Well, this is quite the kerfuffle!

It seems, Matt Schnieder, Detroit, MIED U.S. Attorney, has referred the matter to the Civil Rights Division of DOJ, which seems to cloying Michigan Governor Gretchen Whitmer with those silenced cries for due process, a right of civility, for those individual residents of the State, who have unfortunately lost their lives to the cooties, by invoking CRIPA.

But, herein lies the issue - what about the private nursing homes?

Yes, that is correct, Michigan has privatized just about anything in the industry of human asset management.

By specifically using the term "public", this immediately stands up to me as a federally certified facilities, meaning, CMS authorizes cost reimbursement for Medicaid and Medicare.

Just for fun, because you know I love to disprove my first impressions when it comes to stealin', I conducted a random experiment, by controlling for randomness by closing my eyes and picking one *Public Private Partnership* nursing facility, and looked up Shorepointe Nursing Center.

Optalis nursing home chain further expanding reach ‘ahead of the curve’

A growing skilled nursing and senior living company is looking to expand its reach throughout the United States.

Optalis Healthcare, based in Novi, MI, gearing up to either build or acquire more facilities in Michigan, Ohio and Florida, Crain’s Detroit Business reported. CEO Raj Patel, however, declined to specify the number of facilities or give any details about future acquisitions, stating plans “are still under review.”

“We are very optimistic that we are in front of the bell curve with a large amount of seniors eight to 10 years away from when they really need services,” Patel told the news organization. “Age 65 is the new 55. Many seniors don’t need a lot of services until they get into their high 70s, early 80s. We are innovative and ready for the big wave.”

The 15-facility company purchased five Detroit-area, Beaumont-affiliated properties (four SNFs and one senior living facility) from Premier Health Care Management in September. Patel called the deal a “perfect fit to the Optalis growth plan in the southeast Michigan market.”

Death toll rises as coronavirus sweeps through Michigan nursing homes

I am not going to broach the subject of how or why Ascension St. John was flipping properties, because I already did, but we shall soon revisit these days of yore.

See, there is no FOIA for private state contractors, so, Michigan self reports, which means they are not held to GAGAS or any external audit.

Try filing a FOIA for school records for a former foster child and see what happens.

So, if there is no FOIA in child welfare, what the hell makes you think there is FOIA in nursing home data?

The only logical action by DOJ would be to use the CRIPA prong test.

CRIPA, in part, says:

(II) residing in such facility or institution for purposes of receiving care or treatment; or 

(III) residing for any State purpose in such facility or institution (other than a residential facility providing only elementary or secondary education that is not an institution in which reside juveniles who are adjudicated delinquent, in need of supervision, neglected, placed in State custody, mentally ill or disabled, mentally retarded, or chronically ill or handicapped);  or (v) providing skilled nursing, intermediate or long-term care, or custodial or residential care.

(2) Privately owned and operated facilities shall not be deemed  "institutions" under this subchapter if-- (A) the licensing of such facility by the State constitutes the sole nexus between such facility and such State;
(B) the receipt by such facility, on behalf of persons residing in such facility, of payments under title XVI, XVIII [42 U.S.C.A. §§ 1381 et seq., 1395 et seq.], or under a State plan approved under title XIX [42 U.S.C.A. § 1396 et seq.], of the Social Security Act, constitutes the sole nexus between such facility and such State;  or

So, what if the CRIPA prong test?

The CRIPA prong test is when DOJ asks for information in the course of a civil rights investigation, where, in this instance, happens to be individuals who died from the cooties in public nursing homes, and the State Governor says, "No".

That is how you automatically know they are stealin'. [see above].

Then, there is still that lingering issue about DOJ asking MIED to look into the constitutionality of Gretch's Executive Orders, where, I have addressed her illegitimacy to be granted under that indelible seal to hold office.

What a messy!

I guess Gretch has two choices: (1) produce the data; or, (2) bear her armiger, but, hey, what do I know?

Dept. of Justice requesting COVID-19 nursing home data from Gov. Whitmer

(FOX 2) - The Department of Justice is requesting data from Michigan Gov. Gretchen Whitmer in regard to the COVID-19 order that may have resulted in deaths of elderly nursing home residents.

The data is being requested to help inform whether the Department of Justice will initiate investigations under the Civil Rights of Institutionalized Persons Act (CRIPA).

Other governors were asked to also provide data, including New York, New Jersey and Pennsylvania. These states required nursing homes to admit COVID-19 patients, often without adequate testing.

The DOJ is asking for the following information from Gov. Whitmer:

• The number of public nursing home residents, employees, other staff, guests and visitors who contracted COVID-19, regardless of where it was contracted
• The number of public nursing home residents employees, other staff, guests and visitors who died of COVID-19 including those who died in a public nursing home or after being transferred to a hospital or other medical facility, hospice, home care or any other location
• All state-issued guidance, directives, advisories or executive orders regarding admission of persons to public nursing homes, including those previously superseded, as well as the dates each such document was in effect
• The number of persons who were admitted to a public nursing home from a hospital or any other facility, hospice, home care or other location after testing positive for COVID-19 during the period the guidance or orders were in effect

The information requested is due within 14 days.

