Turning Point USA co-founder Bill Montgomery dies after contracting coronavirus

One of the founders of the youth conservative group Turning Point USA died at the age of 80 from complications of the coronavirus.

Bill Montgomery died on Tuesday after being diagnosed with COVID-19, according to two of his friends: pro-Trump conservative strategist Caleb Hull, who posted about the death on social media, and Chicago-based citizen journalist Vic Maggio.

In a statement acknowledging Montgomery's death, Turning Point USA released a statement calling the co-founder its “first believer and senior advisor."

“I can’t put into words how saddened I am by the death of my dear friend Bill Montgomery," Charlie Kirk, who co-founded the organization with Montgomery, told Politico.

A 2015 National Journal story explained that the two met at an event at Benedictine University and Montgomery urged Kirk to skip college so he could "start an organization to reach out to young people with your message.”

“It was Bill and Charlie’s chance encounter in 2012, along with Bill’s generosity and willingness to invest in an 18-year-old with no experience and no connections that gave birth to the dream that would one day become Turning Point USA,” Turning Point said of the discussion.

Kirk has frequently derided health officials' recommendations for people to wear masks while indoors or when they are unable to socially distance in order to stop the spread of the coronavirus.

“[E]very single time I go into one of these grocery stores, ‘Where’s your mask?’ I say, well first of all, the science around masks is very questionable, very questionable,” he said during a recent episode of his podcast. “In fact some people, some doctors think that masks actually make you sicker and have you less likely to be able to get oxygen and more likely to infect yourself, and less likely to be able to fight the virus, and actually more likely to be able to die sooner."

Hull tweeted a message that said he hopes people will stop politicizing the pandemic.

“I really wish people would just stop politicizing this pandemic and grow up while innocent people around us are dying,” Hull said. “You have no idea how painful it is to be forced to sit at home while your loved one dies alone in a hospital.

After ruling in New York gun rights case, more Second Amendment cases set for Friday conference

Yesterday the Supreme Court issued its long-awaited decision in a challenge to New York City’s ban on the transport of licensed handguns outside the city. Because the city had repealed the ban last summer, a majority on the court agreed with the city that the challengers’ original claims are moot – that is, no longer a live controversy. In a concurring opinion, Justice Brett Kavanaugh joined the majority in concluding that the case should go back to the lower court, but he also indicated that he shared the concern – expressed by Justice Samuel Alito in his dissenting opinion – that the lower courts “may not be properly applying” the Supreme Court’s most recent gun rights rulings, in District of Columbia v. Heller and McDonald v. City of Chicago. Therefore, Kavanaugh suggested, the Supreme Court “should address that issue soon, perhaps in one of the several Second Amendment cases with petitions for certiorari now pending before the Court.” The court’s electronic docket reveals that Kavanaugh’s suggestion may come to fruition soon: By the end of the day yesterday, the Supreme Court had distributed for consideration at Friday’s conference 10 cases that had apparently been on hold for the New York case.

Several themes emerge from the cases that the justices will now review on Friday. The justices are being asked to weigh in on (among other things) whether and to what extent the Second Amendment protects the right to carry a handgun outside the home for self-defense, whether state and local governments can ban assault rifles and large-capacity magazines and whether the federal ban on interstate gun sales is unconstitutional. A full list of the 10 cases distributed for Friday’s conference, as well as a brief description of the question presented in each one, follows the jump.

We expect orders from Friday’s conference on Monday, May 4, at 9:30 a.m. EDT.

Mance v. Barr – Whether the federal ban on interstate handgun sales violates the Second Amendment or the due process clause of the Fifth Amendment.

Rogers v. Grewal – In a challenge to New Jersey’s handgun carry permit scheme, whether the Second Amendment protects the right to carry a handgun outside the home for self-defense; and whether the government can condition the right to carry a handgun outside the home on the showing of a special need to carry a firearm.

Pena v. Horan – In a challenge to a California law banning most commonly used handguns, the petition asks the justices to weigh in on the scope of the Second Amendment.

Gould v. Lipson – In a challenge to Massachusetts’ handgun carry permit scheme, whether the Second Amendment protects the right to carry a handgun outside the home for self-defense; and whether the government can condition the right to carry a handgun outside the home on the showing of a special need to carry a firearm.

