SCOTUS ruling in "Hobby Lobby" is all about child welfare

For those of you who have not heard about the SCOTUS "Hobby Lobby" decision, here it is for your
SCOTUS Chief Justice John Roberts "divining" on
the Hobby Lobby opinion
reading enjoyment.

For those of you who dare not muddle through the legalize, which I must say, Justice Ruth Ginsburg's dissent was eloquently scathing, have fun.

The controversy at hand is not, or rather, should not, be centered on an all male majority "He-Man-Women-haters Club" nor should it be on a woman's ability to have equal access to necessary medicine and medical procedures similar to men as Viagra is covered for men.

The issue at hand, which has failed to see the light of the legal and political pundits, is child welfare.

Yes, the Hobby Lobby case is about child welfare.

Some years ago, 2007, I worked with Michigan House Republicans to craft a Resolution on protecting Parental Rights.  This was taken to the federal level to be the Parental Rights Amendment.

The underlying base of the Parental Rights Amendment was the Religious Freedom Restoration Act (RFRA).

RFRA had been successfully used in cases involving Child Protective Services improperly removing children from parents.  The premise was, and is, parenting is a religious belief which bars government intervention, unless there is a "compelling governmental interest".

During the Michigan crafting period of its Parental Rights Resolution, the state was in its darkest days of defalcation of federal funding of child welfare.  It was a free-for-all where anyone who had a child welfare contract with the state could and would double, triple, phantom-bill, typically, Medicaid.

Court cases were fictitious whereby the family court policy of Lincoln Hall of Justice, under leadership of, then, Referee Kelly Ann Ramsey and Judge Judy Hartsfield where children, as young as 2 years of age, were being prosecuted as juvenile delinquents and contemporaneously adjudicated as wards of the court for foster care placement without a single person (no attorney, no parent, no Assistant Attorney General, no human being) ever being in the courtroom because all the orders were "rubber stamped".  Parents were tried of child abuse where there were never any charges nor pleas nor evidence entered into the record. (emphasis added.)

The Democratic leadership of Wayne County refused to publicly address the issue because money was being funneled to election campaigns via organizations like Black Family Development and even Michigan Supreme Court Justice Maura Corrigan (now, DHS Director).

West Michigan Republicans, many evangelical Christians, began to examine the application of RFRA into numerous other areas under the guise of economic prosperity of the family through the promotion of Christian values.

Now, the power of RFRA applications have been honed to parsimoniously craft a national agenda of child welfare via the Hobby Lobby.

Unbeknownst to the anti-abortion, pro-life, advocates, their rally cry to "save the babies" in basted in the juices of "compassionate cleansing".  This is the advocacy for children of poor, who are typically cognitively and psychologically developmentally disabled, to become productive, low wage, future workers of corporations and purge the human gene pool by naturally controlling human reproduction through the installation of "good Christian values" of abstinence, marriage and reducing life expectancy with chemical constraints of psychotropic medications, complete with social repression of sexual orientation, creativity and personal expression.

The logic of future cheap labor
I consider it social eugenics to create a cheap labor force for global competition in the free market.  The literal interpretation of the "best interests of the child" is to reap the future interest of workforce productivity from the investment in the human capital of the babies who are "saved".  Christian assimilation.

It begins with the removal of the child from the legal custody of the parent, either in vitro or ex vitro.

The Christian campaign of "saving the child" begins with the codification of a zygote/fetus for personhood.  The grant of legal custody and guardianship of the child is quickly being reclaimed as chattel as part of the national platform for the conservative movement but what is even more foreshadowing of this ruling is the possibility of that grant at the moment of conception.  This is the thrust of religious fervor behind the pro life movement.  "

If a woman is to abort or prevent, then her legal rights to the child have defaulted to the state.  The promotion of child protective services, eventually, under the theory of Christian compassion, removes that child from its human host as economic preservation of future productivity in human capital as the likelihood of that child growing up to pay taxes is not statistically significant according to conservative think tanks.

This conservation of Christian values revisits an era of err for which I identify as the beginning of civil rights, specifically the 13th, 14th and 15th Amendments to the U.S. Constitution.  The Emancipation Proclamation "erred" as it did not address the future grant of custody and guardianship of posterity.

Children are acknowledged in the U.S. Constitution as "our posterity" and this is what this precursive ruling addresses: the "peculiar institution" of child welfare, in the name of a Christian God.

HHS Secretary Burwell recruits Kevin Thurm to the battle of corporations.

HHS Secretary Burwell seems to be moving smoothly along as she implements the strategic plan of redeveloping how we, as a nation, look upon health care, and, as a nation, how the world looks upon us.
Team HHS kicking the mean-spirited-tea-bagger-kiddy-
hate-corporate-monster butt

Our international reputation wanes in compassion towards our posterity.  This is the mission: Rebuild America's  Future.

I am quite sure there are those scratching their heads trying to figure out how it is that one may rebuild something which has yet to exist.

The U.S. has an extremely poor history in dealing with the concept of "the best interest of the child', better recognized as child welfare.  Of course we can go as far back as to the burgeoning the days of the peculiar institution of slavery to see just how well we have treated children.  If not, you can click this link for all the latest updates on well we treat our children.

Just for a moment, think of humans as capital.  If one does not invest wisely, there will be no future profit.

Under the proper economic conditions financial capital will grow through investments in real capital.  Now, think of a child who thrives in quality environmental conditions: good housing; decent education; access to proper nutrients; clean water; with health care as a monitoring indicator of future returns on the investment of a child to grow up to be a productive, tax-paying member of society.