Gov. Whitmer's office released the following statement later in the day Wednesday after receiving the letter:

"Protecting the health, safety, and wellbeing of our seniors and most vulnerable residents has been a top priority throughout this crisis. The fact that this letter was sent during the middle of the Republican National Convention week to four Democratic governors should make it crystal clear that this is nothing more than election year politics by an administration that is more concerned with the president's re-election campaign than protecting Michigan seniors. We will review this letter and respond as appropriate, however, Americans would all be better served if the Trump administration stopped the partisan games and focused on delivering a real plan to defeat COVID-19."

In a town hall with FOX 2 back in July, Gov. Whitmer said she was following the best advice she had at the time when making this decision.

Whitmer said that the state was following guidance from the Center for Disease Control and prevention when COVID-19 patients were housed with non-coronavirus patients in nursing homes.

"We know that this experience has played out across the planet frankly but we’ve seen it in real-time here in the U.S., first in Seattle then of course across the U.S.," she said. "In every step of the way we've followed the CDC best guidance and our policies reflected that. All of the efforts that we've taken to keep people safe by closing down the ability for outsiders to come in, our policy with regard to...we never once required that nursing homes took COVID-19 patients. Many chose to and when they did they followed the promulgated practices from the CDC about separation and not having intermingling at all," she said.

And she did admit that following best practices ended with lives being lost to the virus.

"In the early days, following the CDC was the gold standard. That's what we were doing," Whitmer said. "Our nursing home death numbers are far too many but are better than in many other states. At the time we followed the protocols the CDC has prescribed."

In the end, Whitmer said if she had the knowledge she has now, she would do things differently but says it was CDC guidance.

"We followed the protocols that they prescribed and that's the best any state was able to do, frankly," she said. "We always have a mindest we are going to be conservative and follow the science. And sometimes that makes us a leader and in other ways, it's made us average with other states. With nursing home experiences, it's the latter."

The Department of Justice’s Civil Rights Division is evaluating whether to initiate investigations under the federal “Civil Rights of Institutionalized Persons Act” (CRIPA), which protects the civil rights of persons in state-run nursing homes, among others.

The Civil Rights Division seeks to determine if the state orders requiring admission of COVID-19 patients to nursing homes is responsible for the deaths of nursing home residents.

According to the Centers for Disease Control, New York has the highest number of COVID-19 deaths in the United States, with 32,592 victims, many of them elderly.

New York’s death rate by population is the second highest in the country with 1,680 deaths per million people. New Jersey’s death rate by population is 1,733 deaths per million people - the highest in the nation.

In contrast, Texas’s death rate by population is 380 deaths per million people; and Texas has just over 11,000 deaths, though its population is 50 percent larger than New York and has many more recorded cases of COVID-19 - 577,537 cases in Texas versus 430,885 cases in New York.

Florida’s COVID-19 death rate is 480 deaths per million; with total deaths of 10,325 and a population slightly larger than New York.

DOJ: Former North Carolina State Political Party Chairman Previously Pleaded Guilty to Lying to the FBI in Connection with the Bribery Scheme

Founder and Chairman of a Multinational Investment Company and a Company Consultant Convicted of Bribery and Public Corruption are Sentenced to Prison

The founder and chairman of a multinational investment company and a company consultant were sentenced to prison today for orchestrating a bribery scheme involving independent expenditure accounts and improper campaign contributions. 

Greg E. Lindberg, 50, of Durham, North Carolina, the founder and chairman of Eli Global LLC (Eli Global) and the owner of Global Bankers Insurance Group (GBIG), was sentenced to 87 months in prison and three years of supervised release.  Lindberg’s consultant, John D. Gray, 70, of Chapel Hill, North Carolina, was ordered to serve 30 months in prison, followed by two years of supervised release.  Lindberg and Gray were also ordered to pay forfeiture in the amount approximately $1.45 million held in accounts established by the defendants for the purpose of funneling the bribe payments.

On March 5, 2020, a federal jury convicted Lindberg and Gray of conspiracy to commit honest services wire fraud and bribery concerning programs receiving federal funds following an approximately three-week trial.  U.S. District Judge Max O. Cogburn Jr. presided over the trial and today’s sentencing hearings.

Co-defendant, Robert Cannon Hayes, 74, of Concord, North Carolina, was also sentenced today to a one-year probationary term.  Hayes previously pleaded guilty to making false statements to the FBI and agreed to cooperate with the government’s investigation.

