Prelude To Detroit: Buzzfeed & CNN Find Out Through FOIA That You Cannot Hack A Handwritten Letter

Jason Leopold has yet to tell us how Cernovich came into possession of his Confidential Congressional Documents, which were published by Buzzfeed, to assassinate a character in the act of blasphemy.

So, who was this FBI Special agent who had to give White House Counsel the FBI director's email address, who then, generated a missive, got Trump to approve and sign, then deliver to a third party, a letter of termination,  on the other side of town, in under four minutes?

New FBI Documents From Mueller’s Russia Investigation Reveal What Witnesses Said About Trump

BuzzFeed News filed a public records lawsuit to get the documents Robert Mueller used to write his report. Today, we are publishing the ninth installment of what witnesses in the investigation told Mueller’s team.

A new cache of witness interview summaries from special counsel Robert Mueller’s two-year probe into Russia’s interference in the 2016 presidential election was released Monday in response to Freedom of Information Act lawsuits by BuzzFeed News and CNN.

  • The documents indicate that in the fall of 2017, the accountant for Michael Cohen, Trump’s longtime lawyer, was under the impression that Cohen was getting a White House job and “needed to liquidate his assets.” Cohen did not get an administration position.
  • Michael Cohen used to refer to himself as “Trump’s pitbull” — before he flipped on his former boss and cooperated with Mueller — and according to his accountant, even had a statue of himself in his office bearing that title.
  • An Ohio woman who caught the attention of the special counsel’s office because in 2016 she renamed her Twitter account @Guccifer2 — after the character credited with hacking and leaking Democratic emails — told the FBI she had created the account to see if it would be censored by Twitter.
  • One witness whose name was redacted told investigators that before the Miss Universe pageant, Trump “would have all of the contestants line up on stage and then he would ask them questions about each other.” Most people would be cleared out of the room for this exchange, which was recorded, the witness said.


These documents, known as FBI 302s, shed light on what Trump administration officials and campaign staffers, as well as other people close to the president, told federal law enforcement agents about events during and after the campaign. In the last set of summaries that were released, one witness said people in Trump’s “orbit” didn’t care whom they hurt, believed their “deep state narrative,” “read books like ‘The Turner Diaries,’” and “downloaded military manuals from the internet.”

A person whose name was withheld on privacy grounds told investigators during an Aug. 11, 2017 interview that after the 2016 election Trump's "hardest" supporters were "shut out" of the new administration by the Republican National Committee, which cut a deal with Reince Priebus, the former White House chief of staff.

"They had many favors to repay the Committee. Trump gave Priebus a chance but Priebus didn't get the healthcare bill passed," the person told Mueller's investigators.

On Nov. 21, 2017, an FBI agent and two lawyers from Mueller’s office interviewed Jeffrey Getzel, who had worked as an accountant for Trump’s former lawyer and fixer Michael Cohen. Getzel was under the impression that Cohen was up for a job in the White House. He told investigators that roughly a month to a month and a half before the interview, someone (whose name is redacted) told Getzel that Cohen “was going to the White House and that COHEN needed to liquidate his assets.”

Getzel said he respected Cohen’s “significant position” in the Trump Organization. He noted to investigators that Cohen had a statue of himself in his office with the phrase, “Trump’s pitbull” written on it, a phrase that Cohen used to describe himself in the past, according to CNN.

A White House job never materialized, though. Cohen would eventually turn on his former boss and cooperate with Mueller’s investigation. He pleaded guilty to financial crimes unrelated to his dealings with Trump as well as campaign finance violations related to his role orchestrating hush-money payments to two women who claimed to have had affairs with Trump.

Getzel told investigators that Cohen was “an extremely sharp individual,” but also a “difficult client” who didn’t pay his bills on time. Cohen “resented paying taxes more than most people” that Getzel did work for, he said, and would pay penalties at the end of the year rather than paying quarterly estimated taxes.

Much of Getzel’s interview summary is redacted, but one section makes clear that he spoke with Mueller’s team about Essential Consultants, the corporate entity that Cohen created to facilitate the hush-money payments. Getzel said that if he’d known more about Essential Consultants, he would have “pushed harder to encourage COHEN to include his interest in the company” in a personal financial statement.