The world has witnessed hate-spewing political and religious, specifically Christian, leaders unleash their Leviathan to unweave the very last fibers of the social safety net through the use of the personification of the corporation.

As the corporation begins to be transmogrified into Hobbes' absolute sovereign beast through SCOTUS cases like 'Citizens United' and 'Hobby Lobby', the social contract is being rewritten without the voice of children.  This new social contract can be witnessed in the cacophony of religious fervor calling for the pending death and/or corporate servitude of a child who is poor.

It seems under the new leadership of HHS Secretary Burwell, a combative strategy has been borrowed from the corporate playbook.  Over the last few years there has been extreme silo-busting in HHS.

What better way of rebuilding America's future than by actually running it as public service corporation with private corporation experts.

Kevin Thurm to join HHS as Senior Counselor
Today, Health and Human Services Secretary Sylvia M. Burwell named Kevin Thurm as a Senior Counselor, to further strengthen the HHS management team and help the agency fulfill its mission to better serve the American people.
Kevin brings more than 25 years of business, executive management, legal and policy experience.  Throughout his career, he has demonstrated the ability to deliver meaningful results in both complex public and private sector organizations.
“We’re continuing to build on the strong leadership team that exists at HHS and recruit top talent,” said Secretary Burwell.  “Kevin’s decades of broad experience spans business and government with the focus necessary to advance our goals.  He brings to the Department not only his proven abilities as a leader, but also a deeply-held commitment to our mission.”
As a Senior Counselor, Thurm will work closely with the Department’s senior staff on a wide range of cross-cutting strategic initiatives, key policy challenges, and engagement with external partners.
Since 2001, Thurm has held various leadership positions within Citigroup, managing thousands of employees and budgets of hundreds of millions of dollars.  Before joining Citigroup, Thurm served as the Deputy Secretary for Health and Human Services in the Clinton Administration under former Secretary Donna Shalala.  He oversaw major policy and management issues, including the implementation of the Government Performance and Results Act and the “Y2K” computer programing situation.
Thurm will report directly to the Secretary.

Kevin Thurm, a former official within HHS, is returning to the agency as a senior counselor.

HHS announced the move Wednesday. Thurm, 53, previously was second-in-command as the HHS deputy secretary from 1996 to 2001 under President Bill Clinton and former HHS Secretary Donna Shalala. Thurm also served as HHS chief of staff.

After leaving HHS, Thurm went to banking giant Citigroup, where he held several roles. Most recently, he was Citigroup's chief compliance officer and senior adviser for compliance.

In Thurm’s new role, he will report to HHS Secretary Sylvia Burwell and help the department “on a broad range of critical health and human services programs,” a spokeswoman said. No further details were given.

Thurm’s appointment is part of a string of new hires within HHS. Last month, Burwell named former Wal-Mart executive Leslie Dach a senior counselor. He will help with the second open-enrollment period for the health insurance exchanges. Jackie Cornell-Bechelli was named a regional director last week. She will oversee all health and social-service issues in New York, New Jersey, Puerto Rico and the U.S. Virgin Islands. In July, Burwell also hired Andy Slavitt as the CMS’ principal deputy administrator—the second-highest position within CMS.

HHS is also in the process of recruiting a CEO and chief technology officer for the HealthCare.gov insurance exchange.

SCOTUS: The Very Second Live Broadcast Of The Very First Time The World Witnesses The Dark Residuals Of The Peculiar Institution On Stealin' The Children, Land & Vote - Termination Of Corporate Parental Rights - Little Sister Of The Poor

Little Sisters of the Poor!!!!!!!!!!!!!!!!!!

Trafficking tiny humans.

Child trafficking.

Sex trafficking of kids.

This is about Medicaid Fraud in Child Welfare.

Funneling federal money through children's trusts for human R&D.

This is about Parental Rights.

Here comes Pennsylvania.

Blasphemous Propagandists!

This is about invading foreign lands for the purposes of stealin' the children, land & vote, in what under the legal doctrine of the residuals of the peculiar institution called gerrymandering, or, of those who need a more modern day human trafficking doctrine, forced migration of chattel, but all the "Legal Geniuses" (trademark pending) are doing a distractionary hovering over the APA.

Vile creatures.

https://www.nationalreview.com/bench-memos/positive-developments-for-the-little-sisters-of-the-poor/

https://www.wsj.com/articles/the-endless-war-on-the-little-sisters-of-the-poor-11588720068

Why are these people promulgating trafficking tiny humans?

Why?

I need someone to explain this to me.

No, I need these "Legal Geniuses" (trademark pending) to be defrocked.

Noel Fransico is arguing.

Noel has a vested interest in this case, so I really do not know why he has yet to disclose.

The transcription sucks.

Symbols - Symbols | 8
Corporate Parent Logos with lots of
registered trademarks all look alike.
Why are they using as the argument of children doing chores and an issue of fealty to a foreign nation, even though the logos of the corporations, even though they all look the same, but are not beholden to the right to bear the arms of the United States to be a subrecipient of Faith Based Funding, when it comes to handing out contraceptives to women and children who are being trafficked and babies snatched, sold, and used as lab rats in the name of the lord, through their Public Private Partnerships, which are nothing more than Ham Sandwiches, because they are not incorporated?

Unacceptable!

Clarence Thomas spoke, for the second time, where the first, in some decades, was in the previously, historic, live stream of trafficking tiny humans through USAID, where defense got their legal tail feathers all fluffed, becauase it was the first time in 10 years that the U.S. brought up the issue of sex trafficking women and children through their Public Private Partnerships which all use that similarly looking logo, all over the world.

So far, no one in media or any of the brilliant *investigative journalists* have dared to touch this.