Cheeseman v. Polillo – Challenge to New Jersey handgun carry permit scheme.

Ciolek v. New Jersey – Challenge to New Jersey handgun carry permit scheme.

Worman v. Healey – Challenge to Massachusetts ban on the possession of assault weapons and large-capacity magazines.

Malpasso v. Pallozzi – In a challenge to Maryland’s handgun carry permit scheme, whether the Second Amendment protects the right to carry handguns outside the home for self-defense.

Culp v. Raoul – Whether the Second Amendment requires Illinois to allow nonresidents to apply for a concealed-carry license.

Wilson v. Cook County – Challenge to Cook County’s ban on assault rifles and large-capacity magazines, as well as to the Second Amendment analysis used by the U.S. Court of Appeals for the 7th Circuit to uphold the ban.

Who Is Alleged Russian Spy Maria Butina?

Confessed Russian agent Maria Butina, who was released from prison and immediately deported back to Moscow in October, has been invited to join Russia's High Commissioner for Human Rights to assist citizens in various predicaments overseas, according to comments she made in an interview published Tuesday.

Speaking with Russia's Federal News Agency, Butina said as part of her post-incarceration advocacy she will work to raise funds for Konstantin Yaroshenko and Viktor Bout, two Russians serving lengthy prison sentences in the United States.

Yaroshenko, a former aircraft pilot, was convicted in April 2011 of conspiring to smuggle cocaine into the United States. The Justice Department says he is a trans-national drug trafficker "who transported thousand-kilogram quantities of cocaine throughout South America, Africa, and Europe."

Bout, an international arms dealer, was convicted by a U.S. jury in November 2011 for his participation in a conspiracy to sell weapons to Colombian FARC rebels, an armed guerilla group that had long been in conflict with the country's security forces. The FARC officially disarmed in 2016 amid a broader peace deal with the Colombian government.

In the interview, Butina decried the "huge sentences" and "terrible conditions" both men are facing. Yaroshenko was sentenced to 20 years in prison; Bout was sentenced to 25.

In response to a request for comment, Lee Ginsberg, a lawyer for Yaroshenko, provided Newsweek with the following statement:

"I always believed that Mr. Yaroshenko's prosecution was the result of the overreaching of the U.S. government in a drug sting operation. Hopefully, this new development will lead to his release from custody."

Newsweek reached out to the Russian Federation's Commissioner for Human Rights about Butina's work and has not yet heard back.

As part of her plea deal with federal prosecutors in the District of Columbia, Butina admitted to establishing "unofficial lines of communication" with American powerbrokers in order to influence domestic politics at Russia's behest. Working to advance the interests of a foreign entity often requires pre-registration with the Justice Department, which Butina admitted did not do.

Butina's years-long efforts included attempts to infiltrate the National Rifle Association (NRA) and ingratiate herself with influential conservatives. By attending various NRA conferences and co-mingling with Republican attendees, she hoped to establish an unofficial back channel to a prospective Trump administration.

More than just a rogue operator, Butina has become a cause célèbre in her native Russia after making well-publicized comments about the conditions of her confinement in the United States.

Her characterizations of the American prison system and descriptions of languishing inside solitary confinement have served as fodder for Russian propaganda, but they also recall credible criticisms of how the United States treats detainees.

As part of the work she says she will do for the human rights commission, Butina described a hotline she will purportedly help develop to provide legal assistance to Russian citizens. She also said she will push to eliminate abusive prison practices internationally.

"I will be working to ban torture in the form of prolonged solitary confinement in places of imprisonment around the world," she said. "You need to call things by their names, a person is not meant to live in isolation. Solitary confinement is torture. Even though the U.N. convention classifies it as torture, this method of punishment is still widely used, especially in the United States. My four months in solitary confinement is a great example."

In the interview, Butina also recounted a previously untold story about being welcomed back to Russia once her prison sentence was complete. After being put on an Aeroflot plane in Miami, she claims, a reporter handed her a phone with Maria Zakharova, the spokesperson for Russia's Foreign Ministry, on the other end of the line.

According to Butina, Zakharova comforted her, saying, "Maria, the whole country is looking at you. Get ready, we have been waiting for you so much."

Butina says she will work on preparing a forthcoming report on the status of Russians currently in legal jeopardy abroad.