“When Greg Lindberg and John Gray offered millions of dollars in bribes to the North Carolina Insurance Commissioner, they referred to their elaborately corrupt scheme as a ‘win-win’ – unaware that the FBI was watching and listening,” said Acting Assistant Attorney General Brian C. Rabbitt of the Justice Department’s Criminal Division.  “Today, both men have been held accountable for their crimes, and their sentences underscore the Department of Justice's unyielding commitment to rooting out corruption wherever we find it.”

“Lindberg and his accomplices, driven by greed, devised an extensive political bribery scheme to illegally funnel millions of dollars to an elected official for the benefit of Lindberg’s business interests.  To this day, Lindberg and Gray remain unremorseful and refuse to accept responsibility for their criminal actions.  The severity of their brazen conduct is reflected in the Court’s sentence,” said U.S. Attorney Andrew Murray for the Western District of North Carolina.  “Bribery of a public official is far from a victimless crime.  It is our duty to the American people to stop bad actors with deep pockets and unscrupulous intentions from wrecking the foundation on which this country proudly stands.  To those that greedily seek to line their own pockets through deceit and fraud, I offer the following advice: Keep a travel toothbrush handy.”

“When the prison bars close behind Mr. Lindberg and Mr. Gray, they will hear the sound of justice, loud and clear,” said Special Agent in Charge John Strong of the FBI’s Charlotte Field Office.  “The FBI will root out any and all forms of public corruption.  We remain committed to ensuring those who attempt to interfere with the integrity of our democratic process pay the price.”

According to filed court documents, evidence presented at trial, and today’s sentencing hearings, in January 2018, the elected Commissioner (Commissioner) of the North Carolina Department of Insurance (NCDOI) reported concerns to the FBI about political contributions and other requests made by Lindberg and Gray, and agreed to cooperate with the federal investigation that was initiated. 

According to evidence presented at trial, from April 2017 to August 2018, Lindberg and Gray engaged in a bribery scheme involving independent expenditure accounts and improper campaign contributions for the purpose of causing the Commissioner to take official action favorable to Lindberg’s company, GBIG.  Trial evidence established that Lindberg and Gray gave, offered, and promised the Commissioner millions of dollars in campaign contributions and other things of value, in exchange for the removal of NCDOI’s Senior Deputy Commissioner, who was responsible for overseeing regulation and the periodic examination of GBIG. 

According to trial evidence, Lindberg, Gray and the Commissioner held numerous in-person meetings at different locations, including in Statesville, North Carolina, and had telephonic and other communications with each other, and others, to discuss Lindberg’s request for the personnel change in exchange for millions of dollars, and to devise a plan on how to funnel campaign contributions to the Commissioner anonymously.  In order to conceal the bribery scheme, at the direction of Lindberg, two corporate entities were set-up to form an independent expenditure committee with the purpose of supporting the Commissioner’s re-election campaign, and Lindberg funded the entities with $1.5 million as promised to the Commissioner.  In addition, at Lindberg and Gray’s direction, Hayes caused the transfer of $250,000 from monies Lindberg had previously contributed to a North Carolina state party of which Hayes was chairman, to the Commissioner’s re-election campaign.

According to admissions Hayes made in connection with his guilty plea, on or about Aug. 28, 2018, Hayes falsely stated to FBI agents that he had never spoken with the NCDOI Commissioner about personnel or personnel problems at NCDOI, or about Lindberg or Gray.  Hayes further admitted that, at the time he made the materially false statements, Hayes knew that it was unlawful to lie to the FBI, and knew that his statements were false because Hayes had in fact spoken with the NCDOI Commissioner about Lindberg and Gray, and about Lindberg’s request that the Commissioner move certain personnel within NCDOI.  

The FBI’s Charlotte field office investigated the case.

Trial Attorney James C. Mann of the Criminal Division’s Public Integrity Section and Assistant U.S. Attorneys William T. Stetzer and Dana O. Washington of the U.S. Attorney’s Office for the Western District of North Carolina prosecuted the case.

Wayne State University President M. Roy Wilson and School of Medicine leadership are blasting a recent decision by Tenet Healthcare Corp., owner of the Detroit Medical Center, to oust WSU pediatricians from Children’s Hospital of Michigan after decades of service and in the midst of the city’s struggles with the coronavirus outbreak.

“Our outstanding pediatric faculty physicians, who have cared for sick children in Children’s Hospital of Michigan for decades, will now be summarily evicted from the place they practice and separated from the patients they serve,” said the university. “Their passion for children and their credentials remain steadfast. What has changed is that Tenet, a for-profit company based in Dallas, is once again prioritizing profits over patients. Rather than responding to our inquiries about how this decision was reached after prior assurances that doctors could continue to serve their patients, we were informed that we must contact a high-priced law firm hired by Tenet to defend this unconscionable decision.