Let me know when you find the first mention.

The Court at one point called the argument to give them back their money, or they will collapse and can no longer traffic tiny humans, by claiming they could no give out contraceptives to support such moral turpitudity as being forced to do the sexual chores of producing tiny human products so they can keep their operations of running biogenetic, psychological, educational, and socieconomic target populations lab rat experiments in "The Third World", because you do not have to deal with any challenge to the acquisition of goods under chattel law, when on that salvific evangelic mission, in the name of the tax exempt foreign king, to save the souls of the savages, as being moot.

The case was called Hobby Lobby.

Defense lawyer dude claimed that because the insurance provider for the Little Sisters of the Poor, the parent, foreign, corporation, said they did not have to follow the laws of the U.S., and, as such, came up with the brilliant idea to animate the fictitious person called a corporation, and acknowledge on the record in a ruling, that corporations now have belief systems, and can claim all their entire existence on the fealty to a foreign nation, only connected through the children's trust funds, the offspring of the Public Private Partnership between the Vatican and the U.S.

So, basically, without any names being named, like Ascension Health, under the U.S. Conference of Catholic Bishops, under the Vatican, which runs, and has run, for a millennium or so, the Little Sisters of the Poor just admitted in SCOTUS, that the problem lies with their parent corporation and the contractual understanding of, "when a country gives you money, you cannot keep it and, in the same breath, fund trafficking tiny human operations in the sex slave trade.

That seems Defense dude lawyer stated into the official record that Little Sisters of the Poor has an oath of fealty to the Vatican, and not the United States.

Defense lawyer dude was not in a happy place.

I guess that is why his arguments should be considered arbitrary and capricious, my most favorite Michigan Children's Institute Superintendent Section 45 Cotton Pickin' argument.

Looks like we are quickly moving up the food chain in the residuals of the peculiar

Always remember, "there is no rule that does not have an exception", said the Court.

Section 1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction. Section 2. Congress shall have power to enforce this article by appropriate legislation.
 Praise the lord.

God save the queen, the foreign Allodial Title Holder of the Corporate Parent of the Little Sister Of The Poor.

And, of course, Sam Brownback.

Lisa Bloom, Bill Barr, Laura & George Bush, and Pat Cipallone, too!

And that, my dearies, is why Parental Rights to Bear the Arms of the U.S. shall be terminated, and they shall fall from the heavens to face the laws of the land, in the public square.

Survivors of Nigeria's 'baby factories' share their stories

Girls who fled Boko Haram attacks are being enslaved and raped by human traffickers who then sell their babies.

Women and children gather at the Madinatu IDP camp to listen to members of the Borno Community Coalition speak about the dangers of human trafficking [Philip Obaji Jr/Al Jazeera]
"Birth those babies. USAID & the their christians are in town."
As 16-year-old Miriam* stepped out of her tent to fetch water near the Madinatu Internally Displaced Persons (IDP) camp in Nigeria's northeastern Borno state in January last year, a middle-aged woman she knew as "Aunty Kiki" approached her.

She asked Miriam if she was interested in moving to the city of Enugu to work as a housemaid for a monthly salary.

Miriam, who is now 17, wasted no time in accepting the offer and began to prepare for her trip to the east the following day.

She told her 17-year-old cousin, Roda*, about it and advised her to approach Aunty Kiki.

When Roda, who is now 18, met Aunty Kiki the next morning, she asked if there was a job for her, too. The woman quickly agreed, so Roda packed her bags.

"We were both very excited to travel to Enugu," Miriam says. "We had suffered so much for four years and were happy to go somewhere new to start a new life."

The promise
Both girls, who used to live in the same compound in Bama, fled the northeastern Nigerian town in 2017 when Boko Haram stormed the area, burning down houses and kidnapping women and children.

Miriam and Roda fled, leaving other members of their family behind. They do not know what happened to them.

The two girls trekked for several days to reach Madinatu, where they remained for nearly two years before their trip to Enugu in southeastern Nigeria.

In Madinatu, Miriam and Roda lived together in a small bamboo tent inside the camp that houses more than 5,000 people who, like them, had fled Boko Haram.

Life was tough in the camp. Food was in short supply and IDPs had to beg on the streets of the nearby town to be able to get enough to eat.

So the girls jumped at the chance of paid jobs in Enugu.

They did not have time to tell anyone they were going.

The journey
First, they travelled with Aunty Kiki to Maiduguri.

Then a 12-hour journey to Abuja followed. They spent the night there in the home of a woman who knew Aunty Kiki.

The next day, after a nine-hour journey, they reached Enugu.

Aunty Kiki took them to a compound where she handed them over to an elderly woman she called "Mma" and told the girls to do whatever the woman asked of them.

"The compound had two flats of three bedrooms each, filled with young girls, some of them pregnant," says Miriam. "Aunty Kiki said it was where we'd be working."

At first, the girls thought their jobs were to clean the compound and do household chores as Aunty Kiki had led them to believe. Their new employers, however, had other ideas.

A daily torture
"Mma asked that we stay alone in separate rooms for that first night," Miriam explains. "We were surprised because the other girls in the compound were sharing rooms, some of which had four people in them."

Late that night, according to Miriam, a man walked into her room, ordered her to take off her clothes, held her hands tightly, and raped her.

The same thing happened to Roda, but her rapist was much more brutal.

"When I tried to scream, he covered my mouth and gave me a dirty slap," Roda says. "If he saw tears in my eyes, he slapped me even more."

The next day, the girls were moved to shared rooms with others, only being sent to single rooms when they were required to "work".

Both girls say they were raped almost daily by several different men.

