Drama in Rhode Island

I just adore public debate.

Here you have one side, Children's Rights taking a stance in the courts to change public policy. The gravamen of the case is to protect those children who have been remanded to the foster care system and to accelerate and expedite exits from the foster care system through adoption or reunification, mostly focused on the former.

Then, on the other side of the dramatic spectrum, you have the one man show of the National Coalition on Child Protection Reform who is taking a stance in the media to change public policy. The crux of his advocacy is to cease and desist the improper and unnecessary removal and placement of children in the foster care.

So why is it these two positions cannot merge into one significant force to reform child protection?

It's because neither of them understands the system or its secret...yet...

With Rhode Island’s child welfare system facing a lawsuit by one advocacy group, another advocate has taken aim at both the state and the plaintiff.

Richard Wexler, head of the National Coalition for Child Protection Reform, held a news conference in Rhode Island Thursday to issue a 64-page report calling the state “the child warehousing capital of America.” The report, State of Denial: Why Rhode Island’s Child Welfare System is so Dismal – and How to Make it Better, says the state removes children from their homes 80 percent more frequently than the national average, and places them in the poorest of group homes and institutional care.

Children’s Rights, a New York-based advocacy group, also believes Rhode Island’s child welfare system is a mess, and in 2007 joined a class action lawsuit by the state’s child advocate, Jametta Alston, against the state Department of Children, Youth and Families in an effort to force reforms. In June, the federal First Circuit Court of Appeals reinstated the lawsuit, which had been thrown out by a lower court. The case is now awaiting reassignment to a judge.

Wexler charged that reforms pushed by Children’s Rights in other states rely too heavily on continuing to remove children from their homes, and that any settlement in Rhode Island would probably “exacerbate” that practice. He called for a settlement emphasizing “safe, proven alternatives to taking away so many children in the first place.”

Susan Lambiase, associate director of Children’s Rights, replied via e-mail that Wexler’s report “identifies issues we have been trying to get Rhode Island officials to address” through the lawsuit, including “the growing number of children placed in large, unsafe institutional settings.” She said lawsuits by Children’s Rights in other states led to changes that include reducing foster care populations.

The nonprofit National Coalition for Child Protection Reform advocates alternatives to removing children from their homes. The nonprofit Children’s Rights has brought class actions lawsuits against several states to reform their child welfare systems.

Michigan Child Abuse Propaganda Cover Ups

I apologize to my readership, but I neglected to post one of my all time favorite, classic child abuse propaganda reports of Michigan.

This is the report where, former Direct Marianne Udow announced her resignation the day I did a WWJ national radio interview and ripped the administrative entombments of its systemic fraud.

Ah, the memories. There was a series of state administrative resignations that followed that day.

Anyway, this is the report that came out to play damage control for the State Auditor General's report that came out documenting the horrifying operations of the state's child welfare system.

The recommendations of the report were to "identify, target, maximize, engage and focus" on more Title IV-E funds and that is exactly what they did.

"Mo' money, mo' money, mo' money."  I do so enjoy a good propaganda campaign.

Murder of foster child leads to state investigation





GAINES TOWNSHIP, Mich. (WZZM) - Five-year-old Emily Meno and her twin Tiffany were placed in the care of 30-year-old Joy Heaven several months ago. The placement was arranged by Bethany Christian Services, a private organization licensed by the Department of Human Services for foster care training and placement.

"There is an investigation going on with both the state and some of the licensing process," said Senator Mark Jansen, (R) Gaines Township. Jansen is a member of the Department of Human Services Committees.

DHS and Bethany Christian Services both say they cannot answer any questions regarding the case because of child protection laws, which are in place to ensure the child's privacy.

"Myself as a Senator can't ask to see really all of the files," Jansen said.

Here ya go, precious.

 The worst part of this entire scenario is Bethany Christian will be put on First Provisional Licensing.

"What's that?", you ask.  Well, allow me to tell you the story of Michigan's contractual non-debarment policies.

See, Michigan does not have open bidding for child placing agency contractual services, but there is a good reason why.

There are only so many child placing agencies who pay their dues to the State created, state funded, independent, quasi-governmental-lobbying organization/partnership which gives them their seal of approval with accreditation to operate in Michigan.