In terms of the cases of Yaroshenko and Bout, which the Russian government has been pressing for years, Butina believes that the President Donald Trump's administration is no longer willing to cooperate on these sorts of issues.

"We expected one thing, for example, that a friendly [President Donald] Trump would be interested in building a new, good relationship between Russia and the United States, and that the United States would stop being hostile towards Russia," she said. "But as you see, it turned out to be the opposite of that."

Butina professed a sense of patriotic duty in her purported work for Russian citizens on behalf of the government, which regularly detains dissidents and utilizes torture, according to Human Rights Watch.

"The Russians do not abandon their own, so now the baton is in my hands, and I consider it my duty to help those who find themselves in the same situation," she said.

Byrne and his family contributed most of the funds in support of House Bill 148 in Utah, a bill that would allow the state to provide funding vouchers for students who decide to leave public schools for private schools.[54] In January 2008, it was reported that Byrne and his parents contributed about $4 million to the pro-voucher campaign, or three-quarters of its $5.4 million funding. Opponents of vouchers, funded mostly by the teacher unions, spent $4 million; approximately $3 million came from the National Education Association.[55][56] When that bill was defeated in a statewide referendum (62% opposing vs. 38% favoring),[57] the Salt Lake Tribune reported that Byrne "called the referendum a 'statewide IQ test' that Utahns failed." He said, "They don't care enough about their kids. They care an awful lot about this system, this bureaucracy, but they don't care enough about their kids to think outside the box."[58]

Byrne criticized Utah governor Jon Huntsman for not sufficiently supporting the voucher campaign. According to Byrne, Huntsman had before he was elected stated that he was "going to be the voucher governor", and Byrne had donated $75,000 to Huntsman's campaign for governor in 2004. However, to Byrne's disappointment, the moment Huntsman was elected he went missing from the debate, and Byrne told the Associated Press that he would now bankroll anyone who could defeat Huntsman at the polls, "even a communist".[59]

Byrne was also against short selling in dealing with banks and Google, but if you say he was funding political campaigns through child welfare fraud, I think you may be on the right track, too, but hey, what do I know?

Overstock shares plunge more than 30 percent after CEO says he assisted 'Russia investigation'

Shares for the internet retailer Overstock have plunged more than 30 percent this week after its CEO issued a statement saying that he assisted efforts to investigate Russian interference in the 2016 election.

The e-commerce company's stock has fell by 36 percent since Monday, a figure that represents its biggest two-day hit in 11 years, Bloomberg News reported.

The significant slide began after CEO Patrick Bryne came out with a statement about what he referred to as the "deep state."

"Starting in 2015 I (operating under the belief that I was helping legitimate law enforcement efforts) assisted in what are now known as the ‘Clinton Investigation’ and the ‘Russian Investigation,’" Byrde said on the company's website. "It was the third time in my life I helped the Men in Black."

“I will speak no more on the subject,” he continued. “Instead, having lived in places lacking Rule of Law and having witnessed the consequences of its absence, I plan on sitting back and watching the United States Department of Justice re-establish Rule of Law in our country.”

Bryne did not address any specifics regarding the aid he offered the investigation. His statement appeared to have come in response to an independent journalist's story about the Russia probe.

Bloomberg News noted that Byrne has a history of making unusual statements. Among other things, the CEO has compared the e-commerce giant's cryptocurrency goals to the polio vaccine, the news outlet noted.

Overstock becomes the latest company to see its stock tumble following controversy related to politics. Wayfair, an online furniture company, has experienced a 7 percent plunge in stocks since employees discovered it sold beds to a detention facility housing migrant children, The Washington Post noted.

Employees found out in June that a nonprofit government contractor managing migrant camps placed a $200,000 order for bedroom furniture.

Trump taps former House speaker as Grand Rapids U.S. attorney

President Donald Trump has nominated Michigan’s former House Speaker Tom Leonard to be U.S. attorney for the Western District of Michigan, even as a criminal bribery case against one of his Republican caucus members is prosecuted from the office.

The announcement of Leonard, a former assistant attorney general and assistant prosecutor, as the nominee was made Wednesday. The position requires Senate confirmation.

The DeWitt Republican said Trump's consideration was an "incredible honor."

"Since becoming a prosecutor in Genesee County, my heart has been to work with law enforcement to keep our citizens safe," Leonard said in a Wednesday statement. "I look forward to working with the White House and the Senate as we work through the confirmation process."