“This immoral act puts children at risk and separates doctors from patients in the midst of a global pandemic. We will vigorously oppose this despicable act, and urge members of our community and government leaders to do likewise.”

So far, Tenet has refused to offer any explanation for the ban on the nearly 25 doctors who form Wayne Pediatrics, instead referring inquiries by Wayne State leaders to law firm Jones Day.

Meanwhile, Mark Schweitzer, M.D., dean of the Wayne State School of Medicine, noted that the decision to bar the pediatricians from the hospital marked a complete reversal of hospital leaders’ earlier position.

“The decision comes only a few weeks after Audrey Gregory, the new chief executive officer of the Detroit Medical Center, assured Wayne State officials that Children’s Hospital of Michigan has an ‘open medical staff,’ allowing physicians who meet requirements and standards to provide care in the hospital,” said Schweitzer. “Wayne State University physicians meet those standards.”

With Detroit reeling from nearly 10,000 confirmed cases of COVID -19, university officials expressed concern that Tenet’s decision not only marks yet another vindictive turn in the for-profit corporation’s years-long efforts to destroy ties between WSU and the Detroit Medical Center, but that it will also unfairly punish the area’s children.

“This disturbs me to my marrow and runs counter to everything I was taught by my parents and learned during my more than three-decade medical career,” added Schweitzer. “The CEO of Tenet made nearly $15 million in 2018. How many children could receive preventive medical care for that unseemly amount? Maybe every child in the city of Detroit?”

Conversely, throughout the pandemic, Wayne State has extended numerous good-faith acts to Tenet at the request of its CEO, including recently providing campus residence hall space to DMC physicians and health care workers.

Sanders drops 2020 bid, leaving Biden as likely nominee

Washington – Sen. Bernie Sanders, who saw his once strong lead in the Democratic primary evaporate as the party’s establishment lined swiftly up behind rival Joe Biden, ended his presidential bid on Wednesday, an acknowledgment that the former vice president is too far ahead for him to have any reasonable hope of catching up.

The Vermont senator’s announcement makes Biden the presumptive Democratic nominee to challenge President Donald Trump in November.

Sanders plans to talk to his supporters later Wednesday.

Sanders initially exceeded sky-high expectations about his ability to recreate the magic of his 2016 presidential bid, and even overcame a heart attack last October on the campaign trail. But he found himself unable to convert unwavering support from progressives into a viable path to the nomination amid “electability” fears fueled by questions about whether his democratic socialist ideology would be palatable to general election voters.

The 78-year-old senator began his latest White House bid facing questions about whether he could win back the supporters who chose him four years ago as an insurgent alternative to the party establishment’s choice, Hillary Clinton. Despite winning 22 states in 2016, there were no guarantees he’d be a major presidential contender this cycle, especially as the race’s oldest candidate.

Sanders, though, used strong polling and solid fundraising – collected almost entirely from small donations made online – to more than quiet early doubters. Like the first time, he attracted widespread support from young voters and was able to make new inroads within the Hispanic community, even as his appeal with African Americans remained small.

Sanders amassed the most votes in Iowa and New Hampshire, which opened primary voting, and cruised to an easy victory in Nevada – seemingly leaving him well positioned to sprint to the Democratic nomination while a deeply crowded and divided field of alternatives sunk around him.

But a crucial endorsement of Biden by influential South Carolina Rep. Jim Clyburn, and a subsequent, larger-than-expected victory in South Carolina, propelled the former vice president into Super Tuesday, when he won 10 of 14 states.

In a matter of days, his top former Democratic rivals lined up and announced their endorsement of Biden. The former vice president’s campaign had appeared on the brink of collapse after New Hampshire but found new life as the rest of the party’s more moderate establishment coalesced around him as an alternative to Sanders.

Things only got worse the following week when Sanders lost Michigan, where he had campaigned hard and upset Clinton in 2016. He was also beaten in Missouri, Mississippi and Idaho the same night and the results were so decisive that Sanders headed to Vermont without speaking to the media.

Sanders had scheduled a rally in Ohio but canceled it amid fears about the spread of coronavirus – and the outbreak kept him home as his campaign appeared unsure of its next move. The senator addressed reporters the following day, but also sounded like a candidate who already knew he’d been beaten.

“While our campaign has won the ideological debate, we are losing the debate over electability,” Sanders said then.

A physician who from 2016 to 2017 was the top prescriber of oxycodone 30 mg in Michigan was charged in a superseding indictment unsealed today with an over $120 million health care fraud and money laundering scheme that involved the alleged medically unnecessary distribution of over 2.2 million dosage units of controlled substances and the administration of medically unnecessary injections that resulted in patient harm. 

Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division, U.S. Attorney Matthew Schneider of the Eastern District of Michigan, Special Agent in Charge Steven M. D’Antuono of the FBI’s Detroit Division and Special Agent in Charge Lamont Pugh III of the U.S. Department of Health and Human Services Office of Inspector General’s (HHS-OIG) Chicago Regional Office made the announcement.

