The battle between Warren Mayor Jim Fouts and the City Council has escalated after the council either wittingly or unwittingly cut the position of the mayor's longtime assistant from the new budget.
The council also took another perceived swipe at Fouts by approving ballot language to reimpose stricter term limits on the mayor's office.
"This is an out-of-control council controlled by outsiders who would like to get control of lucrative contracts and licenses," Fouts said of the budget the council approved June 30, hours before the new fiscal year began July 1. "This is a combination of censorship, retaliation, retribution and basically political terrorism."
Fouts has been battling with the City Council since a newly-elected council took office after the November election. They have sparred on matters involving recreational marijuana, a proposed social media policy for officials, access to city department heads and even the city attorney's job status.
The new budget eliminates one of six positions in the mayor's office, that of executive administrator, which had a salary of $90,857.
Council President Pat Green said the council was merely eliminating what it thought was a long vacant position.
"That position has been open since Lou Schimmel left the city (in 2011) and it's never been filled," he said.

But Amanda Mika — who has worked for Fouts for a nearly a decade and whose relationship with the mayor has come under public scrutiny after they were secretly videotaped arm-in-arm on an out-of-town trip together — said that is her position. She told the council so during public comments after the vote at its June 30 online meeting.
She told the Free Press on Monday that she was promoted to the No. 2 spot in the mayor's office earlier this year from her longtime position of executive assistant, which had a budgeted salary of $78,494.
Mika and Fouts said the council not only cut her executive administrator position from the budget, but also her former union position as assistant planner.
Mika's six-month stint as an assistant planner caused a kerfuffle in 2017, when a complaint was filed to look at whether it was a ploy to provide her with lifetime job protection under civil service rules.
Mika returned to her non-civil service job in Fouts' office after the six-month period, putting in enough time to allow her to transfer to a civil service job in the city if Fouts left office. The Warren Civil Service Commission didn't take up the complaint.
"They're clearly targeting me," Mika said of the council's recent budget move. "I think it's political. Obviously, they have an issue with me. ... I'm not happy. I'm offended."
Mika said she's going to continue working "even if it means I'm working for free." She said a few residents have called her, and "I'm right where they need me to be."
Green said the council did not receive information that anyone had been appointed to the long-vacant position.
"And we went back historically," he said, "there's no appointment to that position. We are reasonably assured that has never been filled. And we stand by that information."
Green said all of Mika's emails come out with the title of executive assistant on them, her LinkedIn account says executive assistant and Fouts referred to her as executive assistant during a June 18 budget hearing. Green said nothing about Mika's change in position was sent over to the clerk's office or announced to council.
Green said as part of budget questions to the city controller, he asked for a list of everyone in Fouts' office by name and position, but the controller's office did not respond.
He said Fouts could have provided this information at the June 18 budget hearing, but refused to, "so we're standing by our budget." He said council is asking its legal counsel whether Mika was in the administrator position improperly and what steps can and should be taken.
But Mika and Fouts said the council never afforded Fouts the chance to provide the information about his office at the budget hearing, saying they muted him and hung up on him.
After that, Green said that Fouts just referenced that Mika is the executive assistant and that he thought that she was the executive administrator, "so I just want to make sure that we have the right people in the right, right positions."
Mika said council could have asked human resources for a list of personnel in the mayor's office. Neither she nor Fouts said council made that request of Fouts' office.
Mika said she wants to continue to use the executive assistant title because it's "more relatable." She said all of the positions in Fouts' office are filled, including her old job as executive assistant.
Fouts said he believes the budget will be reconsidered by the council. Councilwoman Angela Rogensues said in a July 2 email to council that she would like her vote reconsidered for the 2020-21 budget.
Fouts said he's planning to have budget meetings with key people on his staff this week to discuss options, including a veto. He said he doesn't want to lay off remaining staff to put Mika into place because "everyone who works for me is valuable."
While Fouts hasn't vetoed the budget, he has vetoed council's approval of a ballot question that would ask voters a yes or no question: Should the office of mayor have the same terms as the other city elected offices, which is the greater of three complete terms or 12 years?
Green said the ballot language has to be approved by the state. If approved, he said the question would be on the November ballot. If approved by voters, he said, it would take effect immediately, but Fouts would serve out the rest of his current fourth four-year term.
"In no way, shape or form is it trying to remove him from office," Green said, adding that council wants all elected officials in the city on the same page with 12 years in office.
