Special prosecutor named to look into Jussie Smollett case

CHICAGO (AP) — A judge appointed a special prosecutor Friday to look into why the Chicago state's attorney's office abruptly dropped the case against Jussie Smollett, leaving open the possibility that the former "Empire" actor could yet face charges in what police say was a phony attack on himself that he staged to get attention.

Smollett, who is black and gay, maintains that he was the target of a racist and homophobic attack in January. But if the special prosecutor, former U.S. Attorney Dan Webb, determines that the charges shouldn't have been dropped, he could recommend that they be reinstated or that new charges be brought.

Webb, who was appointed by Cook County Judge Michael Toomin during a Friday hearing, told reporters afterward that he would move the investigation along as quickly as possible. Such probes typically include impaneling a special grand jury, issuing subpoenas, taking witness statements and a final report.

"I intend to expedite everything. But the facts will take me where they take me," Webb said. "I'm going to start fresh and see where it goes."

The Cook County state's attorney's office charged Smollett in February with 16 counts of disorderly conduct for allegedly staging the attack and lying about it to investigators. However, it dropped the charges a month later with little explanation, angering city officials and the police.

Webb, who served as U.S. attorney in Chicago during the 1980s before going on to become arguably the city's most high-profile defense attorney of the last few decades, has been tapped to serve as a special prosecutor on five previous occasions. His list of high-profile clients has included former Illinois Gov. George Ryan, tobacco company Philip Morris and, more recently, Ukrainian energy oligarch Dymitro Firtash.

As a special prosecutor in 2012, Webb was asked to reopen the investigation into the death of David Koschman, who died after being punched in 2004 by then-Chicago Mayor Richard M. Daley's nephew. After an investigation of more than a year that included testimony from nearly 150 witnesses, Webb determined that charges were warranted.

Toomin said the 73-year-old Webb wasn't the first person he considered for the Smollett case. The judge was required by law to first see if the state attorney general, the appellate prosecutor or a state attorney from elsewhere in Illinois wanted the job. During Friday's hearing, he suggested few expressed interest in leading an investigation whose outcome will inevitably spark outrage in some quarters.

"I might say that the responses were less than enthusiastic, as you might expect," Toomin told the courtroom.

A former state appellate judge, Sheila O'Brien, petitioned for a special prosecutor earlier this year in what many believed was a long-shot to reopen the case. But in a surprise decision, Toomin ruled in June that a special prosecutors was, in fact, called for, citing "unprecedented irregularities" in how the case had been handled.

A Smollett spokeswoman declined to comment Friday. But in court filings last month, Smollett's attorneys sharply criticized Toomin's decision to appoint a special prosecutor with broad powers, calling the process a "travesty of justice."

Smollett, now 37, told police he was walking home early on Jan. 29 when two masked men approached him, made racist and homophobic insults, beat him and looped a noose around his neck before fleeing. He said his assailants, at least one of whom he said was white, told him he was in "MAGA country" — a reference to President Donald Trump's campaign slogan, "Make America Great Again."

Several weeks later, authorities alleged that Smollett had paid two black friends $3,500 to help him stage the attack because he was unhappy with his salary as an actor on "Empire" and wanted to drum up publicity for his career.

In his June ruling, Toomin suggested that the county's state's attorney, Kim Foxx, mishandled the case by appointing a top aide to oversee it after she recused herself.

Foxx had been in contact with a Smollett relative and was approached by former first lady Michelle Obama's one-time chief of staff on behalf of Smollett's family. Foxx explained at the time that she was recusing herself to avoid "even the perception of a conflict" of interest.

Foxx has said that Smollett was treated no differently than thousands of other defendants in low-level cases whose charges have been similarly dropped. She also publicly wondered if her being black had anything to do with the criticism she received.

She released a statement Friday pledging her office's "full cooperation" with Webb's investigation.

When you have your entire licensed profession, come forth, to bear witness, in the content of its character, in the official use of its seal, to say that you messed up, you messed up.

This is deeper than Jussie Smollet because his sister sits on the board of the Children's Defense Fund, a money laundering trafficking tiny humans network that funds campaigns.

Children's Defense Fund Holds Its Annual Tax Exempt Propaganda Hustle

The New York Society for the Prevention of Cruelty to Children started with Animals.  

Seriously.

Instead of these lavish events speaking upon the rape, torture, drugging and human trafficking of children of "The Poors" in the foster care and adoption industry, the Who's Who of New York will come out to rally for more money to market and procure more children.

April, of course, is the month of child abuse prevention propaganda where all the street level, tax exempt, non-profits will hit the pavement with their blue pinwheels, and what naught, to promote an atmosphere of fear and safety for a child by calling Child Protective Services.