Francisco Patino, 65, of Wayne County, Michigan, was charged in the superseding indictment with one count of conspiracy to commit health care fraud and wire fraud, one count of conspiracy to commit money laundering and one count of money laundering.  These charges are in addition to the two counts of health care fraud and one count of conspiracy to defraud the United States and pay and receive health care kickbacks that was charged in the initial indictment.  The case is pending before U.S. District Judge Denise Page Hood of the Eastern District of Michigan.  Trial has been scheduled to begin on April 7 before Judge Hood.

The superseding indictment alleges the laundering of the proceeds of the health care fraud scheme to falsely portray the defendant as a legitimate doctor through the publication of a diet book and plan described as the “next Atkins,” paid-for appearances on a nationally syndicated television show, and the sponsorship of boxers, cagefighters and prominent Ultimate Fighting Championship (UFC) world champions and hall of famers.    

The superseding indictment alleges that Patino owned, controlled and operated numerous pain clinics and laboratories in Michigan – including Global Quality Inc., RenAMI, FDRS and Patino Laboratories – and was the top prescriber of Oxycodone 30 mg in Michigan from 2016 to 2017.  As alleged in the superseding indictment, from 2008 until his arrest in 2018, Patino induced patients to come to his clinics by offering unnecessary prescriptions for addictive opioids, of which he ultimately prescribed over 2.2 million dosage units of medically unnecessary controlled substances, including fentanyl, oxycodone and oxymorphone.  Patino prescribed these opioids to Medicare beneficiaries, some of whom were addicted to narcotics.  Some of these opioids were resold on the street, the superseding indictment alleges.  Fentanyl is one of the most potent opioids available for human use.

According the superseding indictment, Patino forced patients to submit to unnecessary and sometimes painful back injections and other procedures in exchange for the opioid prescriptions as part of a scheme to defraud Medicare of over $120 million.  The superseding indictment alleges that Patino persisted with these unlawful practices even after Medicare informed him that the injections violated Medicare’s rules and after Patino entered into a consent order with the State of Michigan that his prescription of opioids “constitute[d] a violation of the public health code.”

Patino also ordered unnecessary urine drug testing in exchange for illegal kickbacks, the superseding indictment alleges.  Patino was aware that his ownership structure and kickbacks were a violation of law and authored emails acknowledging that such ownership constituted  a “violation of the Stark and Anti-Kickback laws” and attempted to conceal and disguise the ownership structure and scheme in order to keep himself “out of Federal Prison & having all our assets seized to pay a 15 million dollar fine.”

The superseding indictment alleges that Patino conspired to commit money laundering and committed money laundering in connection with the creation and promotion of the “Patino Diet” plan, which Patino described to others as the “next Atkins diet.”  In order to conceal and disguise his illegal health care fraud scheme, Patino allegedly paid for the authorship and publication of a book touting the diet plan, entitled “The Age of Globesity,” and paid hundreds of thousands of dollars in order to promote the diet plan and appear as the exclusive medical expert on a nationally syndicated television show.

In addition to concealing the scheme by paying money to falsely portray himself as a media personality and a legitimate physician, the superseding indictment alleges, that Patino laundered the healthcare fraud and kickback money by entering into sham contracts or employment relationships to pay others on his behalf to sponsor boxers, mixed martial artists and Ultimate Fighting Championship (UFC) combatants, including UFC world champions and hall of famers.  The superseding indictment alleges that Patino also withdrew the proceeds derived from the conspiracy to live an extravagant lifestyle and spend money on luxury clothes, real estate and international travel, including multiple trips to the Cayman Islands.

The charges against Patino are related to a broader investigation into the Tri-County Network of pain clinics in Michigan and Ohio, which involves over $300 million in alleged Medicare fraud and the alleged distribution of over 6.6 million dosage units of controlled substances.  In connection with the investigation, 22 defendants, including 12 physicians, have previously pleaded guilty or been found guilty at trial.

An indictment is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law. 

This case was investigated by the FBI and HHS-OIG.  Assistant Chief Jacob Foster and Trial Attorney Thomas Tynan of the Criminal Division’s Fraud Section are prosecuting the case.

The Fraud Section leads the Medicare Fraud Strike Force.  Since its inception in March 2007, the Medicare Fraud Strike Force, which maintains 15 strike forces operating in 24 districts, has charged more than 4,200 defendants who have collectively billed the Medicare program for nearly $19 billion.  In addition, the HHS Centers for Medicare & Medicaid Services, working in conjunction with the HHS-OIG, are taking steps to increase accountability and decrease the presence of fraudulent providers.

Israel's health minister gets coronavirus; top officials isolate

Coronavirus has forced more top Israeli officials into isolation after the country's health minister, who has had frequent contact with Prime Minister Benjamin Netanyahu, tested positive, the health ministry said on Thursday.