"Did you just say that I am contradicting myself?  Well, of course I am, that is the way Michigan has structured its child welfare operations, silly!"

If Michigan was actually federally compliant to funding mandates, it would not be operational.  Imagine the entire state being shut down by ending child welfare fraud.

If the U.S. Department of Health and Human Services and the U.S. Department of Justice were really executing its statutory duties, Michigan's entire child welfare system would be under federal administrative receivership. But whose going to stop a racket when everything is shrouded in secrecy.

Groundbreaking' new law will change definition of family

This ought to piss off the family rights and parental rights groups, (snicker).

By the way, the terms "family" and "parent" have never been statutorily defined in the United States.

The B.C. government plans revolutionary changes to family law to better reflect the realities of modern society.
Its proposals to update the 30-year-old Family Relations Act include revising the legal definition of a parent, changing property-division rules, making children's interests the "only" consideration in parenting disputes, and even replacing the terms "custody" and "access" with "guardianship" and "parenting time."

So what is wrong with this new law???

It will do nothing for the fraud in child welfare and this is why:
  • There is no exclusionary database;
  • Foster Care and Adoption case records are hidden from open examination;
  • The Attorney General would have to prosecute agencies he has previously defended;
  • If you prosecute the child placing agencies and find that they have violated multiple provisions of law, you will have to contractually debar them from doing business, meaning there will not be enough child placing agencies to handle the services needed for foster care because there is no competitive bidding process for these contracts, further fueling instances of Medicaid fraud in child welfare; and,
  • The state will be publicly humiliated by exposing what I just previously stated.

JOHNSON BILL TO CRACK DOWN ON MEDICAID FRAUD SIGNED INTO LAW


(TRENTON) - Legislation sponsored by Assemblyman Gordon Johnson (D-Bergen) to further protect taxpayers by increasing penalties for Medicaid fraud has been signed into law.

The new law (S-2141/A-3015) will help combat attempts to cheat the program of state and federal funds that are intended to serve the health care needs of the medically indigent by increasing penalties for committing Medicaid fraud.

"At a time when we need to make sure that we stretch every public dollar as far as it will go, this law is crucial," Johnson said. "It sends a clear message that we will not tolerate the abuse of taxpayer dollars, especially those that provide critical healthcare to some of our most vulnerable and needy residents. Those that attempt to defraud the program, especially if they are a medical professional, will not only face hefty fines and possible imprisonment, but risk jeopardizing their very career.”
The law will ensure that the decision not to impose a jail sentence in a Medicaid fraud case - as well as other fraud involving public agencies or public funds - is given especially careful consideration by the sentencing court, since the matter involves fraud against the public.

The law:
  •  Upgrades certain offenses involving Medicaid fraud from a “high misdemeanor” to a crime of the third degree punishable by a fine or imprisonment for three to five years, or both, or a crime of the fourth degree punishable by a fine or by imprisonment for not more than 18 months, or both;
  • Creates new mandatory monetary penalties for Medicaid fraud offenses of not less than $15,000 and not more than $25,000 for a crime of the third degree, and not less than $10,000 and not more than $25,000 for a crime of the fourth degree, in addition to any other penalty that may be imposed by law;
  • Eliminates the presumption that a person who has not been previously convicted of an offense, will automatically avoid prison for an offense involving Medicaid fraud that is defined as a crime of the third degree under this law; and
  • Creates a new crime of the second degree, with a monetary penalty of not less than $25,000 and not more than $150,000, for persons convicted of repeated Medicaid fraud offenses under certain circumstances, specifically, where the aggregate amount obtained or sought to be obtained is $1,000 or more, and the person has previously been convicted of such a violation within 10 years of the current violation, under circumstances where the aggregate amount obtained or sought to be obtained was also $1,000 or more.
The law also directs the Attorney General to turn the matter over to the appropriate professional or occupational licensing board within the Division of Consumer Affairs, when applicable, in order to determine if appropriate action should be taken regarding a person’s license or other authorization to practice as a health care professional.

Johnson noted that nothing in this bill is to be construed to preclude the indictment or conviction for any other offense defined by law, or to impair or limit the discretion and authority of the state regarding any civil action, criminal prosecution, or other action authorized by law.

The bill unanimously passed both houses of the Legislature on June 28 and was signed into law by the Governor on June 30. The provisions go into effect immediately.

