The argument being used to reopen the schools is that teachers cannot report child abuse.

Researcher Pleaded Guilty to Conspiring to Steal Scientific Trade Secrets from Ohio Children’s Hospital to Sell in China

Former Ohio woman Li Chen, 46, pleaded guilty today via video conference in U.S. District Court today to conspiring to steal scientific trade secrets and conspiring to commit wire fraud concerning the research, identification and treatment of a range of pediatric medical conditions.

“Once again we see the People’s Republic of China (PRC) facilitating the theft of our nation’s ingenuity and hard work as part of their quest to rob, replicate and replace any product they don’t have the ability to develop themselves,” said John C. Demers, Assistant Attorney General for National Security.  “Far from being an isolated incident, we see the PRC implicated in around 60 percent of all trade secret theft cases.  This continued economic belligerence runs contrary to the values and norms that facilitate the success of our industries and countering it remains among our highest priorities.”

“Nationwide Children’s Hospital’s Research Institute took reasonable measures to protect its cutting-edge intellectual property and trade secrets regarding exosomes, and I commend the cooperation of Nationwide Children’s throughout this investigation,” U.S. Attorney David M. DeVillers said. “Chen betrayed her employer of 10 years by stealing trade secrets from this American institution and transferring them to China after receiving payments from the Chinese government.”

“Li Chen was a trusted researcher at Nationwide Children’s Hospital, conducting cutting-edge U.S. government-funded research,” stated FBI Cincinnati Special Agent in Charge Chris Hoffman. “With her guilty plea, she admits that she abused this trust to establish a company in China for her own financial gain. The FBI is committed to working closely with partners such as Nationwide Children’s Hospital to protect the innovations that make America a world leader in science and technology.”

Chen admitted to stealing scientific trade secrets related to exosomes and exosome isolation from Nationwide Children’s Hospital’s Research Institute for her own personal financial gain.

Chen and her husband, alleged co-conspirator Yu Zhou, 49, worked in separate medical research labs at the Research Institute for 10 years each (Zhou from 2007 until 2017 and Chen from 2008 until 2018).  They are charged with conspiring to steal at least five trade secrets related to exosome research from Nationwide Children’s Hospital.

Exosomes play a key role in the research, identification and treatment of a range of medical conditions, including necrotizing enterocolitis (a condition found in premature babies), liver fibrosis and liver cancer.

Exosomal microRNA predicts and protects against severe bronchopulmonary dysplasia in extremely premature infants

Premature infants are at high risk for developing bronchopulmonary dysplasia (BPD), characterized by chronic inflammation and inhibition of lung development, which we have recently identified as being modulated by microRNAs (miRNAs) and alterations in the airway microbiome. Exosomes and exosomal miRNAs may regulate cell differentiation and tissue and organ development. We discovered that tracheal aspirates from infants with severe BPD had increased numbers of, but smaller, exosomes compared with term controls. Similarly, bronchoalveolar lavage fluid from hyperoxia-exposed mice (an animal model of BPD) and supernatants from hyperoxia-exposed human bronchial epithelial cells (in vitro model of BPD) had increased exosomes compared with air controls. Next, in a prospective cohort study of tracheal aspirates obtained at birth from extremely preterm infants, utilizing independent discovery and validation cohorts, we identified unbiased exosomal miRNA signatures predictive of severe BPD. The strongest signal of reduced miR-876-3p in BPD-susceptible compared with BPD-resistant infants was confirmed in the animal model and in vitro models of BPD. In addition, based on our recent discovery of increased Proteobacteria in the airway microbiome being associated with BPD, we developed potentially novel in vivo and in vitro models for BPD combining Proteobacterial LPS and hyperoxia exposure. Addition of LPS led to a larger reduction in exosomal miR 876-3p in both hyperoxia and normoxia compared with hyperoxia alone, thus indicating a potential mechanism by which alterations in microbiota can suppress miR 876-3p. Gain of function of miR 876-3p improved the alveolar architecture in the in vivo BPD model, demonstrating a causal link between miR 876-3p and BPD. In summary, we provide evidence for the strong predictive biomarker potential of miR 876-3p in severe BPD. We also provide insights on the pathogenesis of neonatal lung disease, as modulated by hyperoxia and microbial product–induced changes in exosomal miRNA 876-3p, which could be targeted for future therapeutic development.

According to her plea agreement, Chen conspired to steal and then monetize one of the trade secrets by creating and selling exosome “isolation kits.”  Chen admitted to starting a company in China to sell the kits.  Chen received benefits from the Chinese government, including the State Administration of Foreign Expert Affairs and the National Natural Science Foundation of China.  Chen also applied to multiple Chinese government talent plans, a method used by China to transfer foreign research and technology to the Chinese government.