But, of course, there will be no mention of fraud because all the fundraising will go into what is called Trust Funds!

Each state has a Children's Trust Fund which is strictly used for marketing child abuse propaganda, but they call it "direct service and technical grants".

Gotta keep it classy and clandestine, you know how dark money operates.

Nothing goes to assist a family seeking housing (notice I did not even dare mention quality and affordable housing), health or mental care assistance, or any other forms of access to basic living resources.

The money is invested and lest not fail to mention those child welfare privatized lines of credit.

When A Child Shoots The Parent, Call CPS

This commentary was taken from a Twitter post of the Children's Defense Fund which raises the issue of gun violence by children, little kids, where the victims are the parents.

As I have been touting for more than 10 years, all policies begin with the child so why not start here with ending gun violence.

Under the policies of Child Protective Services, it would be considered child neglect to be shot by a gun you own, by your own child.

The Children's Defense Fund could start a public awareness campaign to let people know that CPS will prosecute both parents, for allowing their child to engage in criminal behavior with the improper discharge of a firearm, and in some instances, murder.

Then, the children would be placed in foster care, subjected to intense psychotropic medication while a concurrent plan of adoption is put into play.

This may sound like a harsh proposal, but the laws are already on the books.

Children are placed in foster care for reasons far less.

CPS can remove a child from a home for being poor or in need of mental health services but cannot step up to the plate to protect children, and families, when it comes to gun violence.

This is just another parody I put together to make people think just how ridiculous our child welfare laws are selectively applied to protect children.

When Kids Shoot Their Parents: An American Tradition

Shots fired at mothers and fathers by sons and daughters are as much a part of the history of gun ownership as Davy Crockett or the Minutemen.

When aspiring gun model and staunch Second Amendment defender Jamie Gilt was shot by her four-year-old son in Florida earlier this week, some observers saw a moment ripe for the particular form of schadenfreude most at home on social media: an instant-karma story of someone getting what was coming to them.

A prolific sharer of pro-gun memes, Gilt had recently posted “My right to protect my child with my gun trumps your fear of my gun” to her Facebook page, and on Twitter referred to a gold-tone handgun as “my new toy.” It felt almost inevitable that her child and her toy would find each other with calamitous results.   

To regard Gilt’s shooting as a black comedy of just deserts would be a mistake, however. Her family’s near tragedy is also the latest chapter in  a mostly forgotten history of very young children accidentally shooting their parents. Recorded as part of a litany of gun accident reports that stretch back deep into the eighteenth century, shots fired at mothers and fathers by sons and daughters are as much a part of the American tradition of gun ownership as Davy Crockett or the Minutemen..

“Baby Accidentally Shot His Mother,” read a 1909 headline in Illinois. The story that followed recounted how a boy named John, 14 years old, had come in from hunting rabbits and placed his rifle in the corner of the room. Then his three-year-old brother Harold took up the gun and shot their mother as she tended the fire, “the bullet entering the front of her neck and passing out just behind the ear.”

Like Gilt, many of the parents involved were proud gun owners, eager to pass down a heritage of sportsmanship and self-reliance.

“A Chicago father bought his boy a .22-caliber revolver and was proud of the fact that the youngster was making great progress as a marksman,” a report from Pennsylvania said in 1900. “A few days ago the boy accidentally shot his mother, and, after several days lingering between life and death, she is now dead. There is a lesson to be learned in this by indulgent fathers. There are plenty of things for boys to play with besides firearms.”

The notion of “play,” too, can be found across the centuries. Here’s one such occasion from 1897:

Fults that “I hit mommie.”

Hillary Clinton Called Minority Kids "Superpredators Who Must Be Brought To Heel"

As Secretary Hillary Clinton wishes to steer her campaign towards her work in child welfare, I find it

only proper to assist her in her endeavors.

Here is a clip from 1997, right around the time of the passage of the Adoption and Safe Families Act, where she refers to juveniles as "super-predators who must be brought to heel".

The term, "bring to heel" is from the command to make a dog closely follow its master.

It also means to compel someone to obey, to force someone into a submissive condition.

For those who are just now being exposed to the industry of child poverty, or rather child welfare, the Secretary is making reference to "targeted populations" and we all know this is in reference to those who hail from traditionally economic disenfranchised of the darker persuasion.

This was the political rhetoric that launched to the disparaging policies of juvenile justice and child welfare.

Just another little known moment in history to remember Black History Month.

Hillary Clinton, Child Poverty, & A Campaign In Flint, Michigan

The times when I stumble across child abuse related propaganda which is so perversely distorted that it literally brings me to tears in disgust are quite rare.