They believe that Mma and Aunty Kiki work together in the same trafficking cartel and that Mma is the leader of the group.

All they could make out for sure, however, was that the two women communicated with each other and the men in Igbo, the language spoken in southeastern Nigeria.

Giving birth
Within a month, they were both pregnant. But still, they were raped.

"It doesn't matter whether you are six weeks or six months pregnant," says Roda. "If any of the men wants you, you can't say no."

It was pointless trying to escape, they explain, because the compound was guarded by men with guns.

Around a dozen girls were living in the compound when Miriam and Roda first arrived. But the number would change as the girls gave birth and were sent away, before new girls were brought in to produce more children for the cartel.

Miriam gave birth to a baby boy in the compound, with the assistance of a midwife who was called in from outside. But her son was taken from her.

Three days later, she was blindfolded and taken to a bus station where her traffickers made sure she boarded a vehicle back to the north.

"They didn't want me to know the way to the compound, that's why they covered my face," she explains. "I was given 20,000 naira (about $55) to assist in my transportation to my destination."

She first went to Abuja where she spent a night on the street before boarding a commercial vehicle back to Maiduguri.

'Boys are more expensive'
Miriam does not know how much her baby was sold for.

"Some traffickers let their victims leave after giving birth because they believe if girls stay for too long, they could develop a plan to expose the trade," explains Abang Robert, public relations head of Caprecon Development and Peace Initiative, an NGO focused on rehabilitating victims of human trafficking in Nigeria. "They are scared of sabotage."

Baby factories are more common in the southeastern part of Nigeria, where security operatives have carried out several raids, including an operation last year when 19 pregnant girls and four children were rescued.

Women and girls are held captive to deliver babies who are then sold illegally to adoptive parents, forced into child labour, trafficked into prostitution or, as several reports suggest, ritually killed.

"Boys are more expensive than girls in the baby sale business," says Comfort Agboko, head of the southeastern arm of Nigeria's anti-trafficking agency, the National Agency for the Prohibition of Trafficking in Persons (NAPTIP), at her office in Enugu.

"Male children are often sold for between 700,000 naira (about $2,000) to one million naira (about $2,700) while female babies are sold for between 500,000 naira (about $1,350) and 700,000 naira."

The majority of the buyers are couples who have been unable to conceive.

Although anyone caught buying, selling or otherwise dealing in the procurement of children can be prosecuted, the baby trade remains prevalent in Enugu.

'Orphanages'
In recent years, security officials have carried out several undercover operations targeting suspected baby trafficking cartels whose operations the Enugu state government said are aided by some security agencies and unscrupulous state officials.

To avoid suspicion in the local community, baby factories are often presented as orphanages, experts explain.

"Baby factory operators hide under the 'canopy' of orphanages," says Agboko. She believes people receiving babies from them either do not know or do not care that they are not really orphans.

NAPTIP has arrested and prosecuted a number of people involved in the sale of babies in the southeast in recent years, Agboko explains. There are currently around half a dozen cases going through the court system.

"We are now working in collaboration with the association of orphanage homes operators in the entire southeast to identify, arrest and prosecute such people," she adds.

There is no official data to show how many babies are bought and sold each year in Nigeria, nor the number of girls exploited by human traffickers.  The United Nations estimates, however, that "about 750,000 to one million persons are trafficked annually in Nigeria and that over 75 percent of those trafficked are trafficked across the states, 23 percent are trafficked within states, while 2 percent are trafficked outside the country."

Human trafficking 'widespread'
Like Miriam, Roda was also discarded after she gave birth to a boy.

The cousins were reunited in Madinatu, where they are now living together in a small mud house, not far from the camp they were trafficked from.

"Luckily, we got to Madinatu on the same day," says Miriam, who spent weeks on the streets of Abuja, before she was able to make her way back to the northeast.

"We thought it was no longer safe to stay in the camp, so talked to the man who owns this place to let us stay here."

To earn money, the girls now make and sell groundnut cakes at a mini kiosk just outside their compound.

They were not the first to be trafficked from the Madinatu camp. There have been many reports of girls being trafficked from the camp to cities in Nigeria and to countries including Italy, Libya, Niger and Saudi Arabia. The victims are often promised good jobs only to end up being exploited or enslaved.

Although widespread in Madinatu, the problem of human trafficking is not peculiar to this area alone. It is common across the entire northeast region.

The 2019 United States Department of State Trafficking in Persons report revealed that: "Sexual exploitation, including sex trafficking of IDPs (internationally displaced persons) in camps, settlements, and host communities around Maiduguri remained a pervasive problem." The report also notes that some security officials are complicit in these activities.

NAPTIP says it is aware of high numbers of cases of human trafficking in Madinatu and is increasing efforts to address the issue in the IDP camp in particular.

"The office has now increased surveillance in the IDP camp," Mikita Ali, head of the NAPTIP office covering the northeast region, says. "We are working with camp managers and camp officials to whom we've given our toll-free numbers and told to call us if they suspect any case of human trafficking."

'Easy to exploit'
Inside the Madinatu camp, however, residents remain worried about the number of cases. Community leaders say the lack of adequate amenities like potable water facilities and cooking stoves means that people have to walk long distances in search of water and firewood, making them vulnerable to the human traffickers who prey on them.

"If we had easy access to water and firewood, there'd be little talk of human trafficking," says Mohammed Lawan Tuba, a community leader in Madinatu. "Criminals take advantage of our children when they go out to find what they need to keep them and their families alive."

Human rights campaigners are running "sensitisation campaigns" which aim to educate displaced persons about the dangers of human trafficking and how to spot the signs of it inside the IDP camp.