If confirmed, Leonard would oversee an office prosecuting one of his former caucus members for charges that stemmed from a controversial prevailing wage initiative vote during Leonard's tenure as speaker. He also is the subject of a civil lawsuit in the Western District alleging the former House speaker used his influence to pressure an insurance association to fire its lobbyist.

The civil lawsuit against Leonard wouldn't have much of an impact on his duties as U.S. attorney, said Peter Henning, a law professor at Wayne State University.

Leonard also could recuse himself from criminal case against his former Republican colleague, Henning siad.

"That doesn’t preclude him from becoming the U.S. attorney, but it will require him to not have any involvement in that prosecution," Henning said.

The Western District has been lacking a Senate-confirmed U.S. attorney since early 2017.

Andrew Birge has served as U.S. attorney for the Western District of Michigan since the day Trump took office on Jan. 20, 2017, when Democratic U.S. Attorney Pat Miles resigned from the office. Why is it reported that Miles 'resigned' when McQuade was 'fired'? Odd. Birge first served as acting U.S. attorney and then in November 2017 was appointed interim U.S. attorney by then-U.S. Attorney General Jeff Sessions.

In March 2018, the U.S. District Court in Grand Rapids named him U.S. attorney.

Several Republican lawmakers applauded Trump's consideration of Leonard for the position, including Congressman John Moolenaar of Midland, who called Leonard "an experienced prosecutor who has always been focused on public safety and ensuring justice for Michigan families."

Democratic U.S. Sen. Debbie Stabenow did not voice the same enthusiasm about Leonard.

“Sen. Stabenow has strong concerns over Mr. Leonard’s nomination,” spokeswoman Miranda Margowsky said.

“As part of her constitutional duty as U.S. senator, she will be thoroughly reviewing his background and qualifications.”

A spokesman for Democratic Sen. Gary Peters said the congressman would review Leonard's qualifications.

“Senator Peters takes seriously the Senate’s responsibility to advise and consent on nominees, and will closely review Tom Leonard’s qualifications," said Zade Alsawah. "However, Senator Peters has deep concerns about Mr. Leonard’s tenure in the Michigan House of Representative, including as Speaker, and if his experience and record are appropriate for serving as a U.S. attorney.”

A former Genesee County assistant prosecutor and assistant attorney general, Leonard served in the state House from 2012 to 2018, with his last two years spent as speaker. Leonard served in the special crimes division while working in Genesee County and practiced civil defense for the Michigan Department of Corrections under Republican former Michigan Attorney General Mike Cox.

Leonard formed a consulting firm after departing the Legislature at the end of 2018 called MiStrategies LLC and named Quicken Loans as his first client.

Leonard ran an unsuccessful campaign to become Michigan’s  attorney general in 2018, losing to Plymouth Democrat Dana Nessel. They tussled over issues from the future of Enbridge's Line 5 running under the Straits of Mackinac to the potential enforcement of state abortion laws.

It was the tightest of the top statewide races as Leonard didn't concede until the morning of Nov. 7. The Republican's failure to concede earlier prompted Nessel to quip at a 2 a.m. Nov. 7 press conference: "Tom Leonard, if you're watching this, feel free to call me and concede at any time."

Leonard had promised to be a “rule of law” attorney general who would tackle mental health issues, elder abuse and government transparency complaints.

Miles also made a bid for the Democratic nomination for Michigan attorney general, but lost the party’s endorsement to Nessel.

Potential case conflict

Leonard was still House speaker in June 2018 when the Republican-majority House and Senate approved a controversial repeal of Michigan's prevailing wage law, which guaranteed union rates on state construction jobs. The House vote and some of the negotiations that occurred beforehand gave rise to federal charges against a Traverse City area legislator months later in the Western District.

Rep. Larry Inman, R-Williamsburg, is charged with trying to sell his vote to a union group opposed to the June 2018 prevailing wage repeal. Prosecutors have included text messages Inman exchanged ahead of the vote, including ones with the union in general and Leonard's then-chief of staff, Dan Pero.

According to federal filings in the case, Pero told Inman, "You're on edge, pal," and warned the lawmaker that he already risked losing financial support from business community donors and political action committees because of votes on other bills.