As part of her plea, Chen has agreed to forfeit approximately $1.4 million, 500,000 shares of common stock of Avalon GloboCare Corp. and 400 shares of common stock of GenExosome Technologies Inc.

Chen and Zhou were arrested in California in July 2019 and their case was unsealed in August 2019 when they appeared in federal court in Columbus.

Couple Who Worked at Local Research Institute for 10 Years Charged with Stealing Trade Secrets, Wire Fraud

A former Dublin, Ohio, couple has been charged with crimes related to stealing exosome-related trade secrets concerning the research, identification and treatment of a range of pediatric medical conditions announced Assistant Attorney General John C. Demers of National Security, U.S. Attorney Benjamin C. Glassman for the Southern District of Ohio, Assistant Director John Brown of the Counterintelligence division and FBI Special Agent in Charge Todd Wickerham of the Cincinnati division.

“Nationwide Children’s Hospital devoted years of work and its own money to researching exosomes in order to promote honorable medical advances,” U.S. Attorney Glassman said.  “The hospital’s Research Institute took reasonable measures to keep its trade secrets secret.  I commend the cooperation of Nationwide Children’s throughout this investigation.”

“The theft of trade secrets is a growing threat that severely impacts our economy and our national security,” stated FBI Cincinnati Special Agent in Charge Todd Wickerham.  “The FBI is committed to investigating these cases and working with all of our partners to protect intellectual property.”

According to the indictment, Yu Zhou, 49, and Li Chen, 46, currently of San Diego, California, conspired to, attempted to and did steal scientific trade secrets related to exosomes and exosome isolation from Nationwide Children’s Hospital’s Research Institute for their own personal financial gain.

The defendants were arrested in July and the case was unsealed today at the defendants’ arraignments in federal court in Columbus at 2pm before U.S. District Judge Sarah D. Morrison.

Zhou and Chen are spouses who worked in separate medical research labs at the Research Institute for 10 years each (Zhou from 2007 until 2017 and Chen from 2008 until 2018).  Exosomes play a key role in the research, identification and treatment of a range of medical conditions, including necrotizing enterocolitis (a condition found in premature babies), liver fibrosis and liver cancer.

The husband and wife allegedly founded a company in China in 2015 without the hospital’s knowledge.  While Zhou and Chen continued to be employed by Nationwide Children’s, they marketed products and services related to exosome isolation through their Chinese company.

The indictment also alleges that in 2017, Zhou and Chen helped co-found an American biotechnology company.  As of 2019, the company’s website advertises multiple products and services related to exosome isolation, including a kit that was developed from a trade secret created at a Nationwide Children’s research lab.

Zhou and Chen allegedly used the hospital’s Research Institute resources and equipment to conduct the exosome research necessary for their unauthorized, outside work.

In November 2017, Zhou and Chen allegedly received more than $876,000 and stock related to an asset purchase agreement involving the American biotechnology company.  It is also alleged Zhou entered into a stock purchase agreement with that same company under which he would receive $450,000.

Zhou resigned from the Research Institute at Nationwide Children’s, effective Nov. 10, 2017.  On Jan. 31, 2018, Chen resigned from her position at the research institute.

Before his official last day of employment with the research institute, Zhou allegedly participated in a press release announcing the American company’s plans to market and distribute “proprietary exosome isolation systems” from its headquarters in Central Ohio.

Conspiring to, attempting to and committing theft of trade secrets is punishable by up to 10 years in prison. Conspiring to, attempting to and committing wire fraud carries a potential maximum sentence of up to 20 years in prison.

Assistant Attorney General Demers and U.S. Attorney Glassman commended the investigation of this case by the FBI, as well as Assistant United States Attorneys S. Courter Shimeall, Peter Glenn-Applegate and J. Michael Marous and National Security Division trial attorney Matthew J. McKenzie, who are prosecuting the case.

An indictment merely contains allegations, and defendants are presumed innocent unless proven guilty in a court of law.

Tales Of The New Crown: DOJ Charges Detroit Procurement Consortia Task Force Small Business Wire Fraud Scheme - But Not Sherry The Sleuth - Yet

I wonder when I shall read a MIED presser on all the glorious things Sherry "The Sleuth" Gay Dagnogo has done for the children of Detroit because we already knows what she does for herself.

A Detroit resident was charged in a criminal complaint for his alleged role in a scheme to obtain $590,900 from the Payroll Protection Program for a non-functioning business, announced United States Attorney Matthew Schneider.