Israeli Health Minister Yaakov Litzman and his wife, who also contracted the virus, are in isolation but said they feel well and are being treated, a ministry statement said.

Shortly after the announcement, the prime minister's office said Netanyahu returned to self-quarantine because of his contact with Litzman.

Netanyahu had previously been in isolation after a top aide tested positive for the virus. Netanyahu has tested negative.

The Israeli daily Haaretz reported the head of Israel's Mossad spy agency and the National Security Council were asked to self-quarantine because of their interactions with Litzman.

The health ministry's director and Litzman's staff also self-quarantined, and the ministry said requests to enter isolation will be sent to those who came in contact with the minister in the past two weeks.

Israel has gone into near-lockdown to try to contain the outbreak. The country has reported more than 6,200 confirmed cases and 31 people have died from COVID-19, the illness caused by the virus.

Israel's large, insular ultra-Orthodox community, of which Litzman is a member, has been particularly hit hard by infections. In the early phases of the outbreak, some rabbis pushed back or ignored government-mandated movement restrictions, but resistance appears to have diminished.

On Wednesday, Netanyahu ordered a police cordon around the largely ultra-Orthodox city of Bnei Brak, east of Tel Aviv, to limit movement to and from the city. Bnei Brak has the second-highest number of coronavirus cases in Israel.

For most people, the coronavirus causes mild or moderate symptoms, such as fever and cough. But for others, especially older adults and people with existing health problems, the virus can cause severe symptoms like pneumonia or death.

Since the state keeps cutting SNAP benefits, all the stores shuttered, leaving the local party store the only place for groceries, as most people either do not have vehicles, disabled and aged.

Guess what people are going to do with the stimulus checks?

Dr. Anthony Fauci, the infectious disease expert who is the most credible U.S. spokesperson on the coronavirus outbreak, has been absent from White House events for three days after contradicting President Donald Trump.

Fauci participated in a White House news conference on Friday, where TV cameras caught him putting his face in his hands after Trump disparaged the State Department as the “deep State Department.” He then gave an interview to Science magazine on Sunday in which he agreed that Trump makes false statements about the outbreak and said his response is to “try and get it corrected for the next time.”

Fauci didn’t appear at White House news conferences on Sunday or Monday or at a “virtual town hall” that Fox News broadcast from the White House on Tuesday. Another doctor who advises Trump and Vice President Mike Pence, State Department official Deborah Birx, fielded technical questions about the outbreak at the events Monday and Tuesday.

Fauci was also expected to make an appearance on Sean Hannity’s Fox News program on Monday night, but he did not go on air.

But Fauci, in an interview Tuesday with WMAL, disputed the idea that he’s had a falling out with Trump.

“The president has listened to what I have said and what the other people on the task force have said,” Fauci said. “When I’ve made recommendations, he has taken them. He has never countered or overridden me. The idea of just pitting one against the other is not helpful. I wish that would stop and we’d look ahead at the challenge we have to pull together to get over this thing.”

Since the beginning of the outbreak, Fauci has been praised as a reassuring voice for Americans who have seen their lives upended by “social distancing” measures intended to stop the virus’s spread. Fauci’s recent absence has generated speculation Trump has sidelined the outspoken doctor.

The president on Tuesday re-tweeted a photo of Fauci covering his face at Friday’s news conference. The tweet was later deleted.

The New York Times reported Monday that Trump and some of his advisers have grown impatient with Fauci, who has notably disagreed with Trump’s promotion of a malaria drug, hydroxychloroquine, as a treatment for coronavirus. The FDA hasn’t approved the drug to treat the virus and Fauci has said there is only “anecdotal” evidence it might be effective.

Fauci is also among a group of top government health experts who have argued that in the absence of both effective treatments for the virus and widespread testing for infection, only lengthy, economically painful restrictions on daily life can slow the outbreak. Trump has shown impatience with those measures in recent days, saying Tuesday he wants the U.S. economy re-opened by Easter.

House Speaker Nancy Pelosi said Tuesday she would be concerned if Fauci’s advice was being ignored.

“Dr. Fauci is a truth-teller,” Pelosi, a Democrat from California, said on MSNBC.

Trump on Tuesday downplayed the notion that Fauci’s absence signals he is angry with the doctor, saying at a Fox News town hall that Fauci “has other things to do.” Trump was accompanied at the Rose Garden event by Pence, Birx and Surgeon General Jerome Adams.

“We get along very well,” Trump said when asked about his relationship with Fauci, whom he called “extraordinary.” “I think it is very good, you would have heard about it if it wasn’t.”

Fauci and the National Institute of Allergy and Infectious Diseases, where he is the director, did not respond to a request for comment.