This is one of those moments.

For U.S. Congresswoman Karen Bass to shamelessly come out and support a political candidate by controlling the narrative of the national foster care system as a success is an utter embarrassment to my intelligence and my mission.

Yes, this is a wonderful story and I am proud of this gentleman, but now is the time to show courage by standing up and admitting that the Adoption and Safe Families Act has codified poverty as the crime of abuse and neglect.

As Secretary Hillary Clinton wishes to tout her work with child welfare, I believe it is only fitting to let her know that my entire blog is dedicated to inspire anyone in leadership to admit the reality of the secrecy behind the iron curtain of foster care.

Everyday, children in foster care are raped, drugged and tortured, yet, due to privacy constraints, very few even know that the majority of these children were removed due to poverty.

In 1997, the Adoption and Safe Families Act created an expedited, cost reimbursement system and launched a campaign to end poverty from the platform of "the best interest of the child" and Michigan led the nation in the development of policies to maximize revenue from the chattel of the poor,

The federal funding flood gates were opened as direct funding to assist families in need was shut down under the Personal Responsibility Work Opportunity Reconciliation Act.

PRWORA also stripped what little civil rights protections that existed from the poor to raise children.

The Children's Defense Fund is nothing more than the propaganda machine to criminalize poverty and sugar coat the entire child welfare industry as it is too big to fail.

I will even go so far to allege that this non-profit has, contributed and/or coordinated, in some for or fashion, to her Super PAC.

ASFA, for which the States have failed to meet one single benchmark, allows for children to be Legally Kidnapped.

Until I hear Madame Clinton speak upon the targeting of populations, the horrors of foster care, the ills of poverty and the culture of rampant fraud in child welfare, for which ASFA has promulgated, I will make it my hobby to call her out, and any other individual who fails to address the reality of hell for any child who survives foster care and those who did not.

I did not just write a book on this, I am an original source.  Hillary Clinton is not.

Welcome, Secretary Clinton to Genesee County, Flint, Michigan, second to Detroit in child poverty rates, where children would be typically removed from the homes in these lead related issues as a situation of environmental neglect..

This time, there are too many.

I am glad you find the urgency to protect vulnerable children of Flint, but I ask you, "Where were you all these years?"

How Hillary Clinton Inspired a Foster Youth to Become a Lawyer

As the Co-Chair of the Congressional Caucus on Foster Youth, I have time and again seen the power of positive mentorship. With encouragement and opportunity, many of the roughly 424,000 children in America's foster system go on to lead successful lives. That said, I was still deeply moved by this Hillary Clinton inspired video featuring Jelani Freeman, a foster youth turned government lawyer.

If you haven't watched the video yet, you absolutely should! Jelani describes a moment from his 2003 internship in Hillary's Senate office when he came across his boss talking with Sen. Ted Kennedy. As Jelani tells it, Hillary was "bragging about" him as an incredible young man who had rocketed from foster care to Capitol Hill.

That encounter meant the world to Jelani. "I grew up... just wanting someone to be proud of me," he says. "It was moments like that when Hillary would brag about me and build me up that I really, really treasure."

It's not often we get these glimpses into a presidential candidate's personal side. I'm thrilled that Jelani shared his story, as part of the "Let's Talk Hillary" project, and I'm hopeful that Hillary's example can inspire others in this country to offer support. After all, role models like her make all the difference.

In Hillary's case, Jelani is a single but important example of a long career helping young people. As a lawyer with the Children's Defense Fund, Hillary advocated for juvenile justice reform. She later worked as First Lady to push the Adoption and Safe Families Act of 1997, which boosted foster adoptions by 64 percent by 2005. And as Secretary of State she created a special advisor on international children's issues while bolstering foster care worldwide.

Hillary's current platform is equally ambitious. She calls for universal preschool, so that children with fewer resources can make strides alongside their wealthier peers. Meanwhile, her New College Compact promises lower tuition rates, which means people like Jelani can continue to succeed from foster care onto college.

Too Small to Fail, family planning, criminal justice--the list goes on. My point is this: when it comes to helping children, Hillary has far more experience and far more detailed proposals than her opponents, Democrat and Republican alike. That fact, alone, earns her my vote.

Congress can only do so much, even on issues where both parties agree. The power to protect foster children will largely rest with a bully pulpit and executive actions--with the next leader in the White House. Four (or eight) more years are too many to wait around on this issue.

Jelani's story follows a pattern. If you had successful former foster children how they came to succeed, I'd be willing to bet a person like Hillary played a role. And with Hillary's nuanced proposals, many more foster kids can be business leaders or civil rights activists--maybe, one day, the President of the United States.