Joining in the announcement was Special Agent in Charge Steven M. D’Antuono, Federal Bureau of Investigation.

Charged is Darrell Baker, 51, of Detroit, Michigan.

As alleged in the complaint, Baker applied for and obtained a $590,000 Payroll Protection Program Loan on behalf of a purported business that he owns, called “Motorcity Solar Energy, Inc.” The Paycheck Protection Program is a program managed by the Small Business Administration (SBA) that provides loans to help businesses keep their workforces employed during the Covid-19 crisis. The SBA will forgive the loans if all employees are kept on the payroll for eight weeks and the money is used for payroll, rent, mortgage interest, or utilities. The Payroll Protection Act loans are funded from participating banks, in this case Customers Bank in Pennsylvania.

The complaint further alleges that Baker submitted paperwork with his loan application representing that Motorcity Solar Energy Inc. had 68 employees and, in 2019 paid wages, tips, and other compensation totaling $2.8 million. In fact, the state of Michigan had dissolved Motorcity Solar Energy Inc.’s status as a corporation in July 2019. All of Motorcity’s purported business locations were either empty suites or single-family residences, with no evidence of business activity. And Motorcity never established any account with the State of Michigan’s unemployment insurance program, which is a prerequisite for any valid employer in the state. 

The complaint further alleges that, in the two days after the loan was funded, Baker purchased four cashiers checks and withdraw an additional $60,000 in cash. None of these cashier’s checks went to payroll or other business expenses. Indeed, Baker used the four cashiers checks to purchase two Cadillac Escalades, a Dodge Charger, and a Hummer.  According to the complaint, Baker purchased one of vehicles for his brother-in-law and one for his sister; the remaining two vehicles Baker kept for his own use and enjoyment.

United States Attorney Schneider stated “Defendant Baker is charged with lying to obtain money that was supposed to help small businesses struggling with their payroll and expenses due to the COVID-19 pandemic.  Defrauding banks to obtain loans is never acceptable, and doing so during our current national emergency is unconscionable.  This prosecution is yet another example of our office’s commitment to holding accountable anyone who would exploit the COVID-19 crisis for their own greedy desires.” 

“The Paycheck Protection Program is designed as a lifeline to businesses struggling to survive this current crisis. Instead of using these loans to salvage a legitimate business, the defendant allegedly bought expensive personal items for himself and his family,” said SAC D’Antuono. “These actions harmed hard-working Americans and deserving small businesses. The FBI is committed to investigating anyone who seeks to take advantage of a global pandemic to line their own pockets at the expense of American taxpayers.”

A complaint is only a charge and is not evidence of guilt.  Trial cannot be held on felony charges in a complaint.  When the investigation is completed a determination will be made whether to seek a felony indictment.

The case is being prosecuted by Assistant United States Attorney John K. Neal. The investigation is being conducted by the FBI.

From 2006 to 2008, Bright returned to working in the private sector of the biotechnology industry at Novavax in Maryland, where he was vice president of their global influenza programs as well as of their vaccine research and development. During this time, he participated in World Health Organization committees on vaccine development and pandemic preparedness.[8][11][13]

In February 2008, Bright worked at the non-profit PATH on a Bill & Melinda Gates Foundation grant funded project as the director in vaccine manufacturing capacity building in Viet Nam. He was also the scientific director of the influenza vaccine project as well as the global vaccine development program, a position he held until October 2010.[8]

In 2010, Bright joined the U.S. Department of Health and Human Services (HHS) governmental agency Biomedical Advanced Research and Development Authority (BARDA). He was the program lead of BARDA International Programs, then in June 2011 became acting chief of the influenza antiviral drug advanced development program, a position he held until December 2011. From June 2011 to December 2015, he was both deputy director and acting director of BARDA's Influenza and Emerging Diseases Division, eventually serving as director of the division from December 2014 to November 2016. From February 2016 to November 2016, he was an incident commander in the ASPR/BARDA Zika Response.[8][14]

Rick Bright will warn Congress of 'darkest winter in modern history' without ramped up coronavirus response

(CNN)Dr. Rick Bright, the ousted director of a key federal office charged with developing medical countermeasures, will testify before Congress on Thursday that the Trump administration was unprepared for the coronavirus pandemic and warn that the the US will face "unprecedented illness and fatalities" without additional preparations.

"Our window of opportunity is closing. If we fail to develop a national coordinated response, based in science, I fear the pandemic will get far worse and be prolonged, causing unprecedented illness and fatalities," Bright is expected to say Thursday, according to his prepared testimony obtained by CNN. "Without clear planning and implementation of the steps that I and other experts have outlined, 2020 will be darkest winter in modern history."