But Yusuf Chiroma, head of the Borno Community Coalition, a group of aid workers assisting survivors of the Boko Haram insurgency through skills acquisition programmes, says: "Displaced persons in Madinatu are really struggling to survive, as they are not getting enough food supply from the government and that is why it is easy for traffickers to exploit those who are desperate for jobs."

"Sensitisation programmes have to be matched with adequate security and availability of food and social services by the state government to effectively tackle human trafficking."

Conyers & Cohen: “Supreme Court Ruling an Affront to Reproductive Rights, While Opening Door to Employer Discrimination”

(WASHINGTON) – Today, the U.S. Supreme Court issued its decision in Burwell v. Hobby Lobby, ruling that closely-held for-profit companies with religious objections can opt out of providing contraception coverage under the Affordable Care Act. After the ruling, Ranking Members John Conyers, Jr. (D-Mich.) and Subcommittee on the Constitution and Civil Justice Ranking Member Steve Cohen (D-Tenn.) delivered the following statement:

U.S. Representative
John Conyers, Jr.
Representative John Conyers, Jr. (D-Mich.): “Today, the Supreme Court delivered yet another blow to women’s reproductive rights, based on the extraordinary conclusion that corporations – as opposed to their individual owners – have their own right to the free exercise of religion. Already, millions of women in America are benefiting from the protections found in the Affordable Care Act, including access to contraceptives. The ruling today could undermine this essential coverage for many women under the guise of ‘religious liberty.’ Alarmingly, the ruling also opens the door to the unnerving possibility that corporations could claim exemptions to various health and safety protections based on their asserted religious beliefs. Regrettably, the Supreme Court’s ruling today allows for bosses to wade into – and potentially discriminate against – the personal healthcare choices of their employees; healthcare decisions must continue to remain between an individual and their doctor.”

Representative Steve Cohen (D-Tenn.): “I am disappointed in today’s Supreme Court ruling that puts women’s reproductive care in a class of its own and strips it as an element of comprehensive healthcare. This ruling means that the Affordable Care Act’s benefit of contraceptive care is no longer guaranteed for the millions of American women who are employed by private businesses helmed by anyone who may object to providing basic, preventive care to its female employees. I am disappointed in this wrong-minded ruling and will continue to work to see that women have access to the care they deserve as prescribed by the Affordable Care Act.”

PELOSI, SLAUGHTER, & DeGETTE, ALONG WITH 91 MEMBERS OF CONGRESS FILE AMICUS BRIEF IN SUPREME COURT CONTRACEPTIVE COVERAGE REQUIREMENT CHALLENGE

WASHINGTON, DC – Today, Democratic Leader Nancy Pelosi (D-CA), U.S. Reps. Louise Slaughter (D-NY), and Diana DeGette (D-CO), along with Democratic Whip Steny Hoyer (D-MD), Ranking House Judiciary Member John Conyers, Jr. (D-MI),  Ranking House Education and the Workforce Member George Miller (D-CA), Ranking House Energy and Commerce Member Henry A. Waxman (D-CA), Ranking House Ways and Means Member Sander Levin (D-MI), and Ranking House Subcommittee on the Constitution and Civil Justice Member Jerrold Nadler (D-NY) are filing an amicus brief in the United States Supreme Court in Sebelius v. Hobby Lobby Stores and Conestoga Wood Specialties Corp. v Sebelius.  Those challenging the contraceptive coverage requirement under the Affordable Care Act (ACA) claim that it imposes a substantial burden on the exercise of religion. A total of 91 House members have signed onto the brief.

These members chose to participate as amici in these cases because they want the Supreme Court to hear the full story from Congress.  They strongly believe the contraceptive coverage requirement does not violate the free exercise of religion and will ensure all Americans receive vital preventive health care services. The preventive care provisions, including the contraceptive coverage requirement, are the least restrictive means of accomplishing Congress’ goal of ensuring the necessary healthcare coverage for women.

In the amicus, the members explain how the legislative history of the ACA supports the conclusion that the contraceptive coverage requirement of the ACA satisfies the test applicable to a free exercise of religion challenge under the Religious Freedom Restoration Act (RFRA).

As the Congressional amici point out to the court: “The contraceptive coverage requirement does not substantially burden any exercise of religion in which the Corporations might be found to engage because it does not compel the Corporations to administer or use the contraceptive methods to which they object, nor does it require them to adhere to, affirm, or abandon a particular belief. It merely requires the Corporation, like other for-profit employers to provide comprehensive insurance coverage under which their employees may make their own personal decisions whether to use whatever form of contraception, if any, best suits their individualized health and wellness needs.”

Michigan Prepares to Launch God's Economic Model to End Child Poverty

Yes, Bill Johnson has slithered into another secret division of DHS. Johnson has abdicated to his trusty side-kick, Bruce Hoffman, who has taken over the throne of omnipotence.

I am guessing, as I really do not feel like finding out where he went at this particular moment, that he is doing something with child welfare contracts.

Now, how did I come to this conclusion?

Well, the Madame Maura Corrigan has stepped down as DHS Director after successfully running a game on the federal court monitor that "all is well" in Michigan child welfare.

All is not well, not even close because it seems the U.S. Department of Health and Human Services has picked Michigan, under the Madame's leadership, to launch a pilot model for privatizing the entire system of child welfare, or more specifically, foster care. The pilot city is Grand Rapids and it has a long, nasty, sordid history of snatching kids via bible thumping.

When I say "bible-thumping" I specifically mean the christian child placing agencies which are all Michigan non-profit corporations.