“You’ve been a no vote on the income tax and no fault; you support fee increases; and if you become a no vote on PW, there’s zero incentive for the big PACs to write you a check,” Pero texted. “You vote yes on PW, my friend, you will get a pass on the other votes.”

Inman ended up voting to approve the repeal of the prevailing wage law.

Last September, former lobbyist Nathan Medina filed suit against Leonard in the Western District, alleging that the House speaker pressured his employer, The Doctors Management Company, in November 2017 to fire him after he had criticized Leonard’s performance as speaker on social media and panned musician Ted Nugent’s endorsement of Leonard’s run for Michigan attorney general.

In court filings, Leonard has denied pressuring the insurance company or intervening in the lobbyist’s employment. The Doctors Management Company has denied Leonard contacted or pressured them about the social media posts and denied Medina was fired for voicing his political views.

In July, parties to the lawsuit were given until the end of August to complete discovery in the case.

Files: Covered hot check with loan

State Sen. Jake Files, R-Fort Smith, said Tuesday that he used a $30,000 loan from a lobbyist to pay off a hot check of more than $6,800, for "working capital" for his construction businesses and to purchase material for other construction jobs.

 A week ago, Files and Bruce Hawkins said Hawkins' lobbying firm lent $30,000 to Files on April 20. Hawkins' lobbying firm -- DBH Management Consultants -- disclosed the loan in an amendment to the firm's second-quarter lobbying report and its third-quarter lobbying report, both filed Oct. 15 with the secretary of state's office.

But, the gerrymanding scheme continued to reveal itself with more clarity of stealin' upon the uncloaking of another layer.

Former Arkansas state Sen. Linda Collins-Smith reportedly found shot to death at her home

A former Arkansas state senator was reportedly found dead at her home this week, and authorities are investigating her death as a homicide.

The body of a woman was discovered Tuesday night at Linda Collins-Smith's residence in the city of Pocahontas, some 145 miles northeast of the state capital, Little Rock. The Randolph County Sheriff's Office said its deputies responded to the scene and then asked the Arkansas State Police to be the lead investigative agency in what is currently being treated as a homicide investigation.

"The condition of the body prevented any immediate positive identification," Randolph County Sheriff Kevin Bell said at a press conference Wednesday. "The body has been sent for an autopsy to determine the positive identification and cause of death.

Authorities wouldn't say if Collins-Smith is the victim, and a judge has issued a gag order sealing the documents and statements obtained by police.

"Arkansas State Police has not, as of this hour, issued a statement that positively identifies a homicide victim in this case," Arkansas State Police spokesman Bill Sadler told ABC News in an email early Thursday morning.

However, Collins-Smith's former press secretary, Ken Yang, told Little Rock ABC affiliate KATV that she was found shot to death inside her home and her body was wrapped in some sort of blanket. Neighbors apparently reported hearing gunshots a day or two before her body was discovered.

Collins-Smith, who ran for reelection last year but was defeated in the Republican Party primary, was "someone who truly cared about Arkansas, truly cared about her district," according to Yang. She was 57, per the Associated Press.

"It was shocking," he told KATV in an interview Tuesday night. "This was not just a political relationship. This was a close personal friendship that I had with Linda."

Politicians on both sides of the aisle expressed shock and sadness at the news of the death of their Republican colleague.

"I’m both stunned and saddened by the death of former State Senator Linda Collins-Smith," Arkansas Gov. Asa Hutchinson said in a statement via Twitter on Wednesday afternoon. "She was a good person who served in the public arena with passion and conviction. The First Lady and I extend our deepest sympathies to her family and friends during this difficult time."

"Today, we learned of the untimely death of former Senator Linda Collins Smith. She was a passionate voice for her people and a close member of our Republican family," the Republican Party of Arkansas said in a statement via Twitter on Tuesday evening. "We are praying for her loved ones during this difficult time."

"To so many of us, Senator Linda Collins-Smith was more than just a colleague," the Democratic Party of Arkansas said in a statement via Twitter on Tuesday night. "She was a friend and warm person. We are stunned and saddened to hear of her death. Please join us in prayer as we remember her family and her loved ones."

Collins-Smith lost to James Sturch in the Republican Party primary for the 19th district in Arkansas in May 2018 by fewer than 600 votes. She previously served one term in the Arkansas House of Representatives from 2011 to 2013, switching parties after being elected as a Democrat.