Whitmer issues stay-at-home order through April 13; $500 fines, jail possible

Lansing —  Michigan Gov. Gretchen Whitmer issued Monday a "Stay Home, Stay Safe" executive order requiring Michigan businesses to suspend in-person operations from 12:01 a.m. Tuesday through April 13 to help stem the spread of the novel coronavirus. 

Exemptions to the order include operations that are part of the "critical infrastructure workforce" or those needed for "minimal basic operations." Schools also will remain closed through April 13.

Michigan residents are ordered to stay in their homes unless they're “critical infrastructure workers.” People can still leave for outdoor activities, to care for family members, perform necessary government activities and obtain necessary supplies such as groceries or medicine.

The order came hours before the state released new data, confirming an almost 300-case jump in confirmed positive COVID-19 tests, putting the total at 1,328. Fifteen people have died in Michigan after testing positive for the virus, Chief Medical Executive Dr. Joneigh Khaldun said. 

“The goal here is simple: Stay home. Stay safe. Save lives," Whitmer said during a Monday live-streamed press event. "This will be temporary. This intervention is important to buy time so we can create surge capacity in our hospitals, so we can ramp up testing and develop therapeutic drugs that may lower hospitalization and fatality rates.

“It's been observed: If it were possible to wave a magic wand and make all Americans freeze in place for 14 days, six feet away from one another, the whole epidemic would sputter to a halt. It's on all of us to do our part."

Without the stay-at-home order, current models project 70% of the state's population of nearly 10 million could become infected with 1 million people hospitalized, Whitmer said. The state has roughly 25,000 acute care beds. 

Federal resources recently sent to the state were frustratingly sparse, she said, with an allotment for one hospital "barely enough to cover one shift."

The current trajectory, she said, "looks a lot like Italy."

"When we look back at this, we’ve got to be able to say we did everything we could," Whitmer said. 

Penalties for violations

Businesses that do not comply with the order will be fined or shuttered, the governor said. Whitmer said there will be no "check points."

The governor said a "willful" or deliberate violation would be a misdemeanor. The penalty for a misdemeanor is $500 and/or up to 90 days in jail, said Kelly Rossman-McKinney, a spokeswoman for Michigan Attorney General Dana Nessel.

"Don’t play fast and loose with what is essential and what is not," Whitmer said. "Don’t try to skirt the rules."

Michigan State Police Lt. Michael Shaw said Whitmer’s order “isn’t a lock-down. This isn’t martial law.”

“This isn’t meant to lock people up in jail, but it’s important to know this does carry the weight of a misdemeanor,” Shaw said, adding that businesses that don't comply could be fined or lose their licenses. 

“Like we do anyway, we allow our troopers a lot of discretion,” he said. “So we’d most likely have a conversation with someone first, before giving them a ticket; maybe they don’t understand the seriousness of the situation.”

Shaw said he hasn’t heard of any violations of the governor’s order last week shutting down bars, gyms, restaurants and other gathering spots. 

“I think people understand what they’re supposed to do,” he said. “There haven’t been any major problems.”

The lifting of the stay-at-home order on April 13 will depend on testing numbers, compliance with the executive order and hospitals' capacity to test, isolate and treat those infected, Whitmer said. She emphasized that grocery stores, restaurant take-out, pharmacies and gas stations will remain open. 

"Do not panic. Do not hoard. These services will remain open," she said. 

'Critical infrastructure' workers allowed

Critical infrastructure workers are defined as those in the fields of health care, law enforcement, public safety, food and agriculture, energy, water and wastewater, transportation, communications, other community-based government operations, critical manufacturing, hazardous materials, financial services, chemical supply chains and defense industrial base.

The order also exempts child care workers, those employed by “designated suppliers and distribution centers,” workers in the insurance industry and those who “perform critical labor union functions.”

There are exemptions from the penalty for places of religious worship and exemptions that allow businesses to maintain minimum basic operations. 

“Individuals must secure such services or supplies via delivery to the maximum extent possible,” the new order says. 

Earlier Monday, Michigan Chamber of Commerce CEO and President Rich Studley said he had spoken with administration officials Monday morning regarding the order. He said the directive was not expected to be the equivalent of the "blunt instruments" used in states on the East and West coasts when they had sudden upticks in cases. 

"I think what we’re going to see from the governor later this morning is a very measured, very thoughtful and very considered order," Studley said.

But after the 11 a.m. Monday announcement, Studley said Whitmer's order was not identical to the one that had been outlined to business leaders. The Michigan Chamber's team is still reviewing the governor's signed directive.

But a major labor union welcomed Whitmer's decision.

"The difficult decision by Gov. Whitmer, and other governors to issue stay at home orders will in fact not only save lives but speed up the timetable to get our workforce back up and running at capacity," United Auto Workers President Rory Gamble said in a Monday statement. "The sooner we can limit exposure and ‘flatten the curve,' the sooner all American’s can go back to work, school and our daily normal routines. It’s a tough decision, but a necessary one.”

