STOP AND DESIST LETTER SENT TO KENTUCKY SUPREME COURT CHIEF JUSTICE JOHN MINTON


            After multiple episodes of misconduct; Chief Justice John Minton has received a stop and desist letter.  At issue are deputy clerks within the Kentucky Supreme Court, supervised by Chief Justice Minton committing repeated acts of misconduct in case 2013-SC-00030, such as tampering with stamped dates, returning properly filed briefs without legal reason, ex parte communication with the opposing party concerning Ms. Mischler’s pleadings and failing to send copies of orders.
            The latest act of misconduct occurred in July and August 2013.  The Supreme Court Clerk failed to file and send copies of filings to Amy Mischler.  In addition, the online docket was not updated to keep knowledge of said filings from Amy Mischler.
            Chief Justice Minton is a defendant of a 42 USC 1983 civil rights action which Ms. Mischler filed alleging civil rights violations in the Pike County Courts to benefit attorney Jonah Lee Stevens and to deny her access to the courts and her parental rights. 
            Federal District Judge Amul Thapar ordered that Chief Justice Minton be served the complaint filed by Ms. Mischler in late June 2013.  That case is 13-CV-8 in the Eastern District of Kentucky Federal Court. 
            Ms. Mischler asserts that the deputy clerks actions are in retaliation for Chief Justice Minton being sued in the Federal Courts.  Further, as Ms. Mischler states to Chief Justice Minton’s attorney Mark Overstreet, that in the private sector the deputy clerks would have already been terminated from their employment for the past misconduct.