Voters in 2016 approved extending the term limit for the office of mayor from three four-year terms in office or 12 years to five four-year terms or 20 years.
Fouts said he hasn't decided whether he would run for a fifth term as mayor and called the council's ballot question vote "a distraction."
"They want to take over the office of the mayor," he said. "They don't think they can beat me in a fair and square election."

Tracy Green is a judge at the Wayne County Family Court. Her job is to determine whether children are being abused and to protect them. Her grandson says she not only ignored how her son - who is his father - beat his kids, he says she covered it up.
"My dad would tell her about a bruise I had or something, and she'd put make-up on it 'cause we had to go to school and stuff and she didn't want people to see," her grandson said.
The young boy, who FOX 2 is not naming, says Green would put the makeup on him in her upstairs bathroom.
Green denies the allegations entirely.
"I didn't put makeup on any bruises, conceal any abuse, that is utterly preposterous," Green said. "It just didn't happen."
Green, an experienced family court lawyer, was running for judge last summer when a disturbance at her son's home prompted neighbors to call 911.
The following is a portion of the 911 call made last summer:
"He was beating his kids like, I'm talking about, he's been beating them for like 45 minutes. And this is like beyond a whooping. He was over there screaming and telling them, like, how he blacked their mama's eyes, he would kill everybody," the caller said.
A second caller said the ruckus interrupted her slumber:
"Woke me up out my sleep he was beating these kids so bad."
When Detroit Police and Child Protective Services workers arrived, they found a house in chaos. Green's son, Gary Davis-Headd, admitted that he hit his then 8 and 10-year-old sons with a belt.
Where fraud is a forbidden word to be spoken
The beating was so severe, CPS removed the boys and three other children from Davis-Headd's home. Over the next few months, the boys and their siblings told child welfare workers and testified in court that their dad turned their cramped home into a house of horrors.
Both boys spoke with FOX 2 with their mom present. The younger boy, who is now 9, described what life was like in his dad’s house.
"It was bad and difficult," he said. "We weren't getting fed right and stuff and we got beat."
In interviews with child welfare workers and on the witness stand, the boys and their siblings described how their father ordered the boys to strip down to their shorts, kneel down, then stick their face in a pillow to muffle their cries as he whipped them with a belt.
The children and their stepmother also told investigators and testified that their father once choked out their stepmother until she passed out. The children said they thought she was dead, until their father splashed water on her face.
Davis-Headd denied beating his wife, but acknowledged what he called "spanking" the boys - and even his young daughter - with a belt. He denied abusing them, however, and explained that he was administering appropriate discipline.
In March, after deliberating for less than an hour, a Wayne County Family Court jury found him guilty of neglect and said he put them at substantial risk of harm to their mental well-being and was unfit to care for them.
The judge said he found Davis-Headd's testimony to be "appalling and abhorrent" and that Davis-Head demonstrated "a complete an utter inability to understand parenting at all."
The judge concluded that "by clear and convincing evidence" Davis-Headd "abused the children" and "there is a reasonable likelihood that the children will be harmed if returned" to him.
Green, who became a judge in the same courthouse earlier this year, doesn't agree.
"Obviously, I love him. He's my son and he's a decent person. He's certainly not without his challenges and beyond that I can't really get into a lot of opining, because there's open litigation concerning him. I'd like to, but I'm bridled in that way," Green said.
Because she's a judge, Green is bound by rules that prevent her from speaking as freely as she would like. She can, however, address matters that came up in court. That's good because the investigation into her son raises questions about what she knew - and when.
Her eldest grandson not only testified that Green used makeup to hide his bruises, he testified that he had been telling her since 2016 that his father was beating him. What follows is some of what he said on the witness stand:
"Like almost every time I saw her, I told her. I told her about the time he choked her (his step-mom). I told her about the times he beat us that I remember. I don't remember too much now. I told her about most everything.
"I told his mom, my grandmother."
Attorney: "Your grandmother Tracy?"
Boy: "Yes."
Later on in his testimony, he says nobody ever tried to help him, including her.
"She never helped us," he said.
Green said it was painful to hear her grandson say that, but added it's not true.
"It's not truthful at all," Green said. "I have some opinions, but it wouldn't be appropriate for me to give them to you because of pending litigation."
Her oldest grandson initially told child welfare workers that his stepmother put makeup on his face to cover up his bruises. When FOX 2 asked him to clear up the contradiction in what he told welfare workers and what he testified to, he said both his stepmother and grandmother used makeup to conceal his injuries.