Bright is set to testify Thursday morning before the House Committee on Energy and Commerce's health subcommittee after he filed a whistleblower complaint last week alleging he was removed from his post in retaliation for opposing the broad use of a drug frequently touted by President Donald Trump as a coronavirus treatment.

Bright will reiterate that he believes he was removed from his post because he "resisted efforts to promote and enable broad access to an unproven drug, chloroquine, to the American people without transparent information on the potential health risks."

Bright is seeking to be reinstated to his position as the head of the Biomedical Advanced Research and Development Authority (BARDA) and the Office of Special Counsel, which is reviewing Bright's complaint, has determined there is reason to believe his removal was retaliatory and is recommending he be reinstated during its investigation, according to Bright's attorneys.

A Department of Health and Human Services spokesperson responded that it was "a personnel matter that is currently under review" but said it "strongly disagrees with the allegations and characterizations."

Expanding on his whistleblower complaint, Bright is expected to testify that he sought to warn his superiors about potential shortages of critical medical supplies earlier this year, but that his "urgency was dismissed" and that he "faced hostility and marginalization from HHS officials" after conveying his concerns about shortages to a senior White House official, Peter Navarro.

"As I reflect on the past few months of this outbreak, it is painfully clear that we were not as prepared as we should have been. We missed early warning signals and we forgot important pages from our pandemic playbook," Bright will testify, according to his written testimony.

In his written testimony, Bright also calls for several key steps to improve the federal government's response to the pandemic and head off a spike in cases in the fall, including increasing public education of preventative measures, ramping up production of essential medical supplies and developing a national testing strategy.

"The virus is out there, it's everywhere. We need to be able to find it, to isolate it and to stop it from infecting more people," Bright plans to say. "We need tests that are accurate, rapid, easy to use, low cost, and available to everyone who needs them."

He made his complaint public through Washington Post but failed to release the 33 attachments to the committee.

He did not follow the well established chain of command for filing a whistleblower action.

He sounds like he was coached by one of those absolutely brilliant "Legal Geniuses" (trademark pending).

I guess Rick was blinded by science when it comes to the rule of law in actions of false claims.

I would have fired him, too.

His complaint was pending and I see no certification of verification.

HHS Announces New Ventilator Contracts, Orders Now Totaling Over 130,000 Ventilators

This week, the Department of Health and Human Services announced five new contracts for ventilator production rated under the Defense Production Act (DPA), to General Electric, Hill-Rom, Medtronic, ResMed, and Vyaire, as well as two other contracts for ventilator production, to Hamilton and Zoll.

In total, combined with contracts with General Motors and Philips rated under the DPA earlier this week, HHS has finalized contracts to supply 6,190 ventilators for the Strategic National Stockpile by May 8 and 29,510 by June 1. The seven new ventilator contracts announced by HHS this month will provide a total of 137,431 ventilators by the end of 2020.

The rating of the five contracts under the DPA follows President Trump's direction to HHS Secretary Alex Azar to invoke the Act with regard to General Electric, Hill-Rom, ResMed, Medtronic, and Vyaire on April 2.

Secretary Azar issued the following statement:

"President Trump and HHS's use of the DPA is getting private manufacturers what they need to ramp up ventilator production rapidly. We are grateful to the patriotic Americans at companies working around the clock and retooling factories to increase ventilator production. The thousands of ventilators delivered to the Strategic National Stockpile starting this month, continuing through the spring and summer, will mean we have more capacity to respond to the pandemic as it evolves. HHS and FEMA deployment of ventilators from the stockpile have helped ensure that hospitals in states such as New York have not run out of ventilator capacity while working to save lives."

General Electric's contract, at a price of $64.1 million, is for 2,410 ventilators produced by June 29, with 112 by May 4 and 736 by June 1.

Hamilton's contract, at a price of $552 million, is for 14,115 ventilators produced by July 3, with 850 by May 8 and 4,404 by May 22.

Hill-Rom's contract, at a price of $20.1 million, is for 3,400 ventilators produced by July 13, with 400 by June 1.

Medtronic's contract, at a price of $9.1 million, is for 1,056 ventilators to be produced by June 22, with 200 by May 4 and 678 by June 1.

ResMed's contract, at a price of $31.98 million, is for 2,550 ventilators produced by July 13, with 400 by May 4 and 1,150 by June 1.