Getzel knew about another corporate entity that Cohen recently created, Michael D. Cohen & Associates P.C. Getzel told investigators that he didn’t think the company had “any real value” because its only client was Trump, ”who had a propensity for firing people.” The Washington Post reported Cohen used that business to pitch himself as a consultant to companies based on his close ties to Trump.

“As such,” the summary reads, “MDCPC was not really a company COHEN could sell to anyone.”

One of the interview summaries is of Cassandra Ford, an Ohio woman who caught the attention of the special counsel's office because in 2016 she renamed her Twitter account @Guccifer2, after the character credited with hacking and leaking Democratic emails. Ford's identity and the interest she attracted from Mueller's investigators were first revealed in October 2018, in an article in BuzzFeed News.

Ford was interviewed by the FBI in April 2018. In the six-page summary of that encounter, much of which is redacted on privacy grounds, she explained why she created @Guccifer2 and chose to give the impression that she was Russian.

"In creating her own twitter account @Guccifer2, Ford wanted to see of the account would be censored by Twitter, because of the notoriety of Guccifer2.0," the interview summary said. She went on to say that she chose the Volgograd time zone for her Twitter account in order to “appear to be Russian.”

“Ford used the photo of Felix Dzerzhinsky as her Twitter profile photo. Ford read in the article on Smoking Gun that some of the documents released by Guccifer2.0 persona had the name of Dzerzhinsky on internet and thought he had a ‘creative background,’” the summary said.

In a separate interview, the Republican strategist Jason Miller, who was chief spokesperson of Trump’s 2016 presidential campaign, told the FBI he sought assistance from the Republican National Committee in 2016 poring over the hacked Democratic National Committee emails that WikiLeaks released. Moreover, he said he recalled hearing stories “about there potentially being a tape in which Trump used the ‘N-word."’ When the campaign learned it was the infamous Access Hollywood tape, Miller said he and the campaign went into damage control. He said he was responsible for disseminating the statement that Trump’s “grab em by the pussy” line “amounted to locker room talk.”

Although the Mueller investigation led to 37 indictments and seven convictions, Trump has aggressively sought to discredit it, repeatedly referring to it as a “witch hunt.” His efforts have been supported by Attorney General Bill Barr, who has intervened in several cases related to the investigation, including the prosecutions of former national security adviser Michael Flynn and political consultant Roger Stone. Last year, Barr also tapped a US attorney in Connecticut, John Durham, to investigate the origins of the Russia probe.

Last month — after Trump commuted Stone’s prison sentence and referred to the probe as a “hoax” and “witch hunt” that the “Left and its allies in the media perpetuated for years in an attempt to undermine the Trump Presidency” — Mueller broke his silence by writing an op-ed in the Washington Post defending his investigation. In June, in response to a separate lawsuit filed by BuzzFeed News and the Electronic Privacy Information Center, a previously blacked-out portion of the Mueller report was disclosed; it showed that Mueller’s team suspected Trump had lied to investigators in his written responses to their questions about Stone.

The final 448-page Mueller report, released in April 2019, was the most hotly anticipated prosecutorial document in a generation. But it reflected only a tiny fraction of the primary-source documents that Mueller’s team had amassed over the course of its two-year probe; much of the content of the typewritten interview summaries taken by the special counsel’s office has never before been reviewed publicly. A month after the report was released, BuzzFeed News sued the FBI and the Department of Justice, seeking access to those records. That litigation was subsequently joined by CNN.

In October, a federal judge ordered the release of the documents, and the two agencies began releasing 302s last November. Under the court order, records must be disclosed every month; to date, the government has produced about 3,000 pages of summaries from interviews with more than 500 witnesses who spoke to Mueller’s team during the course of the investigation.

The vast majority of the 302s have been heavily redacted, leaving vast swaths of information about what witnesses told investigators obscured from view. BuzzFeed News has challenged some of those redactions, arguing in court that one category of exemption the government has cited to justify the withholdings was legally unfounded, politically motivated, and implemented solely to protect the president.

Well, this is quite the kerfuffle!

It seems, Matt Schnieder, Detroit, MIED U.S. Attorney, has referred the matter to the Civil Rights Division of DOJ, which seems to cloying Michigan Governor Gretchen Whitmer with those silenced cries for due process, a right of civility, for those individual residents of the State, who have unfortunately lost their lives to the cooties, by invoking CRIPA.

But, herein lies the issue - what about the private nursing homes?

Yes, that is correct, Michigan has privatized just about anything in the industry of human asset management.

