethany Christian, who are suing Michigan, turning away same sex adoption couples, except they would turn away non-muslims?

That would be religious segregation.

That last time I checked this was all very illegal which is why I am going to call this a money laundering operation.

Why?

Because I watched it being put together by William Isaac Robinson who is now running another money laundering operation with Imad Hammad, the guy who made a pass at Rashida Tlaib and she freaked out, or rather used the moment as an optic.

William Isaac Robinson ran ops out of Judiciary Committee because I watched.

He now runs the American Human Rights Council, Inc., a domestic non-profit.

After decades of her own struggle, Rehab Amer works to empower other families

Dearborn – The story of Rehab Amer and her husband Ahmad’s struggle to keep their children is known to many. After decades of legal battles, and eventual successes bringing the Amer Law to the state of Michigan in 2010, Amer and her community partners want to inject hope and self-determination into families across the nation.

Rehab Amer has been busy working towards building a strong non-profit organization that protects children and empowers parents.

According to the organization’s website, AMER, or American Muslim Empowerment Resources, will provide, “services and preventative resources, family judicial advocacy and developing of legislative initiatives for children and families in need.”

The AANews met with Amer and board member Hussein Siblini at New Yasmeen Bakery last week to discuss their important work of keeping families united and preventing children from being put into the foster care system where they could go through unchecked abuse or trauma.

Amer’s work, like the law she helped enact, seeks to bring cultural and religious sensitivity back into common sense childcare decisions made by the state and local authorities. More importantly, she has been actively working to advocate for families and ensure that Amer law is observed in judicial proceedings in foster care cases.

“I am a nurse and I left my job after hearing of the overwhelming need, from the community and from outside of it, for someone to be there for them during a potential child separation procedure,” Amer said.

“Our work is even more important when it comes to refugees, who may not speak the language,” she added. “If such a family comes (to this country) with seven or eight children and just one of them gets involved in the protective services system, the state will automatically want to remove all other children as well.”

Amer and her colleagues have a variety of strategies in place to prevent such summary removals and separations. The first of these is seeking out potentially risky family environments, especially in immigrant and refugee homes where cultural norms can be misinterpreted by state authorities as hazardous for children.

“There is a cultural barrier when it comes to these cases,” Siblini said. “A lack of knowledge on the part of Child Protective Services of cultural practices can lead to unfair judgments and child care assessments.”

Amer has personally intervened in several such cases and has helped bring welfare services and much needed resources to families who have had children taken from them, so that they do not face the same threat with the rest of their children.

In cases where children are to be put into foster care, Amer advocates for the next of kin or Muslim foster parents to take the child, following the Amer law.

“I currently have a 6-year-old in my care,” she added. “The importance of having a safe and fit family for a child can make a tremendous difference in his or her emotional life.”

Reflecting on her work, Amer noted that the legal procedure in these cases is often rushed.

“In my interventions I make sure the interpreter to refugee parents is communicating information accurately,” she said. “In some instances, we found that case workers did not inform the court that the family had relatives willing to take care of the child. I make sure to bring these relatives to court so that the judge can see the entire picture.”

Last February, U.S. Rep. Debbie Dingell (D-Dearborn) introduced HR 4990, the Rehab and Ahmed Amer Foster Care Improvement Act of 2018. The legislation would require state foster care programs nationwide to ensure children are prioritized for placement with their relatives and puts additional requirements in place for a fairer decision-making process when an agency places a child.

Additionally, the legislation would require states to establish procedures that would allow any of the parties who receive notice of the placement decision to request, within five days after receipt of the notice, documentation explaining the reasons for the state’s decision.

It would also allow the child’s attorney to petition the court to review the decision and require that the court commence a review within seven days after receipt of the petition.

“This legislation needs nationwide support to pass,” Amer said. “I am urging the community to reach out to their state representatives and request their support by cosponsoring the bill with Congresswoman Dingell.”

The AMER Foundation is currently in the process of getting licensed to become an approved foster care agency. Amer also plans to grow the non-profit to expand its advocacy operations nationwide.

“We need the assistance and support of our community in order to make this vision a reality,” she said. “I would ask all parents, Muslim or not, to look into their hearts and see that the child’s best interest is to keep them close to their loved ones. I invite others to advocate with me in court, provide much needed resources to refugee parents and families and donate to the AMER Foundations mission to empower families.”

There are differing legal traditions within Islam about what constitutes ghanima, and thus how far-reaching khums should be. In some jurisdictions, khums included a 20% tax paid on business profit and on minerals extracted in regions under the control of the state. Khums is different and separate from other Islamic taxes such as zakat and jizya.[1][7]