Davis-Headd's attorney tried arguing in court that the boys were not truthful and had been coached by their mother, Choree Bressler, who does not get along with their father or judge Green.
The eldest grandson testified: "Nobody told me what to say. All my mom said was, 'just tell the truth.'"
A child welfare worker reported that Green told her she once heard her son yelling at one of her grandsons, heard a slapping sound, and saw a handprint on the boy's face. That would suggest that she had some awareness that her grandkids were being hit.
"It certainly would suggest, but regarding the comments that are attributed to me, I never said that. Not even anything close to that," Green said.
Green was called as a witness in her son's custody case. When asked about that report, she acknowledged seeing a handprint on her grandson's face - and denied the rest.
When the prosecutor asked Judge Green if she remembered telling a child welfare worker that she had spoken with her son "about how he disciplined the children," she said: "I don't specifically remember that, but I don't dispute it."
She also testified that the children told her they were spanked, but she never asked what that meant.
She also testified, under oath, that she did not use makeup to cover any bruises.
FOX 2: "There are people who would say that if these kids were beaten so badly and so regularly and left with so many marks, how did someone with your pedigree miss it?"
Green: "Well, I think the assumption there is that, what you just said is true."
The possibility that a judge may have lied under oath is the kind of thing that might interest the Judicial Tenure Commission, which polices judges. Fox 2 described the situation to Peter Henning, an expert on judicial ethics at the Wayne State University School of Law, who said:
"She has an obligation to tell the truth. If there's any issues with regard to her not telling the truth, the Judicial Tenure Commission is going to be very interested in that, because that could effectively be thwarting what the family court would be doing."
Currently, only her grandson is accusing Green of a cover-up, but the case against her son raises concerns because it transcends one family's tragic story.
Green says the people of Wayne County can count on her to protect their kids.
"I am certainly capable of protecting children from my perch as a Third Circuit Court judge," she said. "There's nothing that I have done or would ever do that would jeopardize the safety of any child - particularly a child that I love.
"And what I'm saying to you Mr. Elrick, is that I've done nothing wrong, I've not failed to do something that I should have done. And that's the bottom line."
As for Davis-Headd, he's got more legal problems as he's facing criminal charges of child abuse and domestic violence. He pleaded not guilty to those charges and is scheduled to go on trial next month.
I was supposed to be the Master of Ceremonies, but that all changed when I continuously questioned how it was possible to spend so much money on putting on a spectacular event, with valet parking, formal dining, musical groups, youth dancers in full costume and hired speakers.
Despite my suggestions of sponsorship and collaboration with other groups to expand an audience to bring awareness to what was going on in child welfare, I was shut down.
That was not a problem because it was not my event.
I proposed breakout work sessions for advocacy.
I even went so far as to invite "The Elected Ones" and community leaders since no one wanted to publicly broach the topic of child welfare fraud.
Faith Based Initiative funding was the community propaganda funding scheme launched under G.W. Bush.
In a nutshell, Faith Based funding was doled out to churches, particularly in, oh, how shall we say this, "inner cities that are traditionally democratic and poor."
This was the birth of the megachurches, where massive temples were constructed in the inner cities to "inform" the public on public issues.
Now, of course, those public issues were hand picked by the current administration, the same concept of the Request For Proposals (RFP), where funding is based upon what those in power want, and not what is of concern to the community.
Surrounded by these megachurches were zones of intense poverty.
The "privateers" are federally funded, condoned with religious propaganda, just like has always been done:
“We weighing all and singular the premises with due meditation, and noting that since we had formerly by other letters of ours granted among other things free and ample faculty to the aforesaid King Alfonso -- to invade, search out, capture, vanquish, and subdue all Saracens and pagans whatsoever, and other enemies of Christ wheresoever placed, and the kingdoms, dukedoms, principalities, dominions, possessions, and all movable and immovable goods whatsoever held and possessed by them and to reduce their persons to perpetual slavery, and to apply and appropriate to himself and his successors the kingdoms, dukedoms, counties, principalities, dominions, possessions, and goods, and to convert them to his and their use and profit -- by having secured the said faculty, the said King Alfonso, or, by his authority, the aforesaid infante, justly and lawfully has acquired and possessed, and doth possess, these islands, lands, harbors, and seas, and they do of right belong and pertain to the said King Alfonso and his successors”.