Michigan Legislature just seriously attempted to slam a Bill down the throats of the people under the guise of the Religious Freedom Restoration Act (RFRA).  This Bill, mirrored from its namesake federal Act, was originally used as the backbone for the Michigan Parental Rights Resolution which was introduced for an Amendment of the U.S. Constitution.  I worked on the construction of the Bill.

The RFRA federal case was centered on a Child Protective Service case of parents using certain plants with hallucinogenic properties in their traditional, indigenous religious ceremonies.  Parenting was transmogrified into a religious belief overnight.

The Tea Party began to take roots as a family economic movement and I was there to witness.  It was built off the desperation of parents who had their children legally kidnapped.  These families became powerful catalysts for the extreme right wing to, predatorially, push through their "christian" subversive agendas.  Look who launched the Tea Party on "God's economy" (Michele Bachmann's reference to children @ 4:30):

As few may not know, it takes 3/4ths of the States 7 years to have a referendum to amend the Constitution.  The Parental Rights Amendment did not survive but RFRA did.

RFRA will take the same course as the Parental Rights Amendment, mark my word.  Also mark my words when I say that it just might steam roll the national level and become an Amendment as there are a series of states which have already signed on.

RFRA is not alone in its ride to becoming an Amendment.  The Hobby Lobby decision opened the flood gates for legal challenges to "religious freedom" as corporations, legal persons, now have recognized religious beliefs.

Michigan has introduced, sine die, major changes to its Non-Profit Corporation Law.  From a quick overview, I see it is now easier for a not-for-profit to set up and transfer to a for-profit.

This got me thinking that timing of the shift in Michigan child welfare leadership is not a coincidence.

Michigan spends $1B on charter schools but fails to hold them accountable

Medicaid Expansion + RFRA + Non-Profit Corporation changes +Privatization = Corporate $$$

Charter schools do not provide special needs education but child welfare does and the money comes from Medicaid.  The federal A+PLUS Act would give direct access to CPS in viewing school records, with no oversight, to generate more child welfare cases by providing special needs services.
Every corporation is about to hire a child and no one will stop this from being a nationally diffusable model.

As of this writing, the Michigan Bureau of Adult and Children Licensing no longer has oversight of Grand Rapid child placing agencies.  Actually, no one has oversight as the pilot program of privatization has been launched.  The only way to file a complaint/grievance is through the state court because, remember, a corporation is a person, too, but soon with protected religious beliefs and the ability to dissolve at the drop of a hat to a for-profit.

Children under the auspices of the state (ie. foster care, residential institutions, juvenile justice, court child welfare cases) are not calculated in the national child poverty numbers.

This is God's economic model to reduce child poverty.

FBI Busts Baby Selling Ring, Then Sits Back On Its Arse While Human Trafficking Continues

It seems there is a new interest in the world of child welfare, or rather "saving those poor, abused and neglected children".

Having run across an older piece I posted some years ago on the industry of "Selling Babies", where the term is most endearingly embraced as foster care and adoption, I was remiss for failing to follow through in reporting on this.

My #Superfans found this post to be of interest:

So, I reviewed the case and look what I found.

The FBI nor DOJ have done a damn thing with the organizations Theresa Erickson was working.

Neither has the IRS, because they are, all of them, still in business, as banks, unregulated banks...like land banks.

On that thought, allow me to share a thought of which I have already, in depth, researched:

If land banks, which are completely unregulated, in contrast to a bank in the banking industry, which can take out mortgages from federal programs, and just "poof the debt away", then what stops a human egg bank from doing the same credit scheme, but in the form of life insurance, or perhaps, Medicaid billing?

Donor Egg Bank USA
The Donor Egg Bank USA even has payment plans for those interested in purchasing humans before they are born, because, of course, it is illegal to sell humans.

Once one registers, you can place custom pre-orders or just go down the cyber-aisles from its online human trafficking store front.

Or, a corporation can step in and just manufacture its own human assets for profit in organ donation, human subject research testing of biomedicals, pharmaceuticals, or your basic free labor, reimbursed through tax payer dollars of Medicaid fraud in child welfare.

If there are unregulated donor egg banks, unregulated sperm banks, and  unregulated organ donor banks, does this mean the U.S. Child Welfare System, an internationally diffused model, replete with the importation of tax credits, is an unregulated donor, whether voluntarily, but  mostly involuntarily, human bank where deposits of paper orphans are made, to be leveraged and marketed through privatized, federal cost-reimbursed programs and grants;

Then, selling the "parental rights" to a human is the selling of chattel, the oldest form of survival, for it is the title, the deed, or in this instance, the certificate of birth, which is the moveable good being sold, in an unregulated market;

Therefore, the residuals of the peculiar institution are now mechanized in the financial industry in what is called, privatization, or what I prefer to call modernized slavery, and it is all done in the grace of the tax exempt God, just like they used to do back in the pre-Emancipation days.

But, since this unregulated, quite complex, industry of human trafficking is legally stratified, right down to patents of the biomedical industry, this would mean that humans are the newest form of global currency and ownership of such humans, not all humans, just "The Poors" (always said with clinched teeth), hail from the genus allodial title holders, which are now these unregulated banks.

The same logic can be applied to immigration, deportation, forced migration, human trafficking, slave trade, tomato, tomato, potato, potato, whatever, it is all the same legal concept under the theory Of Parental Rights: The Acquisition of Goods ©.

As one does not have legal residency, children born on this soil, or those whose feet touch this soil without certification, become, by automatic allodium default of title, "wards of the state", or property of the state with financial leverage in billing Medicaid, at whim, arbitrarily and capriciously, whenever or however these privatized arms of the state feel like they want to bill and there is nothing that can be done, as the industry of child welfare is unregulated.