By specifically using the term "public", this immediately stands up to me as a federally certified facilities, meaning, CMS authorizes cost reimbursement for Medicaid and Medicare.

Just for fun, because you know I love to disprove my first impressions when it comes to stealin', I conducted a random experiment, by controlling for randomness by closing my eyes and picking one *Public Private Partnership* nursing facility, and looked up Shorepointe Nursing Center.

Optalis nursing home chain further expanding reach ‘ahead of the curve’

A growing skilled nursing and senior living company is looking to expand its reach throughout the United States.

Optalis Healthcare, based in Novi, MI, gearing up to either build or acquire more facilities in Michigan, Ohio and Florida, Crain’s Detroit Business reported. CEO Raj Patel, however, declined to specify the number of facilities or give any details about future acquisitions, stating plans “are still under review.”

“We are very optimistic that we are in front of the bell curve with a large amount of seniors eight to 10 years away from when they really need services,” Patel told the news organization. “Age 65 is the new 55. Many seniors don’t need a lot of services until they get into their high 70s, early 80s. We are innovative and ready for the big wave.”

The 15-facility company purchased five Detroit-area, Beaumont-affiliated properties (four SNFs and one senior living facility) from Premier Health Care Management in September. Patel called the deal a “perfect fit to the Optalis growth plan in the southeast Michigan market.”

Death toll rises as coronavirus sweeps through Michigan nursing homes

I am not going to broach the subject of how or why Ascension St. John was flipping properties, because I already did, but we shall soon revisit these days of yore.

See, there is no FOIA for private state contractors, so, Michigan self reports, which means they are not held to GAGAS or any external audit.

Try filing a FOIA for school records for a former foster child and see what happens.

So, if there is no FOIA in child welfare, what the hell makes you think there is FOIA in nursing home data?

The only logical action by DOJ would be to use the CRIPA prong test.

CRIPA, in part, says:
(II) residing in such facility or institution for purposes of receiving care or treatment; or 
(III) residing for any State purpose in such facility or institution (other than a residential facility providing only elementary or secondary education that is not an institution in which reside juveniles who are adjudicated delinquent, in need of supervision, neglected, placed in State custody, mentally ill or disabled, mentally retarded, or chronically ill or handicapped);  or (v) providing skilled nursing, intermediate or long-term care, or custodial or residential care.

(2) Privately owned and operated facilities shall not be deemed  "institutions" under this subchapter if-- (A) the licensing of such facility by the State constitutes the sole nexus between such facility and such State;
(B) the receipt by such facility, on behalf of persons residing in such facility, of payments under title XVI, XVIII [42 U.S.C.A. §§ 1381 et seq., 1395 et seq.], or under a State plan approved under title XIX [42 U.S.C.A. § 1396 et seq.], of the Social Security Act, constitutes the sole nexus between such facility and such State;  or

So, what if the CRIPA prong test?

The CRIPA prong test is when DOJ asks for information in the course of a civil rights investigation, where, in this instance, happens to be individuals who died from the cooties in public nursing homes, and the State Governor says, "No".

That is how you automatically know they are stealin'. [see above].

Then, there is still that lingering issue about DOJ asking MIED to look into the constitutionality of Gretch's Executive Orders, where, I have addressed her illegitimacy to be granted under that indelible seal to hold office.

What a messy!

I guess Gretch has two choices: (1) produce the data; or, (2) bear her armiger, but, hey, what do I know?

Dept. of Justice requesting COVID-19 nursing home data from Gov. Whitmer

(FOX 2) - The Department of Justice is requesting data from Michigan Gov. Gretchen Whitmer in regard to the COVID-19 order that may have resulted in deaths of elderly nursing home residents.

The data is being requested to help inform whether the Department of Justice will initiate investigations under the Civil Rights of Institutionalized Persons Act (CRIPA).

Other governors were asked to also provide data, including New York, New Jersey and Pennsylvania. These states required nursing homes to admit COVID-19 patients, often without adequate testing.

The DOJ is asking for the following information from Gov. Whitmer:

  • The number of public nursing home residents, employees, other staff, guests and visitors who contracted COVID-19, regardless of where it was contracted
  • The number of public nursing home residents employees, other staff, guests and visitors who died of COVID-19 including those who died in a public nursing home or after being transferred to a hospital or other medical facility, hospice, home care or any other location
  • All state-issued guidance, directives, advisories or executive orders regarding admission of persons to public nursing homes, including those previously superseded, as well as the dates each such document was in effect
  • The number of persons who were admitted to a public nursing home from a hospital or any other facility, hospice, home care or other location after testing positive for COVID-19 during the period the guidance or orders were in effect

The information requested is due within 14 days.