Vyaire's contract, at a price of $407.9 million, is for 22,000 ventilators produced by June 29, with 1,200 ventilators by May 4 and 9,100 by June 1.

Zoll's contract, at a price of $350.1 million, is for 18,900 ventilators produced by July 3, with 1,010 by May 4 and 4,410 by June 1.

Ambassador-at-Large, Deborah L. Birx, M.D., is the Coordinator of the United States Government Activities to Combat HIV/AIDS and U.S. Special Representative for Global Health Diplomacy. Ambassador Birx is a world-renowned medical expert and leader in the field of HIV/AIDS. Her three-decade-long career has focused on HIV/AIDS immunology, vaccine research, and global health. As the U.S. Global AIDS Coordinator, Ambassador Birx oversees the implementation of the U.S. President’s Emergency Plan for AIDS Relief (PEPFAR), the largest commitment by any nation to combat a single disease in history, as well as all U.S. Government engagement with the Global Fund to Fight AIDS, Tuberculosis and Malaria. Serving as the U.S. Special Representative for Global Health Diplomacy, she aligns the U.S. Government’s diplomacy with foreign assistance programs that address global health challenges and accelerate progress toward: achieving an AIDS-free generation; ending preventable child and maternal deaths; and preventing, detecting, and responding to infectious disease threats.
In 1985, Ambassador Birx began her career with the Department of Defense (DoD) as a military-trained clinician in immunology, focusing on HIV/AIDS vaccine research. From 1985-1989, she served as an Assistant Chief of the Hospital Immunology Service at Walter Reed Army Medical Center. Through her professionalism and leadership in the field, she progressed to serve as the Director of the U.S. Military HIV Research Program (USMHRP) at the Walter Reed Army Institute of Research from 1996-2005. Ambassador Birx helped lead one of the most influential HIV vaccine trials in history (known as RV 144 or the Thai trial), which provided the first supporting evidence of any vaccine’s potential effectiveness in preventing HIV infection. During this time, she also rose to the rank of Colonel, bringing together the Navy, Army, and Air Force in a new model of cooperation – increasing the efficiency and effectiveness of the U.S. Military’s HIV/AIDS efforts through inter- and intra-agency collaboration. Then known as Colonel Birx, she was awarded two prestigious U.S. Meritorious Service Medals and the Legion of Merit Award for her groundbreaking research, leadership, and management skills during her tenure at DOD. 

From 2005-2014, Ambassador Birx served successfully as the Director of CDC’s Division of Global HIV/AIDS (DGHA), which is part of the agency’s Center for Global Health. As DGHA Director, she utilized her leadership ability, superior technical skills, and infectious passion to achieve tremendous public health impact. She successfully led the implementation of CDC’s PEPFAR programs around the world and managed an annual budget of more than $1.5 billion. Ambassador Birx was responsible for all of the agency’s global HIV/AIDS activities, including providing oversight to more than 400 staff at headquarters, over 1,500 staff in the field, and more than 45 country and regional offices in Africa, Asia, Caribbean, and Latin America. Recognized for her distinguished and dedicated commitment to building local capacity and strengthening quality laboratory health services and systems in Africa, in 2011, Ambassador Birx received a Lifetime Achievement Award from the African Society for Laboratory Medicine. In 2014, CDC honored her leadership in advancing the agency’s HIV/AIDS response with the highly prestigious William C. Watson, Jr. Medal of Excellence. 

Ambassador Birx has published over 220 manuscripts in peer-reviewed journals, authored nearly a dozen chapters in scientific publications, as well as developed and patented vaccines. She received her medical degree from the Hershey School of Medicine, Pennsylvania State University, and beginning in 1980 she trained in internal medicine and basic and clinical immunology at the Walter Reed Army Medical Center and the National Institutes of Health. Ambassador Birx is board certified in internal medicine, allergy and immunology, and diagnostic and clinical laboratory immunology.

Black people with HIV infection are at increased risk of kidney disease and the reasons for this are not well understood. We would like to examine the risk factors for this, especially the contribution of a person’s genetic makeup. Participants will provide blood and urine samples, to examine the relationship between genetics and kidney problems. We will be approaching potential participants in clinic. To take part, patients must have HIV infection and have been born (or have parents who were born) in sub-Saharan Africa or the Caribbean.

The HIV research team conduct a variety of drug trials and observational studies. These studies aim to improve our understanding of HIV and discover better treatments. It is up to you whether you want to take part in research and it will not affect your care in any way. A doctor or a research nurse will be very happy to give you more information and discuss your suitability for a trial. As many people are only seen every six months you may miss out on the chance to take part in some studies.