The concept of slavery had finally been introduced as a mainstream concept in child welfare, but as the idea of child welfare being the "residual of the peculiar institution" is so novel, being completely omitted from the vernacular of the academic world, discord of the discourse will go on for the next four scores and seven years, all funded through relious faith based initiatives,
Chaos is a stable and predictable, open system.
How can one "fight the system" when it was designed to function under property law, or rather chattel law?
There is no parallel jurisprudence and now, through privatization, there is no redress of grievance.
How can there be shared parenting when the state, codifed in federal law, retains parental authority, or rather parental rights under the doctrine of commerce?
If a child is under the aegis of the state, is this not parental rights and would that mean that an origianl parent would have to share with the state?
Does this sharing include federal funding?
I was going to do an introductory lecture on my book, but that would be considered commerce and selling it, which will eventually be online, would violate that religious based funding eligibility.
The distractive bickering of "black-man-hate-white-man-hate-black-man-hate-white-man" will be well funded with the blessings of tax exempt God, with lots of fancy events praising the "profiteers" who continue their financial swashbuckling of the children, the land and the votes.
This State of the Children event was put on with this funding which is why there can be no corporate partnerships or profiteering.
This is why the FBI will participated in these community outreach functions.
But, the funding issue is not the sole issue which has me miffed.
FBI Special Agent In Charge, Dave Gelios made a statement which took me aback.
He came up after the Child Custody, Child Protective Services, Foster Care and Adoption horror stories of fraud.
I noticed that he was in a bit of a controlled shock as he broughtforth the disclaimer that his staff had advised him the subject matter of the event was human trafficking and the opioid crisis.
I cannot stand when staff does this crap.
It is just personal.

DETROIT (WXYZ) - Carnell Alexander says he got a shock during a traffic stop in the early 1990s. The officer arrested him, telling him he is a deadbeat dad.
When he appeared in court Alexander told the judge, he didn’t have any children. The court told him to find the woman.
The court gave him an old address. When he couldn’t find her, he says was told he would have to pay.
“It is such an unfair system,” said Alexander. “Period.”
He later learned that while he was in prison for a crime he committed as a young man, an ex listed him as father on an application for welfare benefits. Notice of the paternity hearing that followed was taken to his old house.

Families & Children Justice is hosting the "Save Our Children" event at Belle Isle, Detroit, Michigan on September 24, 2016. The even is to promote public awareness on issues of civic engagement in dealing with child poverty and civil rights in child welfare.
Each year, in Michigan, this little group of sanctimonious arbitrators, armed with their lust of being bestowed community recognition of their self-imposed adjudicative powers of stripping the rights of due process from "the poors"m the Foster Care Review Board has a nomination process.
Each year the Foster Care Review Board provides a forum for recognition of the excellent work that is performed by child welfare professionals who work diligently to overcome systemic barriers and go above and beyond policy, court rule, and statutory standards to help ensure the safety, well being, and timely permanency for children and families served by our foster care system.
TRANSLATION TO REALITY: Each year the Foster Care Review Board makes no recommendations to the Michigan Attorney General's Office for suspected violations of law and policy, nor does it make recommendations of civil rights violations or fraud within its child welfare system.
The annual awards are presented to those on the “front lines” who have displayed a commitment to excellence and integrity in serving the needs of our states most vulnerable children and families.One nominee from each of the following categories – jurist (judge or referee), foster care caseworker, lawyer-guardian ad litem (LGAL), foster parent(s), and parent attorney – will be recognized for their exemplary service to abused or neglected children in the Michigan foster care system. All other nominees will receive a congratulatory letter from the Foster Care Review Board, informing them of their nomination and thanking them for their service. TRANSLATION TO REALITY: The annual awards exclude anyone who has fought on the front lines against the nefarious indolence of administrative buffoons like Steve Yager and Bill Johnson.

There is no option to nominate anyone who has made substantial efforts to end fraud, waste and abuse of Medicaid funding and the horrors of privatization.
There is not even an option for a birth parent who has successfully advocated for their own child.
Why, one may ask. Well, it would be quite an awkward situation to acknowledge the child welfare system has flaws due to the fact the state is still under federal monitoring.
So, it is at this point I ask for everyone who cares about providing equal justice to the poor, or just to give a voice to a child who is in the foster care system screaming, silently, writhing in seering physical and emotional pain, to give recognition to the work of an individual who has dedicated her life to illuminating the injustices of foster care.