Other state's orders

In recent days, Whitmer's answers on a potential stay-at-home order have shifted as the number of coronavirus cases in Michigan has grown. On Thursday — when the state had 334 confirmed cases — Whitmer told The Detroit News she wasn't considering such an order.

When asked about it on Sunday morning — when the state would later that day report 1,035 confirmed cases — Whitmer said things were "moving fast."

"We are always evaluating," she said during an interview on "Fox News Sunday." "We've got an ongoing debate about what the next step is and I would anticipate additional steps being taken."

Illinois and Ohio have already barred non-essential business and travel in their states.

Whitmer has been working closely with the governors of Illinois and Ohio as all three states have taken similar steps to combat the virus.

Illinois Gov. JB Pritzker issued his state's stay-at-home order on Friday. It says people in Illinois can only leave their homes for "essential activities, essential governmental functions or to operate essential businesses and operations."

On Sunday, Ohio Gov. Mike DeWine issued his state's order, which featured similar language. Both orders allow businesses to continue "minimum basic operations."

In Ohio, people can still leave their homes for outdoor activity, to obtain "essential supplies," such as groceries, for essential business and to take care of family members.

The Ohio order also exempts health care operations, human services operations, stores that sell groceries, stores that sell medicine, manufacturers of food and licensed marijuana, religious entities, media, charitable organizations, gas stations, hardware supply stores, mail operations and educational institutions, among others.

Both the Ohio and Illinois orders exempt restaurants that offer takeout and delivery services.

Ohio's order included 25 types of "essential" businesses that can continue operating. The Illinois order included 24 types.

The order in Michigan appears to require businesses to do more to prove that they have to maintain minimum basic operations or qualify for exemptions.

Michigan lawmakers react

U.S. Rep. Paul Mitchell, a Dryden Republican, opposes a stay-at-home order, fearing that it will create more confusion among the public and cause some people to overreact. 

“You need to let businesses and individuals make decisions about what they need to do to take care of themselves. We lead people. We don’t direct people. We don’t order people,” Mitchell said. “I think a stay-home or shelter-in-place order is a step too far, rather than taking a breath in seven to 10 days to see what the circumstances are.”

Mitchell said he spoke to Whitmer late Saturday afternoon and advised her such an order would do further damage to the already struggling economy.

“What I advised the governor to do was particularly to reinforce what’s necessary to keep themselves safe and prevent the spread to people who are particularly vulnerable,” Mitchell said. 

Mitchell, who sits on the House Armed Services Committee, is worried that Whitmer’s order would discourage some employees from going to work at crucial businesses, such as defense contractors and others. 

He said he visited his local Home Depot twice on Sunday and talked to folks picking up supplies for home-improvement projects, all while abiding by social-distancing guidelines and wearing protective gloves. 

“We aren’t going to achieve more compliance (with public health guidelines) by this order, but we are going to create more confusion and a great deal more panic,” Mitchell said. “I’m worried about people overreacting. I’m worried about droves going to the grocery store and putting drains on that all at one time because they’re not sure what this stay-at-home order means for their family.”

But U.S. Rep. Debbie Dingell, a Dearborn Democrat, said she supports Whitmer’s stay-home order. 

“We need to stay at home. Too many people haven’t taken it seriously. When you see pictures of people at bars and beaches, it shows there’s people endangering others in our community,” Dingell said in a Monday interview. 

“Essential workers are allowed, and people need to be able to get groceries and go to drug stores. All of us need to play the role that we have to play, and for some if that means sitting on a couch, they can do it.” 

Dingell on Facebook urged her constituents to heed the advice of public health experts to stay at home and avoid mingling with others to stem the virus’ spread. She said she hasn’t left her home in a week except for a 6 a.m. walk Sunday morning where she saw “nobody.” 

U.S. Rep. Bill Huizenga, a Zeeland Republican and small business owner, said he supports the stay-home order: “It does get people’s attention, and this is a genuine health care crisis.” 

“It’s been surprising to me how many families are still talking about going away for spring break and all these things they’re still doing. There’s people still getting together. It’s just been surprising to me the number of folks who seemingly aren’t taking this seriously,” Huizenga said. “It’s a necessity in my estimation based on the health care systems and where they sit today. We needed to do this.” 

While Whitmer in her remarks panned the federal government for its lack of initiative on this front, Huizenga noted there won’t be a national stay-home order because these restrictions need to go state by state. 

“That’s why it was puzzling and a bit disappointing — the governor’s statement about a lack of a national comprehensive plan and the states doing more,” Huizenga said. “Well, that’s our system. What makes sense in Michigan may not make sense in North Dakota.”

Whitmer has already shuttered Michigan's schools, banned public gatherings of more than 50 people and closed bars, movie theaters, gyms and dine-in service at restaurants.