Ergo, banks own "The Poors" and all perpetuities, thereof.

But, I digress.

Let us return to the issue of surrogacy and selling babies, or rather the pro-life movement.

Yup.  The architects of the pro-life movement like to sell babies in the name of the tax exempt God to make money and they have their wet-dream (pun intended) superstar, Vice President Mike Pence in the White House.

Not to bemoan the entire political ideology of the abortion issue, we shall adopt (pun intended) the nomenclature of the pro life movement:  "Personhood".

For your learning pleasure, or just for my #Superfans to prepare to create a special division when we get back from my dream vacation, I have provided a series of links on "personhood" and its premise in in-vitro & ex-vitro parental rights.

Convicted Surrogacy Attorney: I'm Tip of Iceberg

Under California law, surrogates must enter the agreement with prospective parents before the embryonic transfer.

Under California law, the entire thing about surrogates entering the agreement with prospective owners before the embryonic transfer is based in animal law, yup, the same concept that originated in the Society for the Prevention of Cruelty of Children.

The woman convicted and sentenced for her role in a baby-selling ring said there need to be changes in the surrogacy industry and in state law to avoid similar illegal operations in the future.

Yes, Theresa Erickson, I would love to get with you and do some stuff about this...and make some history...and some money.

Surrogacy and adoption in California is a “billion-dollar industry" that is "corrupt” and needs to be changed according to former high-profile surrogacy attorney Theresa Erickson.

Surrogacy and adoption in the United States is a "multi-billion-dollar industry" that is "corrupt" and needs to be changed according to Beverly Tran.

Erickson, who is now headed to federal prison, called herself the “tip of the iceberg” when it comes to people abusing the system.

Girlfriend got that one right.  This is only the "tip of the iceberg" in the global industry of human trafficking, a.k.a. child welfare.

The Poway resident will spend five months in prison and nine months in home confinement for her role in the operation that sent would-be surrogates to the Ukraine to receive embryo transfers.

That is it.  Five months in and nine months in home confinement for her role in human trafficking.  What I find most egregious is that she could not even create jobs in the U.S.  She just had to send them to the Ukraine to save money in the cover up.

Once the women reached their second trimester, the attorneys then sold the unborn baby to unsuspecting parent claiming a prior surrogacy agreement had fallen through.

The attorneys did not "sell", they charged fees.  You pay a fee for a service to traffic and own a human.  It is a service fee.

Under California law, surrogates must enter the agreement before the embryonic transfer.

Commerce is a legal meeting of the minds which makes this a ripe area for legal discourse on the contractual agreements, including policies of the States for the areas of termination and reinstatement of parental rights, or whatever the hell parental rights actually means, considering it is only found, once, in federal law.

Federal prosecutors said Erickson worked with Carla Chambers of Las Vegas, Nevada and Hilary Neiman of Maryland to create an “inventory of unborn babies.”

"Inventory of unborn babies"?  Central Registry?  Banks?  Repositories?  Fiduciary trusts? U.S. Department of Commerce, Census Bureau's new division on predictive data, or just "bootstrapping"?

The women then submitted court documents claiming the surrogacies were legitimate.

And Child Protective Services submits false claims to be cost reimbursed through Medicaid just because they have the Right To Lie...even though a federal court said it did not.

After the papers were filed, Erickson would add the names of the parents who had purchased the child.

Wow.  She sounds like a child welfare worker.

The group made $400,000 in profit from the sale of parental rights prosecutors said.

Riiiiiiiiiight.  Like the FBI even contacted the IRS or the FEC.  LMAO

Erickson estimated she profited about $70,000 over the course of six years.

Beverly Tran estimates that Erickson is a brilliant and refined liar.  If she only profited about $70,000 selling humans, then that means she made a few million in fees that she probably wrote off as back door tax exempt contributions or your basic money laundering through other international child welfare agencies.  I wonder what ties she had with the Clinton Foundation?

In an exclusive interview with NBCSanDiego, Erickson said she has disgraced her profession and her family and broke an oath she vowed she would never, ever violate.

You mean to tell me it took a federal, criminal prosecution to make her realize she besmirched her profession?  Ooooo, we may not be dealing with a rocket scientist.

However, she believes the alternative family building process is confusing to many.

"Alternative Family Building Process"?  I need to trademark that shit.

“Legal has not caught up with medicine and medicine has created this technology that the law hasn’t kept up with,” Erickson said referring to the surrogacy industry as the “Wild, Wild West.”

Erickson, who closed her practice and resigned from the legal profession, said she would like to see a change in state law and new guidelines put in place.

She did not close her practice, voluntarily.  (See, DOJ Press Release, below).

“The industry has tried to do it for years and the industry hasn’t done much of anything and it needs to be done,” she told NBCSanDiego.

Liar.  Even the DOJ did not do shyte.

She believes people in the industry initially get involved to help people.

True.

She herself was a donor and had infertility within her own family.

She did it for the money, and we all know it.  She is blonde and that brings the highest prices.

Ultimately though, she said there is the temptation of money.

There ya go, come clean.

“They want things to stay the way they are because of the money but it just can’t stay the way they are, it just can’t,” she said.

Ok, Theresa, you are out and I am reaching out.

U.S. Attorney Laura Duffy released this statement regarding Erickson’s sentencing: “The surrogacy laws were enacted to protect both unborn babies and parents seeking children. Erickson abused her position as a trusted legal advisor and officer of the court by circumventing the law and undermining the rights of children and intended parents. Out of sheer greed Erickson preyed upon people’s most basic need: to raise a child. We cannot and will not allow individuals like Erickson to profit by taking advantage of vulnerable people who have a sincere desire to lawfully adopt and parent children.”