A Keys clinic helped obtain a $27 million Medicaid fraud settlement with an Israeli pharmaceutical company.

Teva Pharmaceuticals agreed to pay $27 million to resolve concerns about Medicaid fraud brought to light by a Keys whistle-blower, the state attorney general said Tuesday.

The settlement partially resolves two Leon County Medicaid fraud lawsuits that alleged the company knowingly set inflated prices for medications dispensed by pharmacies and other providers reimbursed by the Florida Medicaid program.

The program sets reimbursement rates it pays to Medicaid providers based on prices reported by drug manufacturers. By reporting inflated prices, the drug manufacturers led the Florida Medicaid Program to overpay millions of dollars in pharmacy reimbursements.

GENERAL REVENUE FUND
As part of the settlement with Israel-based Teva, the state's general revenue fund will be paid about $3.5 million. The Florida Medicaid Fraud Informant Reward Program will receive more than $387,000, and the Agency for Health Care Administration, which administers the Medicaid Program, will receive more than $7.1 million. The rest of the money will be paid from the settlement to the federal government and to the whistle-blower, Ven-A-Care in Key West. Ven-a-Care is a pharmacy owned by four partners who have gained more than $25 million in the past 15 years, starting with a whistle-blower lawsuit filed in 1995.

The Leon County cases are ongoing against four other pharmaceutical companies: Mylan Laboratories, Actavis, Watson Pharmaceuticals and Sandoz Pharmaceuticals.

In an unrelated case, five north Floridians, including a hospital administrator, were arrested Tuesday on charges of Medicaid fraud, racketeering, money laundering and operating a scheme to defraud.
Officers, employees and affiliates of HC Healthcare admitting Medicaid recipients to the hospital without medical necessity, altering medical records on occasion to justify the hospital admissions. False claims for reimbursement were submitted to the Florida Medicaid program for services performed outside the scope of the physician involved.

The fraud occurred at the now closed Trinity Community Hospital and affiliated clinics in Hamilton, Suwanee and Columbia counties. More arrests are pending.

BOGUS IMPROVEMENTS
An investigation found that more than $660,000 in state grant money dedicated to hospital improvements were taken by the corporation, but little if any of the money was used for improvements. Instead, the money was spent on the fraud ring and used by hospital owner Robert A. Krasnow, 36, of Gainesville, who faces several charges, including 10 counts of Medicaid fraud.

The others arrested were Dr. Yong Am Park, 66, of Lake City; Robert T. Krasnow, 58, of Gainesville, the father of Robert A. Krasnow; hospital administrator Christina L. Ortega, 42, of Lake City; and nurse Ashley Lane Butler, 37, of Live Oak.

By law, Stanislaus County Child Protective Services operates under a cloak of secrecy when it comes to specific families and their problems.

So when little Aureliano Joel Vasquez drowned in the algae-clouded water of his backyard pool last weekend, it didn't matter that his mother, Florcita Vasquez, told The Bee that CPS repeatedly had visited her home in recent months because of complaints about her parenting skills.

County authorities couldn't even acknowledge whether they had been to her home because it would have breached her privacy. So the agency's official response was that it had none.

On July 19, 2010, at a press conference held at the National Press Club, major government "Watch Dog" organizations, Whistleblower protection organizations, and numerous Whistleblowers came together in support of a new direction for the Office of Special Counsel (OSC). Some of the organizations in attendance were: The National Federation of Federal Government Employees (NFFE); The National Whistleblower Center; U.S. Justice Watch, the Federal Ethics Center and The Government Accountability Project (GAP). OSC is the primary governmental agency tasked with the protection of our most important watchdogs on the front lines of our national security, government employees and the military.



The press conference, sponsored by U.S. Justice Watch (www.USJUSTICEWATCH.com) , brought these organizations together to support and endorse Attorney Dave Nolan for Special Counsel and government Whistleblower Darlene F. Price as his Deputy. Nolan would replace the former Special Counsel for the Office of Special Counsel, Scott Bloch. Scott Bloch's criminal sentence hearing is scheduled for July 23rd. Although Bloch plead guilty only to withholding information from the House Oversight and Government Reform Committee, he was also accused by many of retaliating against his own agency employees and failing to protect federal Whistleblowers.