Gov. Whitmer's office released the following statement later in the day Wednesday after receiving the letter:

"Protecting the health, safety, and wellbeing of our seniors and most vulnerable residents has been a top priority throughout this crisis. The fact that this letter was sent during the middle of the Republican National Convention week to four Democratic governors should make it crystal clear that this is nothing more than election year politics by an administration that is more concerned with the president's re-election campaign than protecting Michigan seniors. We will review this letter and respond as appropriate, however, Americans would all be better served if the Trump administration stopped the partisan games and focused on delivering a real plan to defeat COVID-19."

In a town hall with FOX 2 back in July, Gov. Whitmer said she was following the best advice she had at the time when making this decision.

Whitmer said that the state was following guidance from the Center for Disease Control and prevention when COVID-19 patients were housed with non-coronavirus patients in nursing homes.

"We know that this experience has played out across the planet frankly but we’ve seen it in real-time here in the U.S., first in Seattle then of course across the U.S.," she said. "In every step of the way we've followed the CDC best guidance and our policies reflected that. All of the efforts that we've taken to keep people safe by closing down the ability for outsiders to come in, our policy with regard to...we never once required that nursing homes took COVID-19 patients. Many chose to and when they did they followed the promulgated practices from the CDC about separation and not having intermingling at all," she said.

And she did admit that following best practices ended with lives being lost to the virus.

"In the early days, following the CDC was the gold standard. That's what we were doing," Whitmer said. "Our nursing home death numbers are far too many but are better than in many other states. At the time we followed the protocols the CDC has prescribed."

In the end, Whitmer said if she had the knowledge she has now, she would do things differently but says it was CDC guidance.

"We followed the protocols that they prescribed and that's the best any state was able to do, frankly," she said. "We always have a mindest we are going to be conservative and follow the science. And sometimes that makes us a leader and in other ways, it's made us average with other states. With nursing home experiences, it's the latter."

The Department of Justice’s Civil Rights Division is evaluating whether to initiate investigations under the federal “Civil Rights of Institutionalized Persons Act” (CRIPA), which protects the civil rights of persons in state-run nursing homes, among others.

The Civil Rights Division seeks to determine if the state orders requiring admission of COVID-19 patients to nursing homes is responsible for the deaths of nursing home residents.

According to the Centers for Disease Control, New York has the highest number of COVID-19 deaths in the United States, with 32,592 victims, many of them elderly.

New York’s death rate by population is the second highest in the country with 1,680 deaths per million people. New Jersey’s death rate by population is 1,733 deaths per million people - the highest in the nation.

In contrast, Texas’s death rate by population is 380 deaths per million people; and Texas has just over 11,000 deaths, though its population is 50 percent larger than New York and has many more recorded cases of COVID-19 - 577,537 cases in Texas versus 430,885 cases in New York.

Florida’s COVID-19 death rate is 480 deaths per million; with total deaths of 10,325 and a population slightly larger than New York.

It is economically feasible and there is already an established model.

Instead of tracing people contact, how about we trace the financial transactions behind everything government officials and their government sanctioned activities are doing, in a SWIFT, and efficient manner of due process through law enforcement?

Follow the money.

Considering the fact that these are public expenditures, I am quite sure there will be no problems with a FOIA.

If that does not work, keeping in mind that these are Public Private Partnerships, I am quite sure a SIGTARP subpoena would also work, just as swiftly because this is gerrymandering.

Detroit already has a tracer tracking system to ensure everyone makes their date, because, before you are a man, you are a child.

MDHHS Launches Large-scale, Volunteer Contact Tracing Effort; Expands Testing Criteria to Include Any Worker Still Reporting in Person

LANSING, MICH. As part of efforts to continue expanding COVID-19 testing and contact tracing of potentially exposed Michiganders, the Michigan Department of Health and Human Services (MDHHS) again expanded its testing criteria to include all essential workers still reporting to work in person, whether they have symptoms or not, and launched a large-scale effort with more than 2,000 volunteers to expand contact tracing capacity.