Very well, but what have you done since her conviction, release, the 2018 Presidential Election....?

Erickson, who practiced law for a decade, regrets losing her law license.

I bet that sucks.

She put herself through law school raising her two children with a husband in the military.

But, what happened?

She said her law license may be reinstated depending on a decision from the state bar.

Nope.  Just checked.  But for the simple fact that she even hallucinated the fantasy of getting her law license reinstated is further evidence that she did not, nor probably still does not, see that selling humans, or the rights to own a human, is not a good thing to do.

However, Erickson said the most difficult realization for her was the damage she did to the victims in the case.

"That was truly the hardest, and I mean that from my heart," she said.

Would you be so kind to share with us how wet your pillow is every morning, or at least every morning when you woke up in a federal prison for 5 months.

Call me, girl.

Prominent Surrogacy Attorney Sentenced to Prison for Her Role in Baby-Selling Case

United States Attorney Laura E. Duffy announced February 24, 2012, that attorney Theresa Erickson was sentenced by United States District Judge Anthony J. Battaglia to serve five months in prison and nine months of home confinement for her involvement in a baby-selling ring that deceived prospective parents and the Superior Court of California.

As noted during the hearing, California law forbids the sale of parental rights to babies and children.

The law does, however, permit surrogacy arrangements, but only if the Gestational Carrier (“GCs”) and the Intended Parents (“IPs”) enter into an agreement prior to an embryonic transfer.

If the GC and IPs do not reach an agreement before the GC receives the embryonic transfer, the GC can only transfer parental rights in the unborn child through a formal adoption procedure.

California law permits participants to profit from surrogacies, but not adoptions.

In her August 2011 guilty plea, Erickson (an internationally renowned California attorney specializing in reproductive law) admitted that she and her conspirators used numerous GCs to create an inventory of unborn babies that they would sell for over $100,000 each.

They accomplished this by sending women to become implanted with embryos in overseas clinics.

If the women (now GCs) sustained their pregnancies into the second trimester, the conspirators offered the babies to prospective parents by falsely representing that the unborn babies were the result of legitimate surrogacy arrangements in which the original IPs had backed out.

The conspirators also drafted fraudulent “assumption agreements” for the prospective parents to sign, which reinforced the lie that original IPs existed but had simply backed out.

According to court records, Erickson admitted to lying to the California Superior Court by fraudulently representing in court documents that these post-pregnancy agreements between the GC and IPs were legitimate surrogacies, which allowed Erickson and her co-conspirators to make over $400,000 in profit from the sale of parental rights.

Specifically, Erickson admitted that she prepared and filed with the Superior Court of California, County of San Diego, declarations and pleadings that falsely represented that the unborn babies were the products of legitimate surrogacy arrangements—that is, ones that involved agreements between the IPs and the GCs prior to embryonic transfer.

With these fraudulently obtained pre-birth orders, the IPs’ names would be placed on the babies’ birth certificates through a surrogacy and the conspirators would be able to profit from their sale of parental rights.

According to court records, Erickson and her co-conspirators risked the health of at least one GC in order to profit from a fraudulent surrogacy, instead of a legitimate adoption.

For example, in 2010, a GC, who was living in a Midwestern state that did not allow surrogacies, received orders from her doctor to be on bed rest due to premature labor contractions.

In response, Erickson told the GC, “I really think that you need to get out to California as soon as possible in order to avert an adoption.” In her guilty plea,

Erickson also admitted that she caused applications containing materially false representations to be submitted to the State of California’s Access for Infants and Mothers program to defraud the agency out of the medical expenses from the birth of the babies. United States Attorney Duffy stated, “The surrogacy laws were enacted to protect both unborn babies and parents seeking children.

United States Attorney Duffy also praised the efforts of special agents of the Federal Bureau of Investigation for their dedication on a unique and complicated investigation.

FBI Special Agent in Charge Keith Slotter commented, “Though the FBI investigates many different types of fraud, it is particularly disturbing when victims have been taken advantage of because of their desire to create a family.

In this case, the victims were exploited at a time in their lives when they were in a most vulnerable situation and trusting in legal counsel to abide by the laws of this country to provide them with legitimate services.”

At sentencing, Judge Battaglia ordered Erickson to pay a $70,000 fine and serve three years of supervised release. Today, Judge Battaglia also sentenced co-conspirator Carla Chambers to serve five months in custody, and seven months of home confinement and $180,020.20 in forfeiture, and three years of supervised release (Case Number: 11CR3368-AJB).

On December 1, 2011, Judge Battaglia sentenced Hilary Neiman, a Maryland attorney specializing in reproductive law and the third member of the conspiracy, to serve 12 months’ custody (five months in prison and seven months of home confinement), pay a $20,000 fine, $133,000 in forfeiture, and three years of supervised release.

 (Case Number: 11CR3247-AJB).

The court will set a future date for the restitution hearing for all three defendants. Defendants Theresa Erickson (11CR3372-AJB) Age: 43 Poway, California Carla Chambers (11CR3247-AJB) Age: 51 Las Vegas, Nevada Hilary Neiman (11CR3368-AJB) Age: 32 Chevy Chase, Maryland Summary of Charges Theresa Erickson and Hilary Neiman Title 18, United States Code, Section 371-Conspiracy to Commit Wire Fraud Carla Chambers Title 18, United States Code, Section 371-Conspiracy to Engage in Monetary Transactions in Property Derived from Specified Unlawful Activity