During the press conference several Whistleblowers had an opportunity to tell their amazing yet most disturbing stories in order to demonstrate how the ineffectiveness of OSC has brought real harm to citizens, and why OSC is so important. Some of this testimony was not only shocking, but heart-wrenching as well.

The most compelling was the testimony of Gary Vander Boegh. Mr. Vander Boegh was a contract engineer at the Paducah, Kentucky Gaseous Diffusion Plant for many years. He and his boss were "conveniently" fired after he began to report serious environmental crimes of improper/illegal dumping of radiological (enriched uranium), hazardous waste in Western Kentucky. Mr. Vander Boegh alleged that these crimes have been going on for years and continue to be "covered up" by numerous government officials with the Department of Energy (DOE), KY Senator Mitch McConnell and Representative Ed Whitfield - just to name a few.

This illegal dumping has contaminated not only the ground in the surrounding area of Paducah, KY, but has also involved releasing hazardous radiological gases into the air where it has the potential to spread as far as the wind may take it. This cover-up has led to widespread cancer clusters in the surrounding area, and currently endangers the tri-state area of KY, ILL, and OH. Also videotaped at the press conference was the heart wrenching story of Jim Faller, founder of U.S. Justice Watch. Mr. Faller described being wrongfully held in custody without a trial by corrupt federal agents and prosecutors. National Campaign to End Medicaid Fraud in Child Welfare

Inspired by the work of the U.S. Department of Health and Human Services partnership with the U.S. Department of Justice Health Care Fraud Prevention and Enforcement Task Force uncovering the largest Medicare fraud scheme in the history of the country, I have decided to honor their work by uncovering the largest Medicaid fraud scheme in the history of this nation.

Unfortunately, there are challenges called "Confidentiality Laws".

According to the U.S. Administration for Children and Families Child Welfare Information Gateway, it states in pertinent part:

Confidentiality of Records
Under the Child Abuse Prevention and Treatment Act (CAPTA), in order to receive a Federal grant, States must preserve the confidentiality of all child abuse and neglect reports and records to protect the privacy rights of the child and of the child's parents or guardians except in certain limited circumstances.2 All jurisdictions have confidentiality provisions to protect abuse and neglect records from public scrutiny. Confidentiality provisions mandate that such records are confidential, and many include specific mechanisms for protecting them from public view.

They only way to stop Medicaid fraud in child welfare is to tell on them.

Internal Reports Of Foster Care Murders Not Verified

This story is not about murder. It is about the secrecy of child protection.

If one cannot even get details of the case until it goes through some form of administrative/legislative review, what makes the public think it can trust what can never be verified?

Ghostwriting of child abuse literature, false claims, and blatant human trafficking are just a few examples of why it is time to smelt the iron curtain of child welfare.

HHS Announced Family Investment Program

It seems HHS has actually been listening to the voices of the people by announcing a reinvestment in the social infrastructure called the family. Child Protective Services programming will now have to be reformatted to give and not take.
Now, the only things left are to:
  1. Create an exclusionary database;
  2. Create a format of filing complaints;
  3. Enhance the authority of the Medicaid Fraud Control Units to include child welfare fraud; and,
  4. Dismantle the belief that poverty is the crime of abuse and neglect.

HHS Allocated $88 Million for Home Visiting Program to Improve the Wellbeing of Children and Families

Affordable Care Act Initial Funding for Maternal, Infant, and Early Childhood Home Visiting Grants

HHS Secretary Kathleen Sebelius today announced the award of $88 million in grants, provided under the Affordable Care Act, to support evidence-based home visiting programs focused on improving the wellbeing of families with young children. Through the Maternal, Infant, and Early Childhood Home Visiting Program, nurses, social workers, or other professionals meet with at-risk families in their homes, evaluate the families’ circumstances, and connect families to the kinds of help that can make a real difference in a child’s health, development, and ability to learn - such as health care, developmental services for children, early education, parenting skills, child abuse prevention, and nutrition education or assistance.

There is strong research evidence that these programs can improve outcomes for children and families and also yield Medicaid savings by reducing preterm births and the need for emergency room visits. Based on these findings, the Affordable Care Act provides a total of $1.5 billion for these initiatives over the next five years.