“Contact tracing is an essential public health tool and will help determine and limit the spread of COVID-19 in our state,” said Dr. Joneigh Khaldun, chief medical executive and chief deputy for health. “This effort is also giving Michiganders an important way to contribute to crisis response and we appreciate their willingness to step up for their communities, pitching in selflessly for work that will help us all.”

Contact tracing is a proven public health strategy that involves identifying those affected by COVID-19 and interviewing friends, families and others near that person about their contacts and symptoms. MDHHS is contracting with Great Lakes Community Engagement, a firm that specializes in outreach campaigns to engage citizens, and Every Action VAN, a voter/individual contact platform used by non-profits, to provide software to help organize remote phone banking and track information and contacts.

More than 2,200 volunteers have completed MDHHS’ contact tracing training and are ready to begin aiding local health departments. This workforce will increase the speed and thoroughness of contact tracing statewide. These volunteers are in addition to more than 130 MDHHS staff who have been assisting local health departments with case investigation over the past couple weeks and have reached more than 12,000 COVID-positive individuals.

Dedicating additional resources to contact tracing is needed as testing criteria and testing locations are rapidly expanding. Last week, MDHHS announced the expansion of testing to all Michiganders experiencing symptoms. Starting April 21, testing eligibility criteria is being expanded again to include all essential workers still reporting to work in person with potential COVID-19 exposure, whether symptomatic or asymptomatic. This will help identify asymptomatic cases who may still be spreading the virus as they report to work.

“This means that anyone with symptoms can get a test as well as any individual regularly interacting with others outside their household, as long as the testing location has the supplies,” Khaldun said. “MDHHSis also working with local health departments to expand testing in group living facilities with potential exposure.”

Watergate 2.0 - Why Mueller Referred To Detroit, Not Judiciary

Image result for how does she knowThe reason why the Mueller investigation did not make any referrals to the U.S. House Judiciary is because the referrals were criminal, and were referred to the Districts, to the two Detroit grand juries.

Now, why would Mueller make criminal referrals to Detroit grand juries and not the House Judiciary?

Perhaps, we could get someone from the media to present this question to the members, or, perhaps, I shall just have to ask them.

But, hey, what do I know?

I know it is about the individual who called for the Special Counsel.


Justice Dept: Mueller prepared no reports to Congress

A request for records akin to Watergate "road map" comes up dry.
Special Counsel Robert Mueller's prosecutors never drafted a report to Congress about alleged misconduct by President Donald Trump, Justice Department lawyers indicated in a court filing Friday.
DOJ attorneys said they were unable to locate any records in Mueller's files that were responsive to a Freedom of Information Act request seeking reports and compilations "prepared for the eventual consideration of one or more members of Congress, whether or not such records were actually transmitted to any party outside of the Special Counsel’s Office."
The FOIA request, submitted in November 2018 by the Electronic Privacy Information Center, invoked a grand jury's submission to the House Judiciary Committee in 1974 of a so-called "road map"to evidence in the Watergate scandal. The point-by-point guide received a spate of fresh publicity in the fall of 2018 after a judge ordered disclosure of portions of the nearly half-century-old compendium.
EPIC appeared to be seeking similar records Mueller might have prepared with an eye to sending them to Congress. After getting no response to the request, the privacy-focused group filed suit last March.
According to the court filing Friday, the Justice Department's initial search turned up no records about actual or potential reports to Congress, but the agency agreed to perform another search after EPIC refined their request. That search also came up dry, Justice lawyers told EPIC on Thursday, the filing says.
While the Mueller lawyers may not have prepared any reports explicitly labeled as referrals or potential referrals to Congress, the final report the special counsel's team drafted last spring was prepared in anticipation that substantial portions of it would be released to the public, which includes Congress.
Some observers compared that report as impeachment fodder akin to the Watergate "road map," although the articles of impeachment the House approved last December largely overlooked the conduct in the Mueller report, including acts analyzed by Mueller's prosecutors as potential obstruction of justice by President Donald Trump.
The House Judiciary Committee is still battling for access to grand jury secrets in the Mueller report. Last October, a judge rejected the Trump administration's arguments that such information should remain off limits to lawmakers. The Justice Department's appeal of that decision is pending at the D.C. Circuit Court of Appeals.
DOJ did report finding records, including the Mueller report itself, that were responsive to other parts of EPIC's request. The suit will continue as the group challenges privacy-based redactions to the version of the report Justice made public last year.