Forty-nine states, the District of Columbia, and five territories applied for and were awarded funding under this program, demonstrating the broad support that exists for these efforts. States and jurisdictions are conducting statewide assessments to identify existing home visiting programs and areas of high need. These assessments will then inform how they use these funds to assure effective coordination and implementation of evidence-based high-quality home visiting programs that are designed to improve maternal and child health, foster healthy child development, and prevent child maltreatment.

“This initiative will give children a healthier start and give parents the help they need to succeed in the most important job in the world – parenting,” said Secretary Sebelius. “This effort builds on impressive research findings and is one more piece of our strategy to invest in prevention and early interventions that pay off.”

“These investments will help States to create and support evidence-based home visiting programs that improve the wellbeing of children and families,” said Health Resources and Services Administration (HRSA) Administrator Mary Wakefield, Ph.D., R.N. “States will be using these grants to design programs that best serve their residents, providing important help to at-risk families, while gathering more detailed information on which approaches work best to put young children on the path to a healthy life at an early age.”

David A. Hansell, acting assistant secretary for children and families, said, “Evidence-based home visiting programs have the potential to provide great benefits for at-risk families in every State.”

Successful home visiting programs are multi-faceted, providing services in the health, child protection, early education, and social services arenas based on a holistic assessment of what families may or may not need. That is why HRSA and the Administration for Children and Families (ACF) are collaborating on this initiative at the Federal level, ensuring that expertise in each of these areas is engaged in the home visiting effort. “We look forward to continuing to work with states and our Federal partners to help families provide children with the healthy environment they need to thrive” said ACF Deputy Assistant Secretary and Inter-Departmental Liaison for Early Childhood Development, Dr. Joan Lombardi.

Each state’s governor designated the state entity to apply for and administer Home Visiting program funds on behalf of the state. The state’s portion of these funds is allocated by formula based on the number of young children in families at or below 100% of the Federal poverty level in the state as compared to the number of such children nationally. Of the Federal funds provided to the states and jurisdictions, $500,000 is immediately available to support their needs and resource assessments and to begin planning their programs. The remainder of the grant funds will be released for use after the state or jurisdiction completes its needs assessment and, based on that needs assessment, submits an approvable plan for addressing the home visiting needs they have identified.

Lack of state, federal funds leave holes in safety net

Detroit -- A growing number of youths in Michigan are reaching adult age while in foster care, a situation experts fear leaves them vulnerable to homelessness, poverty and incarceration.

State and welfare agencies say a lack of funding has been the greatest obstacle to getting these youths the safety net they need when they age out of the system.
When they're pushed out onto the streets at age 19 after years of jumping from home to home, the trauma of being separated from their families and getting inconsistent adult guidance destines them to multiple problems, said Paul Toro, professor of psychology at Wayne State University.

"The cards are against them," Toro said. "And they're expected to be on their own."
When Katrina Killebrew left her foster home, she had no money, job or place to live. For two years, she moved from one homeless shelter to the next in Pontiac, and when there were no beds, she stayed on the streets.

"I was freezing cold and I had to sleep outside," Killebrew said. The 22-year-old has since enrolled in classes to become a medical assistant, found a subsidized apartment for formerly homeless youths and works part time at a doctor's office.
Additional federal funding this fall, state officials say, will enable the state to extend foster care and its payments for several more years for individuals older than 19, which will give them a financial safety net and help them find housing. But some child welfare advocates doubt the state, mired in a budget crisis, will be able to commit enough matching dollars to have a significant impact.

As many as 653 youths reached the end of foster care in 2009 without permanency, a 36 percent increase since 2005, according to the Michigan Department of Human Services. That means as teenagers, they likely pingponged between foster homes and group institutions, having never found adoptive parents and failing to reunify with their own families. Even those with brothers and sisters, in many instances, were placed apart from them.

The transience of these children, often victims of abuse or neglect by their own parents, amplifies their trauma.
"These were kids who were taken away from their parents who were abusive," Toro said. "They're damaged to begin with."

Homeless get help
At Covenant House, a haven in Detroit for homeless and runaway youths, as many a third of residents have aged out of foster care, up from a fifth in previous years, said Melissa Golpe, spokeswoman for Covenant House.

At the 75-bed facility, residents follow a strict schedule: waking at 6 a.m., breakfast at 8, and classes from 9:30 to 3:30 on life skills, GED study or career guidance. Staff members serve as counselors, life coaches and parents, teaching the youngsters to take responsibility for their actions.

"They learn how to be cared for, and how to care for others," said Illene Bosley, a manager of the residential program.

The oft-cited challenge by agencies is a lack of funding for this subgroup of at-risk youths -- to provide beds, hire counselors and mentors or provide stopgap help for rent and basic essentials to help them live on their own.

At Alternatives for Girls, 20 of its 31 beds are for young women who have no place to go. Among them are women who became adults in foster care and found no other lifeline. The Detroit agency lost state funding last year, which amounted to 6 percent of its budget.

"It's been chronically underfunded," Toro said.
More money sought
State officials, with the support of Gov. Jennifer Granholm, are seeking additional money in next year's budget to provide reimbursement for foster care past age 18, in some cases to 20. That amounts to an additional $5.1 million, half of it federal money authorized by the 2008 Fostering Connections to Success and Increasing Adoptions Act. The remainder would be state and local money.

By the end of this year, state officials also plan to seek a legislative change to get federal matching dollars to extend payments to age 21, said Kate Hanley, state director of adoption and permanency services.

Previously, "you had to work with what you had," Hanley said, which resulted in youths being sent on their own before they were ready. Most of those enrolled in educational programs or seeking employment, however, could qualify for financial assistance, she said.

Some observers are skeptical, saying the state's budget crisis has forced Michigan to forgo federal matching funds in the past.

"That's part of the tragedy of the current budget crisis," said Jack Kresnak, president and chief executive officer of Michigan's Children. "We're not getting enough federal dollars in Michigan."

While living with his foster parents in Detroit, Jonathan Baker, 23, saw his drug-addicted mother on occasion, never knew his father and rarely saw his youngest sister.

So Baker lashed out, getting into fights at school, setting fires at home and shoplifting at age 12.

When he left his foster home at 18, he tried twice to commit suicide. "I felt like nobody loved me," Baker said. "Everywhere I turned, people turned their back."
Over the past year, Baker, now 23, has gotten his depression under control and plans to enroll at Henry Ford Community College. As one of the older residents at Covenant House, he is mentoring a 21-year-old who is struggling, like he did, to stay hopeful about the future.

"He said, 'When you leave I don't know what's going to happen,' " Baker said. "I said, 'I'm always going to be there.' "

Glaxo To Pay $1 Billion In Birth Defects Of Paxil

 Keep in mind that children, as young as 2 years old have been prescribed Paxil and foster kids have been used in clinic trials.  

Children have been removed from parents and placed in foster care due to these Paxil birth defects.
Even though the company did turn a profit, the settlement, or rather birth defects are deemed as fiscal liabilities.

July 20 (Bloomberg) -- GlaxoSmithKline Plc has agreed to pay more than $1 billion to resolve more than 800 cases alleging its Paxil antidepressant caused birth defects in some users’ children, according to people familiar with the settlements.

The accords, which provide an average payout of more than $1.2 million to families of affected children, leave more than 100 birth-defect cases still pending, the people said. Officials of Glaxo, the U.K.’s biggest drugmaker, said July 15 they set aside $2.4 billion to resolve litigation over Paxil and its Avandia diabetes drug.

“It looks as if this should be covered in the liabilities to be charged in the second-quarter numbers,” Nick Turner, an analyst at Mirabaud Securities in London, said in an interview today. “If there are further liabilities to be disclosed in the third-quarter numbers, that would be very disappointing.”
The birth-defect settlements bring to more than $2 billion the amount Glaxo has agreed to pay to resolve a variety of Paxil-related suits, including claims it caused suicides or attempted suicides and addiction problems, the people said.

$6 Million Child Welfare Disability Grant

Washington University gets federal grant for new research center on developmental disabilities

ST. LOUIS (AP) — A $6 million federal grant is helping Washington University establish a research center aimed at improving the lives of children with developmental disabilities.

The Intellectual and Developmental Disabilities Research Center in St. Louis will focus on research to treat and prevent developmental disabilities in children.

Funding comes from a five-year grant from the National Institutes of Health.

The university says more than 60 investigators will participate in research at the center.

A child welfare project worth watching.  Let's hope they do not start generating policy recommendations to further fuel reasons to remove and place children in foster care.
